Japan’s Photovoltaic (PV) energy market, which has been growing rapidly since the nation launched the Feed-in Tariff Scheme (FIT Scheme) in 2012, is just about to enter a new penetration stage due to the Revised FIT Act as well as the Japanese government’s Electricity System Reform initiative.

Moreover, at the 2015 United Nations Climate Change Conference (COP 21), member states agreed to conclude the Paris Agreement, meaning that the international community has taken a major step forward towards de-carbonization via renewable energy sources. In these circumstances, Photovoltaic energy, a precious purely-domestic energy source, will continue to grow further in importance.

Please access the “Exhibitors Website” of PVJapan’s official website and apply upon agreeing to the “PVJapan Regulations.”

Application deadline : March 31 (Fri.), 2017Please check the information shown on your form and sign it up within 2 weeks. The signed form needs to be sent to the Show Management Support.

The Show Management Support will forward to you, along with the invoice, a copy of the exhibit application form in which the confirm date is entered. The application is officially confirmed by the Show Management Support at this time.

Any company or organization participating in the PVJapan (“the Exhibition”) as an exhibitor (“Exhibitor”) shall do so pursuant to the terms and conditions set forth in the PVJapan Regulations (“these Regulations”) and Japanese law.

Article 1 The coming into effect of the Exhibit Agreement1. Any entity wishing to participate in the Exhibition shall submit a “PVJapan Exhibit Application Form” (“Exhibit Application Form”) to the show management support of the Exhibition (“Show Management Support”) by a method specified by the organizer ("Organizer"). After being confirmed by the Show Management Support, the Exhibit Application Form shall be subjected to an exhibit review by the Organizer, following which it shall forward a confirmation notice (by email or post) to the applicant. The “Exhibit Agreement” shall come into effect once the said confirmation is forwarded to theapplicant.2. Any entity making an exhibit application for the Exhibition for the first time shall submit to the Organizer attached documents demanded by the Organizer in addition to the Exhibit Application Form in the manner specified by the Organizer. The Organizer reserves the right to withhold accepting, or reject, the exhibit application in the event of the applicant failing to submit such attached documents demanded by the Organizer. Documents submitted to the Organizer by the applicant, such as the Exhibit Application Form and attached documents, shall not be returned to the applicant. Copying each of such documents is recommended.3. In case that the Organizer judges, from the exhibiting information submitted by an applicant, that the applicant's purpose is unsuitable for the purpose of holding the Exhibition, or it might be unsuitable as an exhibit item in the event, the Organizer may reject the exhibit application.4. The Organizer may withhold accepting, or reject, an exhibit application made by an entity located in a country or region designated by WHO (World Health Organization) as an epidemic-affected area. The Organizer may require, at its discretion, even an applicant located in a country or region other than one designated by WHO as an epidemic-affected area to submit relevant documents to the former party.

Article 2 Charging and payment of exhibit fee1. When the “Exhibit Agreement” comes into effect pursuant to Article 1, the Show Management Support shall issue an “Invoice” for the booth fee to the Exhibitor. Accordingly, within 1 month from the invoice date, the Exhibitor shall, by a remittance procedure specified by the Show Management Support, pay the booth fee in full to a bank account specified on the invoice. The applicable bank remittance charge shall be borne by the Exhibitor.2. Despite the preceding paragraph, if the Exhibitor wishes to cancel the “Exhibit Agreement” or reduce the number of booths it intends to use for a reason beyond its control, it shall send to the Show Management Support such a notice of agreement cancellation request or booth count reduction request that specifies the reason for the desired cancellation or reduction and other relevant matters, in the form of a letter or email. When the Organizer consents to the cancellation of the “Exhibit Agreement” or to the reduction in the number of booths to be used by the Exhibitor, as one for a reason beyond the Exhibitor’s control, the Exhibitor may cancel the said agreement or the part of its intended booth use on condition that it should pay to the Organizer the below-mentioned cancellation fee that is caluculated on the date of the Exhibit Application Form receipt notice mentioned in Article 1, Paragraph 1 (“Record Date”) by the date specified by the Organizer.

