Campus Safety

• The Institution is committed to providing a working and learning environment that isfree from drug and alcohol use, discrimination, and/or sexual misconduct includingdating violence, domestic violence, sexual assault and stalking.

• Violations may include disciplinary action up to and including dismissal from school,termination from employment, and legal prosecution.

- Publishing an Annual Security Report (ASR)- Maintaining a crime log with crime statistics- Issuing timely warnings

Campus Safety• Definitions:

• Dating Violence - Violence committed by a person who is or has been in a socialrelationship of a romantic or intimate nature with the victim, where the existence of such arelationship shall be determined based on the reporting party’s statement and withconsideration of the length of the relationship, the type of relationship; and the frequency ofinteraction between the persons involved in the relationship.

• Domestic Violence - A felony or misdemeanor crime of violence committed by a current orformer spouse or intimate partner of the victim, a person with whom a victim shares a childin common, a person who is cohabitating with, or has cohabitated with, the victim as aspouse or intimate partner, a person similarly situated to a spouse of the victim under thedomestic or family violence laws of the jurisdiction in which the crime of violence occurredor any other person against an adult or youth victim who is protected from that person’sacts under the domestic or family violence laws of the jurisdiction in which the crime ofviolence occurred.

Campus Safety• Sexual Assault – Means an offense that meets the definition of rape, fondling,

incest, or statutory rape as used in the FBI’s Uniform Crime Reporting (UCR)program.

• Stalking - Means engaging in a course of conduct (two or more acts) directed ata specific person that would cause a reasonable person to –fear for his or hersafety or the safety of others; or suffer substantial emotional distress. Course ofconduct includes but is not limited to acts in which the stalker directly, indirectly orthrough third parties, by any action, method, device or means, follows, monitors,observes, surveils, threatens, or communicates to or about a person or interfereswith a person’s property.

Campus Safetya) The victim is coerced by the immediate use or threatened use of force against

a person or property.b) The victim is incapable of consent by reason of mental disorder, mental defect,

drugs, alcohol, sleep or any other similar impairment of cognition and suchcondition is known or should have reasonably been known to the defendant.For purposes of this subdivision, "mental defect" means the victim is unable tocomprehend the distinctively sexual nature of the conduct or is incapable ofunderstanding or exercising the right to refuse to engage in the conduct withanother.

c) The victim is intentionally deceived as to the nature of the act.d) The victim is intentionally deceived to erroneously believe that the person is the

victim's spouse.

Campus Safety• Consent – is an affirmative consent standard in the determination of whether

consent was given by both parties to sexual activity. Affirmative consent meanaffirmative, conscious, and voluntary agreement to engage in sexual activity. It isthe responsibility of each person involved in the sexual activity to ensure that he orshe has the affirmative consent of the other or others to engage in sexual activity.Lack of protest, resistance, or silence does not mean consent. Affirmativeconsent must be ongoing throughout a sexual activity and can be revoked atany time. The existence of a dating relationship between the persons involved, orthe fact of past sexual relations between them, should never by itself be assumedto be an indicator of consent.

Campus SafetyConsent – “Consent” means intelligent, knowing, and voluntary consent and does not include coerced submission. “Consent” shall not be deemed or construed to mean the failure by the alleged victim to offer physical resistance to the offender.

Florida Statute § 794.011

Consent is not specifically defined under Georgia law. Consent - "Consent" means assent in fact, whether express or apparent.

Reporting:• The Institution encourages accurate and prompt reporting of all

crimes to the Campus Security Authority (CSA) and theappropriate law enforcement agency.

• A CSA is any school official that has a significant responsibility forstudents and/or school activities. The Institution has designatedthe school’s Campus President/Executive Director as the CSA.The secondary CSA is the Associate Director or Director ofEducation.

• Buddy system• Walk with a trusted friend, rather than alone, to the bus stop.• Be aware of your surroundings – avoid isolated areas• Avoid dark and/or deserted streets and alleyways where a call for help may

go unheard.• Carry a cell phone• Trust your instincts• Leave immediately if a situation or location feels unsafe• Walk with a purpose• A quick, confident stride may keep criminals at bay.

Campus SafetyBystander Intervention:

• Prevent harm or safely intervene when there is a risk of violence• Re-directing individuals to a safe place• Avoid peer pressure and inappropriate jokes• Don’t encourage friends to drink excessively or engage in

promiscuous behavior• Encourage victims to report crime• Listen, be patient and refrain from making judgements
