ACTTo provide for the establishment of the Namibian Council for Property Valuers

Profession; to provide for the registration of professional valuers, associate professional valuers, valuers in training, student valuers in training and specified categories in the property valuation profession; and to provide for incidental matters.

BE IT ENACTEDbytheParliamentoftheRepublicofNamibia,asfollows:

PARTIINTRODUCTORYPROVISIONS

Definitions

1. InthisAct,unlessthecontextotherwiseindicates-

“actively practise” means to practise on an ongoing basis in one of the categoriescontemplatedinsection16;

“associateprofessionalvaluer”meansapersonwho is registered in termsofsection17(2)(a);

“committee”meansacommitteeoftheCouncilestablishedintermsofsection14;

“Council”meanstheNamibianCouncilforPropertyValuersProfessionestablishedbysection2;

“disciplinarytribunal”meansatribunalappointedintermsofsection28;

“investigatingcommittee”meansaninvestigatingcommitteecontemplatedinsection14(1(b);

“Minister”meanstheMinisterresponsibleforlands;

“Ministry”meanstheMinistrychargedwiththeadministrationoflands;

“prescribed”meansprescribedbyaregulation;

“professionalvaluer”meansapersonwhoisregisteredintermsofsection17(2)(a);

“property”includesarightinrespectof,oraninterestin,immovablepropertywhichissubjecttoregistrationorisregisteredinanydeedsregistryinNamibia,andincludesmovableassetswhichformspartofanimmovableproperty;

“propertyvaluation”meansthedeterminationof thevalueofpropertyinaccordancewithprescribedstandards;

“registeredperson”meansapersonregisteredunderoneofthecategoriesreferredtoinsection16;

“Registrar”meansthepersonappointedasRegistrarundersection15(1(a);

“regulation”meansaregulationmadeundersection34;

“studentvaluerintraining”meansanypersonregisteredintermsofsection17(2)(b);

“Valuer-General”meanstheincumbentofthepostofValuer-GeneralintheMinistry;

“valuerintraining”meansanypersonregisteredintermsofsection17(2)(b);

“voluntary association” means any association of professional valuers, associateprofessionalvaluersorvaluersintrainingrecognisedundersection22.

PARTIINAMIBIANCOUNCILFORPROPERTYVALUERSPROFESSION

Establishment of Namibian Council for Property Valuers Profession

2. (1) There is established a juristic person to be known as theNamibianCouncilforPropertyValuersProfession.

(2) TheCouncilhasitsseatandheadofficeinWindhoek.

Constitution of Council

3. (1) Subjecttosubsections(2),(3)and(4),theCouncilconsistsof-

(a) three professional valuers (including associate professional valuers),ofwhomatleasttwomustactivelypractiseinthepropertyvaluationprofession,nominatedbyvoluntaryassociationsandregisteredpersonswhoarenotmembersofanyvoluntaryassociation;and

(b) aprofessionalvaluerinthefull-timeemploymentofthePublicService,selectedbytheMinisterafterconsultationwiththeMinistersresponsibleforregionalandlocalgovernment,works,financeandagriculture;

(c) amemberofthepublicwithexpertiseinpropertymattersnominatedbythepublic;

(d) apersonwithexpertiseinlaw,nominatedbytheMinisterresponsibleforjustice,

andappointedbytheMinister;and

(e) theValuer-General,byvirtueofoffice.

(2) For thepurposesofappointmentofpersonsreferredto insubsection(1)(a),(c)and(d)asmembersoftheCouncil,theMinistermustpublishanoticeintheGazette and inat least twonewspaperscirculating inNamibia, inviting theMinisterresponsible for justice, any interested persons, voluntary associations or bodies tonominatesuchpersonsforappointmentasmembersoftheCouncilwithin30daysofthepublicationoftheinvitationintheGazette.

(3) IfanominationisnotmadetotheMinisterwithintheperiodreferredtoinsubsection(2),theMinistermayappointanysuitablepersonwhoholdsthenecessaryqualificationtobeamemberoftheCouncil,andapersonappointedunderthissubsectionholdsofficeasifheorshewasnominatedinaccordancewithsubsection(2).

(4) TheMinister,bynoticeintheGazette,assoonaspracticableaftertheappointmentofthemembersoftheCouncilintermsofsubsection(1),mustpublish-

(a) thenameofeverypersonappointedasamember;

(b) thedatefromwhichtheappointmenttakeseffect;and

(c) theperiodforwhichtheappointmentismade.

Powers and functions of Council with regard to registration

4. TheCouncilmust,subjecttothisAct-

(a) consideranddecideonanyapplicationforregistration;

(b) prescribetheperiodofvalidityoftheregistrationofaregisteredperson;

(c) keeparegisterofregisteredpersonsandprescribe-

(i) theformofcertificatesandtheregistertobekept;

(ii) themaintenanceoftheregisterorissuingofcertificates;and

(iii) the reviewing of the register and the manner in whichamendmentstheretomaybeeffected.

Powers and functions of Council with regard to fees and charges

5. (1) With regard to fees and charges which are payable to theCouncil,theCouncilmustdetermine-

(a) applicationfees;

(b) registrationfees;

(c) annualfees,oranyportionthereofinrespectofapartofayear;

(d) fees, or any portion thereof, payable in respect of any examinationreferredtoinsection17,conductedbyoronbehalfoftheCouncil;

(e) anychargepayableforthepurposesoftheeducationfundreferredtoinsection13(3)(c);

(f) feespayableforaservicereferredtoinsection7(c);

(g) anyotherfeeorchargeitconsidersnecessary;or

(h) thedateonwhichanyfeeorchargeispayable.

(2) The Council, on applicationmade or on its own accord,may grantexemptionfromthepaymentofapplicationfees,registrationfees,annualfees,chargesoraportionthereofreferredtoinsubsection(1).

