QI own a ground floor flat which hasanother flat above. Recently there was an
overflow in the bathroom in the upstairs flatthat caused damage to my property. This isthe second time it has happened. The firsttime the landlord of the upstairs flat sent hisagent round to assess the damage and organ-ise repairs. This time he says it is nothing todo with his flat and will not even come roundto assess the damage. I am an owner-occupierand we have the freehold between us. Pleaseadvise.
AThe landlord upstairs owes you a duty ofcare to take reasonable steps to prevent
damage being caused to your flat. If you want
to get the landlord to carry out the repairscaused by the overflow at his expense youwould have to take him to court on the basisof his negligence. You would then have toprove he was aware of the problems and thelikely damage to your property and did noth-ing about it.
But there is no point in seeking a remedythrough the courts in an instance like anoverflow of water. This is better dealt with byan insurance claim on your house contentspolicy. Even though the overflow came fromupstairs, your own insurance should pay
under the escape of water section.Your insurer would either then subrogate
on the landlord’s insurer to get their moneyback, because he caused the damage, or, pro-vided he was actually liable at law, if he hasliability insurance then that would pay.Obviously, you cannot claim on the landlord'spolicy, but you can ask him to pass the matterto his insurers.
QAbout 18 months ago I bought a propertywith a friend as tenants in common. My
circumstances have now changed and I wish
to sell, but my co-owner is refusing to sell.Given that the deed wasn’t signed do I haveany legal right to force a sale as per the condi-tions defined in the document?
AYes you can still force a sale, but to do soyou'll need to apply to a court for an
“order for sale”.However, I’m not convinced that forcing a
sale is the best way to go.You’ll need to take legal advice, as will your
co-owner, which can be expensive, and thechances are that you might not get as good aprice for the property as you would if youboth put it on the market voluntarily.
