Sept. 29, 2016 No. 7883 COUNCIL PROCEEDINGS The Thermopolis Town Council met in regular session September 20, 2016 at 7 pm at Town Hall. Present were Mayor Mike Mortimore, Council members Tony Larson, John Dorman Sr., Mark Nelson and Dusty Lewis. Also, present were May- or/Codes Administrative Assistant Fred Crosby, Clerk/Treasurer Tracey Van Heule, Police Chief Steven Shay, Town Engineer Anthony Barnett, Public Works Director Ernie Slagle and Town At- torney Mike Messenger. AGENDA: Dorman made a motion, seconded by Nelson and carried to approve the agenda with the addition of the H.O.P.E. Agency under Citi- zen Participation. FINANCIAL STATEMENT: Nelson made a mo- tion, seconded by Larson and carried to approve the financial statement for August 2016. CITIZEN PARTICIPATION: CATERING PER- MIT: Lewis made a motion, seconded by Nelson and carried to approve a catering permit, for Shorty’s, at the Fairgrounds for Pheasants Forever on Oc- tober 29, 2016 from 4 pm to midnight. The Fair Board gave written approval for the event. DISPENSING ROOM CHANGE: ONE EYED BUFFALO: Nelson made a motion, seconded by Dorman and carried to approve the dispensing room change for One-Eyed Buffalo. Per the dia- gram, the dispensing room was enlarged from a 10x12 room to a 10x22 room. H.O.P.E. AGENCY: Nelson made a motion, sec- onded by Mortimore and carried to allow purple ribbons on the decorative lights for the month of October. TOWN ENGINEER: ANTHONY BARNETT: CHIP SEAL PROJECT: Nelson made a motion, seconded by Lewis and carried to approve pay estimate number one, change order number one and the substantial completion for Wild West Con- struction on the chip seal project. MILLION GALLON TANK PAINTING PROJ- ECT: Barnett noted the contractor had not re- turned the contract documents per the notice of award requirements. Lewis made a motion and Nelson seconded to rescind the award to M&M Tank Coating for the reason that they have not returned the signed contract documents and to award the bid to the second lowest bidder, Wyo- ming Power Wash. Discussion ensued on notify- ing M&M of the contract rescission and making a claim on their bid bond. Motion carried. RESOLUTION 529: $1.4 MILLION WATER TRANSMISSION LINE GRANT APPLICATION TO WWDC: Mortimore made a motion, seconded by Dorman and carried to allow the Mayor to sign Resolution 529 requesting a grant from Wyoming Water Development, to replace several water transmission lines. TOWN ATTORNEY: MIKE MESSENGER: SECOND READING OF AN ORDINANCE TO SET FEES FOR CONSTRUCTION TRASH AND TIRES: Messenger read the ordinance, noting the prior changes in bold. Nelson made a motion and Lewis seconded to approve the second reading of the ordinance. Discussion ensued on revising the charges for tires and provision for fines for dump- ing tires in town. Larson made a motion, Nelson seconded and carried to amend the tire charges to $3.00 per car tire, $5.00 per pickup tire, $10.00 per semi-truck tire and $15.00 per tractor tire and to add the language of “in advance” for pay- ment. Nelson made a motion, Dorman seconded and carried to add a section to provide for fines for abandoning tires in town. All voted aye to ap- prove the second reading of the ordinance with the above amendments. ADMINISTRATION: FRED CROSBY: Chief Shay asked for a revision of Resolution 470 to al- low for meal reimbursement for unanticipated travel, up to the federal per diem with depart- ment head approval. Messenger was directed to prepare another resolution. Chief Shay asked the Mayor and Council to mod- ify or adopt an ordinance to allow for responsible open burning. Town code does not allow for open burn without permission of the Fire Chief. Shay will work with Messenger to prepare an ordinance. Public Works Director Slagle noted the landfill 1996 trac loader was in need of about $40,000 in repairs. Nelson made a motion and Lewis seconded to approve the expenditure. Discussion ensued on the value of the machine, machine hours, age of the machine, DEQ requirements, C & D landfills, rental, lease and purchase. Voting aye were Nel- son and Lewis. Voting no were Mortimore, Lar- son and Dorman. Motion failed. Slagle will look into other options. MAYOR & COUNCIL: Larson expressed con- cern about the golf course pumps and asked for direction from the Town. The meeting adjourned at 8:08 pm. The next Council meeting is October 4, 2016 at 7 pm. COUNCIL PROCEEDINGS

