Burns & McDonnell Engineering Company, Inc. (Burns & McDonnell) is pleased to describe its experience and qualifications to support the Nebraska Department of Roads (NDOR) in the completion of environmental studies and permitting services listed under this Statewide On-Call contract. We value our working relationship with the NDOR under our current On-Call Environmental and Wetland Services contracts and hope to continue our partnership.

Burns & McDonnell has what NDOR is looking for to complete the requested environmental services across Nebraska:

► Experienced Project Manager – Our proposed project manager is located in our Omaha office and brings more than 25 years of environmental studies and permitting experience to NDOR projects. Randy is overseeing all of the NDOR projects requiring CE’s and other related environmental documents. He has completed the NDOR/FHWA Programmatic Agreement/Categorical Exclusion Training. Randy brings strong communications skills and the ability to manage a variety of on-going and fluctuating tasks.

► Qualified Principle NEPA Author – Our proposed NEPA technical leads will serve as the principle document authors. They have completed the online review of the NDOR CE training video and will be supported by our QA/QC lead reviewer along with our top notch technical leaders to develop concise and legally sufficient documents and technical reports.

► Diverse and Experienced Support Team – Burns & McDonnell brings depth in every area anticipated for completion of required studies from our offices in Omaha, Kansas City and Denver. In keeping up with the needs of our clients we have added environmental studies and permitting staff members in our Denver office that can support NDOR projects in western Nebraska. Additionally, our field staff is multi-disciplined and conducts wetland, threatened and endangered species, and hazardous materials surveys, studies, and evaluations following NDOR protocols simultaneously to provide economies of scale on NDOR projects.

Professional Qualifications of the Proposed Team 1

PROFESSIONAL QUALIFICATIONS OF THE PROPOSED TEAM Project Team For the Nebraska Department of Roads (NDOR), Burns & McDonnell’s Omaha and Kansas City offices provide regionally recognized broad-based experience in numerous environmental and engineering disciplines. More than 178 employee-owners within the Environmental Studies and Permitting (ES&P) Global Practice prepare documentation, conduct field studies, obtain permits and approvals, and engage agencies and the public in compliance with National Environmental Policy Act (NEPA) decision-making process and related federal and state statues.

Burns & McDonnell has supported the NDOR during the past three years providing environmental studies and permitting services under the On-Call Wetland Permitting Mitigation Contract and On-Call Environmental Services Contract. We understand NDOR’s way to complete the requested work and exceed expectations. Our team of multi-disciplined specialists (depicted below) is focused on continuing to provide paramount service on your projects in compliance with NDOR/Federal Highway Administration (FHWA) Programmatic Categorical Exclusion Agreement (April 2015).

Professional Qualifications of the Proposed Team 2

Project Manager Randy Root, PWS is located in our Omaha, Nebraska, office and will apply his extensive environmental permitting and studies experience to the management and oversight of this contract. His experience includes Title 117 (State Water Quality Standard), Section 10, 402, 404(b)(1), 408 and lake, wetland and stream restoration. Randy manages Burns & McDonnell’s current NDOR On-Call Environmental effort, and he will continue to oversee field investigations, the development of documents, permitting processes, public outreach, and agency coordination required for completion of assigned task orders. He completed the FHWA NEPA and Transportation Decision Making training in 2000, NDOR NEPA Overview Training Course in 2013, and NDOR/FHWA Programmatic Agreement/Categorical Exclusion Training in September 2015.

Project Leaders Burns & McDonnell has extensive experience preparing Categorical Exclusions (CEs) in accordance with NDOR’s Programmatic Agreement for NEPA Categorically Excluded Transportation Projects (December 2008). We are familiar with recent changes to the NDOR NEPA process, per the April 2015 NDOR/FHWA Programmatic Categorical Exclusion Agreement. Our Project Leaders are ready to implement the required changes necessary to complete deliverables assigned under new task orders, as well as make revisions to projects already in progress. Our Project Leaders and support staff are ready to implement the new “Smart Form” in addition to making submittals, as required, through more traditional means.

Shari Cannon-Mackey, CEP, ENV SP will apply her substantial NEPA, Section 4(f), Sections 9/10, and 404(b)(1) experience to assigned projects. As the previous manager of NDOR NEPA Task Orders, she will provide NEPA oversight in support of Randy’s leadership role. She completed the NDOR NEPA Training Course in August 2011, the NDOR Biological Evaluation Process Training in September 2012, and the NDOR On-Call Environmental Training in February 2013. She attended the 2012 National Highway Institute (NHI)-FHWA Advanced Seminar on Transportation Project Development: Navigating the NEPA Maze.