Powers and functions of Council with regard to education in property valuation

6. (1) TheCouncil-

(a) must,subjecttosections5and6oftheHigherEducationAct,2003(ActNo.26of2003),conductcontactvisitstoanyeducationalinstitutionwhich has a department, school or faculty which offers propertyvaluationeducationprogrammes,butmustconductat leastonesuchvisitduringitstermofoffice;

(b) may,eitherconditionallyorunconditionally,grant,refuseorwithdrawapprovalwithregardtoalleducationalinstitutionsandtheireducationalprogrammeswithregardtopropertyvaluation;

(c) mustconsultwiththeNationalCouncilforHigherEducationestablishedby section 4 of theHigherEducationAct, 2003 (ActNo. of 2003),regardingmattersrelevanttoeducationinpropertyvaluation;

(d) must consult with the Namibia Qualifications Authority establishedby the Namibia Qualifications Authority Act, 1996 (Act No. 29 of1996),oranybodyestablishedbyit,andthevoluntaryassociations,todetermineoccupationalstandardsforthepurposeofregistration;

(e) mustestablishmechanismsforregisteredpersonstogainrecognitionoftheirqualificationsandprofessionalstatusinothercountries;

(f) may recognise, or withdraw the recognition of, any examinationcontemplatedinsection17;

(g) mayenterintoanagreementwithanypersonorbodyofpersons,withinoroutsideNamibia,withregardtotherecognitionofanyexaminationorqualificationforthepurposesofthisAct;

(h) may give advice or render assistance to any educational institution,voluntary association or examining bodywith regard to educationalfacilitiesforandthetrainingandeducationofregisteredpersonsandprospectiveregisteredpersons;

(i) mayconductanyexaminationforthepurposesofsection17;and

(j) mustdetermine,afterconsultationwiththevoluntaryassociationsandregisteredpersons,conditionsrelatingtoandthenatureandextentofcontinuingeducationandtraining.

(2) IftheCouncilhasnotconductedacontactvisitwithinitstermofofficeascontemplatedinsubsection(1)(a)itmust-

(a) notifytheMinisteraccordingly6monthspriortotheexpirationofitstermofoffice;and

(b) providetheMinisterwithreasonsforthefailuretodoso.

General powers of Council

7. (1) TheCouncilmay,inadditiontoanyotherpowersconferredorimposeduponitbythisAct-

(a) acquire, hire,maintain, let, sell or otherwise dispose ofmovable orimmovablepropertyfortheeffectiveperformanceandexerciseofitsfunctions,dutiesorpowers;

(b) determinethemannerinwhichcontractsmustbeenteredintoonbehalfoftheCouncil;

(c) perform any servicewithin its competence if it is requested by anypersonorbodyofpersons,includingtheState;

(d) prescribe,subjecttosection22,therequirementswithwhichavoluntaryassociationmustcomplytoqualifyforrecognitionbytheCouncil;

(e) advisetheMinisteroranyotherministeronanymatterrelatingtothepropertyvaluationprofession;

(f) encourage and itself undertake research into matters relating to thepropertyvaluationprofession;

(g) takeanystepsitconsidersnecessaryfor-

(i) the protection of the public in their dealingswith registeredpersons;and

(ii) themaintenanceof the integrityand theenhancementof thestatusofthepropertyvaluationprofession;

(h) take any steps it considers necessary for the improvement of thestandardsofservicesrenderedbyregisteredpersons;

(i) takeanymeasures itconsidersnecessaryfor theproperperformanceandexerciseofitsfunctions,dutiesorpowersinordertoachievetheobjectivesofthisAct;

(j) prescribetheminimumqualificationrequirementsforregistration.

(2) TheCouncilmay-

(a) arrange insurancewithan insurerwho is registeredordeemed toberegistered under the LongTerm InsuranceAct, 1998 (ActNo. 5 of1998),ortheShortTermInsuranceAct,1998(ActNo.4of1998),fortheindemnificationbymeansofinsuranceofregisteredpersonsagainstclaims arising from the performance of their functions as registeredpersons;

(b) arrangewithaninsurerreferredtoinsubsection(1)fortheprovisionofcoverbymeansofinsurancefor-

(i) anymember,theRegistraroranyemployeeoftheCouncilinrespect of any bodily injury, disablement or death resultingfromanaccidentoccurringinthecourseoftheperformanceofhisorherfunctionsintermsofthisAct;

(ii) theCouncilagainstanyloss,damage,riskorliabilitywhichitmaysufferorincur,includingcoverinrespectofanylossordamagecausedtoitbyanypersoninitsserviceandinrespectofallpropertyunderthecontroloftheCouncil;

(c) print, circulate, sell and administer the publicationof, andgenerallytake any steps necessary to publish, any publication relating to thepropertyvaluationprofessionandrelatedmatters.

Term of office of members of Council

8. (1) Subjecttosubsection(3),thetermofofficeofamemberoftheCouncilisfouryears,butmemberscontinueinofficeuntilthesucceedingCouncilisdulyconstituted.

(2) AmemberoftheCouncilotherthantheValuer-Generalmaynotserveformorethantwoconsecutivetermsofoffice.

(3) Despitesubsections(1)and(2)theMinistermay-

(a) bynotice in theGazette, after consultationwith theCouncil, extendthetermofofficeofamemberorallthemembersoftheCouncilforaperiodnotexceeding12months;

(b) bynoticeintheGazette,afterconsultationwiththeCouncil,andafterthememberconcernedhasbeenaffordedanopportunitytobeheard,terminate the termof office of amember or all themembers of theCouncil.

Disqualification for appointment as member of Council

9. ApersonmaynotbeappointedasamemberoftheCounciliftheperson-

(a) isnotaNamibiancitizenorapermanentresidentofNamibia,andnotordinarilyresidinginNamibia;

(b) has been convicted of an offence and sentenced to imprisonmentwithout the option of a fine, unless he or she has been pardoned orunlesssuchimprisonmenthasexpiredatleast10yearsbeforethedateofappointment;

(c) isunrehabilitatedinsolvent;

(d) isofunsoundmindandhavebeensodeclaredbyacompetentcourt;

(e) is a member of Parliament, a regional council or a local authoritycouncil;

(f) has,asaresultofimproperconduct,beenremovedfromanofficeoftrust;or

(g) hasintermsofthisActbeenfoundguiltyofseriousimproperconduct.

Vacation of office and filling of casual vacancies

10. (1) AmemberoftheCouncilvacateshisorherofficeifthemember-

(a) becomesdisqualifiedintermsofsection9frombeingappointedasamemberoftheCouncil;

(b) resignsbywrittennoticeaddressedtotheMinister;

(c) has,withouttheleaveoftheCouncil,beenabsentfrommorethantwoconsecutivemeetingsoftheCouncil;

(d) is withdrawn by the nominating authority that has nominated themember;

(e) wasappointedintermsofsection3(1)(a),(b)or(c)andceasestobeinthatcategoryofpersons;

(f) isremovedfromofficeundersubsection(2).

(2) TheMinister,bynoticeinwriting,mayremoveamemberfromofficeiftheMinister,afteraffordingthememberanopportunitytobeheard,issatisfiedthatthemember-

(a) isincapacitatedbyphysicalormentalillness;or

(b) is, for any valid reason, unable or unfit to properly, efficiently andeffectivelydischargethefunctionsofamember.

(3) Whenever theMinister acts under subsection (2), theMinister mayfirstsuspendthememberconcernedfromhisorherofficependingafinaldecisiononwhetherornotthemembershouldberemoved.

