 What Can I Do?

In the Winter 2010 issue o Poultry Press , wepublished “Black Eagle Farm: Story o anOrganic Egg Scam” ( www.upc-online.org/

pp/winter2010/black_eagle.html). In it we describedthe appalling cruelty to animals revealed at this armin documents obtained by an attorney in the courseo investigating malnourished dogs at Black Eagle, anoperation owned by Dr. Ralph Glatt, a geneticist, inPiney River, Nelson County, Virginia. Located 100miles rom Richmond and 130 miles rom Washington,DC, Black Eagle portrayed itsel as a “traditional amily arm with a long history o treating our animals and theenvironment with respect” and a “sustainable producero USDA organic, animal-riendly natural livestock products.”

Documents obtained by the investigating attorney in 2009 uncovered an absentee owner, unpaidbills, and malnourished dogs, pigs and sheep. Inaddition, “25,000 organic laying hens” had no food,according to Staff Veterinarian for Animal Care andHealth with the Virginia Department of Agricultureand Consumer Services, Daniel Kovich. A visit to Black Eagle on December 16, 2009 by VA staff veterinarian,Rachel Touroo, revealed thousands of unfed hens –“thin to emaciated,” dying and dead birds, who farmpersonnel said had been without food for 7 days inNovember, 5 days at the beginning of December, andfor two full weeks 5 weeks earlier in a forced molting procedure.

Through December 2009, emails went back andforth among the state veterinarians about these birds.Though starving, they didn’t receive emergency rationsuntil 8 days after the investigating attorney’s Complaintagainst Black Eagle was led by the VA Ofce of  Veterinary Services on December 1. (Excerpts fromthese emails can be read in the Winter 2010 Poultry Press .) The veterinarians told each other that no privatepractitioners were available to help the birds and thatindustry vets could not be bothered with smaller-typefarms like Black Eagle. Discussion centered on “depop”– destroying the hens on December 27 and trucking their bodies to a North Carolina rendering company.New hens would be brought to the farm in 2010.

Carbon Dioxide Gassing Procedure:

 m Shut the lights off. Grab the hens by their lethe perches and floor, take them out of the hand stuff them in metal boxes 2 ft. wide x 5fx 3 ft. deep. Put 200-500 hens in each box. five metal boxes in all.

m Stick a rubber hose attached to a CO2 tankthe box and shoot cold CO2 into the box ththe nozzle until the hens op around. The btop burn and suffocate to death from the freCO2.

 m The birds on the bottom of the boxes won’t When the boxes were opened they ran arounand employees whacked them with boards. Oemployee put a bird on the ground and anostruck her with a board like he was hitting abaseball. Ralph Glatt said, “We gotta play b with these chickens?”

 m  After this, if any hens were still alive, “you jutheir heads off. You’re not supposed to trucif they’re still alive.”

 John Dobbs worked for Black Eagle for three anyears. He grew up on a hog farm where he said hcows and “knocked” piglets, but the killing of th was the worst cruelty he ever saw, he told UPC. the metal box-CO2 procedure for depopulatinghens was developed by the caged-layer industry. “I’m a big advocate of banning the boxes. Betterthe whole house at once.”

assing Chickens to Death with Carbon Dioxide

CO2 is used to exterminate poultry ocksecause it is cheap and readily available. CO2 is used inhole-house killings as well as pumped into containersled with smaller groups of birds to destroy them. Thepes of containers include metal boxes, b arrels, sealedumpsters, and Modied Atmosphere Killing carts.

With CO2, the birds experience freezing temperaturesnd painful injury caused by the high pressure jet streamf burning cold gas. In “Killing Poultry on Farmsuring Disease Outbreaks,” animal scientist Mohanaj explains that the liquid CO2 hosed into housesnd containment boxes to kill the chickens producesmperatures as low as -78.5 degrees C. The noise and

ainful temperatures of the liquid gas shooting throughe hose panics the birds, and any bird in the way of thet will experience “severe blow and injury” and being rozen to death.”

