Dear Speaker Cruz,

Hafa Adai! Thank you for providing me with the opportunity to submit testimony regarding Bill 71-34 (COR), An Act to Amend§ 102 of Title 1, Guam Code Annotated, Relative to the Effective Date of Executive Orders, which was sponsored by Vice Speaker Therese M. Terlaje.

The proposed legislation would add statutory language making an executive order (other than a declaration of a state of emergency) effective when it is transmitted by the Governor to the Speaker of the Legislature and the Compiler of Laws.

My testimony, however, is limited solely to the language referring to the transmittal of executive orders to the Compiler of Laws. Specifically, Bill 71-34 would establish an affirmative act of the Governor to transmit executive orders to the Compiler of Laws. Under the current statutory framework, there is no affmnative duty to transmit to the Compiler's Office, only a practice whereby they are provided to the Compiler's Office via email. Although 1 GCA § 1605 authorizes the Compiler to have access to executive orders in to carry out the purpose of publication, executive orders are generated by the Governor, and therefore, the Compiler's Office receives notice of their issuance only when they have been sent to us. As the government entity responsible for publishing primary legal documents of Guam, it would beneficial for the Compiler's Office to receive executive orders in a timely manner.

of Title 1 Guam Code Annotated, J\e/ath•e to the Efti·ctil'C Date o( Executive Orders. 1 wish to

express nw support for Bill 71-34.

Except for Executive Orders declaring an emergency, Bill 71-34 provides that Executive Orders shall become effective at midnight of the dav that it is signed by the Governor and transmitted to the Speaker and the Compiler of Laws. ·n1e time of midnight is consistent with the other existing provisions of Title 1 G.C.A. Section 102 which similarlv provide

that bills and resolutions become effective at midnight of the day they are approved.

If there is a difference, it is that unlike with bills and resolutions that automatically go into effect at midnight, Bill71-34 imposes the additional requirement of transmittal of the

Executive Order to the Speaker and the Compiler of Laws. l would respectfully submit that these additional requirements should not be imposed, as the Governor's authority to

issue Executive Orders drises from Section 1422 of the Organic Act, which does not require transmittal in order to be effective.