Renee Kuruc manages the development, coordination, and review of NEPA documentation for transportation and infrastructure projects on a daily basis. She specializes in environmental justice analyses, Section 106 processes, and socioeconomic and land use assessment. Renee previously worked at the Federal Transit Administration (FTA) and the Environmental Protection Agency (EPA); this regulatory experience helps shape Renee’s approach to successful project completion. She has viewed the online NDOR/FHWA Programmatic Agreement Categorical Exclusion Training video for completing the new “Smart Forms.”

Jennifer Bell will apply her expertise in land use, socioeconomic analyses, and technical writing in leading designated task orders and specialized tasks. Jennifer led development of the CE for US 77 over the Platte River in Saunders County – our first NDOR-approved CE. She has been a major contributor to a number of NEPA documents prepared for highway, power plant, transmission line, substation, telecommunication, railroad, airport, and water resource projects. Jennifer has completed the NDOR NEPA and Biological Evaluation Process Training.

Katelyn Kowalczyk has been the primary author and point of contact for the most recent NDOR task orders; preparing Supplemental CE Checklists, Hazardous Material Reports (HMRs) and Draft CEs in accordance with the NDOR/FHWA Programmatic Categorical Exclusion Agreement. Katelyn has experience with Section 9/10, and 404(b)(1) and natural resources management including wetland and waters of the U.S. delineations. She has viewed the online NDOR/FHWA Programmatic Agreement Categorical Exclusion Training video for completing the new “Smart Forms.”

SUPPORT STAFF AND TECHNICAL CAPABILITIES Wetland Delineation/Determinations and Permitting Under our current Statewide On-Call NEPA and Wetland Services Contract, Burns & McDonnell has completed delineations and permitting support for more than 30 3R (Resurfacing, Restoration and Rehabilitation) road improvement projects throughout Nebraska, covering more than 180 highway miles. We have extensive experience completing wetland delineations in accordance with the NDOR guidance and procedures, including the 2013 Wetland and Water Resource Delineation and Water Conveyance Structure Investigation, as well as the 2015 Consultants Day Training presentation. Also, our wetland specialists are trained in delineating wetlands and special aquatic sites in accordance with the 1987 Corps of Engineers Wetlands Delineation Manual, the 2010 Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Midwest Region and Great Plains Region. Each delineation team uses a sub-meter-accurate Global Positioning System (GPS) unit with a field tablet data logger capable of displaying aerial and topographic background displays and accessing pertinent reference data including National Wetland Inventory maps, National Hydrography Dataset, floodplain mapping, etc. These tablets allow field teams to quickly review reference materials and display collected data in real time. As part of the report preparation, our team creates project maps in ArcGIS to support the data analysis. Our wetland delineation reports and permit application packages undergo a rigorous and comprehensive multi-step quality review process prior to submittal to NDOR. Our team has substantial experience developing application packages to obtain Section 404 nationwide and individual permits through the Omaha District U.S. Army Corps of Engineers (USACE) and Section 401 water quality certifications/NE Title 117 Anti-degradation approvals through Nebraska Department of Environmental Quality (NDEQ).

Wetland and Stream Mitigation Design and Monitoring Burns & McDonnell worked with NDOR to develop a 20-year strategic plan for future mitigation requirements and develop a planning tool to better understand future wetland mitigation bank needs for NDOR projects. Under this contract, our team looks forward to continuing this effort at the project-specific level. Our wetland specialists are trained to identify potential mitigation opportunities while in the field and, when necessary, work closely with hydrologists and civil engineers to design compensatory wetland and stream mitigation sites in accordance with agency requirements. We have worked with agencies and private entities to obtain mitigation credits in established wetland and stream banks and are experienced in developing stormwater treatment and detention systems that satisfy mitigation commitments for improving water quality.

Burns & McDonnell’s wetland specialists continue to be involved with interagency coordination and mitigation monitoring for the Platte River West Water Production Facilities Project in Douglas and Sarpy Counties. We have also completed stream bank restoration and stabilization design for the Sheldon Station Wastewater Treatment Project.