PC Visits Black Eagle Farm on June 20, 2011

In June 2011, United Poultry Concerns

ranged to visit Black Eagle Farm with egg-industry usinessman Bob Pike. His business, GCB Foods basedNorth Carolina, markets eggs to retailers (such as

Whole Foods) from Black Eagle and other farms thate said to have met inspection standards. In the casef Black Eagle, “humane” standards are set by Humanearm Animal Care (HFAC), which in 2010 decertiedlack Eagle as a “humane” operation based partly one abuses revealed in the public records obtained by 

attorney Gina Schaecher in 2009. Currently, HFACtold United Poultry Concerns on December 2, 2011,“Black Eagle does not have Humane Farm Animal CareCertication. Black Eagle passed our inspection andat the time of the audit met our standards so they cansell eggs to GCB” (who in turn sells the eggs to retailchains and outlets to be sold to customers as “cage free,”“organic,” or whatever).

For our tour of Black Eagle, we wereaccompanied by Bob Pike, Ralph Glatt, a NelsonCounty Animal Control ofcer, and a farm employee.Of the four units housed in a single building (two “cage-free,” two “organic”), two were said to be empty at thetime of our visit. Each unit is designed to hold 12,500hens making 50,000 hens in all. We viewed a unit

holding 12,500 “organic” brown hens through glass.These hens lled every bit of space on the oor and onthe platforms above the oor. The crowding we saw wastotal. Each hen supposedly gets 1.4 square foot of living space for herself under organic and “humane” standardsfor aviary units, Bob Pike told UPC.

Next we visited the “cage-free” brown hens ina unit holding 9,000 hens including what Bob Pikecalled “salvage” hens diverted from other egg farms inthe process of depopulating their own ocks. Moving “salvage” ocks from one farm to another appears to becommon practice. Since the cage-free unit we visited was 3,500 hens short of its 12,500 hen capacity, thehens we saw and walked among had some space to moveabout on the oor and on the platforms which includedsloping strips of plastic for laying their eggs behind littleapping curtains the length of the building. (Theseplastic strips are what they called “nests.”) On the oor was a thin layer of musty wood chips, and overheadfans were running in the “winter garden,” althoughformer farm employee John Dobbs warned that “when

you visit these places, they’ll be sure to turn the fans onright before your visit.” So we don’t know if the fans ranregularly or not.

The noise of the hens in the cage-free unit wasloud and continuous. It was not the contented clucking of happy chickens. The ongoing volume of vocalizationsin chicken connement buildings is a cruelty in itself,as there is no basis in the natural experience of chickensfor such unremitting noise among themselves. (Hens in

battery cage buildings become dead silent after severalmonths in the cages representing the defeated mentalcondition scientists call Learned Helplessness.)

 A long passageway in the cage-free unit wascalled the winter garden. Separated by glass from thegreen vegetation visible outside, the oor of this area  was covered with hens. (John Dobbs told UPC, “They like the winter garden because they gravitate naturally toward sunlight.”) We petted and talked to these hens,crouched down and gently picked up a few, holding them and trying to impart to their spirits that we caredabout them and were sorry, SORRY. They were a littleshy but mostly friendly and interested, but we had togo. We asked if we could please take some hens back to United Poultry Concerns to live i n our sanctuary,but the answer was No. We would have to leave them

behind except in our memories. How were theseinnocent and defenseless creatures, so young and full of unexpressed life, “depopulated”? Were they gassed in themetal boxes, burned and frozen and kicked around likefootballs? Whatever the means, their death was a badone. Bob Pike informed us their time was almost up.

December 2011

On December 2, UPCtalked with Bob Pike of GCBFoods on the phone. He saidBlack Eagle Farm, also calledPiney River Farms LLC, is “allorganic now.” The farm “growsits own pullets to 16 weeks,then transfers them to the laying facility.” Each of the four unitshas its own “isolated pasturearea” for the hens to go outsidesometimes, as required by the

U.S. Department of Agriculture’sOrganic Standards Program. A company called A Bee Organic inCalifornia is Black Eagle’s organiccertier. When the hens aredepopulated, they go to slaughterfacilities in Pennsylvania,Georgia, and Virginia. Some are“salvage ocks.” They’re truckedto other egg-laying facilities.

