REPORT OF BUSINESS CONDUCTED

Announcements: The President of Council announced Council decided more time was needed to understand and discuss the homelessness issue in the City by way of a Work Session.

The Ward 5 Councilor announced she feels the issue is enforcing city laws and ordinances. She agrees the City has many great agencies and trained professionals tackling services for those seeking help. She proposes greater police presence in North and South Parks and the connecting Downtown Corridor and walking the police dog along this route. Enforcing the city and park rules will send the firm message needed and anticipates this will be the outcome of tonight’s meeting.

The Ward 4 Councilor agreed with the Ward 5 Council and asked the panel to highlight their services and the referral processes. She requested the agencies dispel the misinformation shared during other meetings.

Panel Discussion on Homelessness

• The City Manager thanked Council for allowing him to organize the panel of localagencies. The agencies in attendance included Signature Health, who originally couldnot attend the meeting and represent a team of agencies in Ashtabula County. Heasked each agency to describe the services they offer, the challenges they face whiledelivering their services to those in need, and what City Council and Administration cando to assist the agencies. He said this work session will be the first of many and part ofthe group on which he would like to rely.

• Jill Valentic thanked the City Manager and City Council for the opportunity to speakabout homelessness. She also thanked Chief Stell and his officers, and Chief Gruber andSteve Chase from the Ashtabula Fire Department for their efforts helping the needs ofthe community and referring those in need to the agency services. Catholic Charities islocated on the third floor of the First Commonwealth Building, 4200 Park Avenue. Theyare open 9:00 a.m. to 5:00 p.m. Monday through Friday. “We’ve been providing help,creating hope for Ashtabula County since 1944. This is nothing new for us.” CatholicCharities works under the Diocese of Youngstown and Bishop Bonnar. Catholictranslated from Latin means “universal” meaning all are welcome, persons seekingservices need not be Catholic. Catholic Charities serves the people of Ashtabula Countyin three ways: 1. Protective services, through their representative payee program andguardianship program, 2. Educational services, “Getting Ahead” program, financialliteracy, school-based risk avoidance classes, “Opening Doors” parenting class, and 3.Basic Needs assistance to provide rent, mortgage, and utilities assistance, purchasinghousehold supplies and prescriptions. They serve unhoused and people at risk ofhomelessness. Depending on client needs, short-term and long-term funding isavailable. The staff works with people in need on an individual basis. They referinternally within their agency but also team with the other community organizationsdaily. Catholic Charities is a HUD-certified agency, meaning they are able to providecomprehensive housing counseling for foreclosure, pre-purchasing, rental, andhomeless assistance. Catholic Charities is part of the Ashtabula County HousingContinuum of Care, made up housing and social service providers. They meet everyother month at the Ashtabula County Mental Health and Recovery Services Board todiscuss the status of housing and homeless assistance. Ashtabula County is required tohave a coordinated system and Catholic Charities is one of four access points in thecounty for all individuals at risk or experiencing homelessness and in need of shelter.They assess individuals to determine the cause of the situation but must follow thefederal definition of “homelessness”. Catholic Charities takes part in a “Point in Time”count assessing the homeless situation one night every year in January. The AshtabulaCounty Housing Continuum of Care holds monthly prioritization meetings, discussingindividuals who entered into any of the four access points. They also meet weekly todiscuss current needs and funding available, so services aren’t duplicated.Confidentiality is a one of their core principles when dealing with clients. At CatholicCharities, clients are treated as individuals and each client has individual needs. Every

client is served differently and has the right to control their own situation. Clients cannot be required to accept agency services. Ms. Valentic says the challenges Catholic Charities face include safe and affordable housing, predatory lending, lack of supportive family and friends, and funding. She asks to trust in their abilities as service providers, refer to the four access points (Catholic Charities, Samaritan House, Ashtabula County Community Action Agency, and for veterans only, Frontline Services), communicate needs and gaps to the Ashtabula County Housing Continuum of Care, attend and be involved in the meetings, encourage the unhoused to seek out the local agencies, help educate the community to see unhoused people as fellow humans, and decrease the stigma.