Threatened and Endangered Species Reviews Our wildlife and aquatic biologists have completed 20 surveys and biological evaluations for NDOR to obtain project authorizations under the Endangered Species Act, Migratory Bird Treaty Act, Bald and Golden Eagle Protection Act, Fish and Wildlife Coordination Act, and the Nebraska Non-game and Endangered Species Conservation Act. Leading the effort for NDOR projects are Brain Roh and Meg Trowbridge; both have completed the NDOR Biological Evaluation Process Training. Brian and Meg are well-versed in species and habitat issues, having conducted surveys for infrastructure projects across Nebraska, Kansas, Oklahoma, Missouri, Colorado, Wyoming, and South Dakota. Meg is also an aquatic ecologist and has conducted studies associated with the Pallid Sturgeon Recovery Management Program on the Missouri and Platte Rivers. Our team includes a number of experienced wildlife biologists including: Bryan Gasper, a senior wildlife biologist, who is part of the mitigation monitoring team for the Platte River West Water Production Facilities Project; and Jeff Miller and Josiah Maine, USFWS-permitted bat surveyors who have developed appropriate mitigation, defined Best Management Practices (BMPs), and developed monitoring programs for implementation during construction.

Air Quality and Noise Studies Burns & McDonnell’s air and noise group has extensive experience conducting analyses for transportation projects.

Air Quality Our air permitting engineers have used various models to predict traffic air quality impacts. Our team has completed the Motor Vehicle Emissions Simulator (MOVES) training required as a part of calculating the Mobile Source Air Toxics (MSAT) emissions for projects. In addition to MOVES, our team conducts air modeling for traffic air quality analyses using CALINE3, CAL3QHC and/or MOBILE6 (for hot spot analyses). We are conversant in transportation conformity and non-attainment area requirements, as well as air permitting for various industrial and power projects across the U.S.

Noise Our noise team has conducted traffic noise analyses for transportation improvements across the Midwest and is experienced in the use of FHWA’s Traffic Noise Model (TNM) (Version 2.5). They have completed training in TNM usage (NHI training on Highway Traffic Noise (FHWA-NHI-142051)) along with state-specific trainings on developing transportation noise policy. Noise studies have included ambient surveys that follow FHWA guidance; validation models; existing, future build, and future no-build model analyses; and feasible and reasonable abatement analyses for impacted receptors. The noise team has attended public meetings to support project evaluations and to explain in plain language the intricacies of noise analysis and the potential effects of traffic noise on neighboring receivers. Burns & McDonnell owns a Type I noise meter (Larson-Davis Model 831), capable of all metrics and 1/3 octave band measurements, as required for the noise projects we perform.

Section 4(f)/Section 6(f) Our Project Leaders understand FHWA has a heightened awareness regarding Section 4(f)/6(f) issues. Burns & McDonnell Project Leaders have experience in addressing Section 4(f) and Section 6(f) issues on simple as well as complex projects. They have received training on completing the Section 4(f) reviews in accordance with the NDOR’s Guidance for Completing Section 4(f) Reviews Process in Nebraska for Federal-Aid Projects. Our team will use this comprehensive experience to support the NDOR in navigating through issues associated with the use of public land and historic resources.

Coast Guard, Floodplain and Stormwater Permitting Burns & McDonnell permitting specialists have extensive experience in collecting data, conducting analyses, and coordinating with agencies to obtain Section 9/Section 10 Permits under the Rivers and Harbors Act; floodplain permits and Letters of Map Amendment or Revision (LOMR/LOMA); and Section 402/National Pollution Discharge Elimination System (NPDES) permits and approvals for roadway and bridge projects.

Section 9 Permit (Bridge Work in Navigable Waters of the U.S.) Julie Sarson and Doug Waltemath lead the structural and waterway opening analyses and design for major bridge crossings. Both are supported by Brain Roh and other wetland and threatened and endangered species (T&E) scientists in developing information for review by the U.S. Coast Guard and the companion Section 10 Permit issued by the USACE. Doug has served as lead bridge designer and led the Section 9 permitting process for numerous new bridge crossings of the Missouri River including U.S. 275 Veterans Memorial Bridge in Omaha, U.S. 159 Bridge in Rulo, and Chief Standing Bear Memorial Bridge in Niobrara. We also have experience completing USACE Section 408 review processes for impacts to federal levees.

Floodplain Permitting Rick Besancon and George Hunt lead hydraulic and hydrological modeling and evaluations for floodplain permitting. They work closely with wetland, T&E, and mitigation specialists to review longitudinal encroachments, identify effects on riparian and in-stream habitats, and determine appropriate locations and designs of compensatory storage required to achieve “no-

rise” and address project mitigation needs. Our team has extensive experience in obtaining approved Conditional and Final LOMR/LOMA.

