In accordance with the decision of the Oban, Lorn & The Isles Area Committee on 10th January 2007, a site inspection meeting was held in regard to planning application reference 06/01604/VARCON – Deletion of Conditions 2 and 4 from consent 05/01708/DET units 1 and 2 – remove 6 month occupancy and north elevation windows obscurity – The Garage, Breadalbane Street, Oban. The Chairman outlined to those present the procedure that would be followed and invited Mr Ian McIntyre to address the meeting. Mr Ian MacIntyre outlined to those present the details of the application, as set out in the report by the Head of Planning dated 5th December 2006, and concluded by recommending that this application be refused for the reasons set out in the aforesaid report. Ms Cameron expressed the view that given the distance between the subject building and the neighbouring property there is no material ‘overlooking’ issue. In any event the windows on the north side of the property overlook ground space only. She pointed out that the subject units are for let in the same way as housing association properties, and that the condition restricting occupancy to no more than 6 months in any calendar year is illogical. The properties are built to a high standard and more suitable for letting by people in a stable occupation. Each unit has a floor space of 42 sq mtrs and has an amenity space of 75 sq mtrs. In response to a question from Councillor Macaskill, Ms Cameron advised that the point in altering the existing glazed windows would be to provide a much more pleasant outlook.

In response to a question from Councillor Sidney MacDougall, Mr Ian MacIntyre advised that the minimum distance sought between directly opposing windows of neighbouring properties is 18 metres, which is, in fact, the distance between the subject property and the neighbouring property. Councillor Macaskill asked if the application had been advertised and whether the neighbours were aware of this application for variation of conditions. Mr Ian MacIntyre advised that no advertisement was required. Ms Cameron stated that she had been advised by the planning office that no neighbour notification was required in this case. Mr Ian MacIntyre stated that Ms Cameron had been misinformed, and that neighbour notification is indeed required. Decision: It was agreed to continue consideration of this application pending (a) the outcome of the formal neighbour notification process; and (b) clarification regarding why a 6 months occupancy condition had been applied rather than the standard 3 months. 25th January 2007