Postscript: Virginia Lawmakers Abolish FaAnimal Cruelty Penalties

In February 2011, the Virginia General Assembly quietly passed legislation demoting staanimal cruelty penalties from a Class 1 misdemea Class 4 misdemeanor to “ensure accommodaticustomary farming activities” including withholdfood and water from farmed animals to the poinemaciation and dehydration. An amendment thahave allowed “prosecution of a person for deprivan agricultural animal of necessary food, drink, sor emergency veterinary treatment” was withdra VA Senator McEashin, who proposed it. When learned about the legislation in February, we cona vigorous Internet campaign urging Gov. Robe

McDonnell to veto the bills, but he signed themlaw.

Takes Courage to Support Animals’ Dignity

Animal rights means that other animal speciesave moral claims on us based on their nature asxpressed in their behaviors, including their voices, thatll us who they are and what they desire to do and noto.

 Animal rights means that the claims o otherecies, as ellow creatures with eelings, should becognized in the orm o laws that dene and protecteir interests and provide them with a vicarious voice ine orm o legal representation.

Te science o ethology, which studies animalehavior in natural and contrived settings, has producedcopious amount o literature and audiovisual materialat, added to centuries o anecdotal observation,

rovides ample grounds or according legal rights toonhuman animals.

 As a (non-legal) advocate or animals since the980s and ounder o an organization that promotesompassionate and respectul treatment o chickens andher domestic owl, I’m amiliar with the argumentsat are used to silence opposition to the cruelty 

mposed on birds in arming operations.Ironically, we’re charged with

nthropomorphism” or saying the birds suer,hile simultaneously being told that only “happy”hickens lay tons o eggs and put on mountains o eight in enorced, sedentary connement. In act,ey’re manipulated genetically and by other means to

o abnormal biological things at the expense o theirellbeing.

For example, chickens bred or meat productiongo to slaughter lame and in pain, as demonstrated by numerous studies showing that their bones cannotsupport their growth rate and body weight. Chickensoered a choice o ood mixed with pain-relievingmedication choose it.

Te act that these chickens (and turkeys)develop heart ailments in their in ancy, and suer rom amultitude o bizarre production diseases, shows that they are not happy or adapted to the conditions imposed onthem.

 As a sanctuary director or more than 25 years onthe Eastern Shore o Maryland and Virginia, one o thelargest chicken-producing areas in the country, I knowrsthand the abnormal and appalling suering o thesebirds, beret o legal protection.

By the same token it is not complicated to know what a chicken needs and wants to do in order to behealthy and happy.

Visit our sanctuary in Virginia and you willsee that chickens want to be out o their houses eachmorning and into their spacious yards and wooded areasto orage, sunbathe, dustbathe and socialize together.Tey want to roost up high together at night on perches,reecting the act that chickens evolved in the tropicalorest and slept in trees, and still do. Tey want to runon their legs and ap their wings, nest and do all thethings they evolved to do, as reected in their overtbehavior – unless their natural behavior is thwarted anddistorted, as it is in crowded connement situations withboring ood, mutilated beaks, and no outlets or theirtime and energies.

Te reason that even intelligent people insist wecan’t know what an animal o another species wants todo is simple: What animals want to do conicts with what we want to do with them, and to them, and how we want to use, misuse and abuse them.

 Acknowledging that other animal species haveinterests, preerences, desires, dislikes, aversions, afnitiesand so orth would require moral obligations andradical changes in our b ehavior toward them. Let’s stoppretending we don’t know, or can’t know, what a chickenor a goat or a chimpanzee desires to do. I know what ourchickens want to do because I watch them choose theirdaily activities in an environment that stimulates theirinterests.

For instance, chickens released rom a long siegein a cage and placed on the ground almost invariably start making the tentative, increasingly vigorous gestureso taking a dustbath. Tey paddle and ing the dirt withtheir claws, rake in particles o earth with their beaks,u up their eathers, roll on their sides, pause with theireyes closed, and stretch out their legs in obvious relish atbeing able to bask luxuriously and satisy their urge toclean themselves and to be clean, as well as engage in thehighly social activity o dustbathing together.

Dustbathing is one o many examples I can giveo knowing what chickens desire to do as demonstratedby what they choose to do. My knowledge ts that o the ages going back to Plutarch and other recorders o 

chickens’ behavior, in which genetic patterns com with the birds’ learning abilities.