Article 3 Exhibit agreement cancellation and cancellation fee1. After the “Exhibit Agreement” comes into effect, the Exhibitor may in principle neither cancel the said agreement nor reduce the number of booths to be used by the Exhibitor.2. Despite the preceding paragraph, if the Exhibitor wishes to cancel the “Exhibit Agreement” or reduce the number of booths it intends to use for a reason beyond its control, it shall send to the Show Management Support such a notice of agreement cancellation request or booth count reduction request that specifies the reason for the desired cancellation or reduction and other relevant matters, in the form of a letter or email. When the Organizer consents to the cancellation of the “Exhibit Agreement” or to the reduction in the number of booths to be used by the Exhibitor, as one for a reason beyond the Exhibitor’s control, the Exhibitor may cancel the said agreement or the part of its intended booth use on condition that it should pay to the Organizer the below-mentioned cancellation fee that is caluculated on the date of the Exhibit Application Form receipt notice mentioned in Article 1, Paragraph 1 (“Record Date”) by the date specified by the Organizer. (i) When the applicant intends to cancel the “Exhibit Agreement” or the part of its intended booth use before the payment due date of booth fee, the Organizer shall charge to the applicant an amount equivalent to fifty (50) percent of the applicable booth fee as the cancellation fee, regardless of the reason for the cancellation.(ii) When the applicant intends to cancel the booth use wholly or partially which it has already applied for on the payment due date of booth fee or later, the Organizer shall charge to the applicant an amount equivalent to one hundred (100) percent of the applicable booth fee as the cancellation fee, regardless of the reason for the cancellation.(iii) When the Organizer can not confirm the payment of the exhibit fee by the due date, the Organizer deems that the “Exhibit Agreement” has been cancelled by the Exhibitor on or before that date and shall charge to the Exhibitor an amount equivalent to one hundred (100) percent of the applicable booth fee as the cancellation fee. (iv) When the Exhibitor does not start using the booth by 5 p.m. on the previous day to the first day of the Exhibition, the Organizer deems that the Exhibitor has cancelled the “Exhibit Agreement” and shall charge to the Exhibitor an amount equivalent to one hundred (100) percent of the applicable booth fee as the cancellation fee. 3. In case that the Exhibitor has already paid to the Organizer the whole or part of the applicable booth fee when the Exhibitor delivers a notice of cancellation request to the Organizer pursuant to the preceding paragraphs of this Article, or when the Organizer deems that the Exhibitor has cancelled the exhibit agreement, the Organizer shall allocate the already-paid booth fee as such cancellation fee as is set forth in each of the preceding paragraphs. In the event of any balance existing after the said allocation, the Organizer shall reimburse it to the Exhibitor in the manner and by the date that are determined by the Organizer.

Article 4 Exhibit booth fee The applicable exhibit booth fee shall be as specified in the “Exhibit Guide” that is separately provided by the Organizer.

Article 5 Determination of booth location The Organizer shall determine the location of each exhibitor’s booth at the Exhibition according to whether or not the exhibitor is qualified as a member of the Japan Photovolatic Energy Association, to its past exhibit results and to the number of exhibit booths to be used by the Exhibitor, and the Exhibitor shall obey such location determination.

Article 6 Prohibited acts1. Subleasing, trading, sale, exchange of booth and the granting of booth use permission The Exhibitor may not allow a third party to use part or whole of its exhibit booth regardless of whether it takes the form of subleasing, trading, sale, exchange or any other means.2. Exhibit intended to draw exhibition visitors to other event venueThe Exhibitor shall be prohibited to perform any exhibit that is intended to draw the Exhibition’s visitors to a location other than the venue of the Exhibition by exhibiting its products or by implementing a seminar or an event other than the Exhibition, at the said other location.3. Sale at the exhibition venue of exhibited item The Exhibitor shall be prohibited from selling, at the exhibition venue, any of its exhibited items with the exception of its publications and software products. When the Exhibitor intends to sell any of its publications and software products at the exhibition venue, the Exhibitor shall obtain the prior consent of the Organizer to the content of the intended sale item.4. NuisancesThe Exhibitor may not engage in any act to which any of the items mentioned below applies in relation to its exhibit. When the Organizer has judged that any of these items applies to the Exhibitor’s act, the Organizer shall instruct the Exhibitor to redress the said act. In the event of the Exhibitor failing to obey this instruction, the Organizer may require the Exhibitor to immediately suspend performing the act or to immediately remove its exhibit items at the Exhibition.The Exhibitor may not make any demand to the Organizer for the reimbursement of the costs incurred by the Exhibitor owing to any of the “redress,” “immediate suspension” or “immediate removal” actions. If the Organizer has borne any cost in connection with the performing of such action by the Exhibitor, the Exhibitor shall come under the obligation to reimburse the entirety of the said cost to the Organizer.The Exhibitor causes serious nuisance to other exhibitors or to exhibition visitors by using the path outside of its booth (by drawing exhibition visitors, conducting a questionnaire survey and so on). The Exhibitor causes nuisance to other exhibitors or to exhibition visitors by generating a level of speaker sound or other type of sound.The Exhibitor causes nuisance to other exhibitors or to exhibition visitors by generating light, heat, gas, odor, vibration or smoke.

