Proceedings of the 22nd meeting of State Expert Appraisal Committee held on 9/5/2009 at 9:30 a.m. in the Committee Room, Punjab Pollution Control Board, Vatavaran Bhawan, Nabha Road, Patiala. The following were present : 1. Dr. Anil Kumar Jain,

At the outset of the meeting, the Chairman informed the
committee members that Dr. Babu Ram, Secretary, SEAC has been appointed as the
Member Secretary, State Environment Impact Assessment Authority and is replaced
by Er. Malvinder Singh, S.E.E., Punjab Pollution Control Board vide order no.
3/121/05/STE(4)/2122 dated 5/5/2009 issued by the Govt. of Punjab. The chairman
expressed his sincere thanks and gratitudes to Dr. Babu Ram for his co-operation,
vision and high quality work as Secretary, SEAC. His support and efforts in
streamlining the committee functioning was appreciated by the members.
The Chairman SEAC further welcomed Er. Malvinder Singh as the
new Secretary, SEAC. He also indicated that the mission of the committee is to bring
transparency, speedy processing of the projects, uniformity and appraisal of the
projects on merit and we all are striving for this, hopefully this tradition will be
continued in future too.
Afterwards, Dr. Babu Ram, MS, PPCB, welcomed all the members
of the Committee and informed that during his tenure as Secretary to the Committee,
he had learnt a lot from the Committee members from their experience in various
fields. He expressed his sincere thanks to the Committee members for their
cooperation. Thereafter, Dr. Babu Ram handed over the proceedings of the
committee to Er. Malvinder Singh for taking up the regular agenda items for
discussion one by one as under:-
Item No. 22.1 Confirmation of the minutes of 20th meeting of State Expert Appraisal Committee held on 22/3/2009.
The minutes of 20th meeting of State Expert Appraisal Committee
held on 22/3/2009 were circulated to all the members vide letter no. 12133-47 dated
8/4/2009.
No observation had been received from any member.
SEAC confirmed the proceedings.
Item No. 22.2 Action taken on the proceedings of the 20th meeting of State Expert Appraisal Committee held on 22/3/2009.
It was seen by the Committee.
Item No. 22.3.1 Application for grant of environmental clearance for expansion of manufacturing of finished leather @ 22,000 sq. ft./day by M/s Crew B.O.S. Products Ltd., (Tannery Unit), in its existing premises at 140, Leather Complex, Kapurthala Road, Jalandhar.
The following were present from the promoter side:-

The Secretary, SEAC informed that M/s Crew B.O.S. Products Ltd.
(a tannery unit) has applied for obtaining environmental clearance for manufacturing
of finished leather @ 22,000 sq.ft./day for its project located at 140, Leather Complex,
Kapurthala Road, Jalandhar. The case for grant of environmental clearance for the
project was considered in the 3rd meeting of State Expert Appraisal Committee held on
24/3/2008 and Terms of Reference were issued vide letter no. 15191 dated 11/4/2008.
Consequently, the industry has submitted a copy of final EIA report and has requested
for environmental clearance for the project.
The representative of the company and its consultant discussed
the salient features of the project including the control of water pollution, air
pollution, hazardous waste management and finally the environment management
plan. The EIA report submitted by the industry was taken up for discussion by the
Committee members and the consultant of the industry failed to give the satisfactory
reply of queries raised by the Committee members with regard to chemical equations
and water / energy / solid waste balance.
After detailed deliberations on the project, the Committee
members asked the project proponent to submit the process flow diagram indicating
the quantities of all inputs (including water) and out puts (including waste water) on
one day basis. The proponent was also advised to give energy balance data,
hazardous and solid waste generated during each step of manufacturing activities.
In view of the above, the Committee deferred the case and it was
decided that the proposal shall be reconsidered for environmental clearance after the
receipt of the above details / data / documents from the project proponent.
Item No. 22.4.1 Application for grant of environmental clearance for Construction of Residential Township to be developed by M/s HPCL Mittal Energy Ltd. at Village Raman & Tarkhanwala, Distt. Bathinda.
The following were present from the promoter side:-