Section 402/NPDES Permitting We have experienced environmental permitting specialists that have assisted our clients with submitting applications for construction authorizations under general land disturbance permits issued by the Nebraska Department of Environmental Quality and local agencies. They have considerable experience in developing Stormwater Pollution Prevention Plans (SWPPPs) and prescribing cost-effective and proactive BMPs to address water quality, erosion, and sedimentation issues resulting from construction activities.

Hazardous Materials Review Burns & McDonnell has experience preparing HMR reports on several NDOR projects. Most recently, our team has been preparing HMRs in accordance with the NDOR’s Hazardous Materials Review Guidance Manual (September 2015). In addition, our team is reviewing and revising existing HMRs to comply with the current HMR guidance. Section 106 – Historic Preservation and Cultural Resources Coordination Burns & McDonnell has a staff of professional and field archaeologists that have provided Phase I/II/III surveys, testing, and mitigation for all types of sites across the country. John Fulmer and Mark Latham lead our archaeological field surveys and author and review technical reports, study protocols, and submissions to State Historic Preservation Offices (SHPOs) in consultation with Department of Transportation (DOT) staff to obtain concurrence on determinations of eligibility and to develop mitigation requirements and structure memoranda of agreement under Section 106 of the National Historic Preservation Act. Burns & McDonnell has in-house specialists to address tribal/cultural coordination, architectural/historic resources, and geomorphologic assessments. John and Mark have completed training on consultation and management of Traditional Cultural Properties through the National Park Service (NPS). Doug Shaver has extensive experience with Native American Tribes of Nebraska, South Dakota, and North Dakota. Brandy Harris, lead architectural historian, works regularly with bridge designers to evaluate the eligibility of bridges and other structures affected by roadway projects. She has been instrumental in the streamlining of project reviews and issuance of project approvals by SHPOs across the Midwest for various infrastructure projects. Andrew Gottsfield serves as our lead geomorphologist and leads numerous intensive field surveys as well as the analysis and recovery of deeply deposited artifacts.

Socioeconomic Studies, EJ, Farmland, Wild & Scenic Rivers and Other Specialty Areas Carrie Barton and Jennifer Bell will lead the socioeconomic, environmental justice (EJ), and other specialty area analyses. Both have completed land use and demographic inventories, EJ analyses, socioeconomic assessments, and visual assessments for rural and urban transportation projects. They both are well-versed in the application of CEQ, DOT, and FHWA guidance on completing EJ analyses. Carrie and Jennifer completed an EJ analysis for the Kansas City Downtown Streetcar Project following FTAs new guidance. FTA is using that analysis as an approved example in its ongoing EJ training.

Carrie and Jennifer are supported by staff members with backgrounds in soil science, water quality, geography, and GIS mapping to complete specialty analyses required by specific projects. Team members are experienced in addressing farmland conversion issues using both NRCS AD-1006 and AD-106 forms and determining project impacts using GIS applications. Shari Cannon-Mackey and Harold Draper, D.Sc., bring experience in coordinating with the NPS, U.S. Forest Service, and Bureau of Land Management regarding project impacts to designated wild and scenic rivers, national forests, and wilderness areas.

Public Involvement Public outreach and stakeholder engagement is important in the transportation decision-making process to maintain transparency and promote an open public process. Burns & McDonnell has a Stakeholder Management group that plans and implements public outreach programs for all types of projects. From public workshops and open houses to kitchen-table discussions, engagement of the public, stakeholders, and agencies is crucial to obtaining project acceptance. Joab Ortiz and Julie Lorenz have designed and implemented numerous programs for all types of transportation projects. Currently, Julie is leading the NDOR Strategic Transportation Planning Services Project.

On-Site Visits As Project Manager, Randy will oversee coordination with NDOR to arrange on-site visits and surveys. Project Leaders, working with their respective NDOR NEPA Manager, will arrange for rights of entry and coordinate property owner contacts to access properties for surveys and other field assessments.

Safety is a priority for Burns & McDonnell in everything we do from daily office operations and field surveys to construction management and monitoring. All employee-owners are required to successfully complete a safe driver course, maintain clean driving records, and follow applicable Occupational Safety and Health Administration (OSHA) and property owner safety protocols and procedures that are warranted for a particular instance. All site visits will be conducted with the safety of project staff as the top priority.