The Exhibitor’s exhibit or act falls under the category of one that seriously lacks in respectability as a technology presentation, when viewed from a common sense perspective in society. The Exhibitor’s exhibit or act falls under the category of one that is not appropriate for the technology presentation venue and that runs counter to public order and morals.

Article 7 Handling of joint exhibits If two or more companies or organizations intend to apply for jointly participating in the Exhibition as Exhibitors and jointly using a booth, their exhibits shall be referred to as “Joint Exhibits.” In such event, of these joint exhibitors, the company or organization serving as their representative (“Representative Exhibitor”) shall submit the application by specifying their exhibits as joint ones. The payment of the applicable exhibit fee shall be paid in the name of the Representative Exhibitor. The names and contact details of the companies or organizations other than the Representative Exhibitor (“Joint Exhibitors”) shall be informed to the Organizer by the Representative Exhibitor without fail. 1. The Show Management Support shall deliver relevant information and exhibition visitor guide items only to the Representative Exhibitor.2. As is the case with the Representative Exhibitor, the Joint Exhibitors shall be obliged to comply with the terms and conditions set forth in these Regulations, and the Organizer may nullify the “Exhibit Agreement” in the event of any of the Joint Exhibitors having breached the whole or part of these Regulations.3. The Joint Exhibitors shall bear the applicable booth fee and any other obligations payable to the Organizer under these Regulations, as joint and several guarantors with the Representative Exhibitor.

Article 8 Installation of exhibit items and the decoration and removal of exhibition booths1.The delivery of exhibit items to the exhibition venue and their installation there shall be performed by the Exhibitor during a period that is separately notified to the Exhibitor by the Show Management Support. The installation of exhibit items at the booth shall be completed no later than the day immediately preceding the first day of the Exhibition.2.The Exhibitor shall decorate its booth pursuant to the provisions of the “Exhibitor Manual,” a document to be separately forwarded to Exhibitors by the Show Management Support.3.Any booth decoration violating any of the provisions set forth in the “Exhibitor Manual” shall be removed by the Organizer.4.When the Exhibitor intends to deliver its exhibit items to the exhibition venue, transfer them from the venue or move them during the exhibition period, the Exhibitor shall obtain prior consent of the Organizer for it before performing the task without fail.5. The Exhibitor shall complete the removal of its exhibit and decoration items in the booth during a period notified to the Exhibitor by the Show Management Support. Any of such items that have not been removed by the end of the said period shall be removed by the Show Management Support at the cost of the Exhibitor. The provisions of this Article as well as those of the “Exhibitor Manual” shall be strictly observed by the Exhibitor when installing or removing its exhibit items,

Article 9 Handling of personal information1. In the Exhibition, the Exhibitor shall be prohibited from performing any exhibit designed mainly to gather the “personal information” of exhibition visitors without exhibiting the Exhibitor’s product offerings and demonstrating its merchandise and services at its exhibit booth.

2. When obtaining “personal information” through its exhibit process, the Exhibitor shall comply with the “Act on the Protection of Personal Information” and applicable laws and ordinances in Japan. In case of intending to provide “personal information” to a third party in particular, the Exhibitor shall make sure to obtain the prior consent of the person who is the subject of the personal information in question. When any dispute has arisen between the Exhibitor and the person who is the subject of the personal information concerning the “personal information,” the Exhibitor must resolve it at its responsibility and cost. The Organizer shall in no way be held responsible for the said dispute.