Pioneer animal rights activist Walt Rave, who launched the concept o Te Great American Meatout or Farm AnimalRights Movement (FARM) in 1985, diedrom injuries he sustained in a re thatstruck his house in akoma Park, MD onDecember 7. Walt was an activist-artist who gave a home to several rescued cats

 who died in the re and he is believed tohave been burned beyond help trying torescue them. I rst met Walt in 1983 whenthis tall, red-haired, bearded man strodeacross the grass and led me to the animalrights tables on display in Laayette Park in Washington, DC on World Laboratory  Animals Day. Tat was the day I pledgedto ght or animals or the rest o my lie. Activist Peter Wood wrote about Walt that he was“an extremely kind and sensitive soul. In a newspaper article about him severalyears ago, he talked about his love o looking at the stars through a telescope. News o how our consumer choices andcommercial industries are aecting ourplanet has made terms like ossil uel,

carbon ootprint, greenhouse gases and global warmingcommonplace. Carbon dioxide is most commonly associated with global warming, but in Comfortably  

Unaware , Dr. Richard Oppenlander argues that whileit’s important to minimize CO2 emissions rom carsand industry, “the single most devastating actor thataects global warming and our environment is causedby what you eat.” Methane and nitrous oxide, hesays, “are much more powerul than carbon dioxide asgreenhouse gases.” hese treacherous gases enter theatmosphere mainly through the latulence and manureo the 65 billion land animals who are now being raisedor ood – a number that could double by 2050.

Global warming is one component o globaldepletion. Comfortably Unaware insists that animalagriculture, including shing and aquaculture (actory arming o reshwater and sea creatures or human,companion animal and armed animal consumption), isthe primary cause o global depletion – the loss o ourrenewable and nonrenewable resources including ourdrinking water, air quality, land, oceans, rainorests, andbiodiversity. Reports on the health and environmentalhavoc o armed animal production and consumptionstop short o advocating the animal-ree diet that wouldsolve the problem. For instance, 80 percent o the world’s protein-rich soy crop is not being ed to starvingchildren, but to armed animals, and most o this soy “isnow grown on rainorest-cleared land.” In 2004-2005more than 2.9 million acres o rainorest were destroyed,“primarily to grow crops or chickens used by Kentucky Fried Chicken.”

Oppenlander explains why “grass-ed, pastured”animal production is a alse solution to actory armingand why small-scale operations cannot sustainably 

meet the demands o billionso people wanting cheap,readily available meat, dairy and eggs. Smaller arms don’talter the amount o resourcesrequired to raise, transportand slaughter hundreds o billions o animals. Currently,55 percent o our resh wateris given to animals raised orood, and 89,000 pounds o excrement are prodarmed animals every second i n the United Statesays Oppenlander. Moreover, what is ashionably“humane” arming does not meet the behavioralcognitive needs o, or show any genuine respect animals trapped in our ood production systems belittling attitudes.

Comfortably Unaware represents the enorbenets o a nutritious, animal-ree, vegan diet wexplaining why organizations and individuals wh“aware and are in various positions to get the meout so that it could make a dierence do not speit.” While deploring their ailure to do so, Oppenargues that the realities o our ood choices are wthey are, and we can ignore or ace these realitiessays that with “every burger, steak, pot roast, tursandwich, ried chicken, rib, barbecue, pork chobacon, ham, or whatever you want to call it or hyou want to cook i t, you are perpetuating the de which urthers the business o raising animals anslaughtering them or you to eat. You can turn yothe other way, but the process continues.” It conthe detriment o animals, our health, and the heour planet.

 We can reverse the ill ortune, however, ideeply enough. Te power to create a totally dioutcome resides in our determination, our collecintelligence, and our pocketbook.

Amelia, A Turkey Beloved By Allaren Davis's essay, distributed by the McClatchy-ribune News Service, appeared in many ewspapers at Thanksgiving, prompting kind ords from people around the country.

W e adopted Amelia as a young turkey inthe all o 2007 ater a local armer gaveher up. She lived in our sanctuary until

ugust this year when her legs gave out and we had toll our veterinarian, a very kind man, to put her to restthe yard surrounded

y her riends. Untilose last sad days she

ung out with the

hickens and ducks, satth them under theees in the aternoon,nd when people visitede’d an out her snowhite tail eathers, justke a male turkey, androll with the visitors,ver leaving their side.

