Through the efforts of the career service officers and employees of the House of

Representatives, we are proud to bring you the newest edition of the House of

Representatives Directory in the 13th Congress.

This handy guide is an indispensable tool for people to be in closer touch with their

legislators and in order for them to participate actively in formulating legislation. As

limited copies of this Directory are available due to current austerity measures, I urge

its readers and recipients to reproduce the same and disseminate its contents to as many

people as possible.

Over the next six years, we have three basic tasks; reform politics and governance

and build a Strong Republic, make the economy a more efficient creator of social wealth,

cut down poverty incidence, and raise the nation’s quality of life. To do these we need your

help, and with respect to the legislative process, we invite inquiries and suggestions to

bring about legislative measures that will benefit the greatest segment of our population.

With its constitutional mandate of enacting legislation, the House of Representatives

has a vital role in shepherding the country into an era of long-term political and

economic stability by pursuing substantive reform programs and policies. It is hoped that

through this Directory, the Legislative Branch will be even more accessible to our people.

I invite all of you to communicate with your legislators, as well as inform and involve

HISTORY OF THE PHILIPPINE CONGRESS

I. The Unicameral Malolos Congress to theBicameral Congress1

The history of the Philippine legislative

system began with the unicameral Malolos

Congress during the short-lived Philippine

Republic of 1898-1899. During the

American Regime, a colonial legislative

system became institutionalized starting

with an all-American appointed Philippine

Commission established in 1901, which

evolved into a bicameral, predominantly

elective, Filipino-controlled legislature

created by the Jones Act of 1916. This set-

up lasted until November 1935 when the

semi-independent Commonwealth

Government was inaugurated. Under the

1935 Philippine Constitution, which had

been drafted following the guidelines

provided by the Tydings-McDuffie Act of

1934, a unicameral National Assembly

replaced the bicameral Philippine

legislature. In 1941, the Constitution was

amended to restore the bicameral

legislature that came to be called the

Congress. Except during the interlude of the

Japanese-sponsored Philippine Republic

from 1942-45, the Congress functioned as

the national legislature until September

1972 when President Marcos placed the

country under martial law.

II. The Batasan Pambansa- A UnicameralLegislature2

With the proclamation of a new Constitution

in 1973, Congress was abolished and

replaced by an elected unicameral National

Assembly called the Batasan Pambansa.

The 1971 Constitutional Convention’s

preference for a return to a unicameral

structure over the former bicameral

Congress was partly brought about by the

shift from a presidential type of government

to a modified parliamentary form of

government. The Batasan Pambansa was

made up of not more than 200 members

elected from different provinces with their

component cities, highly urbanized cities

and districts of Metropolitan Manila and

representatives from various sectors (six

from the youth and four each from

agricultural labor and industrial labor)

provided by law and those chosen by the

President from the members of the Cabinet.

The members of the Batasan Pambansa

had a term of six years.

III. The Present Philippine Congress

1. The February 1986 Revolution3

The bloodless coup of 22-25

February 1986 brought forth a new

regime. President Corazon Aquino,

backed by a coalition of forces on the

left and right of the spectrum, forged

a new government. A chain of events

dramatically midwifed the rebirth of

the old bicameral body; the abolition

of the Batasan Pambansa following

the proclamation of a new

revolutionary government; the

organization of a Constitutional

Commission that drafted the new

Charter which was ratified in February

1987 and the election of the members

of the new Congress in May that same

year.

CONSTITUTIONAL MANDATE OF THELEGISLATIVE DEPARTMENT

Under the Constitution, legislative power

is vested in the Congress of the Philippines

which consists of a Senate and a House of

Representatives, “except to the extent

reserved to the people by the provision on

initiative and referendum.”

Both Chambers of Congress convene once

every year on the fourth Monday of July for

its regular session, unless a different date

is fixed by law. It will be in session for such

number of days as it may determine until

thirty (30) days before the opening of its

next regular session, exclusive of

Saturdays, Sundays, and legal holidays.