3. Various types of data involved in the Exhibitor’s exhibit application for the Exhibition shall be protected and managed appropriately by the Organizer pursuant to the “Privacy Policy.” For details, please see the following website: http://www.jpea.gr.jp/06policy.html

Article 10 Damage compensation1. The Organizer shall in no way be held responsible for any injury or damage that has occurred to the Exhibitor in its booth or a third party’s physical conditions or its property due to the information contained in any printed matter on the Exhibition or in its official website.2. The Exhibitor shall pay compensation without delay for any and all damages caused to buildings and equipment at the exhibition venue and in surrounding areas and to the equipment made available by the Organizer, regardless of whether the damage occurred by intention or by negligence.3. The Organizer shall take care for the safety and security of the Exhibition at all times during the course of the event, and each exhibitor shall respectively manage and retain its exhibit items and materials at its responsibility in preparation against the theft and loss of them.4. The Organizer shall in no way be held responsible for any dispute that has arisen between the Exhibitor and any other exhibitor or any third party concerning the Exhibitor’s exhibit item. Such dispute shall be resolved and handled by the Exhibitor at its cost and responsibility without causing any nuisance or burden to the Organizer. In the event of any damage being caused to the Organizer in relation to the dispute, the Exhibitor shall promptly pay compensation to the Organizer for the said damage.5. The Organizer shall not pay any compensation for any damage caused to the Exhibitor due to an exhibition period change or exhibition implementation suspension resulting from unavoidable circumstances such as natural disaster, epidemic, public transport delay, labor strike, war, civil war, terrorism and so forth, or resulting from a circumstance not attributable to the Organizer.

Article 11 Postponement and suspension of the Exhibition1. The Organizer may decide to postpone or suspend the Exhibition if it deems the holding of the Exhibition to be difficult or impossible owing to a natural disaster or other circumstance beyond the Organizer’s control.2. Even in the event of postponing or suspending the holding of the Exhibition pursuant to the preceding paragraph, the Organizer shall in no way reimburse the booth fee to the Exhibitor.

Article 12 Nullification1. When any of the following items applies to the Exhibitor, the Organizer may nullify the “Exhibit Agreement” with immediate effect, without issuing any notice or demand and without paying any compensation to the said party.(i) With regard to a property owned by the Exhibitor or its right, the said party has been subjected to attachment, provisional attachment or provisional disposition, or a petition has been filed for auction, or has been subjected to disposition for failure to pay taxes. Excluded are cases where the Exhibitor has been subjected to attachment or provisional attachment as a third party obligor;(ii) The Exhibitor has suspended any payment or entered into a state where it is no longer able to make payment;(iii) The Exhibitor has been ordered by the competent regulatory authority to revoke or discontinue its business operations;(iv) The Organizer has judged that the Exhibitor or any of its planned exhibit items is unsuitable for the purpose of holding the Exhibition or unsuitable as an exhibit item for the Exhibition or the Organizer has judged that for the Exhibitor to participate in the Exhibition is socially inappropreate, regardless of the reason for it.(v) In addition to the circumstances mentioned in the preceding items, the Exhibitor has breached the whole or part of these Regulations or breached the “Exhibit Manual,” and fails to resolve the breach within a reasonable period of time specified by the Organizer, despite the demand issued to the Exhibitor by the Organizer or the Show Management Support.(vi) The Exhibitor or an entity involved in the Exihibitor is revealed to be a gangster group, gangster-affiliated company, corporate racketeer or any equivalent entity, or to be a member of any of such entities.2. When having nullified the “Exhibit Agreement” pursuant to this article, the Organizer shall charge the cancellation fee set forth in Article 3 and other type of damage compensation to the Exhibitor.

Article 13 Governing laws and court of jurisdiction These Regulations and the “Exhibit Agreement” shall be governed by the laws of Japan, and the district court that has jurisdiction over the geographical area in which the Organizer’s headquarters is located shall be the exclusive court of jurisdiction of first instance for any dispute arising out of the said regulations or agreement.
