TERMS AND CONDITIONS FOR THE AWARD OF CONTRACT FOR PROVIDING

AND MAINTAINING WHITE COLOUR BRAND NEW (2016) TOYOTA INNOVA 2.5

ZX DIESEL 7 SEATER

2. INSTRUCTIONS FOR TENDERING

1. Work : The tender is for awarding contract for hiring of the following services:

Brand New (2016) Toyota Innova 2.5 ZX Diesel 7 Seater on monthly hiring

basis including Diesel and Driver.

2. Period : The contract is to be awarded for a period of one year and the rates at

which the contract is awarded will be valid throughout the period of

contract. No claims whatsoever on account of increase in the rate of other

factors such as statutory payments, minimum wages, etc., shall be entertained. It

will be the responsibility of contractor to bear such additional expenses.

3. Tender Cost : Cost of tender is Rs. 1000/- (One Thousand only) (non

refundable).

4. Earnest Money Deposit(EMD) : The Tenderers submitted in response of

Tender shall be accompanied by a Interest free bid security Rs.10,000/- (Rs Ten

Thousand only) in the from of a demand draft from a Nationalised/Scheduled

Bank in India drawn in favour of “Atal Indore City Transport Services Ltd”. And

payable at Indore and shall be encashable at any branch of the bank at Indore.

Tenders received without EMD will not be entertained/considered.

5. Forfeiture of EMD : The tenderer will not be allowed to withdraw the tender

after the same is received in the AICTSL. In case the tenderer withdraws from

the process the EMD deposited by him will be forfeited.

6. Refund of EMD : EMD will be refunded to the unsuccessful tenderer within

thirty days from the date of issue of work order to the successful tenderer. No

interest shall be payable on EMD.

7. Performance Guarantee : The Earnest Money Deposit of successful bidder

shall be retained as interest free performance guarantee during one year. This

will be treated as performance guarantee.

8. Taxes: “Taxes and Duties means all taxes (including road, tax, property taxes)

duties, fees etc. payable under the applicable laws in connection with the

services/project. For removal of doubts, it is hereby clarify that for the purpose

of this clause “all dues regarding taxes” includes all taxes levied or to be levied

by the Central Government, State Government, Local bodies any other

Government agency or private individuals and such taxes will be payable by the

agency/bidder except service tax. The list given in the clause is an illustrative list

and not the exhaustive list which also includes vat tax works contracts tax etc.

9. The bid document shall not be opened if no earnest money deposit and tender

cost in time of submission.

3. TENDER PROCESS

1. TECHNICAL BID WITH BID SECURITY :

Eligibility Criteria - Technical Stage :

A bidder shall be required to fulfill the following eligibility criteria :

1. Enclosed photocopy of shops and establishment act by Indore Municipal

Corporation, Indore.

2. Latest income tax clearance certificate and PAN is also required to be submitted

by the operator.

3. The Bidder should have registered at least 10 new vehicles with RTO, Indore in

last three years. The relevant documents (RC/permit) need to submit with Bid

document.

4. A Tours & Travels Company shall be submit minimum 5 years experience

certificate.

2. SEALING AND MARKING OF BIDS :

Envelope (A) :

“TECHNICAL BID FOR PROVIDING AND MAINTAINING WHITE COLOUR

Should contain :

(a) The original of the Bid Security of the required value and in approved format

in a separate envelope duly marked as EMD

(b) The original of the Technical Bid.

Envelope B :

“FINANCIAL PROPOSAL FOR PROVIDING AND MAINTAINING WHITE

COLOUR BRAND NEW (2016) TOYOTA INNOVA 2.5 ZX DIESEL 7 SEATER

FOR THE PERIOD OF ONE YEAR”

(a) The original of the Financial Bids shall be sealed separately.

(b) Both the envelopes viz. „A‟ and „B‟ along with the original bid documents

issued by AICTSL along with updated addendums/amendments thereto, duly

signed by the Bidder through its authorized signatory on all pages shall then be

sealed in one outer envelope.

i. The inner and outer envelopes shall be addressed to The Managing Director Atal

Indore City Transport Services Limited Indore, and marked as below:

“PROVIDING AND MAINTAINING WHITE COLOUR BRAND NEW (2016) TOYOTA

INNOVA 2.5 ZX DIESEL 7 SEATER FOR THE PERIOD OF ONE YEAR”

ii. The outer as well as inner envelopes shall indicate the name and address of the

Bidder to enable the Bid to be returned unopened in case it is received late.

iii. If the outer envelope is not sealed and marked as above, AICTSL will assume

no responsibility for the misplacement or premature opening of the Bid.

4. MEMORANDUM

5. GENERAL CONDITIONS OF CONTRACT

1. The Tours & Travels Company should have under registered in shops and

establishment act by Indore Municipal Corporation, Indore. Proof of this effect

to be enclosed along with the tender.

2. Participating in the tender Tours & Travels Company should be the main or

branch office in the city of Indore.

3. The vehicles should be in very good running condition with clean interior and

good upholstery and valid Pollution Under Control (PUC) certificate. In case

condition of the vehicles is not found satisfactory, they shall be returned for

immediate replacement.

4. The Tour & Travels Company should have adequate number of telephones for

contact round the clock.

5. The Tour & Travels Company will have to service every day minimum of 12

hours and in possession of the vehicle AICTSL will remain 24 hours.

6. The Tour & Travels Company shall comply with all statutory

enactments/provisions in relation to services offered by them.