The Basic Law of the land gives Congress

the “power of the [nation’s] purse:” “All

appropriation, revenue or tariff bills, bills

authorizing increase of the public debt, bills

of local application, and private bills shall

originate exclusively in the House of

Representatives, but the Senate may

propose or concur with amendments.”

2. The New Congress

Compared to its predecessors, the

new legislature has the biggest

membership and probably the most

powerful, too, with the possible

exception of the Assembly of

Representatives under the Malolos

Constitution. The Constitutional

Commission (Con Com) clothed the

new Congress with vast powers to

perform a wider role.

As mandated by the new

Constitution, the new Congress is a

bicameral body. It has two sets of

legislators. The upper chamber

(Senate) is composed of 24

members elected at large by the

qualified voters of the Philippines.

On the other hand, the House of

Representatives “must have not have

more than 250 members, unless

otherwise fixed by law, who shall be

elected from legislative districts

apportioned among the provinces,

cities and the Metropolitan Manila

area in accordance with the number

of inhabitants, and on the basis of a

uniform and progressive ratio and

those, as provided by law, shall be

elected through a party-list system

of registered national, regional and

sectoral parties or organizations.”4

THE MACE

The Mace is the symbol of authority of the

House. It is displayed upright at the

Speaker’s rostrum to signal that the House

is in session.

It also serves as the warrant for the

Sergeant-at-Arms in enforcing order in the

House.

THE HOUSE OFFICIALS

The House of Representatives has six (6)

elected officials, namely: the Speaker, three

(3) Deputy Speakers, the Secretary General

and the Sergeant- at-Arms.

The Speaker

The Speaker is elected by a majority vote of

all the Members of the House at the

commencement of each Congress and

whenever there is a vacancy in the office.

The Speaker presides over the sessions of

the House, preserves order and decorum

during the sessions, decides all questions

of order (subject to appeal by any member),

signs all acts, resolutions, memorials, writs,

warrants and subpoena issued by or upon

order of the House, exercises supervision

over all Committees, and appoints,

suspends, dismisses or disciplines House

personnel.

In the hierarchical order of the political

leadership, the Speaker is the fourth highest

official in the Philippine government (after

the President, Vice President, and Senate

President).

The Deputy Speakers

The Deputy Speakers, like the Speaker of

the House, are elected by a majority vote of

all the Members of the House at the

commencement of Congress.

They assume the duties and powers of the

Speaker when the Speaker is absent or

incapacitated. They preside over the

session when the Speaker does not

preside and appoint personnel of the

House when so authorized by the Speaker.

The Secretary General

The Secretary General is elected by a

majority vote of all the Members.

The Secretary General carries out and

enforces orders and decisions of the

House; keeps the Journal of each session;

calls the roll of the Members; reads bills,

resolutions, messages, communications,

memorials, petitions and other documents

which should be reported by him to the

House; notes all questions of order together

with the decisions thereon; completes the

printing and distribution of the Record of the

House at the close of each session; attests

and affixes the seal of the House to all writs,

warrants and subpoena issued by or upon

order of the House or Speaker and to all

measures, orders resolutions approved by

the House; submits to the Speaker all

contracts and agreements for the Speaker’s

approval; and acts as the custodian of the

property and records of the House and all

other government property in its premises.

The Secretary General is the immediate

chief of the personnel or secretariat of the

House and is responsible for the faithful and

proper performance of their official duties.

The Sergeant-at-Arms

The Sergeant-at-Arms is elected by a

majority vote of all Members. His or her

duties and powers are: to strictly enforce

the Rules relating to admission to the

Session Hall, the galleries, corridors, and

security of premises of the House Building,

and perimeter of the Batasan Complex; to

execute the orders of the House and serve

all processes issued by authority of the

House or the Speaker; to maintain order

during sessions of the House and during

the meetings of the Committees and

Subcommittees; to be responsible for the

personal safety of the Members while in the

House premises; and to keep the Mace

under his custody.

Political parties are represented on the floor

by their respective leaders. The Majority or

coalesced Majority Party is represented by

the Majority Leader while the Minority or

coalesced Minority Party is represented by

the Minority Leader.

