a vertical separationof not less than 2 metresbetweenthe baseof the leach drain andthe highestrecordedirrigation areagroundwaterlevel or bedrock;

b horizontal separationof not less than 100 metresbetweenthe disposalsystemandexistingdrains,water coursesor water bodies;

c The area aroundeach disposalsystemshall be plantedwith indigenoustrees andshrubsand be maintainedto the satisfactionof the Council;

d Preventionof direct movementof wastewaterand nutrient from the locality of eachdisposalarea;

e The landownershall be responsiblefor ensuringthat the systemis maintainedto theoperationalstandardsrequiredby the Health Departmentof WesternAustralia, andthe Council;

0 The above requirementsmay be varied by resolution of the Council subject to theapprovalof the EnvironmentalProtectionAuthority, the HealthDepartmentof WA andthe Departmentof Planning and Urban Development,to reflect changesin effluentdisposalsystemtechnology.

9. Eachdwelling shall be providedwith a supplyof potablewater from a roofcatchmentofnot less than 120 squaremetresin projectedplan area,connectedto a storagetank witha minimum capacityof 92 000 litres.

10. WaterSupply Provisions:

a The subdivider shall make arrangementsatisfactory to the Council to ensurethatprospectivepurchasersof the lots are advisedthat no reticulatedwater supplycanbeprovidedby the WaterAuthority of WesternAustralia.

b The land subject to the provisions of the Water Authority of WesternAustralia’sBy-laws applicableto undergroundwatersupplyandpollution control.The subdivider/owner shall inform all prospectivepurchasersin writing of the Water Authority ofWesternAustralia’s requirementsmentionedin c and d below.


c A well licence must be obtained prior to construction of a well or bore to drawgroundwater. Groundwatermay be drawn from each of the lots to supplementhouseholdwatersupplyneedsandto supplywaterfor irrigateddevelopmentof anareaof up to 1 000 m2. The maximumamountof groundwaterpermittedto be drawnshallbe 1 500 cubic metresannually.

d Activities carriedouton this land shall not contravenetheWaterAuthority of WesternAustralia’s By-laws applicable to undergroundwater pollution control.

11. All fencingshall be of openpostandrail or postandwire constructionandmaintainedtothe satisfactionof Council.

12. Exceptfor the use of compostbins andotherrecycling methods,all householdrubbishandrefuseshall be transportedto, and depositedin, a disposalsite underthe Health Act.

13. Subdivisionof theland shall begenerallyin accordancewith the SpecialRural SubdivisionGuide Plan adoptedby the Council.

14. No lot shall havean areaof less than two hectares.

15. Eachlot shall containa building envelope,the areaof which shall not exceed2 000 squaremetres.

16. Within the areashown as the building envelope,an areano greaterthan 2 000 squaremetresmay be clearedof vegetationto allow for the constructionof a singlehouseand anyoutbuildingsancillary thereto,andthe establishmentof gardens.

c The landowner shall provide Council with documentationdemonstratingthat thedrainage proposalsdescribed above meet the requirementsof the EnvironmentalProtectionPolicy andthe Statementof PlanningPolicy for the Peel-HarveyCoastalPlain Catchment.

18. The land is to be managedin such a manneras to avoid the land being laid bare ofvegetationresulting in loose, wind erodible conditions.Clearingis prohibitedexceptwithinthe building envelopeandfor vegetationthat has to be removedto makeway for fences,firebreaks,and accessways.

19. The Subdividershall undertakea treeplantingprogramon lots nominatedby Council asbeing deficient in vegetationcover. The subdivider shall within the ‘Tree PlantingArea’as nominatedby Council, plant indigenoustreesandshrubsof a speciesandat a densityanddistributionto be determinedby the Council. Treeplantingshall beundertakenby thesubdividerto the satisfactionof the Council prior to the issueof clearancesby the Councilfor the subdivision of the land. As a guide tree plantingshall be designedto achieveanultimate canopycover on each lot of not less than thirty percentof the areaof that lot.

20. In additionto othertreeplantingareasa Tree PlantingArea not less than twentymetresin width shall be providedalongsidethe Highway Reserveboundariesto the satisfactionof the Council.

21. The subdividershall eithercauseto maintainthe treesandshrubsplantedwithin the‘TreePlanting Area’ to the satisfaction of the Council until the land is sold, or shall plantsufficient numberof trees,andshrubsto achievean effectivethirty percentcanopycoverafter allowance for natural loss. Thereafter, the ownersof the subdividedlots shall beresponsiblefor themaintenanceandreplacementof thosetreesandshrubsplantedby thesubdivider to the satisfactionof the Council.

22. The subdividershall submita planof the siteto the Councilwhich shall show sitecontours,existing treesandstandsof vegetation,to be retainedandproposalsfor treeplantingandmaintenanceat the time of making an application for subdivision.

23. Firebreaksshall be establishedandmaintainedto the specificationsandsatisfactionof theCouncil.

24. The Council will facilitate discussionsbetweenthe subdivider andthe Bush Fires Boardto determinefinancialcontribution towardsthe cost of fire suppressionequipmentfor theShire of Murray Bushfire Brigade andany other fire preventionthat may be requiredbythe Council.