• Steve Sargent explained Samaritan House is the only homeless shelter in AshtabulaCounty. In existence since 1989, they have served over 6,000 people, most of whomwere Ashtabula County residents. During normal years, Samaritan House has room for14 people, but due to COVID it has been reduced, though hotels have been used to fillthe gap when needed. In the early years, people seeking help from Samaritan Househad their needs met, but Mr. Sargent said now, people in need have a multitude ofcomplex problems. The biggest challenge is getting those individuals who need theservices of all the agencies to cooperate with them for assistance. He reiterated much ofMs. Valentic’s information but added they normally conduct a summer or fall “Point inTime” count and often pass out information on agency services and offer assistance inthe remote areas some homeless are known to congregate. The biggest challengeremains prompting the individual with following through on seeking assistance from anyor all of the partner agencies. Samaritan House is open every day and does have certainrestrictions, but they are still able to offer not only shelter, but good food, clean andsafe living space. Samaritan House has produced tremendous success stories and thoseindividuals have gone on to be caring and contributing citizens to this community. Mr.Sargent said he loves what he does with Samaritan House and the people of the City aresome of the biggest supporters of Samaritan House. They have tremendouscooperation from the Ashtabula Police and Fire Departments. “I know we can neverhelp everyone. I know, I received that a long time ago. But I do believe, with the help ofthe people that are in this room, somehow we can make a better impact and a biggerimpact than we already have.”

• Kim Goats described her role when it comes to homeless individuals is from the mentalhealth position. Community Counseling Center serves youth and adults struggling withmental health and substance abuse issues by providing psychiatrists, therapists, casemanagers who assist with environmental needs, employment specialists, and peersupport staff. Ms. Goats supervises the adult mental health department and the AccessClinic. Community Counseling Center often receive calls from individuals experiencinghomelessness. The Access Team assists by gathering information to understand thescope of the individual’s situation. “By the time they get to us, homelessness is just themost recent thing that’s happened.” Many of the behaviors exhibiting mental healthsymptoms can be severe and are not palatable behaviors to people unfamiliar with theprofession. Community Counseling Center’s role is to partner with the individual tomanage the mental health issues and recovery and coordinate with the four accesspoints. Individuals must explain and repeat their story to each agency to receiveresources. Case managers support the individual by helping with those repetitive steps.It is difficult to stay in contact with homeless individuals, as they may not have a reliable

phone, and may not be found in the same place. “We try to walk the walk with them.” Community Counseling Center does not provide financial resources but guides the individuals through the paperwork and processes.

• Carmen Kuula said the Ashtabula County Community Action Agency (ACCAA) is aprivate, non-profit social service agency and not a government entity. They werecreated as part of President Lyndon B. Johnson’s “War on Poverty” and their mission isto help people achieve self-sufficiency and rise above issues of poverty. “More simply,it’s just to help them improve their quality of life and to make positive progressforward.” ACCAA helps people by identifying goals and what success looks like forthem. Programs include WIC Nutrition Program, Head Start, home visits, senior homedelivered meals, senior dining and home maker program, weatherization, home energyand utility assistance, Dragon Empowerment Center, full audiology and speech services,just to name a few.

• Alissa Holdson is Director of Community Development Services department at ACCAAand oversees housing-specific programs. ACCAA is an access point and a part of theContinuum of Care. For people experiencing a housing crisis, the department assesseseach situation, prioritizes needs and coordinates with the other agencies. Ms. Holdsonemphasized how often the agencies work together as a team to provide the bestpossible resources based on the needs of the individual through the coordinated entrysystem. Very rarely do they help a client who isn’t already working with a case managerfrom one of the other agencies. ACCAA offers the New Hope Housing AssistanceProgram for homeless individuals and families which helps with security deposits, rentalassistance, and goal setting. ACCAA focuses on the goal of helping people achieve self-sufficiency. Using the Homeless Management Information System (HMIS), they inputdata collected through the assessments and follow-up by reviewing the cases at themonthly prioritization meetings. Implementing cell phones and text messaging hasbeen “game-changing” in keeping track of clients, though it remains a struggle. In aneffort to help those experiencing housing issues, though may not be homeless, ACCAAuses the CARES Home Relief Program which assists individuals with rent, mortgage andutility arrears which was created due to the coronavirus pandemic. Additional strugglesinclude finding safe and affordable housing, staying in touch with clients, and clients’self-determination and follow-through. Additionally, the 211 information referralprogram is resource available through ACCAA.

