Consulting Engineers Association of India 1 January 2018 FROM THE PRESIDENT'S DESK Dear Members, With the Government of India’s major investments in Infrastructure, project execution of the required quality within given timelines becomes important. The Contract Document is a major enabler and for high end projects requiring National and International Experts, it is becoming the norm to use FIDIC form of contracts. FIDIC contracts are considered fair in apportioning of risks, rights and obligations among stakeholders and are recommended by multilateral development banks, bilateral funding agencies and, recently, for selected large domestic projects where participation from international vendors, contractors or consultants is expected. In the past month, CEAI conducted FIDIC training programs by an accredited trainer for DFCCIL and NHSRCL, two respected professional organisations in the country. In addition, CEAI also organized an open training module, for other participants. We had delegates from public sector undertakings, consultants, contractors and individuals who wished to get trained, including, from the Middle East. CEAI has also intervened on behalf of CEAI members, where deemed appropriate, with relevant Authorities about unfair technical/ commercial terms and conditions, of consequence to the larger Consulting Community. Now that Fy18 is almost behind us, we have started planning events for Fy19, based on inputs from our Regional Centres. We also invite our esteemed members to give their suggestions on how CEAI can better serve you, and seek ideas for training programs or Seminars in potential growth areas. Dear Members,

With the Government of India’s major investments in Infrastructure, project execution of the required quality within given timelines becomes important. FIDIC TRAINING COURSES

CEAI successfully conducted FIDIC Training Courses for the general public and in-house programs for the senior executives of DFCCIL and NHSRCL from 12th to 20th January 2018 at New Delhi.

Mr Bogdan Oprea, a FIDIC accredited faculty, conducted the training programs. He has trained extensively for FIDIC as an accredited trainer in Europe, Middle East, Asia, South America and Africa, specializing on FIDIC contracts and the management of claims and the resolution of disputes.

a) OPEN HOUSE TRAINING PROGRAM

The course provided the participants, the necessary detailed knowledge and insights to the claim management and dispute resolution provisions under the FIDIC Conditions of Contract document, 1999 Edition.

i) Dedicated Freight Corridor Corporation of India Ltd

CEAI organised trainings for Senior executives of Dedicated Freight Corridors Corporation of India Ltd (A Government of India Enterprises), on the following modules:

• Training on “Practical Use of FIDIC Conditions of Contract” held on 12-13 January 2018. Mr Somenath Ghosh, Vice President CEAI, inaugurated the program. 43 executives of DFCCIL trained on the topic.

TRAINING COURSE ON ‘CONSULTING ENGINEERING PRACTICE’

With a view to improve the skill development of new entrants to Consulting Engineering Organisations, fresh engineering graduates and final year engineering students, CEAI is planning to organise a training programs for young engineers and engineering students on different modules. The courses will be conducted by experienced high profile practising consulting engineers.

The first training course ie Module I on the topic ‘Consulting Engineering Practice’ is scheduled to be held on 17th February 2018 at CEAI Centre, Vasant Kunj, New Delhi. Upto a maximum of 20 participants will be accommodated on a first come first served basis. The training fee will be Rs 2000/- plus GST as applicable per person. Currently the GST applicable is 18%.

CEAI INTERVENTIONS

DMRC TENDER NOTICE

DMRC issued a Notice inviting Tender for Contract for selection of DDC Consultants for the Phase IV of Delhi MRTS projects. CEAI is concerned that the provisions in the document are likely to eliminate participation of Consulting Organisations from India in Metro projects.

Construction of Metro Railway projects, whether underground or elevated, have started in India with full vigour only in recent years, leaving aside the first Metro at Kolkata, that was completed in the early eighties. The technology has changed significantly thereafter. Starting with the systematic expansion of Delhi Metro, that brought in new technology, followed by commencement of Metro work in other centres like Jaipur, Chennai, Bangalore, Mumbai, Hyderabad, Lucknow, etc., the Indian Consultancy organisations have had the opportunity of participating in the design of underground, at grade or elevated Metro projects for the track work as also for the Stations. Indian Consultants also got experience in other packages like electro-mechanical, planning and Architecture. The Indian organisations are looking forward to gain increasing proficiency in Metro projects, along with the continued development and expansion

of DMRC, and other Metro organisations in India.