The Majority Leader

The Majority Leader is elected in a party

caucus of the majority ruling party. His

primary function is to direct the proceedings

on the floor.

The Majority Leader is the Chairman of the

Committee on Rules. As such, he is

responsible for all matters relevant to the

Rules of the House, specifically the

calendaring of bills, preparation of the Order

of Business and the Calendar of Business.

The Minority Leader

The Minority Leader is the acknowledged

spokesman of the Minority Party, consisting

of one or more political groupings.

The Minority Leader, like the Majority Leader,

is elected in a party caucus of all Members

of the Minority Party. He is also a member of

the Committee on Rules.

Second Reading

The Committee Report is included in the

Order of Business and referred to the

Committee on Rules.

The Committee on Rules schedules the bill

for consideration on Second Reading.

On Second Reading, the Secretary General

reads the number, title and text of the bill

and the following takes place:

a) Period of Debate

• Sponsorship Speech

• Interpellation

• Turno en Contra

b) Period of Amendments

• Committee Amendments

• Individual Amendments

c) Approval on Second Reading - which

may be by

THE LEGISLATIVE PROCESS

The bill is prepared by the Representative

or by the Bill Drafting Division upon the

Representative’s request.

First Reading

The bill is filed with the Plenary Affairs

Bureau where it is numbered. Three days

after its filing, it is included in the Order of

Business for First Reading. On First

Reading, the Secretary General reads the

title and number of the bill. The Speaker

refers the bill to the appropriate Committee.

Committee Consideration

The Committee evaluates the bill. It may

conduct public hearings and invite resource

persons or groups to comment on the bill.

From the results of the public hearings, the

Committee may introduce amendments,

consolidate bills on the same subject

matter, or propose a substitute bill. It then

prepares the Committee Report.

The Committee approves the Committee

Report and formally transmits it to the

Plenary Affairs Bureau.

The Committee Report is registered and

numbered by the Bills and Index Service of

the Plenary Affairs Bureau.

Bicameral Conference Committee

A Conference Committee composed of

Members from each House of Congress

meets to settle or reconcile different

versions or disagreements in any provision

of the bill.

The conferees are not limited to reconciling

the differences in the bill but may introduce

new provisions “germane” to the subject

matter or may report out a compromise

version of the bill.

The Conference Committee Report is

submitted for approval of both Houses. No

amendment is allowed.

Transmittal of the Bill to the President

After approval by both Chambers, the bill,

which is signed by the President of the

Senate and the Speaker of the House of

Representatives, and certified by both the

Secretary of the Senate and the Secretary

General of the House, is sent to the

President.

Presidential Action on the Bill

If the bill is approved by the President, it

becomes a law as a “Republic Act.” If the

President does not act on it, it becomes a

law after the lapse of 30 days.

If it is vetoed, the bill is sent back to the

Chamber where it originated with the

President citing his or her reasons for the

veto. The veto can only be overridden by two-

thirds vote of both Chambers of Congress.

Action on Approved Bill

Approved bills are then officially published,

distributed to the implementing agencies,

and thereafter included in the annual

compilation of Acts and Resolutions.

Third Reading

After approval on Second Reading, the

amendments, if any, are engrossed by the

Plenary Affairs Bureau and printed copies

of the bill are reproduced by the Printing and

Reproduction Service of the Administrative

Management Bureau for Third Reading.

The engrossed bill is distributed to the

Members and is included in the Calendar

of Bills for Third Reading. Three (3) days

must pass before the bill can be considered

for Third Reading.

On Third Reading, the Secretary General

reads only the number and title of the bill.

The roll is called and a Member, if he

desires, is given three (3) minutes to explain

his vote. No amendment on the bill is

allowed at this stage.

affirmative vote of a majority of the

Members present. Bills granting

tax exemptions, however, must be

approved by the majority of all the

Members.

b) If the bill is disapproved, the same

is transmitted to the House

Archives.

Transmittal of the Approved Bill to theSenate

The approved bill is transmitted to the

Senate for its concurrence.

Senate Action on Approved Bill of theHouse

The Senate considers the bill in the same

manner as bills filed by the Senators.