• Paul Brickman, one of the founders of Signature Health, has been in Ashtabula for overtwenty years, and six years at the present location on Main Avenue. Signature Health isa friendly, qualified health center, obligated to provide services to everyone includinguninsured and underinsured people. They have over 30 case managers active in thecommunity and supporting the folks coming in the door. Collectively all these agenciesworking together have prevented many people from being homeless. Mr. Brickmanreferenced Father Martin and his movie “Chalk Talks” by saying, “You can lead a horseto water, and you can’t make him drink… but you sure as hell can make him thirsty.”The agencies identify and evaluate the needs of each individual seeking services, but Mr.Brickman asked the question, “How do we make them thirsty enough to come back?”Signature Health works with the police department and court system so those peopletend to follow-through because they have a probation officer. Signature Health alsoprovides primary care. Many of the clients seen have physical problems as well as

problems of the mind. He added they have a security department and security cameras throughout the parking lot. Mr. Brickman invited all to visit Signature Health.

• The City Manager said the situation rose to the level it is now because a vacant structuredowntown was vacated, and access was restricted. Eight to ten people who werestaying there are consequently now in the parks and on Main Avenue. These aren’t theonly people of concern, there are nearly one hundred people living in the Gulf and thoseliving in other vacant structures around the City. The developing idea is to make ituncomfortable for homeless to stay in the park which hopefully encourages them tomake a call for help to an agency.

• Chief Stell said the game plan for many years has been to cooperate with all of theseagencies. The problem at hand has many layers and is not simply a police force, socialservices, or housing matter. The enforcement issue has been discussed many timeswith the City Solicitor. Removing people from a public space, in the parks, violates theirrights and could lead to civil lawsuits. Chief Stell is adhering to the City Solicitors legalcounsel. Some City Ordinances can be followed and if a police officer witnesses illegalactivity, the laws can be enforced. Some police action in the parks has been under coverdue to drug complaints in the park. They have witnessed low-level activity and madesome arrests. Resources are better utilized for larger drug busts. Chief Stell explainedbecause of COVID, staff levels are just now getting back to normal. Typically, three tofour patrol officers are on the road at any given time to serve a community of roughly19,000 people. Last month, APD received 1600 calls for service, not including theundercover narcotics unit and officers assisting situations on their own. The APDreceives a lot of calls for service, which take precedence over anything else. Domesticsituations, motor vehicle accidents, violent crimes as well as citizen complaints andneighbor disputes are the majority of calls. Chief Stell has been able to increase patrol inthe parks five to eight times each day and a few times during the night since there is anordinance prohibiting sleeping in the parks. Moving sleeping people out of the parksresults in complaints they are sleeping elsewhere. Chief Stell says he can chase them outof the park, but they aren’t going to leave Ashtabula. The homeless individuals ChiefStell has spoken with say Ashtabula has the best services for the homeless thananywhere around. There are nine jail cells in the City of Ashtabula and an individual canstay for a maximum of twelve days. Often, APD jail house County prisoners in half ofthose cells. There may be one or two cells open on Friday before the weekend andputting someone in jail for sleeping or urinating in the parks isn’t practical, though theywill issue summons.

• The Ward 4 Councilor hopes to include local treatment facilities, AshtabulaMetropolitan Housing Authority (AMHA) and Beatitude House in subsequentdiscussions. She explained lack of support as a key problem preventing some individualsin need from seeking help. She introduced the idea of hosting pop-up clinics throughoutthe year to serve their needs when groups are congregating.

• Mr. Sargent explained Samaritan House cannot take in an individual if they are a threatto themselves or others. If the police are called and an individual is removed, theycannot come back.

• Ms. Valentic said clients are mainly referred from 211 or another agency. Ms. Holdsonadded referrals come from family members. All the agencies conduct outreach.

• The Ward 1 Councilor asked why some individuals aren’t using the services available inAshtabula. One of the excuses given at a past meeting was they don’t have birth

certificates or social security cards. The Councilor stated in July, St. Vincent de Paul Society on Lake Avenue spent $407 to help people get birth certificates and $210 for ID cards. The Donahoe Center can help people get birth certificates also.