The Secretary, SEAC informed that it is a Residential Township to
be developed at Village Raman & Tarkhanwala, Distt. Bathinda by M/s HPCL – Mittal
Energy Limited Ltd. The total area of the proposed site is 147.66 acres and the
expected cost of the project is Rs. 130 crore. The promoter shall require 887.120 KLD
canal water through refinery. The project proponent proposes to provide 2 no.
Sewage Treatment Plant of 150 cum capacity each. Treated waste water will be used
for gardening purposes only.
The Secretary, SEAC informed that at the time of scrutinizing the
application along with Form 1 & 1A at the secretariat level, the following documents
were not submitted by the project proponent. The committee members advised the
proponent to submit the following documents/information, within 15 days and the
case was deferred.
1. Proof of ownership of land
2. CLU for an area of 3 Kanal 9 Marla belonging to Gram Panchayat
3. Approved Layout plan and Building plan from Competent Authority.
4. Topographical map of the area showing Contour Plan.
5. Status of construction, if any, alongwith photographs from all the four sides.
6. 500 meter radius map of the area from periphery of project site clearly indicating the various industries (specifically red category industries) and structures lying in the area.
7. Certificates from authorized departments regarding
i) State Boundary not within 10 Km.
ii) Project not lying in eco-sensitive and protected area including wild life sanctuaries.
iii) Not lying in the critically polluted areas.
8. Site plan of the project showing the following
i) Location of STP ;
ii) Solid waste storage area.
iii) Green belt
iv) Parking space
v) RWH and water recharge pits
vi) Fire fighting equipment layout
vii) First aid room
viii) Location of Tubewells
9. Permission of Competent Authority for ;
a) Water and Sewerage connection
b) Collection of Solid waste
c) Use of Ground Water
10. Water balance chart for summer, rainy and winter seasons indicating critical requirements.

Item No. 22.4.2 Application for grant of environmental clearance for "Rajgadh Estates" Residential Group Housing Project to be developed by M/s Dev Arjuna promoters & Developers (P) Ltd. at Village Birmi Road, Sidhwan Canal, Ludhiana.
The following were present from the promoter side:-

The Secretary, SEAC informed that it is a Residential Group
Housing Project namely "Rajgadh Estates Phase-II" to be developed at Village Birmi
Road, Sidhwan Canal, Ludhiana by M/s Dev Arjuna promoters & Developers (P) Ltd.
The total area of the proposed site is 1,43,943.33 sq. mt. (14.39 ha) and the
expected cost of the project is Rs.120 crores. Total water required for the project is
approx. 297 Kl/day and fresh water requirement will be approx. 198 Kl/day. For
treatment of sewage, a separate Sewage Treatment Plant having capacity of 250
Kl/day will be installed in phases. The treated effluent will be used for recirculation in
flushing system and horticultural purposes in the colony.
The Secretary, SEAC informed that at the time of scrutinizing the
application along with Form 1 & 1A at the secretariat level, the following documents
were not submitted by the project proponent. The committee members advised the
proponent to submit the following documents/information, within 15 days and the
case was deferred.

Item No. 22.4.3 Application for grant of environmental clearance for Industrial Project to be developed by M/s Kahlon Metal Works at 333/35 B, Industrial Area-C, Dhandari Kalan, Ludhiana.
The following were present from the promoter side:-

