This Proclamation may be cited as the "Revised Anti-Corruption Special Procedure nnd Rules of Evidence (Amendment) Proclamation NO.882/2015."

2. Amepdments

The Revised Anti-Corruption Special Procedure

and Rules of Evidence Proclamation No.

434/2005 is hereby further amended as follows :

1/ Sub-article ( I) of Article 2 of the

Proclamation is deleted and is replaced by

the following new sub-article ( l ):

UI! corruption offenses" means corruption

offences provided for by the Corruption

Crimes Proclamation No.88 112D IS":

'21 The existing sub-anicle (5) of Anicle 2 of the

Proclamat ion is renumbered as sub-article (9)

and the following new sub-articles (5), (6), (7)

and (8) are added:

"S!'Proclamation' means the Revised Anti-

Corruption Special Procedure and Rules

of Evidence Proclamation No. 43412005 ;

61l' commissioner' means the commissioner of

the Ethics and

Commission;

71 'informant' means any person who provides

information, when ~e believes that

corruption offences are committed, to

appropriate organ or other j~tice organs,

to the heads of public office. public

enterprise or public organization or to

anyone who has the duty to investigate

crimes of corruption based on laws or

directives and includes an auditor who

audits matters relating to offences of

corruption or an auditor who detects the

commission of the offence of cOm.lpt ion

in connection with the course of his

81 'head' means any person who leads a

public office, public enterprise or public

organization, or his deputies or deputies of

state ministers;

9/'public organization' shall have the meaning

provided to it in me Corruption Crimes

Proclamation No. 881/2015."

31 Sub-article (1) of Article 4 of the Proclamation

is deleted and is replaced by the following new

sub-article (I):

H I I Any arrested person for a corruption offence

may apply to a court to be re leased on

bail; provided, however, that an arrested

person charged or suspected with a

corruption offence punishable for more

than 10 years shall not be released on bail.

Where there are concurrent crimes

punishable with more than 4 years and

less than ten yeal s and the punishment of

the two crimes is more than ten years, the

arrested person shall not be released on

bail.'·

41 The follOWing new sub~article (5) is added after

sub-article (4) of Article 7 of the

Proclamation:

"51 Notwithstanding the provis ions of sub­

article (4) of this Article:

aJ the appropriate organ may decide to

submit such matters to the nearest First

Instance Coun when it believes Ihat

submiss ion of such procedural matters

to the court having jurisdiction on

corruption offences would affect the

rights of the accused, cause loss of

evidence or cause disproportionate

cost;

b) the party aggrieved by the dec ision

rendered by the court under paragraph

(a) of this sub,article may lodge

appeals to the appropriate court . The

decision rendered by the appeal court

shall be final."

51 Articles 8, 9 and 29 of the Proclamation are

deleted and replaced by the following new

Art icle 8. 9 and 29:

"8.Prjntiple

II Without prejudice to Article I 0 of this

Proclamation, a court may issue a

restraining order against any property

acqu ired by the commiss ion of

corruption offence and fruits thereof.

2/An investigator or a prosecutor, by

evidence supported by an affidavit,

may. apply to the court for a

restraining order against any property

acquired by the commission of a

criminal offence and the fruits of

thereof.

31 An application for a restraining order

may be made before or after the

institution of the criminal proceeding.

4/Without prejudice to sub,articles (1 l, (2) and (3) of this Article, head of the

appropriate organ may, when he

believes that the property may be

squandered, give a restraining order

effective only for 48 hours pending the

issuance of an order by a court of law.

9.CQndjtioQ (or Restraining other Properties

II Notwithstanding that there is no evidence

that the property is acquired as a result of

the corruption offence, where an investigator

or prosecutor made an application for a

restra ining order supported by an affidavit

indicating that the suspect is enriched or

others suffered damage as a result of (he

corrupt ion offence being investigated or

charged, the court may give a restraining

order prohibiting the sale, assignment or

trans fer of any money or property deposited

in any bank in the name of the suspect, his

spouse or children under (he age of 18 or

any other property of such persons

proportionate to the amount of enrichment

by (he suspect or damage suffered by others.

21 The restraining order given accord ing to sub­

article (J) of this Article shall not affee( the

suspect's right of using such property.

31 Notwithstanding the provisions of sub-art icle

(2) of (his Article, (he suspect shall not have

the right to use cash or property deposited in

a bank. When compelling circumSlances

emerge, the court may allow the suspect to

USe the appropriate amount of such cash or

other property,

41 When the investigator or the prosecutor so

applies, the court may give an order it deems

fit to minimize the damages that may resu lt

when the suspect uses the property.

11 Where the accused is found guilty of

corruption offence, the Court shall give a

confiscation order on:

a) property obtained from corruption

offences or fruits thereof or any

property proportionate to the benefits obtained there from ;

b) property of the accused proportional to

the benefit procured by another person

or damage caused by corruption

offences on private, public or State

interest or advantage of public

organization even where the accused

has not obtained benefits for himself

from such offence.

