Four days later on April 18 th , OCSD erroneously turned Mr. Sixtos over to the custody of Immigration Customs Enforcement (ICE). 1  Samuel is currently being detained at the corporate GEO ran Adelanto Detention Center in San Bernardino County where he faces deportation. The prolonged detention of Mr. Sixtos based on an ICE hold request violated the TRUST Act and California Government Code § 7282, which prohibits county jails from detaining a person based on an immigration detainer after they would otherwise be released exce pt in circumstances not present in Mr. Sixtos case. The detention also violates his due  process rights since a judge did not sign this ICE hold request. Dear Latino Caucus Chair and Vice Chair,

On April 14th

, 2014 Samuel Sixtos-Gomez was walking on the street and after being

 pulled over by the Santa Ana Police Department (SAPD), who checked his name andfound an outstanding warrant for driving without a license in 2008, was arrested and

family and community. Mr. Naranjo has been made aware of Mr. Sixtos case and he can

 be reached at his office at (213) 830-7949 and via email at [email protected].

Mr. Sixtos is absent a major criminal record and under the Obama Administration andICE deportation priorities; he is a perfect candidate to be released on a positive exercise

of prosecutorial discretion. He is the father of a U.S. citizen child, has deep ties in thecommunity, can potentially qualify for Deferred Action for Childhood Arrivals (DACA)

once he obtains a G.E.D, and is a victim of false imprisonment because OCSD turnedhim over to ICE in violation of TRUST Act. In addition, his life is in danger if he is

deported to his home state of Guerrero due to cartel violence.

This is an urgent matter and I would advise you to respond immediately as he can bedeported at any moment. Congresswoman Loretta Sanchez supports Mr. Sixtos (I have

attached her support letter below) and his state Senator Lou Correa has been made awareas well. However, it is important for both of you to be involved and the Latino Caucus

since you are the authors of the TRUST Act and decided to take bold leadership inmaking it law.

 Now will you stand behind your law and protect immigrant rights by supporting Samuel

Sixtos-Gomez?