(4) IfamemberoftheCouncildiesorvacatesofficebeforetheexpirationofhisorhertermofoffice,theMinister,afterconsultationwiththeCouncil,andsubjecttosection3mayappointapersontofillthevacancyfortheunexpiredportionoftheperiodforwhichthatmemberwasappointed.

Election of chairperson and vice-chairperson of Council

11. (1) ThemembersoftheCouncilmustatthefirstmeetingofeverynewlyconstitutedCouncilelectachairpersonandavice-chairpersonoftheCouncil-

(a) who must be registered persons, but excluding valuer in training,studentvaluerintrainingandprescribedcategories;and

(b) ofwhomatleastonemustactivelypractiseinthepropertyvaluationprofession.

(2) Thechairpersonandvice-chairpersonoftheCouncilholdofficeforthedurationoftheirtermsofoffice.

(3) If the chairperson of theCouncil is for any reason unable to act aschairperson,thevice-chairpersonoftheCouncilmustperformallthefunctionsandmayexerciseallthepowersofthechairperson.

(4) Ifboththechairpersonandthevice-chairpersonoftheCouncilareforanyreasonunable topresideataCouncilmeetingthememberspresentmustelectapersonfromtheirnumbertopresideatthatmeeting.

(5) Aperson elected as contemplated in subsection (4)mayduring thatmeetinganduntilthechairpersonorvice-chairpersonoftheCouncilresumeshisorherfunctions,performallthefunctionsandexerciseallthepowersofthechairperson.

Meetings and decisions of Council

12. (1) The Minister, as soon as practicable from the date of theappointmentoftheCouncil,mustdeterminethedate,timeandplaceofthefirstmeetingoftheCouncil,andthereafter,subjecttosubsection(3),meetingsoftheCouncilmustbeheldquarterlyatthedates,timesandplacesastheCouncilmaydetermine.

(2) IftheCouncilhasnotdeterminedthedate,timeandplaceforitsnextmeeting,thechairpersonoftheCouncilmustdeterminethedate,timeandplace.

(3) ThechairpersonoftheCouncil-

(a) may,inadditiontothequarterlymeetingsreferredtoinsubsection(1),conveneaspecialmeetingoftheCouncilatanytime;and

(b) mustconveneaspecialmeetingoftheCouncilonthewrittenrequestoftheMinisteroratleastthreemembersoftheCouncil.

(4) ThechairpersonoftheCouncilmustconveneameetingrequestedintermsofsubsection(3)(b)within14daysafterthedateofreceiptoftherequestandatsuchdate,timeandplaceasheorshemaydetermine.

(5) AtameetingoftheCouncil-

(a) amajorityoftwo-thirdsofallthemembersoftheCouncilconstitutesaquorum;

(b) a decision of a majority of the members present and voting at anymeetingoftheCouncilconstitutesthedecisionoftheCouncil.

(6) Intheeventofanequalityofvotesthepersonpresidingatthemeetinghasacastingvoteinadditiontohisorherdeliberativevote.

(7) Subject to subsection (5), a decision of theCouncil is not renderedinvalidbyreasononly–

(a) ofavacancyontheCouncil;or

(b) ofthefactthatapersonwhoisnotentitledtositasamemberoftheCouncildidsositwhenthedecisionwastaken,

ifthatdecisionwastakenbytherequisitemajorityofthememberswhowerepresentatthetimeandentitledtovote.

(8) The Council may determine the manner in which meetings of theCounciloranycommitteeoftheCouncilareconvened,theprocedureatsuchmeetingsandthemannerinwhichtheminutesofsuchmeetingsarekept.

Funds of Council and keeping and auditing of accounts

13. (1) The funds of theCouncil consist ofmoney appropriated byParliamentforthepurposeoftheCouncilandanymoneyreceivedintermsofthisActandallothermonieswhichmayaccruetotheCouncilfromanyotherlawfulsource,includingfinesimposedbytheCouncil.

(2) TheCouncilmay-

(a) collectandinvestfundsoftheCouncil;

(b) raisemoneybywayofloanforthepurposeofeffectivelyperformingitsfunctions;

(c) with a view to the promotion of anymatter relating to the propertyvaluationprofession,lendmoneyagainstsuchsecurityastheCouncilconsidersadequate;and

(d) mortgageanyofitsimmovablepropertyassecurityforaloanreferredtoinparagraph(b).

(3) TheCouncil-

(a) mustpayfromits funds to itsmembersandcommitteemembers theallowancesdeterminedbytheMinisterascontemplatedinsubsection(7);

(b) mayfinanceanypublicationreferredtoinsection7(3)

(c) may establish and administer an education fund for the education,training and continuing education and training of registered personsandstudentsinthepropertyvaluationprofession.

(4) TheCouncilmustkeepfullandcorrectaccountofallmoniesreceivedandexpendedbyit.

(5) Subjecttosubsection(9),thefinancialyearoftheCouncilendson31Marchofeachyear.

(6) TheCouncilmust-

(a) annuallyprepareastatementofincomeandexpenditureandabalancesheetshowingitsfinancialpositionasatthecloseofthefinancialyeartowhichitrelates;

(b) havethestatementandbalancesheetauditedbyanauditorregisteredintermsofthePublicAccountants’andAuditors’Act,1951(ActNo.51of1951);

(c) haveacopyof theauditedstatementandbalancesheetavailableforinspectionattheofficesoftheCouncil.

(7) TheCouncilmust,withinsixmonthsfromthecloseofeachfinancialyearorsuchotherperiodasmaybeagreedtobytheMinisterafterarequestbytheCouncil,submittheauditedstatementandbalancesheettotheMinisterwhomusttablethemintheNationalAssembly-

(a) within30daysfromthedateofreceiptthereof,iftheNationalAssemblyistheninordinarysession;or

(b) iftheNationalAssemblyisnottheninordinarysession,within30daysaftercommencementofitsnextordinarysession.

(8) If, after consultation with the Council, theMinister is satisfied thattheCouncilisfinanciallystrongandfundsareenoughtosustaintheoperationsoftheCouncil,theMinistermustissueanoticeintheGazettetothateffect.

(9) Afterthepublicationofthenoticereferredtoinsubsection(8)–

(a) theCouncilisnolongerentitledtoreceivemoneyfromParliament;

(b) subsection(7)ceasestoapply;and

(c) the Council, by notice in the Gazette, may determine a differentfinancialyearthatmaybemoresuitabletoitsoperations.

(10) TheCouncilmust apply due care and diligencewhen investing anymoneyorincurringanyexpenditurefromthefundsoftheCouncil.

