Minority and Women-Owned Business Enterprises Program Overview

The Office is responsible for ensuring that the OGS and its host agencies comply with

the provisions of New York State Executive Law, Article 15A and the rules, regulations

set forth in 5NYCRR, Part 140 – 144 and the Business Diversification Act of 2010.

All Construction Contracts $100,000 or more are reviewed to determine if there are 30%

MWBE subcontracting and/or supplier opportunities.

15% MBE and 15% WBE goals are assigned for this project.

MWBE firms must be certified by the New York State Empire State Development

Service-Disabled Veteran Owned Business Program Overview

• Service-Disabled Veteran Owned Business Act was enacted in May of 2014

• The Act established a 6% state-wide participation goal for Service-Disabled

Veteran-Owned Businesses (SDVOBs)

• Eligible Businesses must be certified by OGS Division of Service-Disabled

Veterans’ Business Development (DSDVBD)

• 260 New York State SDVOBs are certified as of 9/21/16

• Agencies select methods for meeting goal including the use of set-asides

• Pilot roll-out expanding as the number of certified SDVOBs increase

NYS OGS Requirements for Determining GC Vendor Responsibility

If you are a Prime Contractor determined to be the lowest bidder at time of bid opening you will be required to:

Complete the CCA-2 as found on OSC VendRep System within 72 hours of determination of low bid

The CCA-2 is the standard New York State Vendor Responsibility Questionnaire. It is designed for use by State Contracting Entities to obtain necessary disclosures from prospective construction vendors.

OGS Vendor Responsibility Requirements for Subcontractors

• Prime Contractor must submit subcontractors electronically via OGS/Vendor Interface on a BDC329 prior to the sub working per Article 6 of the General Conditions.

• If subcontract is $100,000 or more, sub must complete and certify a CCA-2 questionnaire.

• For VendRep System, all vendors, including subs, must obtain a NYS Vendor ID assigned by OSC.

• All subs on OGS projects are reviewed using Vendor Responsibility “FLIP” review protocol.
