Direction issued by the Commission

The Commission received a complaint dated 25.07.2014 from Shri Praveen Poddar, in which he has alleged that on 22.04.2014 he was mobbed, abused, threatened and confined by Mohd. Afshar Khan, SSE / Drawing alongwith staff / union members in the office of CEE/ NFR Shri B.P. Verma, in Chamber of Dy. CEE/TL/NFR. His request for inquiry and suspension of staff has not been granted by NF Railway. He has also alleged that CEE / Planning / NFR Shri Arjun Kumar issued two highly damaging open letters on 08.05.2014 stating that complainant is suffering from Paranoid disorder despite issuance of fitness certificate by NF Railway Medical Board on 28.06.2013. On 16.05.2014 the Railway Board issued orders for placement of his two batches junior in Selection Grade and denying the same to the complainant for the third year. Vide its proceedings dated 01.12.2014, the Commission called for a report from the concerned authorities. Pursuant to the directions of the Commission, the Additional Director General of Police (L&O), Assam, Ulubari, has submitted his report dated 23.03.2015 alongwith a report dated 21.12.2014 submitted by the Dy. SP, Pandu Division, Jalukbari, Guwahati, in which it is stated that a case Crime No. 393/13 was registered U/S 120-B/341/504 IPC in this connection. The case was investigated thoroughly and in course of investigation the allegations of the case revealed to be a misunderstanding of the departmental disciplinary matter, which is civil in nature. So, the investigation officer submitted a Final Report No. 384 in the Court. The Commission has perused and considered the report. No report has been submitted by the Chairman, Railway Board. Let a reminder be issued to him for submission of his report in the matter within six weeks positively.

Grievance Description : Request for grievance redressal from Cabinet Sectt - Despite grievance DPG/R/2015/50241 dated 22/01/2015 pending with N F Railway and despite non-payment of salary for February 2015 and March 2015, in April 2015, I was nominated for training at CRIS/New Delhi under the approval of AGM/N F Railway Sh D N Jha who is incidentally not competent to approve for training costing more than Rs 15000/-. So accordingly I informed both N F Railway and Railway Board for immediate relief of arranging salary for February 2015 and March 2015. In this regard, relief sought from Cabinet sectt vide RTI appeal CABST/A/2015/60018 dated 31/03/2015 was not agreed vide disposal dated 28/04/2015. Accordingly Deptt of Expenditure was approached. Vide decision dated 05/06/2015 for RTI appeal DOEXP/A/2015/60035 dated 27/05/2015, they referred the matter to Railways. Ignoring all types of criminal harassment faced by complainant and his family, GM/NFR Sh R S Virdi issued Major Penalty charge sheet on 12/06/2015 on the alleged grounds of not proceeding for training. Grievance Description : 1. I am IRSEE/98 Exam Batch Officer working as Deputy Chief Electrical Engineer, Coordination, Northeast Frontier Railway, Maligaon (Guwahati), Assam since 30/08/2012. From 25/01/2012 to 27/08/2012, I worked as Senior Electronic Data Processing Manager, Alipurduar Division, Northeast Frontier Railway. 2. I was issued 10 recorded warnings dated 27/07/2011 by earlier DRM/Alipurduar Sh Anirban Dutta (Presently DRM/Howrah/ER) on the last day of leaving Alipurduar Division. Representation against the warnings was submitted on 27/08/2012 and pursued upto the level of Ministry of Railways. Till date, no response has come despite clear Railway Board Instructions (Railway Board letters No. 2004/V-1/DAR/1/3 dated 16.8.2004 and No. 2005/V-1/DAR/1/3 dated 6-10-2005) regarding disposal of representation against recorded warnings. The warnings, if allowed to persist, may affect my career and reputation. 3. Kindly advise Railway Board (GM/N F Railway) to respond to my representation.

These proceedings shall be read in continuation of the earlier proceedings of the Commission. The previous complaint received from the complainant was disposed of by transmission of the complaint to the authorities concerned for such action as deemed appropriate in the matter. The authorities concerned were also directed to inform the complainant, within 8 weeks, of the action taken in the matter. The complainant, vide his letter dated 17.11.2014 has now again approached the Commission alleging inaction in the matter.