The Secretary, SEAC informed that M/s Kahlon Metal Works has
applied for obtaining environmental clearance for establishment of an industrial plant
at Industrial Area, 8-C, Dhandari Kalan, Ludhiana for the manufacturing of Lead Alloy
@ 5 TPD i.e. 1500 T/annum from used lead acid batteries. As per schedule of EIA
notification 2006, all toxic and heavy metal producing units with capacity <20,000
Ton/annum falling under the broad category of “secondary metallurgical processing
industries” are covered at Sr. No. 3(a), Category-B of the Schedule attached to EIA
notification dated 14/9/2006. The total land area of the site is 3 Kanal 6 Marla and the
total project cost is Rs.23 lacs. The industry has already obtained ‘consent to
establish’ (NOC) from the Punjab Pollution Control Board.
Sh. Anil Kumar Singla, Environmental Consultant of the project
proponent informed that the scrapped batteries are broken / dismantled and the
plastic is sold to recyclers. The metallic portion is loaded and heated / melted in a
heating furnace. The molten portion is put in moulding boxes and then cooled to get
the final product (lead ingots). The slag is removed during the melting process, which
will be sent to common hazardous waste disposal facility at Vill. Nimbua, Tehsil Dera
Bassi developed by M/s Nimbua Green Field Ltd. The charcoal will be used as fuel in
the furnace. Multi-cyclone followed by bag filter house will be installed as air pollution
control device.
No process effluent is generated from the manufacturing activities
of this project. The domestic wastewater will be treated in a septic tank and used for
watering of green area within the industry.
The case was discussed and it was decided to categorize the
project into category B-1. After the detailed deliberations on the project, the
Committee approved the following Terms of Reference for Environmental Impact
Assessment Study of the proposed project:-
1. The study area should cover an area of 10 km. radius around the proposed
site.
2. Land use of the study area as well as the project area shall be given.
3. Location of any National Park, Sanctuary, Elephant / Tiger Reserve (existing as
well as proposed), eco-sensitive area, interstate boundary, migratory routes, if
any, within 10 km. of the project site shall be specified and marked on the
map.
4. One season site-specific meteorological data (except monsoon) shall be
provided.
5. One complete season Ambient Air Quality (AAQ) data from the NABL accredited
lab alongwith the copies of the test report (except monsoon) to be given
alongwith the dates of monitoring. The parameters to be covered shall include
SPM, RSPM, Lead, SO2 and NOx. Monitoring shall be carried out for at least 6
different locations all around the project within 10 km. radius. The location of
the monitoring stations should be so decided so as to take into consideration
the pre-dominant downwind direction, population zone and sensitive receptors
including reserved forests. There should be at least one monitoring station in
the upwind direction.
6. Impact of the project on the AAQ of the area, details of the model used and
the input data used for modelling should also be provided. The air quality
contours may be plotted on a location map showing the location of project site,
habitation nearby, sensitive receptors, if any. The wind roses should also be
shown on this map.
7. Assessment of quantity of fuel required, its source and mode of transportation.
8. Source of water and its availability.
9. Characteristics of lead emissions to be generated from the process and details
of pollution control measures to be taken.
10. Occupational safety aspects should be studied and brought out clearly in the
EIA study report.
11. Details of the slag to be generated from the process; its characteristics and
measures for safe handling / disposal of slag.
12. Details of rainwater harvesting and how it will be used in the plant.
13. Details of green belt i.e. land with not less than 1000 trees per hectare giving
details of species, width of plantation, planning schedule etc.
14. Fuel analysis from NABL accredited laboratory with copies of the test report
and assessment of ash generation and details of ash utilisation / management
plan.
15. Details regarding infrastructure facilities such as sanitation, fuel, restroom etc.
to be provided to the labour force during construction as well as to the casual
workers including truck drivers during operation phase.
16. Environment Management Plan (EMP) to mitigate the adverse impacts due to
the project along with item-wise cost of its implementation.
17. Risk assessment to be undertaken. Based on the same, proposed safeguard
measures should be provided.
18. Any litigation pending against the project and / or any direction / order passed
by any Court of Law against the project, if so, details thereof.
19. A detailed environmental protection budget would also be presented and
earmarked.
The source of getting secondary data, wherever applicable, should be
intimated alongwith its reference. Generic structure of Environment Impact
Assessment Document, given in Appendix III of EIA Notification 2006 shall be
followed in preparation of Rapid Environmental Impact Assessment report.
Besides the above, the following general points / guidelines will also be
followed:
a) All documents to be properly referenced with index, page numbers and
continuous page numbering. A uniform system of units (SI) to be used while
reporting data.
b) Where data is presented in the report especially in table, the period in which
the data was collected and the source should invariably be indicated.
c) The questionnaire for environmental appraisal of thermal power projects as
devised earlier by the Ministry of Environment & Forests shall also be filled and
submitted.
d) The list of abbreviations used in preparing the report should be given in a
separate index.
In addition to the above, information on the following may also be
incorporated in the EIA report.
1. Is the project intended to have CDM-intent?
(i) If not, then why?
(ii) If yes, then
(a) Has PIN (Project Idea Note) {or PCN (Project Concept Note)}
submitted to the ?NCA? (National CDM Authority) in the Ministry
of Environment & Forests?
(b) If not, then by when is that expected?
(c) Has PDD (Project Design Document) been prepared?
(d) What is the ?Carbon Intensity? from your electricity generation
projected (i.e. CO2 Tons/MWH or Kg/KWH)
(e) Amount of CO2 in Tons/year expected to be reduced from the
baseline data available on the CEA?s web-site (www.cea.nic.in)
2. Notwithstanding 1 (i) above, data on (d) & (e) above to be worked out and
reported.
The industry should prepare draft EIA / EMP Report for its project
based on above Terms of Reference (TOR) and submit final EIA / EMP Report
alongwith Executive Summary to the State Expert Appraisal Committee.
Item No. 22.4.4 Application for grant of environmental clearance for the Married Accommodation project to be established by Executive Engineer, CPWD, Amritsar at New Amritsar Military Station State- Amritsar Attari Road, Amritsar.
The following were present from the promoter side:-

