THE TIMES OF INDIA, AHMEDABADTUESDAY, DECEMBER 7, 20104 TIMES CITY

Ahmedabad: Gujarat high court(HC) on Monday permitted the Su-preme Court-appointed special in-vestigation team (SIT) to recordvoice samples of Naroda Gam caseaccused, Babu Bajrangi and Jai-deep Patel.

Setting aside an order passedearlier by a special court hearingthe riots case, Justice MR Shah al-lowed the state government’s andSIT’s application to collect voicesamples of the accused persons,

who were seen in tapes of Oper-ation Kalank in 2007, making extra-judicial confession to the crime.

SIT’s special prosecutor, AjayChoksi sought the samples to be re-corded at the All India Radio. Afterthe voice recording, the samplesare to be sent to the Forensic Sci-ence Laboratory (FSL) at Jaipurfor the purpose of comparison andanalysis. The tapes of the sting op-eration were also verified by theJaipur FSL, when CBI had probedinto the authenticity of the videorecording.

On March 4 this year, while re-fusing SIT to collect voice samples,

vestigation, but of the court. Moreover, the trial court men-

tioned that legislature has provi-sion for only specimen signatureand handwriting. Hence the courtcannot invoke Section 311-A ofCrPC because there is no referenceto voice sample in the amended leg-islation.

Interestingly, two courts hear-ing SIT cases — Gulbarg Societymassacre case and the Naroda Pa-tia case — had permitted the probeagency to collect voice samples ofthe accused.

SH Vora, a special judge hearingNaroda Gam case, observed thatthe Indian Evidence Act and theCriminal Procedure Code have no“expressed and specific provision”for directing an accused to givevoice sample for comparison.

The lower court also observedthat by collecting voice samples,SIT was not going to bring freshevidence on record because thevoices have already been recordedduring the sting operation. Andcomparing voice samples or hand-writing is not a subject of police in-

Thiruvananthapuram/Ahme-dabad: Retired Gujarat DGP R BSreekumar alleged that Special Investigation Team headed byex-CBI chief RK Raghavan prob-ing Gujarat riots has actually functioned as a team ‘B’ of Gujaratpolice.

“None of the evidence provid-ed by me have been considered by the SIT for reasons best knownto them,” Sreekumar said at ameet-the-press organised by PressClub in Thiruvananthapuram onMonday.

Reacting to reports that SIThad given a clean chit to Gujaratchief minister Narendra Modi inthe riots cases, Sreekumar said hehad given 35 pages of evidence toSIT on what happened in Gujaratduring the 2002 riots, which wereignored. He is consulting lawyers

about the possibility of movingSupreme Court.

In a letter submitted to Ragha-van, just before the SIT status re-port on the complaint filed by Za-kia Jafri was leaked out,Sreekumar pointed out the veraci-ty of the evidence provided in hissix affidavits to the Nanavati-Meh-ta commission, which was alsosubmitted to the SIT. Jafri had fileda complaint against Modi and 62others, blaming them of omissionand commission during the riots.

Reacting to the SIT holding for-mer minister of state for homeGordhan Zadaphia, retired ADGPMK Tandon and IGP PB Gondiaguilty in this inquiry, Sreekumartold TOI over the phone, “This is aclear move to assuage the feelingsof Mrs Jafri and saving Mr Modiand co in the conspiracy case.” Ac-cording to him, Zadaphia is a per-

sona non grata as far as Modi isconcerned. “He did not play anyrole in the parading of Godhra car-nage victims’ bodies in Ahmeda-bad,” he said.

Sreekumar’s affidavits con-tain evidence in the form of a di-ary which he kept when he wasstate intelligence chief, recordinghow illegal orders were given tohim by bureaucrats in Modi’s gov-ernment. The note to SIT chief, hasa point-by-point argument againstwhat Sreekumar says was a cam-paign by ‘advocates of the stategovernment and accused personsin the Jafri complaint to denigratethe veracity of my evidence andmalign me’. He also refers to the‘cajoling and intimidating’ by thethen undersecretary (home) Di-nesh Kapadia and secretary(home) GC Murmu, to suppress in-formation before the commission.

Ahmedabad: An accused in the Soh-rabuddin Sheikh fake encountercase, N K Amin, on Monday soughtone more adjournment from thecourt in the proceedings on his appli-cation to turn an approver and seek-ing pardon.

Interestingly, the investigatingagency did not take any objection toAmin’s request. Following this, addi-tional chief judicial magistrate A YDave kept the hearing on Amin’s pleaon December 18. Amin sought timefrom the court to study CBI’s statusreport filed in the Supreme Court andto collect necessary documents.

Amin, who was arrested in 2007 inthis controversial case, was chargedwith destruction of evidence by theearlier probe agency, CID (crime). Hewas booked under Section 201 of IPC.When Gujarat police was investigat-

ing, police inspector V A Rathodnamed Amin in his statement. Aminled the legal battle against the probeagency’s move to make Rathod a wit-ness. Ultimately, Gujarat high courthad to decide the issue and Rathodwas made an accused, taking the tallyof the accused cops to 14.

However, when investigation wastransferred to CBI, the new probeagency levelled charges of conspir-acy and murder also against Amin inits charge sheet filed on July 23, andbooked him under Section 302 and120B of IPC.

Just four days after he was ac-cused of murder, Amin moved an ap-plication that he will turn an approv-er and reveal the hitherto notdisclosed details of the case. CBI, too,has been eager to know how Kauserbiwas killed, and informed the courtthat it has no objection if Amin is par-doned.

Ahmedabad: The way for-ward for a city in today’s glob-alised world is by making abrand out of it. And this is pos-sible only when its citizens col-laborate and participate ingovernance issues, said chiefminister Narendra Modi at theinaugural session of the three-day brainstorming session forthe newly-elected municipalcouncilors of Ahmedabad Mu-nicipal Corporation (AMC).

Modi pointed towards Chi-na which took every visitor toShanghai, instilling a gloriousimage of the country as awhole. “If China can think ofsuch strategies why can’t weplan something for our four ci-ties in Gujarat? After spendingmany years in politics, I havefelt that it is difficult to takeprogressive strides if one re-stricts vision for a city or thestate to just the number of

votes they gain.”Cleanliness and a slum-

free city were keys to shapingAhmedabad’s image, Modi in-sisted. “It’s pleasing to noticethat the same Amdavadi whomay throw garbage outside onthe main roads or spit in cor-ners, holds back those urgeswhen once inside the Kanka-ria lake premises. The lake isan experiment which willshow Amdavadis that cleanli-ness is on their conscience andthe habit should be allowed toexpress itself in a person’s im-mediate living or work envi-ronment.”

Modi even indicated that aspecial body of individualsshould be formed to help thecity think collectively. “Thecity largely owes it to millworkers who made this city. Itis one of the few cities in thecountry which is formed ofpeople who had come here insearch of opportunities.”