• The City Manager summed up with a vision for moving forward. He asked Jill Valentic toorganize another presentation like she’s given in the past for better understanding ofthe City’s homeless situation and include the agencies represented as well as theAshtabula County Housing Continuum of Care. He plans to continue correcting badbehavior by making things uncomfortable in the parks for immediate action, though thiswill move the problems “down the road”. Ideally, the City Manager wants to get thepeople in need of help in contact with the agencies best suited to their situation. Overtime, housing stock has dropped in the City and the County, so increasing infrastructureshould be part of the discussion. The City Manager, Chief Stell and representatives fromlocal treatment facilities met to discuss and update release and transition policies.

• Miscellaneous public discussion came from Patrick Haywood, Sharon Sholton Hudder,Pete Bean, Pastor Wood, and other unidentified speakers from the City of Ashtabula.

The President announced the meeting adjourned at 8:09 p.m.

Regular Meeting Minutes Tuesday, September 7, 2021

Opening The regular meeting of the ASHTABULA CITY COUNCIL was held in Council Chambers and viewed on the City of Ashtabula website and Facebook page as well as Spectrum channel 1024. The meeting was called to order at 7:00 p.m. by the Council President. The Ward 3 Councilor offered the opening prayer, and the Pledge of Allegiance was recited. A moment of silence was observed for Stanley D. Guerini, a former employee of the Ashtabula Fire Department, who recently passed.

Members Present Ward 3 Councilor – Ms. Laydean Young, Ward 4 Councilor – Ms. Octavia Harris, Ward 5 Councilor – Ms. Jane E. Haines, Ward 2 Councilor – Mr. Calvin Crawford, Council President – Mr. John S. Roskovics

Members Absent Ward 1 Councilor – Mrs. Kym A. Foglio, Council Vice President – Mr. Michael D. Senskey Sunshine Law The Clerk of Council certified conformity to the Ohio Sunshine Law. Presentation The Ward 5 Councilor read RESOLUTION 2021-89 A RESOLUTION HONORING ST. ANGELO-GAGE FURNITURE FOR SERVING THE CITIZENS OF THE CITY OF ASHTABULA FOR 50 YEARS in its entirety and presented a ceremonial copy of the resolution to Frederick and Sandra Gage. Sandra commented, “Fifty years were just wonderful years for us. A lot of work, a lot of headaches, but the best part is, we made so many new friends and wonderful

customers.” The Councilors present approved the resolution by a five to zero voice vote. Approval of Minutes The Clerk of Council presented minutes from the August 16, 2021, Regular Meeting. Ms. Harris moved; Mr. Crawford seconded to waive the reading of the minutes; motion CARRIED. Hearing no corrections, the minutes were approved as presented. City Manager Report and Communications The City Manager formally requested an ordinance to enter into an agreement with Castle Block Properties LLC for a historic conservation easement for property located at 331-341 Center Street, Ashtabula City, Ohio. Ms. Haines moved; Ms. Young seconded to approve the request. Discussion: A historic conservation easement provides protection for the construction project and future building owners that certain interior and exterior historical features will be preserved for the life of the building. The City will conduct inspections to ensure the features are being preserved. Motion CARRIED. The City Manager formally requested an ordinance to enter into an agreement with Utility Truck Equipment, Inc. through the State of Ohio Cooperative Purchasing Program for the purchase of a 2022 Ford F550 Aerial Truck Package for an amount not to exceed $111,077.00. Funding for this purchase will be taken from fund 412. Ms. Haines moved; Ms. Young seconded to approve the request; motion CARRIED. The Council President expressed concern regarding Lake City Plating leaving the City of Ashtabula. The City Manager explained it is not a “done deal”. Clerk of Council Report and Communications The Clerk of Council reminded Council her two-year anniversary as Clerk of Council was September 3, 2021. She has seven and one-half points to collect to achieve the Certified Municipal Clerk designation. Community Development/Economic Development/Parks & Recreation Committee Report and Communications The next meeting is scheduled for Tuesday, September 14, 2021, at 4:00 p.m. in Council Chambers. A representative of the Ashtabula County District Library will update the committee on their programs and events. Finance and Personnel Committee Report and Communications The next meeting is scheduled for Friday, September 17, 2021, at 8:30 a.m. in Council Chambers.

New Business The City Manager invited the public to the Manager’s Cup football game at Lakeside Stadium Friday at 7:00 p.m. where the Lakeside Dragons will host the Geneva Eagles. Tell Us Something We Don’t Know The Ward 5 Councilor congratulated the City for the large turn-out at Bands on the Beach featuring Country Redford. The event was free to the public. The Council President went to see the new Ashtabula County Medical Center (ACMC) Sleep Center and Carterland Candles, both on Lake Avenue. He thanked ACMC for continuing to invest in the City. Carterland Candles will be hosting classes on candle-making and sells decorations as well as candles.

