November - "Attitude of Gratitude" month This is the month where we celebrate "Thanksgiving." A day our forefathers broke bread with a tribe of Native Americans to celebrate a plentiful harvest. Since then it has evolved in many families as a day to give thanks for all that we have thru-out the year.
November is also the start of the Holiday Season & a great time to remember why we do, what we do. The answer is different for all of us & a course correction is often needed. I have found that the "one thing" that will move the needle in every aspect is the "Attitude of Gratitude." Used properly, this one principle can catapult you to success in any area. It's easy to take things for granted in the hustle-n-bustle of everyday life and especially in our business. Simple questions like these can help with the tallying process: 1) Am I operating in a way that serves my highest potential, or am I lacking? 2) Am I expressing my gratitude at a level that best serves the people that mean the most to me, or do I need to adjust? 3) How would the person I aspire to be, act in a given situation? As it pertains to real estate, we have to constantly dig deep inside ourselves as most of the issues we face are a reflection of our attitude at the time it took place. My personal belief is that our attitude will always dictate our altitude. If we take this one step further, we could say that the collective attitude of our membership, will dictate the altitude of our Association. I am speaking about the attitude towards one another, towards other managers, towards other brokerages, & towards the Local, State & National Associations. Sometimes we have to take a step back, to move forward. In my opinion, the only way to take a step forward is to change the way we look at things. I am grateful for the opportunity to serve YOU!

button to Pay below. 6) Complete your name, credit card information and e-
mail address (this is a secure site), and then Next. 7) Review the payment information, and if correct click
on Submit Payment. (Important: your transaction may take a couple of minutes to process, so please be patient until confirmation is provided. If error occurs, please contact the RAIRC office as soon as possible)
8) Print the confirmation for your records if desired. If you provided an email address, payment confirmation will be emailed.

It’s time to renew your 2020 RAIRC membership. You have until Oct 31st to pay without penalty. A $100 late fee will be assessed 8:30am Nov 1st on all dues balances. There are NO exceptions.

Fabiola Simon, a Florida native with a Bachelor’s degree in Event Management from the University of Central Florida (Go Knights!). She is now the Marketing Coordinator for TWO MEN AND A TRUCK® playing an active role in grassroots marketing, lead generation, social media and graphic design. Ethics Case Interpretations related to Article 6
Case #6-4: Acceptance of Rebates
from Contractors (Revised Case #16-4 May, 1988. Transferred to Article 6
November, 1994. Revised May, 2017.)
REALTOR® A, who managed a 30-year-old apartment building for Client B, proposed a
complete modernization plan for the building, obtained Client B’s approval, and carried out the
work. Shortly after completion of the work, Client B filed a complaint with the Association of
REALTORS® charging REALTOR® A with unethical conduct for receiving rebates or
“kickbacks” from the contractors who did the work.
At the hearing, Client B presented written statements from the contractors to substantiate
his charges.
REALTOR® A defended himself by stating that he had carried out all work involving the
preparation of specifications, solicitation of bids, negotiations with the contractors, scheduling
work, and supervising the improvement program; that he had presented all bids to the owner who had authorized acceptance of the
most favorable bids; and that he and Client B had agreed on an appropriate fee for this service.
REALTOR® A also presented comparative data to show that Client B had received good value for
his money.
After all of the contracts were signed and the work was under way, REALTOR® A found that his fee was inadequate for the time the work
required; that he needed additional compensation but didn’t want to add to his
client’s costs; and that when he explained his predicament to the contractors and asked for
moderate rebates, they agreed.
Questioning by panel members revealed that the contractors felt that since they were being asked
for rebates by the man who would supervise
their work, they felt that they had no choice but to agree.
The Hearing Panel concluded that REALTOR® A was in violation of Article 6 of the Code of Ethics
and that if he had miscalculated his fee with Client B, his only legitimate recourse would have
been to renegotiate this fee with Client B.

MLS Statistics
Statistics developed by the REALTORS
Association of Indian River County through its Multiple Listing Service and in conjunction with
Florida REALTORS reflect the following for September 2018/2019. The Residential closed sales of single-family detached homes totaled
263 units for September 2019. This compares to a total of 231 units in September 2018. The
median price of single-family detached homes sold by members of the REALTORS Association of Indian River County MLS for September 2019 was $255,000. This compares to a median price of $240,000 for September 2018. Current active inventory of residential single-family detached
homes total 1,269 for September 2019. This compares to the active inventory of 1,332 for
September 2018.
The Residential closed sales of condominium homes totaled 50 units for September 2019. This
compares to a total of 62 units in September 2018. The median price of condominium homes sold by members of the REALTORS Association of Indian River County MLS for September 2019 was $153,500. This compares to a median price of $142,250 for September 2018. Current active inventory of condominium homes total 418 for September 2019. This compares to the active
inventory of 365 for September 2018.

The Broker Involvement Program What does it offer?

The program is an opportunity to bring a strong and
united REALTOR® voice to members of Congress. With over 16,000 broker owners and 450,000 agents in
the program, the REALTOR® voice will be heard loud
and clear.

Proven Results
Calls For Action response rates are significantly higher when agents receive their message from their broker.
Nearly 40% of all responses on Calls For Action were from agents in the Broker Involvement Program.