The Secretary, SEAC informed that the Executive Engineer,
CPWD, Amritsar has applied to State Environment Impact Assessment Authority for
grant of environmental clearance under the provisions of EIA notification dated
14.9.2006 to set up a Married Accommodation at New Amritsar Military Station State -
Amritsar Attari Road, Amritsar. The project is conceived to meet the housing
requirements of the defence personnel of the army cantonment. Amritsar cantonment
is divided in two parts, Old Amritsar Cantonment (OAC) and New Amritsar Military
Station (NAMS). The total area of the OAC is 4-5 sq. km., while for NAMS it is approx.
35 sq. km. The total area for the proposed project is 80.41 acres scattered as
different pockets.
The Secretary, SEAC informed that at the time of scrutinizing the
application along with Form 1 & 1A at the secretariat level, the following documents
were not submitted by the project proponent. The committee members advised the
proponent to submit the following documents/information, within 15 days and the
case was deferred.

Item No. 22.4.5 Application for grant of environmental clearance for industrial project to be developed at Vill. Ghal Kalan, Distt. Moga by M/s N.G. Chemicals & Fertilizers.
The following were present from the promoter side:-

The Secretary, SEAC informed that M/s N.G. Chemicals &
Fertilizers has applied for obtaining environmental clearance for industrial project for
manufacturing of Zinc Ingots @ 1050 MT/year, Zinc Ash @ 1050 MT/year and Zinc
Sulphate @ 750 MT/year to be established at Vill. Ghal Kalan, Distt. Moga. The
industry is a small scale unit.
Sh. S.K. Aggarwal informed that the industry proposes to install
wet scrubber as air pollution control device to control emissions to be generated
during the process of manufacturing zinc ingots and alkali scrubber to control
emissions to be generated during the process of manufacturing zinc sulphate. The
solid waste / hazardous waste from the reaction vat will be stored as per Hazardous
Waste Management Rules, 2008, framed under Environment (Protection) Act, 1986.
He further informed that the stored solid waste will be finally disposed off to the
Common Facility at Vill. Nimbuan, Tehsil Dera Bassi developed by M/s Nimbuan Green
Field Ltd.
On query from the Committee members, Sh. Navjeevan Garg,
Prop. of the industry stated that the site falls in agricultural area and no residential
area falls within 500 m.
On further query from the Committee members, he submitted the
copy of CLU granted by the Competent Authority for subject cited project, which was
taken on record by the Committee.
After the detailed deliberations on the project proposal submitted
by the industry, it was decided to categorize the project into category B-1. Further,
the Committee approved the following Terms of Reference for Environmental Impact
Assessment Study of the proposed project:-
1 Present land use based on satellite imagery. Study area should be 10Km radius.
Socio-economic development activities.
2 Site-specific micro-meteorological data including inversion height and mixing
height.
3 Data on existing air, water, soil & noise etc.
4 Ambient air quality monitoring (minimum 8 locations) modeling for plant.
5 Sources of secondary emissions, its control and monitoring as per the CPCB
guidelines.
6 Provision of details of air pollution control equipment.
7 The industry proposes to scrub air emissions. It shall provide a suitable treatment
system to treat the wastewater, to be shed from the recirculation system before
discharging any where.
8 Chemical characterization of RSPM and incorporation of RSPM data.
9 One-month data for gaseous emissions for winter season.
10 Water balance data including quantity of effluent to be generated, recycled and
reused and discharged.
11 Permission for withdrawal of water should be obtained.
12 Efforts be made to minimize use of ground water. A chapter on hydrology study
by the State Govt. may be included. Ground water monitoring minimum at 8
locations.
13 Surface as well as roof top rainwater harvesting and ground water recharge.
14 Scheme of proper storage and handling of raw materials. Details of raw material,
their sources and mode of transportation.
15 Risk assessment and damage control.
16 Occupational health of the workers.
17 Green belt (minimum 33%) development plan as per CPCB guidelines. EMP
should include a clear map for plantation/green belt.
18 Details of location of wildlife sanctuary and national parks within 10 km radius of
the plant.
19 Detailed Environment management Plant (EMP) with specific reference to air
pollution control system, water management, monitoring frequency, responsibility
and time bound implementation plan.
20 EMP should include the concept of waste-minimisation, recycle/reuse/recover
techniques, Energy conservation, and natural resource conservation.
21 The issues raised during public hearing and public consultation should be
presented in Tabular chart after incorporating and addressing the each issue.
The industry should prepare draft EIA / EMP Report for its project
based on above Terms of Reference (TOR) and apply to the Chairman, Punjab
Pollution Control Board for conducting public hearing as per EIA Notification, 2006 on
submitting EIA / EMP prepared by the industry as per TORs.
After completing the process of public hearing / public
consultation, the industry should submit final EIA / EMP Report alongwith Executive
Summary to the State Expert Appraisal Committee after incorporating all the issues
raised during public hearing / public consultation for Appraisal of its project.
Item No. 22.4.6 Application for grant of environmental clearance for Retail Mall Project to be developed at Plot No. C-4, Circular Road, Opp. Basant Avenue, Amritsar by M/s TRIF Amritsar Projects Pvt. Ltd.
The following were present from the promoter side:-