7. It will be responsibility of the Driver to carry the proper Registration Certificate

and valid insurance at all times in respect of the vehicle being driven by him. He

shall also agree to indemnify the AICTSL against all losses and claims arising

out of any negligence or misconduct on the part of the operator or agent.

Necessary proof to this effect should be enclosed along with the tender. All

tenders without such documents will be rejected.

8. The AICTSL shall be liable to pay the hiring charges only. Any other liability

shall be borne by the contractor/tenderer. If during the course of engagement of

the vehicles to the services of the AICTSL, any harm due to accidents, etc. is

caused either to the vehicle or to the third party, the AICTSL will not be

responsible. Any liability arising out of such accident will be the responsibility

of the firm only. All incidental expenditure towards repair will be borne by the

contractor.

9. Latest income tax clearance certificate and PAN is also required to be submitted

by the operator.

10. In case of break down of any vehicle during official duty, it shall be

responsibility of the firm to provide a replacement immediately. If no

replacement is provided on time or alternate arrangement will be made available

and the cost thereof will be deducted from the payment to be made to the firm.

11. More than 2500 kilometers per month in addition to the minimum monthly rental

rate per kilometer approved additional kilometer will be paid. we paid

agreemented minimum monthly payment for 2500 kilometers per month.

12. Beacon lights and other accessory is provided by Tour & Travels Company.

13. To be contracted vehicle must be in Taxi quota/Taxi permit. Vehicle registration

as well as in Indore RTO office, fitness, insurance papers etc. must also be

completed.

14. The Bidder should have registered at least 10 new vehicles (As Taxi) with RTO,

Indore in last three years. The relevant documents (RC/permit) need to submit

with Bid document.

15. A Tour & Travels Company shall be required minimum 5 years experience in

Tours & Travels Business.

16. The disputes, if any, arising out of this contract will be subject to the

jurisdictions of the courts in Indore only.

17. In case of dispute of any kind, the decision of AICTSL shall be final and

binding.

18. Submission of Tenders:- The wax sealed tender superscripted as

„„PROVIDING AND MAINTAINING WHITE COLOUR BRAND NEW

(2016) TOYOTA INNOVA 2.5 ZX DIESEL 7 SEATER FOR THE PERIOD

OF ONE YEAR‟‟ should be addressed to Managing Director, Atal Indore City

Transport Services Limited, 30, Residency Area, A.B.Road, Opp. MGM

College, Indore (MP) 452001. Please note that the envelope cover which is not

wax sealed will not be considered even if they fulfil all the other terms and

conditions.

19. The last date of receipt of bid is 28.07.2016 at 3:00 PM and the bid will be

opened on same day at 3:30 PM in the presence of the bidder or their

representatives as may wish to be present.

20. The tenders of only those firms who satisfy all the requirements/conditions

stipulated in this document will be considered. Rates with any cutting or

overwriting in the figures will not be considered.

21. The competent authority reserves the right to reject any tender at any time

without assigning any reason whatsoever.

22. The contract so awarded will commence from the date of consent of the firm to

the terms and conditions. The contract so awarded can be terminated by the

AICTSL at any time without giving any reason.

23. For Agreement Rs.100/- (One Hundred only) stamp expenditure shall be borne

by the Tour & Travels Company.

24. No advance payment will be made by the AICTSL. The billing will be done on a

monthly basis. The payment will be made only for those duty slips/logbook

which have been signed by the officer/staff using the vehicle. It will be the

responsibility of the driver to get the duty slips signed by the officer/staff on a

daily basis. No payment will be made for unsigned duty slips/logbook. Duty

slips/logbook should be complete in all respects in terms of start kilometer, end

kilometer, distance covered, time of Department, time of closure of duty at

Department, places visited, etc.

25. The Tour & Travels Company submit last monthly bill date of 5th of the

following month to certified by vehicle officer in-charge.

26. Vehicle during regular servicing or repairing the vehicle owner by giving prior

notice to the other alternative would be to arrange for the other vehicle. All

repairing work will be done by the vehicle owner.

27. Diesel and Oil will provide the vehicle owner. Driver's salary and allowances, vehicle

repairing, insurance and all expenses are to be borne by the Tour & Travels Company.

28. Driver under the control of the AICTSL by the AICTSL from time to time would have

to drive according to the instructions and any case do not use alcohol of any kind.

29. The driver having to leave the Tour & Travels Company must provide the other driver

immediately.

30. The Tours & Travels Company should be given by appointed driver's all information

such as driver's full name, permanent address, mobile and phone number, passport size

photograph and a photocopy of the driving license etc. will compulsory provide the

office of AICTSL. When change the driver above information regarding new driver

will also provide immediate. No criminal case should not on driver.

31. The Tour & Travels Company must ensure that the drivers employed have valid

commercial driving licence, should be well behaved and providing his police

verification and well conversant with the traffic rules/regulations and roads/routs

in Indore and surrounding localities. Driver uniform must be compulsory.

32. The vehicle owner/vehicle driver of the vehicle must be kept in working order will

milometer.

33. The vehicle driver must have a mobile phone facility. Mobile phone expenses shall be

born by the Tour & Travels Company/vehicle driver.

34. In case of the vehicle to go out of Indore paid Rs. 100/- extra to driver per night in the

form of allowance. The amount of parking and toll tax payment will be paid with

monthly bill.

35. After contract increase in diesel amount will be paid by separately.

36. During the period of contract by the Tour & Travels Company using the vehicle for

personal reasons with immediate effect terminate the contract and on the Tour &

Travels Company will be legal action.
