this conn~ction, defendants have already indicated that they will

December 27. 1990, when Sandoz served a response to plaintiffs'

through May 31, 1991.

In support of their motion, plaintiffs state:

1. In his first request for production of documents to

defend~nts, served on det'endants in November, 1990, plaintiff

Dauer reque~ted that defendants produce documents (incl~djng

informat.ion stored 1.n computet r8adable form) from ·... r·,ich th~

members ot the putative class and payors for CPMS could be

ident i fled (Plainti ff' s First Request fot:" Production of

Documents, re~lest no. 4). This information is crucial for

plaintiffs to determine ·...hether t.lley have properly defined the

scope of the putative class in their complaints and to determine

the approp~iate scope of their class certification motion. In

this connection, defendants have already indicated that they will

take the poaition that there is a conflict between the state

paren~ cases and the putative class.

2. PlaintiffS have pursued production of the above-

described information from defendant sandoz since on or, about

lJe<::ember 27, 1')90, when Sandoz served a response to plaint1.ffs'

document request agreeing to production of t·he information. In

its response, Sandoz stated thdt it would produce infonnatl.on in

~esponse to document request no. 4 following the entry of an

appropriate protective order. This Court entered the protective

order sought by Sandoz in January, 1991. Nevertheless, Sandoz

has fa iled and otherwise refused to prodllCe the requested

inform~tion.

1. In a Rule 12(k) conference on Hay 10, 1991, Plaintiffs

rei terated the 1 r request for thi s infonna t i.on t.o S.-:tndoz 's

counsel. Pl~intiffs confirmed this request by a letter froro Gary

L. Specks to Quentin Wittrock d~ted May 13, 1991. (See Exhibit

.tA" hereto). Ten days later, on May 23, 1991; plaintiffs'

sounsel received a letter dated May 22, 1991 and several thousand

documents from Mr. Wittrock. Neither the docum@nts nor the

letter contained or provided any response to Plaintif.fs repeat~d

request for the relevant computer tapes and djsks.

4. On May 23, 1991, Plaintiffs' counsel ~gain wrote to Mr.

Wittrock requ~sting a response to his May 13 letter (EXhibit ltB Il

hereto). Mr. Wittrock's response, dated May 24; 1991 (Exhibit

"en hereto) again failed to inform Plaintiffs whether the

computer tapes, which Sandoz had already agreed to provide to

plaintiffs, would be produced. As of the filing of this ~otion

Sandoz has failed to respond to Pla int i.ffs' r~peated r~quebts j;or

these computer tapes and disks.

5. Plaintiffs reiterated their request for this

information to defendants Caremark and Sandoz in open court at

the status hearing:.m May 3, 1991. Caremark, like Sandoz, ~s

fai] ed and othenl15e refused to produce any of this informa.tion

to plaintiffs.;

6. As a consequence of defendants' failure to produce this

information to plaintiffs, plaintiffs are unable to determine the

appropriate s~ope ~f the class to be included in plaintiffs'

motion for class ~ertificatjon or to prepare their motion ~nd

memorandum in support of class certification within the briefing

schertule set by this court.

WHEREFORE, plaintiffs respectfully request that the Court

enlarge the time for plaintiffs to file their motion and

memorandum in support of class certification until a date thirty

(30) days after the date on which defendants produce to

plaintiffs the computer tapes and/or disks containing the

tnfollQ~tion identifying pati~nts and payors participating in t.he

Caremark has obj ected to producing the requested computet' tapes, claiming undue burden, irrelevance, and a "heal th (;a re provider/patient privilege."

Plaintiffs Victor Dauer and Richard Newell, respectfull~

move for an order enlarging the time previously fixed by this

Court for them to file their Motion for Class Certification and

their Memorandum in Support of Motion for Class Certification

until a date th~rty (30) days following the production to

plaintiffs by defendants of copies of existing computer tapes

~nd/or disks containing informa~ion relating to the purchasers

of, prices, and payors for clozapine under the Cloza~il ~ati~nt

lwfana'}ernent System (CPMS) durinq the period February 1, 1990

throuqh May 31, 1991.

In support of their motion, plaintiffs state:

1. rn his first request for production of documents to

defendants, served on defendants in November, 1990, plaintiff

Dauer requested that defendants produce documents (ir.cluding

information stored in cQmpute~ re3dable form) from which the

members ot the putative class and payors for CPMS could be

identified (Plaintiff's First Request for Production of

Documents, request no. 4). This information is crucial for

plaintiffs to dete~ine ~hether they have properly defined the

scope of the putative class in their complaints and to det~rmine

~he appropriate scope of their class certification motion. In

this connection, defendants have already indicated that they will

take the position that there is a conflict b~tween the state

pgrens cases and the putative class.

~. Plaintiffs have pursued product jon of the above-

described information from defendant sandoz since on or about

December 27, 1990, when Sandoz served a response to plaintiffs'

document request agre~ing to production of the information. In

its response, Sandoz stated that it would produce information in

response to document request no. 4 following the entry of an

appropriate protective order. This court entered the protective

order sought by Sandoz in January, 1991. Nevertheless, Sandoz

has failed and otherwise refused to produce the requested

information.

3. In a Rule 12(k) conference on May 10, 1991, Pldintiffs

reiterated their re~!est for this infor~ation to Sandoz's

cOllnsel. Plaintiffs confirmed this request by a letter from Gary

L. Specks to Quentin Wittrock dated Hay 13, 1991. (See Exhibit

"A" hereto). Ten days later, on May 2), 1991, plaintiffs'

counsel received a letter dated Hay 22, 1991 and several thousand

documents from Mr. Wittrock. Neither the documents nor the

letter contained or prOVided any response to Plaintiffs repeated

request for the relevant computer tapes and disks.

1. On May 23, 1991, Plaintiffs' counsel again ~rote to Mr.

Wittrock. requesting a response to his May 13 letter (EXhibit "B II

hereto). Mr. Wittrock's response, dated Hay 24, 1991 (Exhibit

tiC" hereto) again failed to inform Plaintiffs whether the

computer tapes, which Sandoz had already agreed to provide to

plaintiffs, ~ould be produced. As of the filing of this motion

Sandez has failed to respond to Plaintjffs' repeated requests for

these computer tapes and disks.

5. Plaintiffs reiter.ated their request for this

information to defendants Caremark and Sandoz. in open COU1"t at

the status hearing on May 3, 1991. Caremark, like sandoz, has

failed and otherwjse refused to produce any of this information

to plaintiffs. l

6. As a consequence of defendants' failure to produce this

information to plalntiffs, plaintiffs are unable to determine the

appropriate scope of the class to be included in plaintiffs'

motion for class certification or to prepare their motion and

memorandum in support of class certification within the briefing

schedule set by this Court.

WHEREFORE, plaintiffs respectfully request that the Court

enlarge the time for plaintiffs to file their motion and

memorandum in support ef class certification until a date thirty

(30) days after the date on which defendants produce to

plaintiffs the computer tapes and/or disks containing the

tnformation identifying patients and payors participating in tho

Caremark has objected to producing the requested computer tapes, claiming undue burden, irrelevance, and a "health care provider/patient privilege."