The Secretary, SEAC informed that it is a Retail Mall and Multiplex
Project namely “TRIL City Centre” promoted by M/s TRIF Amritsar Projects (P) Ltd., to
be set up at Plot No. C4, Circular Road, Opposite Basant Avenue, Amritsar. The area
of the project is 22,419.58 sq. mt. and expected cost of the project is Rs.300 crore.
The built up area of the project is 62,132.56 m2. The proposed project is commercial
building project and is part of planned and approved master plan of New Amritsar City
Center of Govt. of Punjab.
The Secretary, SEAC informed that at the time of scrutinizing the

Item No. 22.4.8 Application for grant of environmental clearance for "Royal Residency" a Group Housing Project to be developed by M/s Omaxe Ltd. at Vill. Thakarwal, Distt. Ludhiana.

The Secretary, SEAC informed that earlier M/s Omaxe Ltd. had
applied for environmental clearance for Residential Group Housing Project namely
“Royal Residency” to be developed at Vill. Thakarwal, Pakhowal Road, Ludhiana to
SEIAA on 6/2/2008. The same was considered by SEAC in its 6th meeting held on
24/5/2008 and again in its 11th meeting held on 23/8/2008, wherein the project
proponent was requested to submit some details.
The project proponent vide its letter dated 20/9/2008 intimated
that there are certain changes in the project proposal and accordingly requested to
file the application. The request made by the project proponent was considered by
SEIAA in its 15th meeting held on 5/3/2009 and the request for withdrawal of the case
was accepted, which is intimated to project proponent vide letter no. 40886 dated
14/11/2008.
Afterwards, the project proponent has submitted a fresh case
applied on 26/11/2008 to State Environment Impact Assessment Authority for
Environmental Clearance.
Sh. Mukesh Bhatti representative of the project proponent during
the discussion on the project stated that there are further certain changes in the
project proposal and he requested for withdrawal of the application submitted by the
project proponent on 26/11/2008.
The Committee members asked the representative of the project
proponent to submit his request to the Committee in writing for withdrawal of
application. Further, the Committee members decided that the application of the
project for environmental clearance will be treated as disposed off/withdrawn as and
when the request is received from the project proponent.