2/ For the application of sub· article (\) of this

Article, where the value of the property of the

accused is less than the benefit obtained, or the

damage caused by corruption offence or where

no property is registered in the name of the

accused, the common property shall be

confiscated.

3/ For the application of sub· article 2 of

this Article, any property jointly owned

by the accused and another person or

property so considered by law, property

in the name of the spouse or child under

the age of 18 or both shaH be presumed

to be the common property of the

accused; provided, however, that the

concerned person may rebut such

presumption by presenting an ev idence

the following new sub-article (I):

"1/ Where confiscation of property is not

ordered by the court, it may be

entertained by the application of the

prosecutor pursuant to Article 29 of

the Proclamation,"

71 Article 32 of the Proclamation is deleted and is

replaced by the following new Article 32:

"32, Recoyery or Property by Ciyil Action

I I Without prejudice to the provisions of Article

29 of this Proclamation, the appropriate

organ may institute civil action for purposes

of confiscation of property obtained through

corruption offences, or fruits thereof, or

property proportionate therewith, or

property proportionate to the damage caused

thereby even where the criminal proceedings

were tenninated or no conviction was

obtained for any reason.

21 The appropriate organ may institute a civil

action in situations other than those

mentioned under sub-article (') of this

Article for purposes of payment of

compensation proportional to property

obtained as a result of corruption offences,

or fruits thereof, or property proportionate

therewith, or property proportionate to the

damage caused thereby.

31 If the proceeds of corruption offence is the

property of a government office, public

enterprise or public organization or any

individual. the appropriate organ may give

its permission or delegate for organs or

individual to initiate civil action against the

suspected person for the recovery of the

assets. The appropriate organ shall have the

duty to follow up the result of such action by

the other organs.

81 Art icle 34 of the Proclamation is deleted and is

replaced by the following new Article 34:

"34. The amount of Property or Benefit to be

Recovered and the Manner of returnin2

it to the Government

11 The defendant shall return the property

acquired by the commission of the

crime and the benefit derived from

the property or the amount equivalent

to it or the amount equ ivalent with

the damage sustained by the

commission of the crime.

21 The amount of benefit to be returned

according to sub-article ( 1) of this

Article shall not exceed the benefit

acquired or the amount that might be

presumed to be realized or the

damage sustained.

31 The appropriate organ shall collect the

property on which confiscation order was

given and hand it over to the Government.

Where the property cannot be confiscated

fully, or where it is merged with other

property or happens to be accessory of other

property, the appropriate organ shall have it

sold legally and handover the proceeds of

such sale to the Government.

9/Sub-article (2) of Article 36 of the Proclamation

is deleted and replaced by the following new

sub-article (2):

2 1 During the preparatory hearing the Court

shall :

a) ensure that the prosecutor and the

accused have discharged their duties in

this Section;

b) give rulings on matters that arise under

Article 130 of the Criminal Procedure

Code;

c) after hearing the accused, ensure

whether the prosecutor would make any

changes to the charges when making

changes to the charges is necessary, it

gives an order to the prosecutor to this effect.

101 Sub-article (4) of Article 37 of the

Proclamation is deleted.

II I Articles 40 and 41 of the Proclamation are

deleted and the existing Articles from Article

42 to 56 are re'numbered as Articles 40 to 54, respectively.

41 The head of the appropriate organ may

request the appropriate

telecommunication 's organ to divulge the

identity and address of anyone who

demands, through a te lephone call to be

paid an undue advantage, threatens a

witness, an informant. an applicant,

investigator or a judge.

51 The appropriate head or employee to

whom a request for divulging of the

idemity and address of the caller is

directed as prescribed under sub-article (4) this Anicle shall provide such

information without delay. Failure to

provide information or providing

incomplete information shall be

punishable under the relevant cr iminal

prOVISions.

Sub-article (2) of Article 51 of the

Proclamation (as re-numbered under sub­

article ( II ) of this sub-article) is deleted

and replaced by the following new sub­

article (2):

21 Evt:ry guvernment office, government

enterprise or public organization shall

establish a procedure to protect its

employees from reprisal.

21 The appropriate organ which has received

the application in accordance with sub­

article (I) of this Article shall examine

the existence or none existence of

repri sa l measure and give forthwith an

appropriate provisional ruling.

31 Any organ that received suspension

order on the reprisal measure from the

appropriate organ pursuant to sub-art icle

(2) of this Article may lodge app licat ion

to a court of law within 60 days; if the

application is not lodged wi thin this time

limit, the order shall be presumed as

accepted and be valid .

41 Where the appropriate organ instituted a

criminal charge against the person who

has taken a reprisal measure, the

slispension order shall remain in force

until the case is disposed.

51 The suspension order given pursuant to

sub-article (2) of this Article shall remain

valid until the court gives its final

accordance with sub-article (4) of this

where it is not fully settled it shall

cooperate and support each other on all

Commissions shall be accountable to