COMPARABLE PROJECTS/SERVICES NDOR On-Call Contracts; Nebraska Environmental Services In 2013, Burns & McDonnell was awarded our first on-call contract for environmental services, which included NEPA CE, T&E species surveys, wetland delineations surveys, cultural resources surveys, hazardous waste reviews, agency coordination, public involvement, environmental permitting (Section 10, Section 404, Title 119, etc.), and wetland and stream mitigation planning. Burns & McDonnell has received four task authorizations to provide environmental studies and permitting services for 24 highway improvement projects.

Wetland Services In 2012, Burns and McDonnell was awarded an on-call contract for wetland studies and permitting services for 15 road improvement projects throughout Nebraska. Wetland services included conducting wetland preliminary determinations of routes and conducting wetland delineations in accordance with the guidelines of the 1987 Corps of Engineers Wetlands Delineation Manual, the 2010 Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Midwest Region and Great Plains Region, and guidance provided by NDOR. Wetland delineation reports were prepared in accordance with specific NDOR guidance, and Section 404 Permit applications were prepared and submitted to the USACE for a Nationwide Permit 14, where necessary.

NDOR determined that a strategic plan was needed for the development for future wetland mitigation banks to meet the needs of future projects. NDOR contracted with Burns & McDonnell to provide an assessment of wetland mitigation banking needs for 5-, 10-, 15-, and 20-year road improvement programs. Also, in that assessment, we were to develop a mitigation

I-35 Interchange EA; Johnson County, Kansas Burns & McDonnell led the Location Study, Break-In-Access Study, and the Environmental Assessment (EA) for a new interchange on I-35 southwest of Kansas City. The study, initiated in 2007, was placed on hold while the USACE and BNSF prepared an EA for development of a new Intermodal Freight Facility and Logistics Park in the area to be served by the proposed interchange. When work was re-initiated on the interchange EA in 2009, the NEPA process was completed in fewer than 14 months with a Finding of No Significant Impact (FONSI) issued by FHWA KS Division on March 21, 2011. Preparation of the EA and associated Break-In-Access Study included review of three locations and more than eight interchange types, including a diverging diamond interchange (DDI).

The EA was prepared following a merged NEPA-Section 404 approach, with Burns & McDonnell staff working closely with FHWA and USACE to include information in the EA that could be used by the USACE to complete their 404(b)(1) Guidelines review and issue the appropriate Section 404 permit to allow construction of the project. Key issues evaluated in the EA included: land acquisition, traffic noise, water quality, and air quality. The re-evaluation also included public workshops to obtain input and comments from the local business community and residents. Coordination with SHPO and the Johnson County Parks and Recreation District alleviated the need to prepare a Section 4(f) Evaluation for a historic barn and parkland.

8t h Street Improvements EA; Bentonville, Arkansas Burns & McDonnell completed an EA and Section 4(f) Evaluation for improving 8th Street from SW I Street to U.S. 71/I-540 in Bentonville. The improvement include widening a two-lane suburban roadway with open ditches to a four- and five-lane section with center turn lane, curb-and-gutter, sidewalks, and a multi-use path. A portion of the project would be constructed on new alignment to provide an interchange connection at US 71/I-540.

The EA involved wetland delineations/jurisdictional determinations, Section 106 coordination and completion of a Section 4(f) Evaluation for unavoidable impacts to the Bentonville National Guard Armory/Readiness Center Vehicle Storage Shed. Socioeconomic and EJ analyses were also conducted. An extensive public outreach program was also implemented.

The EA and Section 4(f) Evaluation were approved on October 19, 2011, and a Location Public Hearing was completed on December 15, 2011. Due to project area changes, the Section 4(f) Evaluation was revised and approved August 1, 2012. The EA included the evaluation of impacts to a historic National Guard Vehicle Storage Shed under Section 4(f) of the DOT Act, development of alternatives to avoid the historic structure and minimize residential relocations, and completion of an EJ analysis. FHWA issued a FONSI on August 26, 2013.

Kansas City Downtown Streetcar EA; Kansas City, Missouri Burns & McDonnell worked jointly with another consulting firm to prepare the EA for a 2.2-mile long starter streetcar line in downtown Kansas City, Missouri. The project included extensive coordination with the City, the FTA, MoDOT (for crossings of I-35/I-70 and I-670), and Missouri Department of Natural Resources SHPO to obtain concurrence on a “no adverse effect” finding for 145 National Register of Historic Places (NRHP)-listed and 42 properties newly or already determined NRHP-eligible. More than 12 hazardous material and waste sites were identified adjacent and upgradient to the existing street right-of-way where the streetcar line will be constructed; these sites require additional testing to determine presence and/or extent of possible contamination within the right-of-way. Burns & McDonnell also evaluated three potential sites for location of a vehicle maintenance facility. We also led coordination with Kansas City Parks and Recreation Department to reach a determination that Section 4(f) would not be applicable to the use of existing boulevards for placement of the streetcar car line.