The Secretary, SEAC informed that M/s Kudos Chemie Ltd. has
requested for exemption from public hearing for expansion of the unit as it is located
in declared industrial zone. This request has been made in reference to the letter no.
J-11011/487/2007-IA-II(I) dated 19/2/2009 issued by Ministry of Environment &
Forests, Govt. of India, New Delhi, vide which its proposal alongwith EIA / EMP for its
expansion case has been transferred to State Environment Impact Assessment
Authority for further action. The Ministry of Environment & Forests, Govt. of India, has
already fixed the Terms of References (TORs) vide letter no. J-11011/487/2007-IA-
II(I) dated 7/12/2007.
Sh. A.S. Kalsi, Vice President of the industry stated that the
project falls under Category ‘B’ and Project 5(f) of the Schedule of the notification
dated 14/9/2006 by Ministry of Environment & Forests, Govt. of India - Part–II,
Section-3 and Sub-section (ii) – Synthetic Organic Chemicals Industry ; BULK DRUGS.
He further stated that the industry is an existing unit and located
in Vill. Kuranwala, Derabassi which is categorized as Industrial Zone (FREE
ENTERPRISES ZONE). To certify this fact, the industry has enclosed a letter issued by
Distt. Town Planner. As the industry is located in Notified Industrial Area demarcated
for the industries, hence, the industry requested to exempt its Expansion Project
from Stage (3) – Public Consultation and also appraise its project under Stage (4). It
has been intimated that the Ministry of Environment & Forests, Govt. of India has
already granted such exemption in case of Nectar Lifesciences Ltd., Vill. Saidpura,
vide their letter dated 2/11/2007.
After detailed deliberations, the Committee members observed
that since the industry is making significant expansion in its existing activities, as
such, it would be appropriate if the industry go for public consultation for its
expansion project. However, in view of para III. Stage (3) of EIA notification no. S.O.
1533 dated 14/9/2006, the relevant part of which reads as under :-
“All Category ‘A’ and Category B1 projects or activities shall
undertake Public Consultation, except all projects or activities located within industrial
estates or parks (item 7(c)* of the Schedule appended with the said
notification) approved by the concerned authorities and which are not allowed in
such approvals.”
* Industrial estates / parks / complexes / areas, export processing zones (EPZs), Special Economic Zones (SEZs), Biotech Parks, Leather Complexes.
The proponent was advised to obtain and submit necessary
documents/certificate from the Competent / concerned Authority i.e. Department of
Industries that the project under reference is falling under the above areas/category
etc.
In view of the above, the Committee deferred the case and it was
decided that the request of the industry in the subject cited matter will be
reconsidered after the receipt of requisite information.
Table Item (II) Application for grant of Environmental Clearance for establishment of 14.5 MW Independent Biomass based power plant to be set-up by M/s Universal Biomass Energy Pvt. Ltd. at Vill. Channo, Tehsil Malout, Distt. Muktsar.

