On March 19, 2013, the director of Ohio EPA authorized the Steam Sterilizer Macerator (SSM) 150 alternative infectious waste treatment technology for statewide use by Red Bag Solutions, Inc., 3431 Benson Avenue, Suite 100, Baltimore, MD 21227, pursuant to Ohio Revised Code (ORC) Section 3734.021 and Ohio Administrative Code (OAC) Rule 3745-27-32 and 38. Ohio EPA had previously authorized the SSM-150 alternative infectious waste treatment technology for statewide use on July 18, 2003 by the WPS Company, the predecessor company to Red Bag Solutions, Inc. The director has determined that the SSM-150 maintains the standards and requirements for a statewide alternative infectious waste treatment technology set forth in OAC Rule 3745-27-38. The SSM-150 is subject to the conditions and specifications set forth in the authorization and all applicable rules and regulations for infectious waste treatment and disposal. Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio EPA) Division of Surface Water (DSW) has received an application for, and has begun to consider whether to issue or deny, a Clean Water Act Section 401 water quality certification for a project to remove the Monument Avenue low dam, and install two in-stream grade control structures and improve one access point on the Great Miami River. The application was submitted by Five Rivers MetroParks. The project is located at between the Monument Avenue and Riverside Street bridges in Dayton Ohio (39.765°N, 84.196°W). The Huntington District Corps of Engineers Public Notice Number for this project is LRH-2012-311-GMR. The Ohio EPA ID Number for this project is 134066. As required by the Antidegradation Rule, rule 3745-1-05 of the Ohio Administrative Code (OAC), three alternatives have been submitted for the project. The applicant's proposed preferred alternative, if approved, would permanently impact approximately 910 linear feet, and temporarily impact 3,050 linear feet of the Great Miami River. The applicant's proposed minimal degradation alternative, if approved, would permanently impact approximately 740 linear feet, and temporarily impact 2,400 of the Great Miami River. The applicant's proposed non-degradation alternative, if approved, would have no direct impacts on waters of the state. Upon review of the request, the Director has approved the relocation and the facility is authorized to move to Wood County Landfill, 15320 Tontogany Road, Bowling Green, OH 43402 upon the publication of this notice. You are hereby notified that this action of the Director is final and may be appealed to the Environmental Review Appeals Commission pursuant to Section 3745.04 of the Ohio Revised Code. The appeal must be in writing and set forth the action complained of and the grounds upon which the appeal is based. The appeal must be filed with the Commission within thirty (30) days after notice of the Director's action. The appeal must be accompanied by a filing fee of $70.00, made payable to “Ohio Treasurer Josh Mandel," which the Commission, in its discretion, may reduce if by affidavit you demonstrate that payment of the full amount of the fee would cause extreme hardship.
