Trauma and life changing events are invariably associated with psychiatric sequelae. Such claims remain subject to high and sometimes complex legal thresholds. Our talk will cover the hurdles for bringing a claim and also provide you with some working examples of how we have helped claimants with such injuries which are all too often misunderstood.

Neurologists frequently encounter patients with neurological symptoms (weakness, seizure-like episodes, cognitive disturbance, pain and other sensory disturbance) where clinical assessment demonstrates that the symptoms are incompatible with a neurological disease process. In essence, the basic “wiring” of the nervous system appears normal, but the person seems unable to get it to work for them. This common clinical situation occupies a very grey area between neurology and psychiatry and raises complex issues, particularly in a medicolegal context, about feigning of illness. Professor Edwards will discuss current scientific evidence and clinical practice in this area.

Professor Mark Edwards, Professor of Neurology, St George’s, University of London

In this presentation Dr Turner will discuss the issues facing psychiatrists “on the ground” and having to deal with patients in an in-patient setting be they formally detained or voluntary patients. In particular he will look at the complex decisions that have to be made as to whether or not someone’s liberty should be taken away (detain them), how to medicate them, levels of observation and treatment monitoring, issues of diagnosis and treatment as well as more practical matters such as ward design and fittings (ie windows, doors, ligation points) and the experience of the staff, all of which are key factors in most inpatient suicides. Mark Bowman will then highlight what is necessary to succeed with an inpatient suicide claim and summarise some of the key cases in this area. He will provide further examples of cases drawn from his own experience and the available literature to ask the audience’s opinion as to whether or not such treatment was negligent or acceptable and provide tips for those involved with the treatment of inpatient psychiatric patients on how to prevent negligence cases from being brought.

Jennifer Buchanan Associate, Fieldfisher

Jenny is an associate working exclusively in the field of claimant high value catastrophic personal injury and fatal accident claims. She also holds a masters in biomedical sciences. She has an extensive and varied caseload alongside assisting Jill Greenfield in her reputable practice of complex and high value cases. Her experience includes undertaking claims for clients injured on the roads, in the workplace and in public places. At Fieldfisher, as part of the personal injury team, she is very conscious to ensure the injured person receives timely appropriate care and treatment and aims to make the claims process as easy as possible. Jenny is also a keen cyclist both on the road and track, racing for Elitecycling RT based in South East London. As such, she have developed a particular interest in and has strong expertise and passion for cycling claims and sports injuries alongside campaigning to make London’s roads a safer place.

Jill GreenfieldPartner and Head of the Catastrophic Injury Department, Fieldfisher

Jill is a partner at London law firm Fieldfisher and heads up the specialist catastrophic personal injury unit. Jill is recognised by Headway and the Spinal Injuries Association as a Specialist Injury Lawyer. In the legal directories (Chambers/Legal 500) she is recognised as a leader in the field. Jill is also a member of the Association of Personal Injury lawyers (APIL) and is a committee member of Headway North London.

She is committed to achieving excellent results for her clients, ensuring the right type of essential care and support is provided; rehabilitation is a real focus. Her cases are generally worth several million pounds and are usually the result of road traffic accidents, occupiers liability claims or accidents at work. She is currently the lead solicitor in the 2009 Godstone Farm outbreak, acting for over 30 children who were exposed to E Coli 0157, some of which now suffer lifelong risks of renal failure.

Alongside her main practice she has a successfully campaigned for victims of terrorist atrocities such as Sharm-el Sheik, Kusadasi, Bali and Mumbai. She was one of the key lawyers who persuaded the Government to introduce a Scheme to Support British Victims of Terrorism abroad, providing financial support for such victims where previously none had been available. She also obtained the highest award for damages for pain and suffering through the civil courts for a victim of rape.

Jill’s cases have regularly hit the headlines and she has appeared on BBC News, ITV, Channel 4, Sky News, BBC Radio 4, Trevor McDonald Tonight, Fiona Bruce, Real Lives and has been quoted in various broadsheets.

Dr Mark SalterConsultant Psychiatrist, East London NHS Foundation Trust

Dr Salter qualified in East London in 1983 and after two years working at junior level as an anaesthetist he began training as a psychiatrist, obtaining his MRCPsych in 1989. In 1994 he became a Consultant in Adult General Psychiatry at St Bartholomew’s and the Homerton Hospitals in London and, apart from a one-year sabbatical working in the Marlborough Sounds, New Zealand, has remained in this post to the present.

