RE: Cannabis Retail Store Application and Relocation
Dear Mayor and Board of Councillors:
Thank you for taking the time to meet with us one again after the outcome of the April 3th, 2019 council
meeting where our application for a Temporary Use Permit (TU000044) and Cannabis Reta il Store (CN00000l) were denied.
We would like to take this opportunity to present the Council with additional options after discussing
the next steps with Planning and Development and the Liquor and Distribution Branch.
We would also like to rectify the immoral approach that we were wrongfully accused of in our initial application.
Below are the additional options we are proposing with regards to our application:
Option A: Approval of TU000049 and CN000006
Option A is to approve the applications for a temporary use permit and cannabis retail business licence.
This would entail that the City and Council approve the temporary use permit and cannabis retail business licence therefore allowing Kush Kove to be fully operational at 1289 3rd Avenue.
Option B: Operating Time Adjustment
Option Bis to approve the temporary use permit and cannabis retail business license with modified business operating hours.
Although the majority of our neighbors and public supported our initial application, we did have
neighbors who were opposed to it based on the location of our building at 1289 3rd Avenue.
We still strongly feel that we can have a positive impact to the revitalization of downtown as well as a
positive impact on educating the public about cannabis.
Our main goal from the outset was to educate the public, and we feel that education is key to instilling
proper rules and regulations on the use and sale of cannabis. Cannabis is now a part of society and a legal substance just like alcohol and tobacco.

However, our neighbors at Intersect Youth and Family Services feel differently, and we understand their perspective. They feel our location would be more of a temptation for the youth who attend their alternative learning centre. As a result, the youth may be tempted to obtain cannabis illegally, as legally, they would not be able to obtain cannabis or enter our retail store.
Since municipal bylaws were set in October of 2018, we were always under the impression that cannabis, as a legal substance such as liquor and nicotine, would be accepted on the block as our location is properly zoned and there are liquor primary businesses and a vape shop on the same block (specifically 2 doors down from our location).
Therefore, we would like to propose Option B: That the City and Council approve TU000049 and CN000006 and allow us to be able to operate our business during the hours when Intersect Youth and Family Services is not operating. This would include evenings after 5:00pm, weekends, statutory holidays and breaks when school is not in session.
Option C : Relocation
Option C is to approve the temporary use permit and cannabis retail licence on the condition that Kush Kove relocate to a different location via a relocation application through the Liquor and Distribution Branch.
Although we have already met all provincial and municipal rules, regulations and guidelines, we are willing to relocate our retail business to a different location. We would like to continue to strive to provide the public with a knowledgeable cannabis boutique.
The Liquor and Distribution Branch (LOB) will allow Kush Kove to relocate to a different location via a relocation application.
However, in order to proceed with Option C, Council members and the City would have to approve the temporary use permit: TU000049 and cannabis retail licence: CN000006.
Although the application is for a 3 year temporary use permit, this time frame can be reduced by Council.
We request that a minimum of 6 months be approved for the temporary use permit and cannabis retail business licence for 1289 3rd Avenue to allow us to follow the necessary steps in relocating.
As per the LOB, this time frame would allow us to apply for a relocation of the business as well as provide us time to find a new property, re-zone it, eliminate the need for a whole new application with the LOB, save over four to six months of processing time, and salvage a piece of our substantial investment made into the business.
During these 6 months we will give the City and Council our word that we will not sell cannabis under the issued cannabis business licence until we relocate . Thus, no cannabis will be sold out of the location of 1289 3rd Avenue. If Council feels that we are not true to our word, they have every right to pull the temporary use permit and cannabis retail business.

Of the 3 options proposed, Option C appears to be the option that would keep a healthy relationship
with our neighbors and the City. Our youth at Intersect Family and Youth Services will not have a
cannabis retail location across the street from them and the teachers and councillors will feel more
comfortable. This option will also allow Kush Kave to open up shop in a different location as we have
abided by and continue to abide by all municipal and provincial bylaws, rules and regulations. However,
should Council feel that either Option A, or B is sufficient, we will accept.
We are also open to any other suggestions that the City or Council may have and are always happy to provide any additional information that you may require.