(11) Theremustbepaidtoamemberof theCounciloramemberofanycommitteewhoisnotinthefull-timeemploymentoftheStatesuchremunerationandallowances,includingsubsistenceandtravelallowances,outofthefundsoftheCouncilastheCouncil,withtheconcurrenceoftheMinister,maydetermine.

(12) TheCouncilmayreimburseanymemberoftheCounciloramemberofanycommitteeforsubsistenceandtravellingexpensesreasonablyincurredbyhimorherwhileattendingameetingoftheCouncilorofacommittee.

Committees of Council

14. (1) TheCouncil-

(a) may establish any committee to assist it in the performance of itsfunctions;and

(b) must establish an investigating committee if a charge of improperconductistobeinvestigated,

andmayappointanypersonasamemberofthecommitteeconcerned,butnomemberoftheCouncilmaybeappointedasamemberofaninvestigatingcommittee.

(2) TheCouncilmustdesignateachairpersonforacommittee.

(3) TheCouncilmayatanytimedissolveorreconstituteacommittee.

Appointment and remuneration of Registrar and other employees of Council

15. (1) TheCouncil-

(a) mustappointaRegistraronsuchconditions,includingthepaymentofremuneration,allowancesandotherbenefits,ifany,asitmaydetermine;

(b) mayappoint,onsuchconditions,includingthepaymentofremuneration,allowancesandotherbenefits,ifany,asitmaydetermine,suchotheremployeesasitmaydeemnecessaryforcarryingoutitsfunctions;

(c) arrangeforthepaymentofpensionandotherbenefitstotheRegistraror any other employee of theCouncil and to the dependants of theRegistrarortheemployeeconcernedontheterminationoftheserviceoftheRegistrarortheemployee;

(d) maydismiss any person so appointed subject to the rules of naturaljustice.

(2) Onacceptanceofhisorherappointmentassuch, theRegistrarmustenterwith theCouncil intoaperformanceagreement in the formdeterminedby theCouncil.

(3) The Registrar must perform, in addition to such functions as mayotherwisebeassignedtotheRegistrarbyorunderthisAct,suchfunctionsasmayfromtimetotimebeassignedtohimorherbytheCouncil.

PARTIIIREGISTRATION

Categories of registration

16. (1) Thecategoriesinwhichapersonmayregisterinthepropertyvaluationprofessionare-

(a) professionalvaluer;

(b) associateprofessionalvaluer;

(c) valuerintraining;

(d) studentvaluerintraining;or

(e) otherspecifiedcategoriesasprescribedbytheCouncil.

(2) Apersonmayonlyactivelypractiseinanyofthecategoriescontemplatedinsubsection(1)ifthepersonisregisteredinthatcategory.

(3) Apersonwhoisregisteredinthecategoryofvaluerintrainingmustperform work in the property valuation profession only under the supervision andcontrolofaprofessionalofacategoryasprescribed.

Registration in any category of valuers

17. (1) Apersonmust-

(a) applyintheprescribedapplicationformtotheCouncilforregistrationinacategoryreferredtoinsection16(1),and

(b) paytheprescribedapplicationfeewhenlodgingtheapplication.

(2) Subjecttosubsection(4),if,afterconsiderationofanapplication,theCouncilissatisfiedthattheapplicant-

(a) inthecaseofapersonapplyingforregistrationasaprofessionalvalueroranassociateprofessionalvaluer-

(i) isordinarilyresidentinNamibiaandisaNamibiancitizenorhasbeenadmittedtoNamibiaforpermanentresidence;

(ii) has passed the prescribed examination, any examinationrecognised by theCouncil or competency test prescribed orrecognisedbytheCouncil;

(iii) has gained practical experience in property valuation inNamibiawhichisoftheprescribedscope,variety,natureandstandard;and

(iv) inthecaseofanassociateprofessionalvaluer,hasnotactivelypracticedinNamibiawithinthelastsixmonths;

(b) applying for registration as a valuer in training, a student valuer intrainingorinaspecifiedcategory-

(i) isordinarilyresidentinNamibiaandisaNamibiancitizenorhasbeenadmittedtoNamibiaforpermanentresidence;

(ii) isenrolledataneducationalinstitutionapprovedbytheCouncilfor a course which includes the prescribed or recognisedexaminations;

(iii) haspassedanyotherexaminationprescribedbytheCouncil;and

(iv) hasprovedthatheorshehassatisfiedtherelevanteducationaloutcomesprescribed,

theCouncilmustregisterthesuccessfulapplicantintherelevantcategoryandissuearegistrationcertificatetotheapplicantintheprescribedform.

(3) The Council may prescribe the restrictions and conditions, if any,applicable to an applicant applying in the category of associate professional valuer,valuerintraining,studentvaluerintrainingorinaspecifiedcategory.

(4) Despitesubsection(2),theCouncilmayrefusetoregisteranapplicant-

(a) iftheapplicanthasbeenremovedfromanofficeoftrustonaccountofimproperconduct;

(b) has been convicted of an offence and sentenced to imprisonmentwithout the option of a fine, unless he or she has been pardoned orunlesssuchimprisonmenthasexpiredatleast10yearsbeforethedateofregistration;

(c) isofunsoundmindandhavebeensodeclaredbyacompetentcourt;

(d) foraslongastheapplicantisdisqualifiedfromregistrationasaresultofanypenaltyimposedonhimorherunderthisAct;or

(e) if theapplicantisanunrehabilitatedinsolventwhoseinsolvencywascausedbyhisorhernegligenceorincompetenceinperformingworkfallingwithinthescopeofthecategoryinrespectofwhichheorsheisapplyingforregistration.

(5) TheCouncilmustprovideanapplicantwhoseapplicationisrefusedascontemplatedinsubsection(4),withawrittennoticeofrefusalprovidingreasonsfortherefusal.

Cancellation of registration

18. (1) TheCouncilmaycanceltheregistrationofaregisteredpersoniftheperson-

(a) becomes disqualified from registration as contemplated in section17(4);

(b) haserroneouslybeenregisteredorhasbeenregisteredoninformationsubsequentlyprovedtobefalse;or

(c) failstopaytheprescribedannualfeeoranyportionthereofwithin60daysfromitbecomingdueorwithinsuchfurtherperiodastheCouncilmayallow,eitherbeforeorafterexpiryofthe60days.

(2) The Council must provide the person whose registration has beencancelled as contemplated in subsection (1), with a written notice of cancellationprovidingreasonsforthecancellation.

(3) If a personwho is registered as a valuer in training qualifies to beregisteredasaprofessionalvalueroranassociateprofessionalvaluerintermsofsection17(2)(a),theCouncilmustcancelhisorherregistrationasavaluerintraining.

