Factory Act Section 6
APPROVAL, LICENSING AND REGISTRATION OF FACTORIES• Pertains to rules state govt shall make for registration
and approval of factories • Submission of plans/description of Factories to Chief
Inspector or State Government• Purpose/nature of plans/ specification/ expansion
related approval • Expansion is deemed if the plan reduces or adds
minimum clear space required for safe working/ environmental conditions/ health
Factory Act Section 7 AGeneral duties of the occupier
• Health, safety, welfare of all workers• The provision and maintenance of plant and system of work that are
safe and without risk to health• Handling/storage/transport of articles and substances(Safety and
health concern)• Information, instruction, training and supervision(Safety and Health)• Maintenance of access outlets/exits for safety and risk mitigation
related to health and safety• Monitoring working environment concerning to safety and welfare at
work• Written statement in relation to safety and health, any revision to
brought into notice of all workers
Factory Act Section 22WORK ON OR NEAR MACHINERY IN MOTION. -• Refers to procedure and legal requirement for
maintenance/lubrication/adjusting operation on Machinery in motion
• Such operation to be carried out by trained adult worker wearing tight fitting clothes provided by occupier
• Specification related to pulley, width of belt, clearance between pulley and fixed structure, secure foothold and handhold and ladder
• Fencing of machinery and other components(Like screw bolts etc) is required
• Woman and young person are not be allowed to clean lubricate or adjust
• State govt is required in gazette, prohibit in any specified factory or class by any person on machinery in motion
Factory Act Section 24STRIKING GEAR AND DEVICES FOR CUTTING OFF POWER. –
• Suitable devices for cutting off power• Driving belt not in use should not rest or ride upon
shafting in motion• Striking gear or other mechanical appliance to be
maintained and used to move driving belts to and from fast and loose pulley
• Locking of Power switch devices for prevention of accidental starting of transmission
Factory Act Section 41(c)SPECIFIC RESPONSIBILITY OF THE OCCUPIER IN RELATION TO HAZARDOUS PROCESSES• Records to be maintained in relation to health. Medical
records of workers in process of handling storing transporting / contact of hazardous toxic chemical
• Appointment of only qualified persons to handle hazardous substances and facilities to be provided for same
• Chief Inspector decision on appointment qualification for persons handling hazardous substance
• Medical examination of every worker (Before employing and continued examination)
Factory Act Section 48Creches• For factories employing more than 30 women workers• Adequate accommodation, ventilation, light, cleanliness
and sanitary condn , under the charge of women trained in the care of children and infants
• State govt to make rules on location, standards furniture, construction, equipment under this sec
• Additional facilities additional to washing and changing their clothing
• Free milk and refreshment for such children• Facilities to feed such children to mothers at the
necessary intervals
Rajasthan Factories Rule, Rule 39Cooling of WaterApplicable on every factory having more than 250 workers
• 39(a) Cooled drinking water (ice cooled/effective method)• Ice should be clean and wholesome, source of ice only
from approved in writing by the Health Officer
• 39(b) supply of cooled water- Definition of “water centres”- lunchroom/canteen/rest room/accessible points
• 39(C) water centres to be sheltered from the weather and adequately drained
Rule 39 (contd)• 39(d) No of water centres one per 150 till first 500 workers.
And one for every 500 persons thereafter 50 mtr max distance from place of work as may be specified by Inspector.
• 39(e) “Water Centres” Clean and orderly cond n – Water supply through taps or other systems, dust proof covers, raised stands/ platform in shade/ water renewal once everyday
• 39(f) Suitable person to be charged for water distribution (NA if mechanically operated refrigarator units placed to the satisfaction of Chief Inspector)
Rule 53
Further Safety Precautions (Sec 21 (2) of factories act)
• 53(2) the fencing and other devices for protection should be so constructed and designed as to render it impossible for any person to pass between fencing and moving part of the machinery while it is in motion.

• Register of specially trained adult workers (Register to be maintained in form 8, trained workers on moving machinery refer sec 22 factories act)
Rule 65
• Ladders• All Ladders used in replacing belts shall be
specially made and reserved for that work and provided with hooks /non skid device.
• Hooks properly placed so as they rest on shaft.
Rule 65 F
Methods of Work• No process or work shall be carried on in any
factory in such a manner as to cause risk of bodily injury.
Rule 65 SConfidentiality of Information-
• The occupier of a factory as mentioned in rule 65NN(Disclosure to workers) 65 O(Disc. To general public, 65 P(Disc to District emergency authority) & 65 PP( Disc of information to chief Inspector) shall disclose all information needed for protecting safety and health of the workers and the general public.
• If occupier is of view that disclosure details regarding the process and formulation will adversely affect his business interest, he may make a representation to the chief Inspector stating the reasons for withholding such information.
• The chief Inspector shall give an opportunity to the occupier of being heard and pass an order on representation( Occupier if aggrieved by an order can appeal within 30 days before the state govt. the order of the state govt is final)
