TAKE NOTICE that the Estate of Wendell George Barbour claims to be the absolute owner, in fee simple, of the lands hereinafter described:

ALL THAT PARCEL of land situate, lying and being on Lot or Township Number Thirty-Four (34), Queens County, Province of Prince Edward Island, bounded and described as follows, that is to say:

COMMENCING at a point shown as station number 1162 on a plan of survey entitled “Plan Showing Property of The Estate of Wendell G. Barbour” prepared by Delta Surveys - Designer Surveys Inc. on January 11, 2012, under Drawing No. D-12-07, duly certified by Brian P. Potter, P.E.I.L.S., said point at the place of commencement having co-ordinates Easting 469481.27 feet, Northing 398216.91 feet;

THENCE westerly on an azimuth 291° 05’ 53” a distance of 51.75 feet or to station number 1150;

THENCE southerly on an azimuth 201° 12’ 17” a distance of 3.98 feet;

THENCE westerly on an azimuth 286° 09’ 48” a distance of 22.81 feet or to station number 1352;

THENCE northerly on an azimuth 19° 19’ 42” a distance of 299.97 feet or to station number 1160;

THENCE easterly on an azimuth 103° 41’ 49” a distance of 75.00 feet or to station number 1161;

THENCE southerly on an azimuth 199° 19’ 42” a distance of 303.69 feet or to the point at place of commencement.

BEING AND INTENDED to be “Now or Formerly Property of The Estate of Wendell G. Barbour” as the same is shown on the aforesaid survey plan and having a calculated area of 0.52 acres of land, a little more or less.

TOGETHER WITH a right-of-way 12’ wide extending from the south boundary of the above described land in a westerly direction across the land of the said Grantor [formerly James “Rupert” Ross] to the new road of the said Grantor [formerly James “Rupert” Ross] extending northwardly from the Stanhope Shore Road;

THENCE southwardly over and along said new road to the Stanhope Shore Road aforesaid; and also a right-of-way to the Gulf of Saint Laurence Shore over said new road through a gate or opening in the National Park Expropriation provided that the said Grantor [formerly James “Rupert” Ross] shall have the privilege of placing one gate at the western entrance of said right-of-way.

AND TAKE NOTICE that any person wanting a legal description of the lands in question may obtain one at the Law Courts Building and any person claiming adverse title or interest in the said lands is to file notice of same with the Prothonotary of the Supreme Court, 42 Water Street, Charlottetown, in Queens County, Prince Edward Island, on or before the 20th day of April, 2012.

AND FURTHER TAKE NOTICE that if no claim to the said lands adverse to that of the Estate of Wendell George Barbour is filed on or before the 20th day of April, 2012, a certificate of title certifying that the Estate of Wendell George Barbour is the legal and beneficial owner in fee simple of the lands may be granted pursuant to the provisions of the Quieting Titles Act, R.S.P.E.I. 1988, Cap.