(4) TheCouncilmustatthewrittenrequestofanyregisteredpersoncancelhis or her registration, but if an investigation into alleged improper conduct by thatperson is inprogressor is tobeheld, theregistrationmaynotbecancelleduntil theinvestigationhasbeenconcluded.

(5) Despite the cancellation of the registration of a registered person intermsofthissection,thepersonremainsliableforanyfee,arrearsorpenaltyimposedbytheCouncilinrespectoftheperiodthatthepersonwassoregistered.

Authorised titles

19. (1) Apersonwhoisregisteredinanyofthecategoriesreferredtoinsection16(1)(a)to(d)maydescribehimselforherselfandusethetitle-

(a) professionalvaluer;

(b) associateprofessionalvaluer;

(c) valuerintraining;or

(d) studentvaluerintraining.

(2) ApersonregisteredinaspecifiedcategoryprescribedbytheCouncilascontemplatedinsection16(1)(e)mayuseatitleprescribedbytheCouncilforthespecifiedcategory.

(3) Aregisteredpersonmustusehisorhertitleinallpropertyvaluationreportsandotherdocumentationrelatingtohisorherworkinthepropertyvaluationprofessionpreparedbyorforhimorher.

(4) TheCouncilmaydetermine abbreviationsor acronyms for the titlesreferredtoinsubsections(1)and(2).

Renewal of registration

20. (1) A registeredpersonmust apply at least 90days prior to theprescribedexpirydateofhisorherregistrationintheprescribedmannertotheCouncilfortherenewalofhisorherregistration.

(2) TheCouncilmayprescribeconditionsfortherenewalofregistration,but if the conditions concerned are less favourable to the registeredperson than thepreviousconditions,ifany,theCouncilmustaffordtheregisteredpersonconcernedanopportunitytobeheardbeforethenewconditionsareimposed.

(3) Subjecttosection17,theCouncilmustregisteronapplicationapersonwhowaspreviouslyregisteredandwhoseregistrationwascancelledintermsofsection18(1)(a)or(c),ifthepersonhaspaid-

(a) theprescribedapplicationfee;

(b) anyarrearannualfeeoranyportionthereof;

(c) anyexpensesincurredbytheCouncilinconnectionwiththerecoveryofanyarrearfees;or

(d) anypenaltyimposedonthepersonbytheCouncil.

Return of registration certificate

21. Apersonwhose registrationhasbeencancelled in termsof thisActmustreturnhisorherregistrationcertificatetotheRegistrarwithin30daysfromthedateofcancellation.

Recognition of voluntary associations

22. (1) Any voluntary association may apply to the Council to berecognisedassuch.

(2) TheCouncilmayrecogniseavoluntaryassociationandissueitwithacertificateofrecognition,ifthevoluntaryassociationcomplieswiththerequirementsprescribedintermsofsection7(d).

(3) Acertificateofrecognitionisvalidforaperiodoffiveyearsfromthedateofissue.

(4) Avoluntaryassociationmustdisplayitscertificateofrecognitioninaprominentplaceatitsheadoffice.

(5) Therecognitionofavoluntaryassociationlapses-

(a) iftheassociationnolongercomplieswiththerequirementscontemplatedinsection7(d);or

(6) A voluntary associationmust apply in the prescribedmanner to theCouncil for the renewal of its recognition at least 90 days prior to the expiry of itsrecognition.

(7) Avoluntaryassociationwhoserecognitionhaslapsedandhasnotbeenrenewedmust,within30daysfromthedateonwhichitissodirectedinwritingbytheCouncil,returnitscertificateofrecognition.

Identification of work

23. (1) TheCouncilmustconsultwith-

(a) allvoluntaryassociations;

(b) anyperson;

(c) anybody;or

(d) anyindustry,

that, in theopinionof theCouncil,maybe affectedby any law regulating thebuiltenvironmentprofessionsregardingtheidentificationofthetypeofpropertyvaluationworkwhichmaybeperformedbypersonsregisteredinanyofthecategoriesreferredtoinsection16.

Prohibition of unregistered persons from performing work reserved for registered persons and from doing certain things

24. (1) ApersonwhoisnotregisteredintermsofthisActmaynot-

(a) perform any kind of work identified for any category of registeredpersons;

(b) pretendtobe,orinanymannerholdorallowhimselforherselftobeheldoutasapersonregisteredintermsofthisAct;

(c) usethenameofanyregisteredpersonoranynameortitlereferredtoinsection16or19;or

(d) performanyactindicating,orcalculatedtoleadpersonstobelievethatthepersonisregisteredintermsofthisAct.

(2) Subsection(1)(a)maynotbeconstruedasprohibitinganypersonfromperformingworkidentifiedintermsof thissection, ifsuchworkisperformedintheserviceoforbyorderofandunderthedirection,control,supervisionoforinassociationwitharegisteredpersonentitledtoperformtheworkidentifiedandwhomustassumeresponsibilityforanyworksoperformed.

PARTIVCODEOFCONDUCTANDDISCIPLINARYPROVISIONS

Code of conduct

25. (1) The Council, after consultation with voluntary associations,registered persons and theMinister,must draw up a code of conduct for registeredpersons.

(2) TheCouncilisresponsibleforadministeringthecodeofconductandmustensurethatthecodeisavailabletomembersofthepublicatallreasonabletimes.

(3) Allregisteredpersonsmustcomplywiththecodeofconductandfailuretodosoconstitutesimproperconduct.

Investigation of improper conduct

26. (1) TheCouncilmustreferanymatterbroughtagainstaregisteredpersontoaninvestigatingcommitteeif-

(a) theCouncilhasreasonablegroundstosuspectthataregisteredpersonhascommittedanactwhichconstitutesimproperconduct;or

(b) acomplaint,chargeorallegationofimproperconducthasbeenmadeagainstaregisteredpersonbyanypersonintheprescribedform.

(2) AttherequestoftheCounciltheinvestigatingcommitteemust-

(a) investigatethematter;and

(b) obtainevidencetodeterminewhetherornotinitsopiniontheregisteredpersonconcernedmaybechargedand,ifso,recommendtotheCouncilthechargeorchargesthatmaybebroughtagainsttheregisteredperson.

(3) An investigatingcommitteemayonlyquestion the registeredpersonconcernedifthecommitteehasinwritinginformedtheregisteredpersonthatheorshe-

(a) hastherighttobeassistedorrepresentedbyanotherperson;and

(b) isnotobligedtomakeanystatement,andthatanystatementsomademaybeusedinevidenceagainsttheregisteredperson.