The Secretary, SEAC informed that M/s Universal Biomass Energy
Pvt. Ltd. has applied to State Environment Impact Assessment Authority for grant of
environmental clearance under the provisions of EIA notification dated 14.9.2006 to
set up a 14.5 MW capacity Independent Biomass based power plant at Vill. Channo,
Tehsil Malout, Distt. Muktsar. The case of the project proponent was considered in the
5th meeting of SEAC held on 13/5/2008, wherein, the Committee approved the Terms
of Reference for conducting Environmental Impact Assessment Study of the proposed
project.
After the submission of final EIA by the industry, the case was
reconsidered in the 20th meeting of State Expert Appraisal Committee held on
22/3/2009 and the observations of the Committee conveyed to the project proponent
vide letter no. 12191 dated 9/4/2009. Now, the industry vide its letter dated 5/5/2009
has submitted the pointwise reply of observations raised by the Committee.
Sh. Yashpal Jain, Environmental Consultant of the project
proponent informed that nearly 70% of the work of the project has been completed.
After detailed deliberations on the reply submitted by the
industry, the Committee members observed that it has submitted satisfactory
clarifications on the observations raised by the Committee. The Committee, therefore,
decided to recommend the project to State Environment Impact Assessment Authority
for following actions:
A. For initiating action under the Environment (Protection) Act, 1986
as the project proponent has started development activities without obtaining
environmental clearance under the provisions of EIA notification no. S.O. 1533(E)
dated 14/9/2006.
B. For grant of environmental clearance, subject to the following
conditions:
1. Effective air pollution control devices shall be provided to contain the
particulate matter within the standards prescribed under the Environment
Protection Act, 1986.
2. i) The minimum height of the stack for dispersion of particulate matter and
SO2 emissions shall be as per the standards prescribed under the
Environment (Protection) Act, 1986 in this regard with continuous online
monitoring system.
ii) Adequate dry ash collection system shall be provided. The project
authorities shall adhere to the provisions stipulated in the fly ash
notification of September, 1999 and as amended in August, 2003 with
regard to fly ash utilization. Fly ash and bottom ash shall be stored and
utilized as claimed by the industry.
iii) Effective dust suppression measures shall be taken to control SPM levels in
the area.
iv) Dust extraction and suppression system and water sprinklers shall be
provided for controlling fugitive dust during transportation and other
vulnerable areas of the plant.
v) The industry shall make adequate arrangements for collection and
transportation of cattle dung at its collection centers as well as at site in an
environmentally sound manner to avoid the nuisance / flies problem in the
area.
vi) The digester residue shall be utilized for making organic manure and left
over will be used as liquid fertilizer.
vii) Water requirement shall not exceed 1072 m3/day and shall be met from
ground water. The industry shall ensure compliance of the conditions of
permission obtained from Central Ground Water Authority.
viii) Treated effluent conforming to the prescribed standards shall be used onto
land for irrigation / plantation.
ix) The industry shall make adequate arrangements for management of R.O.
rejects before sending it to M/s Nimbua Green Field Ltd., which has a
Common Treatment, Storage and Disposal Facility (TSDF) at Vill. Nimbua,
Dera Bassi, Distt. Mohali.
x) Rainwater harvesting shall be practiced. A detailed scheme for rainwater
harvesting to recharge the ground water aquifer shall be prepared in
consultation with Central Ground Water Authority / State Ground Water
Board and a copy of the same shall be submitted within three months to
SEIAA/MOEF.
xi) Leq of Noise level shall be limited to 75 dB(A) and regular maintenance of
equipment should be undertaken. For people working in high noise level
area, personal protection devices should be provided.
xii) A greenbelt shall be developed around the plant boundary with tree density
of around 1000 trees per acre.
xiii) First aid and sanitation arrangement shall be made for the drivers and other
contract workers during construction phase.
xiv) Regular monitoring of the ambient air quality shall be carried out in and
around the power plant and records maintained. The location of monitoring
stations and frequency of monitoring shall be decided in consultation with
the Punjab Pollution Control Board. Periodic reports shall be submitted to
the Regional Office of Ministry of Environment and Forests at Chandigarh.
xv) The industry shall advertise in at least two local newspapers widely
circulated in the region around the project, one of which shall be in the
vernacular language of the locality concerned within seven days from the
date of issue of the letter, informing that the project has been accorded
environmental clearance and copies of clearance letter are available with
the Punjab Pollution Control Board and may be seen at Web site of the
Punjab Pollution Control Board, Punjab.
xvi) A separate Environment Management Cell with qualified staff shall be set up
for implementation of the stipulated environmental safeguards.
xvii) Half yearly report on the status of implementation of the stipulated
conditions and environmental safeguards shall be submitted to MOEF/
SEIAA/ CPCB/SPCB.
xviii) Regional Office of the Ministry of Environment and Forests located at
Chandigarh will monitor the implementation of the stipulated conditions. A
complete set of documents including Environment impact Assessment
report and environment management plan alongwith the additional
information submitted from time to time shall be forwarded to the Regional
Office for their use during monitoring.
xix) Separate funds shall be allocated for implementation of environmental
protection measures along with item wise break up. These costs shall be
included as part of the project cost. The funds earmarked for the
environmental protection measures shall not be diverted for other purposes
and year wise expenditure shall be reported to the MOEF/SEIAA.
xx) Full co-operation shall be extended to the Scientists/Officers from the
Ministry/Regional Office of the Ministry at Chandigarh/SEIAA/SEAC/ the
CPCB / the SPCB/ who would be monitoring the compliance of
environmental status.
3. The State Level Environment Impact Assessment Authority reserves the right to
revoke the clearance if conditions stipulated are not implemented to the
satisfaction of the Ministry.
4. The environmental clearance accorded shall be valid for a period of 5 years to
start of production operation by the power plant.
5. In case of any deviation or alteration in the project proposed from that
submitted to SEIAA for clearance, a fresh reference shall be made to the SEIAA
to assess the adequacy of the conditions (s) imposed and to incorporate
additional environmental projection measures required, if any.
6. The above stipulations shall be enforced alongwith the provisions of the Water
(Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of
Pollution) Act, 1981, the Environment (Protection) Act, 1986, the