Dr Salter is presently responsible for the provision of adult general psychiatric care to a deprived inner city area which is extremely varied in terms of psychopathology and socio-cultural make-up. His day-to-day work routinely brings him into clinical contact with psychiatric disorders including depression, schizophrenia, PTSD and organic cerebral syndromes. Dr Salters professional areas of special interests include the ethics of psychiatry, the psychopathology of trauma, substance misuse and community care.

Because of his interests in ethics, mental illness and trauma, he has for the past 18 years run a fortnightly medico-legal clinic in parallel to his Adult General practice. This work has dealt with diverse topics of testamentary capacity, issues of causation in post traumatic stress and other reactive disorders, unexplained pain and other ‘physical’ conditions, as well as disorders such as psychotic illnesses, substance misuse and personality disorders.

Dr Salter has an interest in the media representation of psychiatric illness and the role of serious incident enquires in the management of homicides and suicides committed by the mentally ill. He is an adviser to the Mental Health Charity MIND and the Jewish Association for Mentally Ill (JAMI). Dr Salter has published numerous articles and letters in the field of substance misuse, schizophrenia, risk and untowardness, mental health legislation and community psychiatry. In 2008, he published Outdoor Psychiatry, an innovative handbook on community psychiatric care.

In addition to his clinical work, Dr Salter is committed to public education in order to improve understanding of complexities surrounding mental illness. He has worked on many radio and television programmes on BBC, ITV and Channel 4 and has also helped with many theatrical performances. Earlier this year he helped the Royal Ballet Company to produce a modern reworking of the Greek myth of Cassandra, as an honest and contemporary depiction of manic-depressive disorder.

Dr Tomas Campbell DClinPsy, PgDip, CPsychol, CSci, AFBPsSConsultant Clinical Psychologist, Re:Cognition Health

Dr Campbell has been a Consultant Clinical Psychologist since 1994 in the NHS. He has extensive experience of working with clients with long-term health conditions including diabetes, cancer and heart disease. More recently, he has specialised in brain injury and has established innovative rehabilitation interventions for those affected and their families. He has published extensively and is the author of more than 20 published papers. He has an interest in family based psychotherapeutic interventions and trained in a brief psychodynamic intervention (Dynamic Interpersonal Therapy).

Professor Iain Hutchison is an Oral & Maxillofacial Surgeon at Barts specialising in Head & Neck Cancer resection and the reconstruction of patients with severe facial deficits following the removal of cancers, traumatic damage or birth defects.

He wants to demystify medicine by improving public knowledge.

• He funded the counter-intuitive Saving Faces Art project charting the physical and emotional journey of patients undergoing facial surgery. This has had a dramatic effect on the public and proved cathartic for the patients who participated. These paintings are freely available for exhibition and continue to tour the world.• He funds and organises free public events to demystify scientific topics such as face transplantation and tissue engineering.• He has set up an “Expert Patient” support group for people starting treatment. • He is a Vice President of the Patients’ Association.

He wants to improve patient treatment into the future by leading international clinical studies. • He founded and runs Saving Faces-The Facial Surgery Research Foundation (www.savingfaces. co.uk) which leads international multi-centre collaborative clinical trials on oral and facial disease and injury prevention and treatment. • He wants to speed up the diagnosis of patients with the most socially debilitating of cancers (mouth, face and throat) so Saving Faces now runs an electronic diagnosis and triage service in the UK for GPs and Dentists so that their patients with cancer can be seen urgently by their local specialist and the “worried well” can be rapidly reassured that they don’t have cancer. This is called SFDADS.• He directs the world’s first National Facial Oral and Oculoplastic Research Centre (NFORC) which is totally funded by Saving Faces. NFORC will revolutionise the treatment for all patients with facial diseases, deformity and injury worldwide by determining best treatment practice through its research. • He is encouraging surgeons to introduce clinical research into their day-to-day practice. He wants to inspire and train the doctors of the future:

• He funds and trains research assistants, PhD students and surgeons in clinical research and has set up a tissue bank for future basic science studies.

Glenn Mead, BA, BSc, MBA, MSc, MBPsSDirector of Corporate Programmes, Chimp Management Ltd

Glenn leads the Corporate Programme Directorate, which helps to improve performance and bring about change in an organisational setting.