REALTOR® Party Mobile Alerts
RPMA texting platform offers REALTORS® a way to stay connected directly from their cell phones or tablet.
When a legislative Call For Action is launched,
subscribers get a short text message containing information to take action.
Realtors can sign up for REALTOR® Party Mobile Alerts
by texting the word REALTORS to 30644.
Agencies Increase Residential Appraisal Threshold
In September, several agencies including the FDIC adopted a
final rule increasing the threshold for requiring an appraisal in
residential real estate transactions from $250,000 to $400,000.
Federally related transactions under $400,000 will require an
evaluation, rather than a full appraisal, to determine value of
the real estate in question. A federally related transaction is a
non-Fannie Mae or Freddie Mac transaction and a non-federal
financed transaction, such as loans under the Federal Housing
Administration, the Rural Housing Service or the Department
of Veterans Affairs.
Appellate Court Reins In FCC on Net Neutrality
In November 2017, the Federal Communications Commission
(FCC) voted to dismantle regulations that prohibit broadband
providers from blocking or slowing internet traffic and ban
them from offering fast lanes to companies willing to pay
more to reach consumers faster than competitors. The FCC’s
decision was challenged by several groups in court. On
October 1, 2019, the DC Circuit Court of Appeals upheld the
FCC’s decision but found that the FCC had overstepped its
authority when it banned states from enacting their own net
neutrality rules. California, New Jersey, Oregon, Vermont and
Washington have already enacted legislation or adopted
resolutions protecting net neutrality. Thirty-four states and the
District of Columbia have introduced bills and resolutions.
NAR will continue to work with Congress and the FCC to
protect our members’ ability to freely share lawful content on
the internet.

“Realist Tax Program” – 10 AM - Noon - Customized
public records solution that is integrated with web-based
MLS providing a direct link from the listing records.
“Basic” – 1:30 - 3:30 PM – Using MLS Resource links,
adding search fields, hotsheets, field related controls,
viewing, sorting and filtering a list and tack related
controls.
"Listing Photo/Image Size in MLS"
When inputting photos/images into the MLS for a listing
the size can be 800x600, an increase from the standard
640x480. This allows you to use JPG format 1080 size
photos rather than the substandard offer "high
resolution."
“Reporting NON-MLS Property as Sold Comps”
A $30 fee for listing entry by Association staff applies to
and includes Non-MLS property when entered and
reported as sold in the MLS for comparable purposes
when there is no listing agreement. The listing will
indicate as NMLS listing office/agent. A sold property
will be allowed to be entered within 30 days of the sold
date and when sold by an MLS Participant firm when
the criteria is met and documentation is provided by
mailing to RAIRC MLS Staff for entry into the MLS.
Contact MLS for instructions and form. Reported sold
properties must have compensation to be reported in the
MLS.
November 13th Launch date for “ShowingTime”
In case you have not heard, Centralized Showing Service
is now part of ShowingTime. The two companies will be
providing all the best features on a single platform
beginning November 13, 2019. On November 11th, 12th,
13th and 14th, ShowingTime will provide a 30-minute
webinar at 11 AM and at 2 PM. The live sessions will
show the same information. Webinar invitation which

Your current appointment phone numbers and staff
answering the phones will remain the same. All of your
history, showing instructions and agent profile will be
preserved in the new software. This is just a software
update; all the data will remain the same. After the
update, all MLS’s in Florida that have a showing system
will be on the same platform, easing scheduling and
management of listings for agents that belong to multiple
MLS’s. Learn to set up the new system and you will have
an opportunity to ask questions. ShowingTime Support

“Sellers Waiver of Entry in MLS”
The “Sellers Waiver of Entry” form is an agreement
signed by the sellers and listing agent/broker to waive
RAIRC MLS entry of a listing for sale in IRC. This
procedure is used if the sellers do not wish to enter the
IRC property listing into the MLS until a certain date or
even for the entire listing period. Once the listing is to be
entered, the correct list date is the original listing date of
the agreement, not the seller waiver of entry date. This
date will appear in the history. Waiver of Entry” form can
be found in Form Simplicity under Board Realtors
Association forms. The form and agreement are sent to
the MLS to keep on file until the listing is inputted.
“CoreLogic “TRESTLE” Management program for
IDX and VOW RETS Feeds”
To set up an IDX RETS or VOW feed the IDX
provider/vendor needs to contact CoreLogic “Trestle”
directly for the RETS program agreement. The setup fee
is $200 and annual fee is $100. Billing is prepared and
handled directly by Trestle. Real Estate brokers will use
“Trestle” to receive listing data feeds from participating
multiple listing organizations and that clients will use
Trestle to manage their RAIRC IDX and VOW RETS
data feeds. The program called “Trestle Defender” will
be used for monitoring and reporting to protect multiple
listing data information from scrapers and fraudulent
third parties to keep your data in the right hands. Sharing
of the unique login of each set up is prohibited. Any

We appreciate your cooperation in your timely arrival as the course will begin promptly as scheduled. Due to DBPR requirements, Registration Sign-In will begin 30 minutes PRIOR to the start of ALL scheduled courses.
REGISTRY DEADLINE: *2 Calendar Days PRIOR to the scheduled course or
event, by (Midnight) 11:59 PM.
Anyone registered after the deadline will be considered a LATE registry and will be REQUIRED to pay FULL PRICE prior to attending the course or event.
REGISTRATION CONFIRMATION: Anyone who registers for a course using the website, www.RAIRC.com, will receive a registration confirmation number. All students registered for an RAIRC CEU course or event will receive email confirmation 2 days prior to the scheduled course. If you have not received a confirmation email by this time, contact the Association to confirm you’re registered. If you register after this time, you will not receive an email confirmation. If you are not on the registration roster the day of class, you will be required to pay a Late Registry fee (see below for fee information).