Burns & McDonnell also completed the socioeconomic and EJ analysis for the project following FTA’s newest guidance released on July 14, 2012. The analysis revealed that no disproportionate impacts on minority and/or low income populations would result from the streetcar project. FTA has used this analysis in their ongoing EJ training.

Contractual liability coverage shall be on a broad form basis and shall not be amended

Policy shall not contain a total or absolute pollution exclusion. Coverage shall be

provided for pollution exposures arising from products and completed operations (as per

standard CG0001 Pollution Exclusion or equivalent). (If the standard pollution exclusion

as provided by CG0001 has been amended, please refer to the following section entitled

“Pollution Coverage.”)

Pollution Coverage –

In the event that the standard pollution exclusion as provided by CG0001 has been

amended, coverage may be substituted with a separate Pollution Liability policy or a

Professional Liability policy that includes pollution coverage in the amount of $1.0 million

per occurrence or claim and $1.0 million aggregate. If coverage is provided by a “claims

made” form, coverage will be maintained for three years after project completion. Any

applicable deductible is the responsibility of the Consultant.

Automobile Liability –

Limits of at least: $ 1,000,000 CSL Per Accident

Coverage shall apply to all Owned, Hired, and Non-Owned Autos.

Workers’ Compensation –

Limits: Statutory coverage for the State where the project is located.

Employer’s Liability limits: $100,000 Each Accident

$100,000 Disease – Per Person

$500,000 Disease – Policy Limit

Consultant agrees to waive its rights of recovery against the State. Waiver of

Subrogation in favor of the State of Nebraska, Department of Roads shall be added to,

or included in, the policy

Professional Liability –

Limits of at least: $ 1,000,000 Per Claim and Annual Aggregate

Coverage shall be provided for three years after work/project completion.

Electronic Data and Valuable Papers –

Limits of at least: $100,000 Electronic Data Processing Data and Media

$25,000 Valuable Papers

Umbrella/Excess –

Limits of at least: $1,000,000 Per Occurrence and Annual Aggregate

Policy shall provide liability coverage in excess of the specified Employers Liability,

Commercial General Liability and Auto Liability.

The State of Nebraska, Department of Roads, shall be an “Additional Insured”.

Consultant agrees to waive its rights of recovery against the State. Waiver of

subrogation in favor of the State of Nebraska, Department of Roads shall be provided.

Additional Requirements –

Any insurance policy shall be written by a reputable insurance company acceptable to

the State or with a current Best’s Insurance Guide Rating of A – and Class VII or better,

and authorized to do business in Nebraska.

Evidence of such insurance coverage in effect shall be provided to the State in the form

of an Accord certificate of insurance executed by a licensed representative of the

participating insurer(s),

For so long as insurance coverage is required under this agreement, the Consultant

shall have a duty to notify the State when the Consultant knows, or has reason to

believe, that any insurance coverage required under this agreement will lapse, or may

be canceled or terminated. The Consultant must forward any pertinent notice of

cancelation or termination to the State, at the address listed below by mail (return receipt

requested), hand-delivery or facsimile transmission within 2 business days of receipt by

Consultant of any such notice from an insurance carrier. Notice shall be sent to:

Failure of the owner or any other party to review, approve, and/or reject a certificate of

insurance in whole or in part does not waive the requirements of this agreement.

The Limits of Coverage’s set forth in this document are suggested minimum limits of

coverage. The suggested limits of coverage shall not be construed to be a limitation of

the liability on the part of the consultant or any of its subconsultants/tier subconsultants.

The carrying of insurance described shall in no way be interpreted as relieving the

consultant, subconsultant, or tier subconsultant of any responsibility of liability under the

contract.

If there is a discrepancy of coverage between this document and any other insurance

specification for this project, the greater limit or coverage requirement shall prevail.

Our policies will provide notice of cancellation to the certificate holder 30 days prior to cancellation. It is recommend to amend this wording to align with our policies otherwise, it will be on the project team to notify the State.