In view of the above, CEAI wrote to DMRC to review the qualifying criteria for submission of the bids, keeping in mind the National need for strengthening Indian Consultancy capability to a level that, they can emerge as International players in this growing sector all over the world, with rapid urbanisation taking place.

ENGAGEMENT OF CONSULTANTS FOR NHAI PROJECTS

CEAI has been collaborating with NHAI & MoRTH for a number of years to streamline the process of engagement of consultants for their projects and take steps to prevent fraudulent use of CVs.

CEAI has again written to NHAI/MORTH requesting them to get a thorough, impartial and time bound inquiry conducted into this matter, so as to convey the message that award of Consultancy Services will only be on the basis of merit and correct technical weightage and not subject to any manipulation, whatsoever.

CEAI also suggested that a system be adopted whereby the bids are submitted in a transparent manner having all the required information, to enable the NHAI team do the evaluation in the correct perspective.

CEAI OUTREACH

CEAI continues to expand its outreach by way of providing support to other professional events and promoting its own, to reach out to new members. One such event is: ➢ India Smart Grid Forum - 4th Edition of India Smart Grid Week (ISGW 2018), International Conference and Exhibition on Smart Grids and Smart Cities, scheduled from

OFFICIAL LAUNCH OF THE 2017 FIDIC SUITE OF CONTRACTS IN LONDON

FIDIC Contracts Committee has updated the FIDIC 1999 Contract documents (Red Book, Yellow Book and Silver Book) and the Second Edition 2017 of each of these three FIDIC contracts was launched at FIDIC Internal Contract Users’ Conference held at London on 5-6 December 2017.

FIDIC YPMTP 2018 - THE ONLINE SESSIONS

FIDIC YPMTP 2018 starts on 5th of February 2018 with 7 months of online sessions where different ideas based on real life cases are discussed. Lectures by the YPMTP mentors are presented as well.

On a monthly basis, participants meet in an online 1-2 hours classroom and present their findings and conclusions about the case work. The average time input of the programme is approximately 100 hours.

The discussions take place on a chat like platform. All discussions, lectures and classroom sessions are recorded and saved, and may be accessed at any time during the course.

A Certificate of Successful Completion is related to the online part only and requires the participant having responded to all case questions and attended at least half the sessions. A Certificate of Participation requires that he/she should have contributed to at least half the case discussions and attended at least half the sessions.

The Conference Session

The final 5-day session involves further lectures and discussions with Mentors and among the students. Intercultural exchange based on some

30 nationalities getting together and representing a variety of approaches to the discussed management issues. An important element is that networking becomes the basis for future international cooperation as consultants.

The final assignment is a plenary presentation at the FIDIC conference of the teams’ perception of their challenges as future leaders in the consulting industry: The Future Leaders Workshop.

International Networking

Almost 60 countries have participated in the course since 2004, linking up in the FIDIC Young Professionals Forum.

Optional Exam

The YPMTP offers an optional exam based on a multiple choice test. This takes place at the conference session. Passing the exam will provide a Certificate enabling them to claim educational points in relation to any required professional accreditation.

VIEW POINT – MARCH ISSUE

The December issue of the View Point has been circulated to all members and relevant organisations including the Government, public and private sector in the first week of January 2018. This issue was on the topic ‘Railways & Metros – Safety, Signalling & Telecommunication’.

The next issue of the View Point will be published by end March 2018. The theme for this issue will be ‘Environment & Climate Change.’

Considering the experience in the subject of CEAI members, CEAI would be happy to receive articles on the above theme.

The articles for the December 2017 issue of VIEWPOINT need to reach CEAI by 15th February 2018. Articles need to be in Times New Roman 12 with single line spacing and of no more than five pages.

Authors could share their views, practical difficulties experienced and suggest solutions. Photographs may be added in the articles for better appreciation of the issues encountered and addressed.
