SAMPLEWARRANTYSTATEMENT

AllsystemsfurnishedandinstalledbyFBPSystems,Inc.(FBP),perthedesign/constructiondrawingsetsprovidedbyFBParewarrantedbyFBPfromdefectinworkmanshipforaperiodofone-year(12months)fromthedateofsubstantialcompletion,providedthecontractagreementtimelinesestablishedaremetbytheGeneralConstructor,Owner/Buyer.Undernocircumstanceswillthislimitedwarrantyexceed(12)monthsduetoprojectdelayscausedbyothers.

FBPSystems’soleandexclusiveobligationunderthiswarrantyshallbetoremedyorreplaceanycomponentoftheProjectdeemedtohaveamaterialorworkmanshipdefectatnoadditionalcosttotheBuyerformaterialandlabor,provided:(1)ThedefecthasbeenpromptlyreportedbyBuyertoFBPwithinten(10)daysafterthedefectisdiscoveredbythebuyer.(2)TheBuyerhasinformedFBPinwritingofanymodificationand/oraddition(s)madetotheProjectatthetimethedefectorerrorisreported.

FBPshallnotberesponsibleforanyandalldefects(a)causedbyorrelatedtoanyportionoftheProjectmodifiedoradded-tobyanypersonotherthanFBP,(b)defectscausedbyorrelatedtotheactsoromissionsofanypersonsotherthanFBP(including,withoutlimitation,persons[otherthanFBP]whoarehiredforthepurposesofdisassembling,reassembling,transporting,servicing,maintaining,orotherwisedealingwiththeProjectaftertheDeliveryDate),or(c)failureoftheBuyertoproperlymaintainandservicethecomponentpartsoftheProject.

Materialsandequipmenthavingamanufacturerwarrantyforaperiodgreaterthanone-yearareonlycoveredbyFBP’sLimitedWarrantyforone-year(12months)fromthecommissioningdate.SubsequentwarrantyclaimsaretheresponsibilityoftheOwner/Buyer.

FBP,atitssolediscretion,maychoosetoassignrepairofcertainelectronicdevicestoamanufacturer’sfactoryauthorized/certifiedtechnician.

WarrantyExclusionsandConditions

FBPdoesnotassumeresponsibilityforanyapplicationtowhichanysystemsorproductsareappliedifsystemsarealteredfromthesign-offinstalled“as-built”configuration.

FBPLimitedWarrantydoesNOTcoveranyperishableitemsincluding,butnotlimitedto:lamps/bulbs,lenses,tapes,flashstorage,andotherexpendablemedia.Existingoranyother“owner-furnished”equipmentshallNOTbeincludedorcoveredunderthiswarranty.