(4) An investigating committee must submit, after the conclusion ofthe investigation, but within 60 days from the date on which the investigation hascommenced, a report containing its recommendations to the Council regarding anymatterreferredtoitintermsofthissection.

(5) An investigatingcommitteemay inwritingapply to theCouncil forextensionof theperiod referred to in subclause (4), and theCouncilmay inwritingextend,ongoodcauseshown,thatperiodasdeterminedbytheCouncil.

(6) Aninvestigatingcommitteemustsubmitinrespectofeveryinvestigationconductedbyit,butwhichhasnotbeenconcluded,totheCouncilaprogressreporttoserveatthenextCouncilmeeting.

Charge of improper conduct

27. (1) Any recommendation by an investigating committeecontemplated in section 26(2)(b) or any report of the investigating committeecontemplatedinsection26(4)mustbeconsideredbytheCouncilatthenextCouncilmeetingafterthedateonwhichithasbeenreceivedbytheCouncil.

(2) IftheCouncil,afterithasconsideredanyrecommendationcontemplatedinsection26(2)(b)orthereportoftheinvestigatingcommitteecontemplatedinsection26(4), isof theopinion that sufficientgroundsexist thata registeredpersonmaybechargedforimproperconduct,chargethatpersonwithin30daysfromthedateonwhichtheCouncilhassoconsideredtherecommendationorthereport,withimproperconductbyfurnishingachargesheettohimorherbyhandorregisteredmail.

(3) Thechargesheetmustinformtheregisteredpersoncharged-

(a) ofthedetailsandnatureofthecharge;

(b) thattheperson-

(i) must,inwriting,admitordenythecharge;

(ii) may, togetherwith theadmissionordenial,submitawrittenexplanationregardingtheimproperconductwithwhichheorsheischarged;and

(c) oftheperiod,whichmustbereasonable,withinwhichhisorherpleaintermsofparagraph(b)mustbesubmittedtotheCouncil.

(4) If a registered person charged admits that he or she is guilty of thecharge, the person is considered to have been found guilty of improper conduct ascharged,afterheorshehasexplainedhisorherconducttotheCouncil.

(5) Aftertheregisteredpersonwhohasadmittedguiltascontemplatedinsubsection(4)hasbeenaffordedtheopportunityto-

(a) addresstheCouncilinmitigationofsentence;and

(b) callwitnessestogiveevidenceonhisorherbehalfinmitigationofthesentence,

theCouncilmayimposeapenaltycontemplatedinsection30(3)onthatperson.

(6) The acquittal or the conviction of a registered person by a court oflawonacriminalchargeisnotabartoproceedingsagainstthepersonunderthisActon a chargeof improper conduct, even if the facts stated in the chargeof improperconductwould,ifproved,constitutetheoffencestatedinthecriminalchargeonwhichthepersonwasacquittedorconvictedoranyotheroffenceofwhichthepersonmighthavebeenacquittedorconvictedathisorhertrialonthecriminalcharge.

Appointment of disciplinary tribunal

28. (1) Ifapersoncharged-

(a) deniesthecharge;or

(b) failstocomplywithsection27(2)(b),

theCouncilmustappoint-

(i) adisciplinarytribunaltoconductadisciplinaryhearingagainsttheperson;and

(ii) achairpersonofthedisciplinarytribunal.

(2) Thedisciplinarytribunalmustconsistof-

(a) aregisteredprofessionalvaluerwhospecialisesinthefieldconcerningthecharge;

(b) a registered professional valuer who has appropriate experience inpropertymatters;and

(c) apersonqualifiedinlawandwhohasappropriateexperience,

butnomemberoftheCouncilmaybeappointedasamemberofadisciplinarytribunal.

(3) Adisciplinaryhearingcontemplatedinsubsection(1)mustbefinalisedwithin4monthsfromthedateonwhichthedisciplinarytribunalhasbeenappointed.

(4) AdisciplinarytribunalmayinwritingapplytotheCouncilforextensionoftheperiodreferredtoinsubclause(3),andtheCouncilmay,ongoodcauseshown,inwritingextendtheperiodasdeterminedbytheCouncil.

Disciplinary hearing

29. (1) Forthepurposesofthissection,thedisciplinarytribunalmayappointapersontoassistthetribunalintheperformanceofitsfunctionsasreferredtoinsubsection(8).

(2) Forthepurposesofadisciplinaryhearing,thedisciplinarytribunal-

(a) mustsubpoenatheregisteredpersoninrespectofwhomthedisciplinaryhearingistobeconductedtoappearbeforethetribunal;and

(b) maysubpoenaanyperson-

(i) who in itsopinionmaybeable togivematerial informationconcerningthesubjectofthehearing;or

(ii) who it suspects or believes has in his or her possession orcustody or under his or her control any book, document orobjectwhichhasanybearingonthesubjectofthehearing,

(3) Asubpoenaissuedintermsofsubsection(2)must-

(a) beintheprescribedform;

(b) besignedbythechairpersonofthedisciplinarytribunalor,inhisorherabsence,anymemberofthedisciplinarytribunal;and

(c) beservedontheregisteredpersonorotherpersonconcernedpersonallyorbysendingitbyregisteredmail.

(4) Thedisciplinarytribunalmayretainforthedurationofthehearinganybook,documentorobjectproducedintermsofsubsection(2).

(5) The chairperson of the disciplinary tribunal may call upon andadministeranoathto,ortakeanaffirmationfrom,anywitnessatthehearing.

(6) Atahearingtheregisteredpersoncharged-

(a) maypersonallybepresentatthehearingoftheproceedings;

(b) may be assisted or represented by another person in conducting theproceedings;

(c) hastherighttobeheard;

(d) maycallwitnesses;

(e) may cross-examine anyperson called as awitness in support of thecharge;

(f) mayhaveaccesstodocumentsproducedinevidence;

(g) mayadmitatanytimebeforeconvictionthatheorsheisguiltyofthechargedespitethefactthatheorshedeniedthechargeorfailedtoreactintermsofsection27(2)(b);

(h) may, in the case where he or she makes an admission in terms ofparagraph(g),befoundguiltyofimproperconductascharged.

(7) If the registered person subpoenaed in terms of subsection (2) isnot present at the commencement of the hearing concerned, the chairperson ofthedisciplinary tribunal, ifheorshe isof theopinion that the registeredpersonhasreceivedthesubpoena,mayhavetheinquiryconductedathisorherintheabsenceoftheregisteredperson.

(8) Thepersonreferredtoinsubsection(1)mayduringahearing-

(b) questionanypersonwhowassubpoenaedintermsofsubsection(2);or

(c) call anyone to give evidence or to produce any book, document orobjectinhisorherpossessionorcustodyorunderhisorhercontrolwhichthepersonreferredtoinsubsection(1)suspectsorbelievestohaveabearingonthesubjectofthehearing.