The Thermopolis Town Council met in regular session September 20, 2016 at 7 pm at Town Hall. Present were Mayor Mike Mortimore, Council members Tony Larson, John Dorman Sr., Mark Nelson and Dusty Lewis. WHEREAS, default in the payment of prin-cipal and interest has occurred under the terms of a promissory note (the “Note”) dated 02/21/2003 executed and delivered by Vincent V. PUBLIC NOTICE

Pursuant to the Wyoming Administrative Procedure Act and the Wyoming Public Ser-vice Commission’s (Commission) Rules, notice is hereby given that a public hearing has been scheduled regarding the application of Rocky Mountain Power (RMP or the Company) re-questing authority decrease rates on deferred net power costs (NPC) pursuant to Tariff Sched-ule 95; and to increase rates pursuant to Tariff Schedule 93, renewable energy credits (RECs) and Sulfur Dioxide (SO2) emission allowances. The public hearing is set to commence on Tuesday, October 11, 2016, at 9:00 a.m., in the Commission’s hearing room located at 2515 Warren Avenue, Suite 300, in Chey-enne, Wyoming.

RMP is a public utility, as defined in W.S. §37-1-101(a)(vi)(C), providing retail electric public utility service under certificates of public convenience and necessity issued by the Com-mission. RMP is subject to the Commission’s jurisdiction pursuant to W.S. §37-2-112.

Pursuant to Tariff Schedule 95, RMP pro-poses to recover an approximately $12.2 mil-lion comprised of total deferred NPC including embedded cost differential adjustments during the deferral period, deferral period interest, and residual balances from prior ECAMs. The Com-pany proposes to revise Tariff Schedule 95 by adding the $12.2 million to the currently effec-tive deferred NPC rate that is designed to col-lect $13.9 million from retail customers. Not-withstanding the $12.2 million increase for the deferral period, the $13.9 million will decrease when the Company stops collecting amounts from prior ECAM deferrals May 14, 2016.

Pursuant to Tariff Schedule 93, the Com-pany is proposing to refund to customers ap-proximately $644 thousand to account for cal-endar year 2015 balancing account adjustments and 2016 forecast sales revenues for REC and SO2 products in the market. From the cur-rently approved $690 thousand surcredit, this results in an overall increase of $50 thousand from current rates.

RMP is also requesting a change to the fil-ing date and rate effective date for future fil-ings beginning in 2017. The current filing date is March 15 and the request is to change it to April 15. The current rate effective date is May 15 and the request is to change it to June 15.

All interested persons are encouraged to at-tend the public hearing which will be conducted in accordance with the Wyoming Administra-tive Procedure Act and the Wyoming Public Service Commission Rules and Special Regu-lations. PROPOSED CONSTITUTIONAL AMENDMENT A

Currently, the Wyoming Constitution allows the legislature to authorize the investment of public employee retirement systems funds and permanent state funds in equities, such as stock or shares in private or public companies. Per-manent funds of the state include funds desig-nated as permanent funds by the Constitution. The Wyoming Constitution does not allow the state to invest any other funds in equities. The adoption of this amendment would allow the legislature, by two-thirds vote of the members of both houses, to authorize the investment of additional specified state funds in equities.

PROPOSITION: FORMATION OF A HOSPITAL DISTRICT

Shall a Hospital District named Hot Springs County Hospital District be formed? The gener-al purpose of the proposed district shall be for hospital purposes as defined by the principal Hospital District ACT W.S. 35-2-401 through 35-2-421 and pursuant to the Special District Elections Act W.S. 22-29-101 through 22-29-601; the boundary of the proposed district shall be the entire County of Hot Springs.