With a background in organisational psychology, resilience and executive coaching, Glenn both designs and delivers talks and workshops for groups ranging in size from start-up teams to multinational corporations, as well as conducting 1:1 mentoring sessions at all levels for clients from a wide range of industry sectors. His work ranges from that with blue-chip organisations and household names in financial services, telecoms, manufacturing and retail to healthcare, local government, higher education and emergency services.

Glenn has over 20 years of operational management experience. He has honours degrees in Russian and German. In 1990 he graduated from the Royal Military Academy, Sandhurst as a commissioned officer and joined an infantry battalion, serving on operations in Northern Ireland and Bosnia-Herzegovina. During his time in the Army, he planned and led the first ever British Army expedition to Siberia, crossing the frozen Lake Baikal on quad bikes.

Since leaving the services, Glenn has held successful operational management roles, including in Ernst & Young and Accenture, where his interest in personal and team performance led him to complete diplomas in executive coaching and leadership development, as well as in MSc in Occupational Psychology and an MBA.

Glenn’s ‘leisure’ interests include running mountain marathons and hill-walking. He has completed the UK Original Mountain Marathon five times in as many years, and his longest achievement was the human-powered Iditarod 100-mile winter race in Alaska in 2000.

Dr Trevor TurnerHonorary Consultant Psychiatrist, East London NHS Foundation Trust

Dr Turner has been a General Adult Consultant (and now Honorary Consultant) in East London since 1987, having trained at Barts and The Maudsley. His MD thesis was a diagnostic analysis of Victorian casebooks, and his interests include the History of Psychiatry, Community Care, and the treatment of psychoses and anxiety-based conditions. He has been a Medical Director and Clinical Director, has published over 90 peer-reviewed papers, and has chaired the North Thames and then the London divisions of the College. He was Vice-President 2004-6, has been on numerous College and Trust committees, and has been a clinical adviser to both Homicide and Suicide Inquiries. He is a GMC Assessor, is the author of 5 books, and since semi-retirement in 2013 has been working independently in medico-legal practice, with a particular interest in providing reports for the NHS Litigation Authority. Outside interests include cinema, opera, history, football and doing nothing.

Mark BowmanPartner, Medical Negligence & Personal Injury, Fieldfisher

Mark joined Fieldfisher as a trainee in 2003 and was promoted to Partner in 2013. He successfully pursues personal injury claims and medical negligence claims on behalf of victims and their families.

His medical negligence practice is wide ranging and includes birth injury, surgical negligence and delay in diagnosis claims. He also has a particular interest and specialty in psychiatric suicide claims. His personal injury speciality is catastrophic injury cases and in particular road traffic accidents and accidents at work. Mark has recently secured the right to anonymity for Claimants who are protected parties or children in personal injury or medical negligence cases, in the landmark Court of Appeal case of JxMx. Mark’s cases are regularly reported in the national and regional press, including his claims involving a successful banker at HSBC who committed suicide whilst under the care of Oxleas NHS Foundation Trust and a teenage boy under the care of the Priory Hospital. Mark is a member of AvMA and the Law Society Clinical Negligence Panel.

His recent cases include awards of £10.6 million and £9.6 million for two children born with cerebral palsy, £5.5 million for a victim of child abuse, over £3 million for a motorcyclist who suffered major brain and orthopaedic injuries following a road traffic accident, £3 million for a young man who required an above knee amputation following an accident in a forklift truck at work, and over £2 million for a young woman who as a pillion passenger on a motorcycle, was thrown from the motorbike and required specialist osseointegration surgery following an above knee amputation of her leg.

The legal directories say he is “tireless in his patience with clients, who also admire how he lives and breathes a case” that he is a “tough negotiator” and that “it is wonderful to be instructed by him.”

Professor Mark EdwardsProfessor of Neurology, St George’s, University of London

Mark Edwards is Professor of Neurology at St George’s, University of London and St George’s Hospital. He has a specialist clinical and research interest in Movement Disorders and in neurophysiological and psychophysical methods for exploring their pathophysiology. He did his PhD at the UCL Institute of Neurology and was then a Senior Lecturer and Honorary Consultant Neurologist at UCL and the National Hospital for Neurology. Here he built up a specific interest in functional neurological symptoms and developed an NIHR funded research program and specialist clinical diagnostic and treatment service for patients with functional movement disorders. With his recent move to St George’s Hospital he plans to expand this clinical and research program, setting up the first integrated diagnostic and treatment service for functional neurological disorder while continuing research work in the pathophysiology and treatment of movement disorders in general.