The Ward 3 Councilor thanked those who helped create a successful Charity, Faith, Love Project school give-away event. They passed out 238 filled bookbags. She specifically thanked the Ashtabula City Health Department, Ashtabula County Community Action Agency, Ashtabula City Council, Ashtabula County Commissioners, and the many barbers and stylists who provided free haircuts at back to school event.

Public Discussion/Comments on General Matters Tim Lesperance of East 16th Street and Scott Avenue expressed his concerned about the recent parking ban on the north side of East 16th. Many residents on East 16th don’t have adequate parking in their driveway and are now parking on the south side, which is interfering with those residents. He also reported a large

puddle that doesn’t drain well on Scott Avenue near the vicinity of East 17th. The City Manager will review both situations.

Jodi Mills announced a give-away event at G.O. Community Development Corporation (CDC) for Saturday, October 16th from 10:00 a.m. to 5:00 p.m. Winter boots, coats, gloves, hats and socks, sizes ranging from toddler to adult will be available for those in need. New and slightly new items will be available to give away, and anyone wishing to donate can deliver items to G.O. CDC Monday through Friday from 10:00 a.m. to 2:00 p.m. The Lift Bridge Community Association scheduled a clean-up and fall flower beautification day, Saturday, September 11 from 9:00 to 11:00 a.m. and are welcoming volunteers. Mrs. Mills and her husband attended the Ward 3 block party and said it was a very nice event.

Stephen Kellat asked for community participation with the Ashtabula County Broadband Taskforce project. Input from community members will help the group determine what is needed.

AN ORDINANCE AUTHORIZING THE CITY MANAGER TO PURCHASE TWELVE (12) 2022 FORD UTILITY INTERCEPTORS WITH ALL NECESSARY EQUIPMENT FROM STATEWIDE

FORD LINCOLN, IN AN AMOUNT NOT TO EXCEED $554,088.00 WHEREAS, the daily operations of the City of Ashtabula and the City Manager's Department require the enactment of this legislation; and,

WHEREAS, it is necessary to provide for necessary equipment for the departments of the City in order to promote the health, comfort, safety, convenience, and welfare of the people of the City in accordance with Section 1 of the City Charter;

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Ashtabula, Ohio:

SECTION 1. That the City Manager be, and he is hereby, authorized to enter into a contract to purchase twelve (12) 2022 Ford Utility Interceptors with all necessary equipment from Statewide Ford Lincoln located at 1108 W. Main St. Van Wert, Ohio 45891, in an amount not to exceed $554,088.00 under and in accordance with the State Purchasing Program. Funding for this expenditure will be taken from the Permanent Improvement Fund.

SECTION 3. It is hereby found and determined that all formal actions of this Council concerning and related to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its Committees that resulted in such formal action were in meetings open to the public in compliance with the requirements of Section 10 of the Municipal Charter of the City of Ashtabula, Ohio, and of R. C. Section 121.22.

SECTION 3. For the reasons stated in the preamble, this ordinance, if approved by the votes of five (5) or more members of Council, shall take effect immediately, otherwise 30 days thereafter. WHEREAS, the City Finance Director has recommended that certain supplemental increases and/or decreases to appropriations be made;

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Ashtabula, Ohio:

SECTION 1. That the Council of the City of Ashtabula, State of Ohio, to provide for current and other expenditures for the period January 1 through December 31, 2021, hereby approves the increases and/or reductions as listed in Exhibit “A” attached hereto and incorporated herein by this Ordinance be, and they are hereby set aside and appropriated as a supplemental appropriation to the existing appropriation.

SECTION 2. That the City Finance Director is hereby authorized to draw warrants on the City Treasury for payments from the foregoing supplemental appropriation as authorized by legislation of Council to make appropriations.

SECTION 3. The Clerk of Council is hereby authorized and directed to certify a copy of this Ordinance and appropriations referred to herein and to deliver the same to the Ashtabula County, Ohio Budget Commission forthwith.