Manufacturing, Storage and Import of Hazardous Chemical Rules, 1989,
Hazardous Waste (Management & Handling) Rules, 1989, the Public liability
Insurance Act, 1991 and Rules thereunder and Environmental Impact
Assessment Notification no. 1533 (E) dated 14.9.2006 and any other applicable
legislation or restrictions / conditions imposed by any statutory authority.
7. The State Level Environment Impact Assessment Authority reserves the right to
add additional safeguard measures subsequently, if found necessary, and to
take action including revoking of the environmental clearance under the
provisions of the Environment (Protection) Act, 1986 to ensure effective
implementation of the suggested safeguard measures in a time bound and
satisfactory manner.
8. All other statutory clearances such as the approvals for storage of diesel from
Chief Controller of Explosives, Fire Department, Civil Aviation Department,
Forest (Conservation) Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be
obtained, as applicable, by industry from the competent authorities. All other
safety measure be undertaken at site as required under the laws.
9. Legal action shall be initiated under the provisions of Environment (Protection)
Act, 1986 against the industry if it is found that construction of the project has
been started without obtaining environmental clearance.
10. This is environmental clearance granted by State Level Environment Impact
Assessment Authority as per the provision of EIA notification no. 1533 (E)
dated 14.9.2006 and the industry shall obtain all necessary clearances from
other statutory bodies as applicable, including Punjab Pollution Control Board.
11. Environmental clearance is subject to final order of the Hon'ble Supreme Court
of India in the matter of Goa Foundation v/s Union of India in Writ Petition
(Civil) no. 460 of 2004 as may be applicable to this project and decisions of any
competent court, to the extent applicable.
General Points :
The Chairman, SEAC informed the members that an informal
meeting was held on 5/5/2009 with the Secretary, Science Technology, Environment
and Non-Conventional Energy, Govt. of Punjab, Chairman, PPCB and MS SEAC,. In the
meeting, the following issues were discussed:
1. Grant of environmental clearance to the projects falling in designated area :
It was discussed in the meeting that with the development of the
State, the mega projects are being established and these projects have applied for
environmental clearance from the State Environment Impact Assessment Authority.
Some of these projects are being located in designated industrial areas meant for
these projects. However, it has been observed that the appraisal of these projects is
not considered on the ground that these projects have not obtained the CLU from the
Competent Authority. But on the other side, Ministry of Environment & Forests, Govt.
of India, is granting environmental clearance without CLU to the mega projects of the
State. Thus, in order to grant speedy environmental clearance as required under EIA
notification dated 14/9/2006, it becomes indispensable that these projects may be
considered for grant of environmental clearance with the condition that these projects
will submit the CLU within two months from the date of issue of environmental
clearance.
The above noted matter was discussed in the SEAC meeting and
different options such as, asking for CLU along with the application; processing the
project and holding the EC till the proponent submits CLU; processing and granting EC
with a condition that the proponent submits the CLU in two months, were discussed
the general opinion was that in case, the environmental clearance is granted to the
project proponent with the condition to get CLU within two months, then there is
every possibility that the project proponent will go ahead with all development
activities without getting the land use changed. According to the guidelines framed by
MoEF, the project proponent is required to submit CLU for any development project
along with the application. Therefore, it was decided by the Committee that it shall
continue to obtain the CLU from the project proponent at the time of submission of
application for environmental clearances in accordance with the guidelines of MoEF.
2. Provision of green belt of width of 15 meters towards the air
polluting source in case the boundary of the projects falls within 100 meter.
Regarding the location of a polluting industry within 100m of a
construction project, the Punjab Govt. Notification no. 3/6/07/STE(4)/2274 dated
25/7/2008, prescribe that a 15m wide green belt with broad leaf tree species towards
the polluting industry be provided by the proponent. The issue was discussed in
details and the general views were:
• The building height goes to 30-40 m in a short span of time, whereas only a
few species of trees can go to that height after a very long time.
• The green belt is more effective to absorb carbon dioxide and a few other
pollutants, not all.
That way the provision of green belt serves a very limited
objective to protect the building from polluting industry.
It was recommended by the Committee to refer the matter to
SEIAA to take it up with the State Govt. to review the notification.
3. Consideration of bio-mass based power plants / co-generation plants and other projects falling in the designated area for grant of environmental clearance without public hearing.
It was discussed in the meeting on 5/5/2009 that Bio-mass based
power plants / co-generation plants projects are asked to get the public hearing
conducted through Punjab Pollution Control Board, irrespective of the fact that the
public hearing has already been conducted by the Punjab Pollution Control Board for
the site to manufacture main products of the industry or MoEF has already exempted
the site of the industry from conducting public hearing for its main products. It has
also been observed that some of the new projects or expansion projects which are
coming in the State in the designated area are asked by SEAC/SEIAA to conduct
public hearing through Punjab Pollution Control Board while appraising these projects.
However, it has been felt during meeting that the projects falling in the designated
area or expansion projects at site for which public hearing has already been
conducted by the Punjab Pollution Control Board, a logistic approach be adopted to
consider to exempt the project from public hearing.
The matter was discussed in the SEAC Committee and the
members observed that the project proponents are advised for public consultation
according to the merits of their projects. In expansion projects, if the industry
proposes significant expansion of its existing activities, then it is the useful to
recommend the conduct of public consultation before grant of environmental
clearance.
Accordingly, it was decided by the Committee that the
requirement of public consultation will be decided on the merits of each case.
4. Disposal of pending cases :
The Committee members observed that certain cases of
environmental clearance are pending since long with the SEAC for want of reply on
the observations conveyed to the project proponents. The status of the following
cases, which are pending for environmental clearance since last six months, was
discussed in the meeting.
