The name of the carafe is Character Diamond. This refers to the cutting technique used to shape the carafe, which involves using a diamond-tipped tool. The technique requires a particularly steady and practised hand to avoid ‘neck-breaking’ consequences. Almindelige salgs- og leveringsbetingelserNedenstående salgs- og leveringsbetingelser finder anvendelse i det omfang, de ikke fraviges ved særskilt aftale. Samhandel sker i henhold til dansk købe-lovs regler med de undtagelser, der følger af nedennævnte.

1. Tilbud og aftaleAfgiver sælger tilbud, der ikke angiver særlig acceptfrist, bortfalder tilbuddet, såfremt accept ikke fremkommer til sælger senest 30 dage fra tilbuddets dato.Har køber anmodet om udarbejdelse af skitser, layout, rentegning, tekstforslag, prøvetryk, specialudviklede produktprøver o.lign., er EGOLive A/S, i det efterføl-gende kaldet EGO, berettiget til at få dette arbejde betalt ved særskilt aftale.Aftale er indgået, når købers accept er modtaget. I tilfælde, hvor køber ikke angiver udtrykkelig accept, er aftale indgået, når EGO har fremsendt en skriftlig ordrebekræftelse af den modtagne bestilling.Enhver ændring af ordrespecifikation, herunder annullering, kan kun accep-teres, hvis ordren ikke er taget i produktion og skal, for at være gyldig, være skriftligt bekræftet af EGO.Mundtlige tilkendegivelser er først bindende, når de er skriftligt bekræftet af EGO.

2. PrisAlle priser er oplyst i specifik valuta og ekskl. moms.Køber er forpligtiget til, indtil levering, at acceptere ændringer i prisen som følge af dokumenterede forøgede omkostninger for EGO som følge af æn-dringer i valutakurser, told, skatter, afgifter og materialeomkostninger mv. vedrørende den aftalte leverance.Alle leverancer er baseret på EUR-paller, der faktureres ved levering og krediteres ved evt. returnering.Prisen forudsætter, at det beordrede kvantum aftages samlet. EGO forbe-holder sig dog ret til dellevering.Ved overskridelse af betalingsfrist beregnes renters rente.

3. BetalingBetaling skal ske i henhold til tilbud/ ordrebekræftelse. Såfremt betaling ikke er angivet, betales 14 dage netto fra fakturadato. Hvis betaling sker efter forfaldsdato, er EGO berettiget til at beregne renters rente af den til enhver tid værende restgæld fra forfaldsdato, med den officielt fastsatte diskonto + 2 %. Køber er ikke berettiget til at modregne eventuelle modkrav over for EGO, som ikke er skriftligt anerkendt af EGO, og har ikke ret til at tilbageholde nogen del af købesummen på grund af modfordringer af nogen art.

4. LeveringsbetingelseAlle leverancer leveres i henhold til aftalt og bindende ordrebekræftelse.

LeveringstiderLeveringstider opgives efter skøn, men vi kan ikke påtage os ansvar for ufor-udsete forsinkelser, der kan forekomme ved fabrikationen. I øvrigt gælder almindelige forbehold med hensyn til force majeure etc.

5. Mangler og reklamationEGO har ret til en mindre- eller merlevering på indtil 10 % af den aftalte leve-rance samt til at fakturere i overensstemmelse hermed. Ved levering skal køber straks foretage en undersøgelse af leverancen. Hvis køber vil påberåbe sig mangler eller anden reklamation, skal køber, senest otte dage efter leveringsdatoen, give EGO skriftlig meddelelse herom samt an-

føre, hvori manglen består. Undlades reklamation, eller reklamerer køber for sent, mister køber adgangen til at gøre manglen gældende. EGO er berettiget til at afhjælpe en mangel, såfremt dette kan ske inden for rimelig tid.

EmballageAlle produkter leveres i EGO standardemballage, medmindre andet er beskre-vet i tilbud/ordrebekræftelse. Gaveindpakning eller specialemballage efter ønske og kun efter skriftlig aftale.

6. Ejendomsret, ophavsret EGOs skitser, layout, rentegninger, tekstforslag, prøvetryk, specialudviklede produktprøver o.lign. tilhører EGO og må ikke uden EGOs skriftlige godken-delse overgives til tredjemand.EGO forbeholder sig desuden, med de begrænsninger, der følger af ufravigeli-ge retsregler, ejendomsretten til det solgte, indtil hele købesummen med tillæg af påløbne omkostninger er betalt til EGO eller til den, EGO har tiltrans-porteret sin ret, jf. pkt.14.

AnsvarsbegrænsningEt erstatningskrav over for EGO kan ikke overstige fakturabeløbet for densolgte leverance. EGO hæfter ikke for driftstab, avancetab eller andre indi-rekte tab i anledning af aftalen, herunder indirekte tab, der opstår som følge af forsinkelse eller mangler ved det solgte.

ProduktansvarI tilfælde af at et leveret produkt volder skade på personer eller ejendom, er EGO kun ansvarlig, hvis det dokumenteres, at skaden er omfattet af produkt-ansvarslovens regler herom. For alle andre skader er vi ikke ansvarlige. Produktansvaret fraskrives således også for skader, der kan henføres til fejl eller forsømmelser fra vores side. Hvis der forvoldes skade på tredjemand eller tredjemands ejendom, som berettiger tredjemand til erstatning, udre-des erstatningen af vor aftalepart, uanset om skaden kan henføres til fejl eller forsømmelser begået af os. Dette gælder dog ikke, hvis skaden omfattes af produktansvarsloven og en sådan ansvarsfordeling strider mod ufravigelige regler i loven. I tilfælde af at EGO bliver pålagt ansvar, der rækker ud over de fastsatte grænser for EGOs ansvar, er køber pligtig til at holde EGO skadesløs herfor såvel som for sagsomkostningerne. Køber er pligtig til at lade sig sag-søge for samme domstol, som behandler spørgsmålet om EGOs ansvar for produktet leveret til køber.EGO har intet ansvar for købers manglende hjemmel til reproduktion, mang-foldiggørelse eller udgivelser af skrift, billeder, tegninger, mønstre, varemær-ker, andre forretningskendetegn, herunder formgivning eller andet, der kan være underkastet tredjemands rettigheder. Pådrager EGO sig ansvar overfor tredjemand i anledning af købers manglende rettigheder, skal EGO holdes skadesløs for et sådant ansvar. Køber er pligtig til at lade sig sagsøge for samme domstol, som behandler spørgsmålet om EGOs ansvar over for tred-jemand.

VærnetingI tilfælde af uoverensstemmelser mellem parterne skal tvisten afgøres efter dansk ret ved EGOs værneting i henhold til retsplejelovens regler.

ForbeholdDer tages forbehold for prisændringer, trykfejl eller mangler.
