Community Legal Services in East Palo Alto’s mission is to provide transformative

legal services that enable diverse communities in East Palo Alto and beyond to

achieve a secure and thriving future. With the help of pro bono attorneys from

firms and companies, private attorneys, law students, interpreters and paralegals,

we support our communities as they confront systems of inequality and injustice.

HUMANITARIAN RELIEF Hundreds of immigrant families, single mothers and their children, seek a better future for themselves and their families. Alma was only 14 years old when she journeyed alone to the United States from Honduras. She was fleeing from a gang who murdered her father and threatened Alma’s life. Maria and her children fled Mexico to escape an abusive husband and extended family member who had threatened to kill her and her children. Maria and Alma have hope today because they have the help of pro bono attorneys, which greatly increases their chances to remain in the United States. Our pro bono attorneys work on U-visas, Violence Against Women Act (VAWA), Asylum, Special Immigrant Juvenile Status (SIJS), Board of Immiration Appeals (BIA) and Ninth Circuit cases. A novel partnership between in-house counsel at PayPal, Inc., Fenwick & West LLP and Arnold & Porter Kaye Scholer LLP has helped unaccompanied minors, such as Alma, seek asylum. Their teams also participated in our asylum clinic, helping pro se asylum seekers with their applications.

In addition, CLSEPA collaborated with the Immigrant Rights Clinic at Stanford Law School, Sanctuary for Families (NY), and Davis, Polk & Wardwell LLP to submit an amicus brief to the Ninth Circuit Court of Appeals, which, if successful, will allow immigrant victims of crime more access to review of their cases and a more just outcome.

REENTRY A proud veteran and a member of the Laborer’s Union, John worked to support himself and his family until an injury forced him to change careers. But John couldn’t find a job because of old convictions, even though he had served his sentences, paid his fines in full and completed all his court mandated programs. Pro bono attorneys helped John expunge his records at a CLSEPA clinic, and he was able to find a job that enabled him to support his daughter through college.

When the passage of Prop 47 reduced the penalties for some crimes, thousands of residents became eligible to have their records expunged. Pro bono attorneys and paralegals help us assist hundreds of residents by reviewing Record of Arrests and Prosecutions (RAP) sheets and preparing clients’ applications at expungement clinics. DLA Piper, Hewlett Packard Enterprise and Kirkland & Ellis help low-income clients access services by covering the costs of our clients’ LiveScan fingerprinting services. Our clients also benefit from our partnership with the Private Defender Program in San Mateo County and the Santa Clara Public Defender’s office that provide criminal law expertise and insight into clients’ cases and advocacy with the courts on improving the dismissal process. In 2016, the Santa Clara Public Defender’s office succeeded in getting 52 dismissals for our clients.

HOUSING As Silicon Valley’s economy prospers, thousands of low to middle income families struggle to simply stay in their homes. Last year, Alicia’s family asked their landlord to stop his frequent visits to the property without their permission. A week later, the landlord retaliated by increasing their rent by almost $1000, ten times their normal annual rent increase, and an amount they could not afford. Pro bono attorneys from Simpson Thacher LLP quickly stepped in to help, ultimately bringing the landlord to the negotiating table and resulting in a settlement that allowed the family to stay in their home, close to their jobs and children’s schools.

In our Mandatory Settlement Conference clinic, pro bono attorneys volunteer one morning a week to negotiate on behalf of tenants facing eviction. Confronting housing laws that favor landlords, these attorneys nevertheless work tirelessly to provide tenants with the representation they deserve. Pro bono attorneys have also taken on affirmative housing and eviction cases while law students from Stanford Law School regularly staff our housing intake clinics. Our housing program relies enormously on these volunteers, who expand our capacity to serve those on the brink of homelessness.

PROTECTING WORKERS Javier worked for a nationwide auto maintenance company that understaffed his location to save money. Left alone during long shifts, Javier was unable to step outside and take his meal and rest breaks. Yet, the company continued to deduct these breaks from his paid time, failing to pay him for his additional hours. Javier was able to work with pro bono attorney, Daniel Feldman, to negotiate a settlement compensating him for the hours he worked.

As the only provider of workers’ rights legal services located in San Mateo County, Community Legal Services in East Palo Alto partners with pro bono attorneys to fight wage theft and ensure that all workers are treated with dignity on the job. Studies have shown that the average low-wage worker, many of whom are women, people of color or undocumented, loses 15% of their income to wage theft, losses which are devastating in the already expensive Bay Area. Pro bono volunteers negotiate directly with employers to improve work conditions, file cases with state agencies to stop discrimination, and settle cases to recover our clients’ unpaid wages. Since November 2015, our program has recovered over $350,000 for local residents plus thousands of dollars more in future earnings.
