The 148th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher

Education (NCTE) was convened on 3rd

-4th January, 2013 at Conference Hall, ERC, NCTE,

15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed

below were present at the time of the 148th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them

about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With

the permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the

Committee for its due consideration and appropriate decision.

Regulations and guidelines issued by NCTE Hqrs and VT Report, , the Committee discussed the matter

in detail and observed as under:

1. The institution be asked to submit the converted original FDRs of Rs. 5.00 lakh and Rs. 3.00

Lakh.

2. As per VT report multipurpose hall is 1763.36 Sq.ft. which is less than the required 2000 sq,ft, as

per NCTE Regulation 2009.

3. Notarized copy of change of land use certificate (CLU) from agriculture to non-agriculture issued

by SDO is to be submitted.

4. Site plan issued by Land Revenue Office is to be submitted.

5. Original affidavit in the prescribed form on Rs. 100/- stamp paper duly attested by Oath

Commissioner or Notary Public, stating the precise location of the land (village, district, state

etc), the total area in possession, the permission of the competent authority to use the land for

educational purposes and mode of possession i.e. ownership or lease is to be submitted.

In view of the above the committee decided as under:

Show cause notice be issued to the institution as to why the recognition to the institution be not refused

on the above points. The Committee therefore, provides an opportunity under section 14(3)(b) of the

NCTE Act 1993 to the institution to submit its reply within 30 days from the issue of the letter before the

Committee takes final decision.

Regulations and guidelines issued by NCTE Hqrs., VTR and the reply Dated 03.12.2012 in response to

clarification letter issued in the matter of complaint, the Committee discussed the matter in detail and

observed as under:

1. The institution was inspected by an expert committee on 25.1.2007. At that time, the land

and building was on lease basis/rent basis.

2. Recognition was granted to the institution on 4.6.2007.

3. As per clause 8(5) of NCTE Regulations notified dated 27.12.2005 and published in Gazette

of India on 13.01.2006, “No institution shall be granted recognition under these regulations

unless it is in possession of required land on the date of application. The land free from all

encumbrances could be either on ownership basis or on lease for a period of not less than 30

years. In cases where under relevant State/UT laws the maximum permissible lease period is

less than 30 years, the State Government/UT Administration law shall prevail.”

4. As per clause 8(8) of NCTE Regulations notified dated 27.12.2005 and published in Gazette

of India on 13.01.2006, “At the time of inspection, the building of the institution shall be

complete in the form of a permanent structure on the land possessed by the institution in

terms of Regulation 8(5), equipped with all necessary amenities and fulfilling all such

requirements as prescribed in the norms and standards.”

5. As per Self-Appraisal Report (2010-2011) submitted by the institution on 2.09.2011, the

institution functions from a rented building, which is not as per the Regulations.

In view of the above, the Committee decided as under:

The institution be asked to clarify whether the institution is functioning in its own building or

rented/leased building as on date and submit its reply within 21 days.

The Appeal Committee remands back the case to ERC for further processing.


Regulations and guidelines issued by NCTE Hqrs. and direction issued by the Appeal Committee vide

order No.89-565/2012-Appeal/10th Meeting-2012 dated 11.12.2012, the Committee discussed the matter

in detail and observed as under:

1. Original FDRs for Rs. 5.00 lakh & Rs. 3.00 lakh were returned to the institution along with

refusal order dated 17.05.2012. The same are required to be submitted again by the institution

after revalidation.

2. A certificate in respect of CLU issued by Circle Officer submitted, wherein, it is not clearly

mentioned that the land is converted for agriculture to non-agriculture purpose i.e. educational

purpose. However, the notarized copy of change of land use certificate (CLU) issued by SDO for

conversion of land from agriculture to non-agriculture is to be submitted.

3. Building completion certificate in prescribed format mentioning plot No. khata No., total area &

built up area etc. issued by Govt. Engineer not below the rank of J.E. – is to be submitted.

4. Site plan approved by the competent authority:-

As the institution has proposed its land in two different plots, the institution is required to

submit the site plan duly approved by the competent authority demarcating the plots where

the said institution is proposed.

5. Undertaking from the Management of institution in the prescribed format not submitted.

In view of the above the Committee decided to issue clarification on the above points to the institution

and to submit its reply within 30 days from the issue of the letter.

1. A letter vide No. CE(E)-23/PSC/2010 dated 27th July 2012 submitted by the institution in

respect of NOC from the State Govt. was sent to the Commissioner cum Secretary (Education)

Govt. of Arunachal Pradesh vide ERC letter dated 13/9/2012 and reminder dated 17/11/2012 for

its authenticity as the State representative of Arunachal Pradesh has confirmed that such letter

was not issued from the concerned department. The State Govt. in its reply vide letter No.

24(aca)/2009/PT/2 dated 23rd November 2012 has confirmed that no such letter has been issued

from office of the Directorate of Higher and Technical Education, Govt. of Arunachal Pradesh,

Itanagar and the Govt. of Arunachal Pradesh have requested the ERC to take appropriate action

against such institution.

2. Further, the institution has enclosed NOC from State Govt. dated 11 May 2010 and it was not

even endorsed to ERC Bhubaneswar. Since, the institution has applied for B.Ed. course on

29/9/2011; however the said letter is not relevant to the present application.


The State Govt. may be requested to issue updated order in respect of the NOC to the institution as the

NOC was issued before the institution had applied to ERC. A copy of the NOC letter dated 11.05.2010

be enclosed for information to the State Government.

4. The institution in its representation dated 17.12.2012 has clarified that the college has three

building in its campus.

5. The number of computers in the library is only 5. It should be 10 as per NCTE norms.

6. As per VT report total seating capacity in the library is 10 which is less than the required 50.

7. Size of the class rooms is less which is less than the required 500 sq.ft.

8. The institution be asked to submit a resolution passed by the Management Committee for

demarcation of land area for the proposed B.Ed. college.

4) Inspection letter was issued on 21.8.2012.

5) The request of the institution is not accepted by the committee.

In view of the above, the Committee decided to refuse the recognition of the institution for the applied

course B.Ed. under section 14(3)(b) of NCTE Act 1993.

2. No reply in response to the show cause notices has been received in this office till date time limit

has already been over.

In view of the above, the Committee decided to issue a letter to Chief Executive Officer, Bihar State

Sunni Waqf Board, 2nd Floor, Haz Bhawan, 34, Ali Imam Path (Harding Road) Patna to submit the reply

within 15 days. A copy of the letter be sent to the institution also.

Regulations and guidelines issued by NCTE Hqrs. and letter dated 15.11.2012 received from the

institution, the Committee discussed the matter in detail and observed as under:

1. The Principal vide its letter dated 15.11.2012 has informed that the Department of Human

Resource Development to the Govt. of India had upgraded the Secondary Teacher Education into

College of Teacher Education under 100% Centrally Sponsored Scheme of Teachers Education

Act, 1993 through vide letter No. F-45-2/93-TE-II dated 24.03.1993.

2. The Principal vide its letter dated 15.11.2012 has informed that the name of Mangaladi Govt. T.

T. College, Magaldai will be changed to College of Teacher Education (CTE).


The institution be asked to submit request letter for changing the name of the institution alongwith an

affidavit and a copy of letter issued by the Department of Human Resource Development dated

24.03.1993 through the State Government for further processing of the matter. A copy of the letter be

endorsed to State Govt. of Assam for appropriate action.
