THESECRETARYOFDEFENSE

SUBJECT:DrawdownPursuanttoSection552(c)(2)oftheForeignAssistanceActof1961,asAmended,ofupto$25MillioninCommoditiesandServicesfromanyAgencyoftheUnitedStatesGovernmentforLibyanGroups,suchastheTransitionalNationalCouncil,toSupportEffortstoProtectCiviliansandCivilian-PopulatedAreasUnderThreatofAttackinLibya

PursuanttotheauthorityvestedinmeasPresidentbysection552(c)(2)oftheForeignAssistanceActof1961,asamended,22U.S.C.2348a(FAA),Ihereby

determinethat:

(1)asaresultofanunforeseenemergency,theprovisionofassistanceunderChapterSixofPartIIoftheFAAinamountsinexcessoffundsotherwiseavailableforsuchassistanceisimportanttothenationalinterestsoftheUnitedStates;and

(2)suchunforeseenemergencyrequirestheimmediateprovisionofassistanceunderChapterSixofPartIIoftheFAA.

Ithereforedirectthedrawdownofupto$25millioninnonlethalcommoditiesandservicesfromtheinventoryandresourcesofanyagencyoftheUnitedStatesGovernmenttosupportkeyU.S.GovernmentpartnerssuchastheTransitionalNationalCouncilineffortstoprotectciviliansandcivilianpopulatedareasunderthreatofattackinLibya.

TheSecretaryofStateisauthorizedanddirectedtoreportthisdeterminationtotheCongress,arrangeforitspublicationintheFederalRegister,andcoordinatetheimplementationofthisdrawdown.