SECTION 4. RESOLUTION 2021-94

A RESOLUTION DECLARING THE CITY OF ASHTABULA’S SUPPORT FOR LOCAL CONTROL OF THE LODGE AT GENEVA-ON THE-LAKE, A CONTINUED FUNDING SOURCE FOR MAINTENANCE OF THE LODGE AT GENEVA-ON-THE-LAKE, CONTINUED OPERATION OF THE LODGE AT GENEVA-ON-THE-LAKE BY THE DELAWARE NORTH COMPANIES, INC. AND TRANSPARENT DECISION-MAKING OF THE LODGE AT GENEVA-ON-THE-LAKE WITH STAKEHOLDER INVOLVEMENT

WHEREAS, the Lodge at Geneva-on the-Lake has been under the ownership of Ashtabula County and operated by Delaware North Companies, Inc. since its construction within the Village of Geneva-on-the-Lake, Ohio in 2004; and

WHEREAS, the Ashtabula County Conventions Facility Authority has overseen the Lodge at Geneva-on the-Lake by leading revenue enhancement projects and contributing to its debt service since its construction; and

WHEREAS, the Lodge at Geneva-on the-Lake is a partnership between Ashtabula County and the State of Ohio due to the State of Ohio being without the financial ability to construct a new state park lodge and Ashtabula County being able to finance the construction of the Lodge at Geneva-on-the-Lake for Twenty-Two Million Dollars ($22,000,000.00) in 2004; and

WHEREAS, Ashtabula County’s annual debt service is One Million Three Hundred Thousand Dollars ($1,300,000.00) paid for with revenues from a bed tax, a lodging tax, the Ashtabula County Conventions Facility Authority, the Lodge at Geneva-on-the-Lake, the Village of Geneva-on-the-Lake, the Geneva-on-the-Lake Visitors Bureau, and the Ashtabula County Conventions and Visitors Bureau; and

WHEREAS, the Lodge at Geneva-on-the-Lake’s new attractions, features and amenities continue to help it achieve continuous record-breaking years in revenue and maintain the Lodge at Geneva-on-the-Lake’s average annual revenue growth of Eleven Percent (11%); and

WHEREAS, Delaware North Companies, Inc. has invested several millions of dollars into the Lodge at Geneva-on the-Lake in the form of pool area renovations, twenty-five (25) lakeside cottages, and a zipline course; and

WHEREAS, the Lodge at Geneva-on-the-Lake accounts for more than a Quarter (25%) of the bed tax revenue that funds the Ashtabula County Conventions and Visitors Bureau; and

WHEREAS, the Lodge at Geneva-on the-Lake’s distinctive presence along the shore of Lake Erie is an integral part of Ashtabula County’s attraction of hundreds of thousands of new visitors each year, as well as enhance the appeal and real property values of an area rich in recreational, historical and entertainment offerings throughout Ashtabula County, specifically including the City of Ashtabula;

NOW THEREFORE BE IT RESOLVED by the City Council of the City of Ashtabula, Ohio, as follows:

SECTION 1. That this Council herein declares its desire for the Lodge at Geneva-on-the-Lake to remain under local control of the Ashtabula County Conventions and Facilities Authority in its current capacity.

SECTION 2. That this Council herein declares its desire for the Ashtabula County Conventions and Facilities Authority to continue being funded through revenue generated by the bed tax for continued preservation, maintenance, and revenue enhancement projects for the Lodge at Geneva-on-the-Lake along with promoting tourism throughout Ashtabula County, including the City of Ashtabula.

SECTION 3. That this Council herein declares its desire for the Lodge at Geneva-on-the-Lake is to continue its current contract with Delaware North Companies, Inc. and to approve subsequent renewal periods that have been agreed upon and set.

SECTION 4. That this Council herein declares its desire for decision-making of the future of the Lodge at Geneva-on-the-Lake be conducted with Ashtabula County stakeholders’ involvement in a public and transparent manner.

SECTION 5. That this Council herein declares its support for efforts to eliminate debt as a function of good government.

SECTION 6. It is hereby found and determined that all formal actions of this Council concerning and related to the passage of this Resolution were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its Committees that resulted in such formal action were in meetings open to the public in compliance with the requirements of Section 10 of the Municipal Charter of the City of Ashtabula, Ohio, and of R.C. Section 121.22.

SECTION 7. For the reasons stated in the preamble, this Resolution, if approved by the votes of five (5) or more members of Council, shall take effect immediately, otherwise 30 days thereafter.