(9) Awitnesswhohasbeensubpoenaedmaynot-

(a) withoutsufficientcause,failtoattendthehearingatthetimeandplacespecifiedinthesubpoena;

(b) refusetobesworninortobeaffirmedasawitness;

(c) withoutsufficientcause, fail toanswer fullyandsatisfactorily to thebestofhisorherknowledgeallquestionslawfullyputtohimorher;or

(d) failtoproduceanybook,documentorobjectinhisorherpossessionorcustodyorunderhisorhercontrolwhichheorshehasbeenrequiredtoproduce.

(10) Awitnesswhohasbeensubpoenaed-

(a) must remain in attendance until excused by the chairperson of thedisciplinarytribunalfromfurtherattendance;

(b) mayrequestthatthenamesofthemembersofthedisciplinarytribunalbemadeavailabletohimorher.

(11) Thelawrelatingtoprivilege,asapplicabletoawitnesssubpoenaedtogiveevidenceortoproduceabook,documentorobjectinaciviltrialbeforeacourtoflawapplyinrelationtotheexaminationof,ortheproductionofanybook,documentorobjecttothedisciplinarytribunalinrespectofanypersoncalledintermsofthissectionasawitness.

(12) Awitnessmaynot,afterhavingbeensworninorhavingbeenaffirmedasawitness,giveafalsestatementonanymatter,knowingthatanswerorstatementtobefalse.

(13) A person may not prevent another person from complying with asubpoenaorfromgivingevidenceorproducingabook,documentorobjectwhichheorsheisintermsofthissectionrequiredtogiveorproduce.

(14) Therecordofevidencewhichhasabearingonthechargebeforethedisciplinarytribunalandwhichwaspresentedbeforeanycommitteewhichinvestigatedaneventorconduct isadmissiblewithout furtherevidencebeing led if therecord isaccompaniedbyacertificate from thechairpersonof thedisciplinary tribunalwhichcertifiesthattheinvestigationwaslawful,reasonableandprocedurallyfair.

(15) If theimproperconductwithwhichtheregisteredpersonischarged,amounts to anoffenceofwhich thepersonhasbeen convictedby a court of law, acertifiedcopyof therecordofhisorher trialandconvictionby thatcourt is,on the

identificationoftheregisteredpersonasthepersonreferredtointherecord,sufficientproofofthecommissionbythepersonofthatoffence,unlesstheconvictionhasbeensetasidebyasuperiorcourt.

Proceedings after disciplinary hearing

30. (1) Aftertheconclusionofadisciplinaryhearing,thedisciplinarytribunalmustwithin30days-

(a) decidewhetherornottheregisteredpersonchargedisguiltyofimproperconduct;

(b) if thedisciplinary tribunalfinds that theregisteredpersoncharged isguilty of improper conduct, take cognisance of any aggravating ormitigatingcircumstances;

(c) informtheregisteredpersonchargedandthecouncilofthefinding;and

(d) informtheregisteredpersonofhisorherrightofappeal intermsofsection31.

(2) Aregisteredpersonfoundguiltyofimproperconductintermsofthissectionmay-

(a) addressthedisciplinarytribunalinmitigationofsentence;and

(b) callwitnessestogiveevidenceonhisorherbehalfinmitigationofthesentence.

(3) Every registeredpersonwho is foundguiltyof improper conductorwhoadmitsthatheorsheisguiltyofthechargeconcernedisliabletoanyoneormoreofthepenaltiesconsistingof-

(a) areprimandoracaution;

(b) payment of a fine not exceeding N$4 000, which amount may beincreasedbytheCouncil,withtheconsentoftheMinister,bynoticeintheGazette;

(c) suspensionoftheregistrationofthepersonforaperiodnotexceedingoneyear;or

(d) cancellationoftheregistrationofthepersonandremovalofthenameofthepersonfromtheregisterreferredtoinsection4(c).

(4) AttheconclusionofthehearingthedisciplinarytribunalmustnotifytheCouncilofitsfinding.

(5) TheCouncilmust-

(a) publishthefindingandthepenaltyimposedintermsofsubsection(3)bynoticeintheGazette;and

(b) giveeffecttothedecisionofthedisciplinarytribunal.

(6) TheCouncilmayrecoveranyfineimposedintermsofsubsection(3)(b)bymeansofproceedingsinacompetentcourt.

Appeal against decision of disciplinary tribunal

31. (1) A registered person found guilty of improper conduct mayappealinwritingtotheCouncilagainstafindingofthedisciplinarytribunaloragainstthesentence,orboth,andtheappealmust-

(a) setoutthegroundsoftheappeal;and.

(b) belodgedwithin30daysafterthedisciplinarytribunalhasinformedthepersonconcernedofitsdecision.

(2) TheCouncilmay-

(a) dismisstheappealagainstthedecisionofthedisciplinarytribunalandconfirmthefindingorsentenceorboth;or

(b) uphold the appeal against the decision of the disciplinary tribunalwhollyorinpartandsetasideoramendthefindingorsentenceorboth.

(3) If a registered person found guilty of improper conduct lodges anappealintermsofsubsection(1),thedecisionofthedisciplinarytribunalundersection30(3)orthepublicationbythecouncilintermsofsection30(5)(a)maynotbeputintoeffectbeforetheCouncilhasdecidedontheappeal.

Appeal against certain decisions of Council

32. (1) AnymemberofthepublicwhoseinterestsorrightsareaffectedbyadecisionmadebytheCouncilmay-

(a) within 30 days from the member becoming aware of the decision,requesttheCouncilinwritingtofurnishhimorherinwritingwithitsreasonsforthedecision;

(b) within30daysfromthedatethememberreceivedthereasonsforthedecision from the Council, and after giving notice of appeal to theCouncil,appealinwritingtotheMinisteragainstthedecision,settingoutthegroundsofappeal.

(2) TheCouncilmustfurnishitsreasonsforitsdecisionascontemplatedinsubsection(1)(a)within30daysofreceiptoftherequestofthemember.

(3) TheMinistermay-

(a) dismisstheappealandconfirmthedecision;or

(b) upholdtheappealwhollyorinpartandsetasideoramendthedecision.

PARTVGENERALPROVISIONS

Professional fees

33. (1) TheCouncil-

(a) must determine, after consultation with the Minister, voluntaryassociations, representatives of service providers and clients in thepublicandprivate sector, the tariffofprofessional feesaccording towhicharegisteredpersonmaycalculatetheamountchargeablebyhimorherinrespectoftherenderingbyhimorherofprofessionalservices,andwhichfeesmayincludefixed,minimumormaximumfees;

(b) mustpublishthosefeesintheGazette;and

(c) mayreviewthosefeesannuallyorwhennecessary.

(2) TheCouncilmaydetermine different professional fees in respect ofdifferentcategoriesofregisteredpersons.

(3) A personwho strongly feels that the professional fees published intermsofsubsection(2)areunreasonablyhighorlowmayappealtotheMinisterwithin30daysfromthedateofthepublication.

(4) The Minister, after consultation with the Council, may confirm oramendtheprofessionalfeeswhollyorinpart.

Regulations

34. (1) Subjecttosubsection(2),theMinister,afterconsultationwiththeCouncil,maymakeregulationswithregardtoanymatterthatisrequiredorpermittedtobeprescribedintermsofthisActandanyothermatterforthebetterexecutionofthisActorinrelationtoanypowergrantedordutyimposedbythisAct.

(2) Before the Minister makes any regulation under this section, theMinistermustpublishadraftoftheproposedregulationintheGazette,togetherwithanoticecallingoninterestedpersonstocommentinwritingontheregulationwithinaperiodstatedinthenotice,whichperiodmaynotbelessthan30daysfromthedateofpublicationofthenotice.

(3) IftheMinisteramendsthedraftregulationsasaresultofanycommentreceivedintermsofsubsection(2),theMinisterdoesnotneedtopublishtheamendmentsconcernedforcommentbeforemakingtheregulations.

(4) Ifcircumstancesnecessitatetheimmediatepublicationofaregulation,theMinister,afterconsultationwiththeCouncil,maymakearegulationwithouthavingtopublishadraftthereofforcommentascontemplatedinsubsection(2).

Procedure and evidence for evidential purposes

35. (1) Theregisterreferredtoinsection4(c)servesasevidenceofallmatterswhichintermsofthisActarerequiredorpermittedtobenotedtherein.

(2) AcertificatepurportingtobesignedbytheRegistrartotheeffectthat–

(a) anentryhasorhasnotbeenmadeintheregister;or

(b) anyfunctionauthorisedbythisActtobeperformedhasorhasnotbeenperformed,

isevidenceofthemattersspecifiedinthatcertificate.

(3) Acopyof-

(a) anentryintheregister;

(b) adocumentinthecustodyoftheRegistrar;or

(c) anextractfromtheregisterorfromanydocument,

purportingtobecertifiedbytheRegistrarisadmissibleinevidenceinallcourtswithoutfurtherprooforproductionoftheoriginal.

Exemptions

36. (1) TheMinister, after consultationwith the Council, voluntaryassociationsandanyotherpersontheMinisterconsidersnecessary,mayexemptanypersonfromanyprovisionofthisActforaperiodnotexceedingtwoyears.

(2) TheMinister,afterconsultationwiththeCouncil,voluntaryassociationsandanyotherpersonheorsheconsidersnecessary,mustmakeregulationsregardingexemptionsfromtheprovisionsofthisAct.

(3) An exemption referred to in subsection (1) must comply with theregulationscontemplatedinsubsection(2).

Liability

37. (1) Noperson,includingtheState,isliableinrespectofanythingdoneoromittedingoodfaithintheexerciseofapowerortheperformanceofafunctionconferredorimposedbyorunderthisAct,unlesstheexerciseorperformanceofthepowerorfunctionisattributabletogrossnegligencebysuchperson.

(2) ApersonwhowasregisteredintermsofthisActandwhoseregistrationwascancelledisliableforanyactiontakenbyhimorherwhileheorshewasregistered.

Delegation of powers and assignment of functions

38. (1) TheCouncilmaydelegateorassign,inwritingandsubjecttosuchconditionsasitmayimpose,anypowerorfunctionconferredorimposeduponitbyorunderthisAct,excludingthepowertoappointtheRegistrarandtoconsiderapplicationsforregistration,toacommittee,anemployeeoramemberoftheCouncil.

(2) TheRegistrarmaydelegateorassign, inwritingandsubject tosuchconditionsasheorshemayimpose,anypowerordutyconferredorimposedupontheregistrarbyorunderthisActtoanyemployeeoftheCouncil.

(3) Adelegationundersubsection(1)or(2)doesnotpreventtheexerciseofthepowerortheperformanceofthedutyorfunctioninquestionbytheCouncilortheRegistrar.

Offences and penalties

39. (1) Apersonwhocontravenessection16(2),21,22(7),or29(9),(10)(a),(12)or(13)commitsanoffence.

(2) Apersonconvictedofanoffenceintermsof-

(a) section 16(2) is liable to a fine equal to or double the remunerationreceivedbyhimorherforworkdoneincontraventionofsection16(2)ortothepaymentofafinenotexceedingN$12000ortoimprisonmentfor a period not exceeding three years on failure to pay the fine,whicheveristhehighest;

(b) section 21 or 22(7) is liable to a fine not exceeding N$400 or toimprisonmentforaperiodnotexceedingonemonth,or tobothsuchfineandsuchimprisonment;

(c) section29(9),(10)(a),(12)or(13)isliabletoafinenotexceedingN$12000or to imprisonmentforaperiodnotexceedingthreeyears,or tobothsuchfineandsuchimprisonment.

Appointment of persons to determine valuation of property under or in terms of other laws

40. Ifanyotherlawconfersuponafunctionarythepowertoappointanypersontodeterminethevalueofproperty,thefunctionary-

(a) maystillappointanypersonnotregisteredintermsofthisActuntil12monthsfromthedateofcommencementofthisAct;

(b) after the12months referred to inparagraph(a),mayonlyappointapersonregisteredintermsofthisAct.

Transitional provisions

41. ApersonwhoatthedateofcommencementofthisActpracticesinthepropertyvaluationprofession–

(a) may apply to the Council, within 12 months from that date, to beregisteredintheappropriatecategorycontemplatedinsection16;

(b) whohasappliedforregistrationintermsofparagraph(a)andwhoseapplicationhasbeenrefusedmaylawfullypracticeforaperiodof30daysafterthedateonwhichheorshehasbeennotifiedthathisorherapplicationhasbeenrefused;

(c) who failed to apply for registration in terms of paragraph (a) mustdiscontinuetopracticetheprofession12monthsafterthecommencementofthisAct.

42. ThisActbindstheState.

Short title and commencement

43. (1) ThisActiscalledthePropertyValuersProfessionAct,2012,andcommencesonadatedeterminedbytheMinisterbynoticeintheGazette.

(2) Differentdatesmaybedeterminedundersubsection(1)inrespectofdifferentprovisionsofthisAct.