She chose a leay nesting spot which she hol-wed out a little to lay her eggs in. In the evening sheved to stay outside with the ducks, poking around untile last minute o sinking sunlight, but when I called her,

In her rst year o lie, Amelia slept on a lowrch in the bird house or sat on a straw bale we kept orr there. But soon she was so heavy it was hard or hermake even a low leap, so she nestled in a corner nextthe ducks, but this wasn’t her rst choice. I turkeys

Over the years I’ve watched many young turkeysnd chickens, with their oversized breasts bred pendu-usly heavy or the meat industry, try to calculate a leapecisely onto a perch, a straw bale or a sawhorse. Tey ll test the spring rom the ground beore making it, asreliving an experience built into their bones and brainlls. I’ve watched them revise their position, test it again,

nd quit i they perceive it’s no go, with a show o disap-

pointment and rustration, oten circling the area withtheir necks craned beore giving up entirely.

In America as late as the 1930s, turkeys wereoten still being driven on oot rom arms to towns andcities, anywhere rom 50 to 200 miles, through terrainranging rom densely wooded mountain trails to treelessexas plains. Te birds’ amiability, vigorous constitution,and long, strong legs made these drives to distant loca-tions possible. A point made about the drives was that i  the birds were not successully regrouped each morning,they scattered in the woods and elds and could not berecovered. In addition, the birds’ determination to roostevery night in the trees had to be accommodated.

In 1907 a New Hampshire historian named E.Gilbert described how during the long drives, the wholeturkey ock with one accord, “rose rom the road andsought a perch in the neighboring trees” at dusk. More

recently, biologist William Healy noted that the deter-mination o turkeys to perch or the night was so strongat his research station that he and his colleagues couldnot keep them out o the treetops even by clipping theiright eathers. “Te turkeys would climb leaning branch-es and leap rom limb to limb to get into tree crowns andthen gradually work their way to the top,” he wrote.

Sanctuary workers like mysel who’ve spent yearsin the company o turkeys and chickens bred or themeat industry know that these birds have not lost theirancestral desire to perch, mate, run, walk and be sociable. We know that the inability o turkeys to mate properly does not reect a loss o desire to do so, but, as we seerom watching them, it results rom growth disordersoten abetted by the act that their claws and part o theirbeaks were cut o at the hatchery, so they can’t get a gripon anything. And like our Amelia, they requently suerrom painul degenerative joint diseases that reduce theirspontaneous activity and age them well beore their natu-ral 20-year liespan.

Despite all these things, sanctuary turkeys are a joy to have around. Visitors unamiliar with turkeys aredelighted and quite taken aback at how riendly they are. Naturalist Joe Hutto has described how a group o young turkeys he was raising, upon seeing him, woulddrop rom their roosts where they'd sat "sotly chatter-ing" and do what he calls "their joyul, happy dance,expressing an exuberance." Tis exuberance is an ele-ment o the lie that we share with our eathered riends,and we can best give thanks by letting them live to enjoy it.

Makes 8 delicious patties

1 eight-ounce package of plain tempeh

2 Tablespoons our 

1 ¼ teaspoons dried rubbed sage

½ teaspoon cumin powder 

½ teaspoon dried thyme

½ teaspoon “poultry seasoning”

½ teaspoon garlic granules

2 Tablespoons oil

2 Tablespoons soy sauce or 

Bragg’s Amino Acids

2 Tablespoons warm water 

Cut the tempeh into chunks or slabs. Steam for 15

to 20 minutes. Cool. Grate tempeh chunks with

coarse grater into a bowl. Add rest of ingredients,

Fuzzy was brought to our sanctuary in December 2010 by a very nice family in Northern Virginia to whom he was givenas an “Easter gift.” The family loved him but couldn’t keep him in their urban home once he became a large duck, so they drove him to UPC where he has thrived in our care ever since. Fuzzy follows us around the yard while we work. He has a

loud breathing voice so we nicknamed him the stalker, but he’s a very nice stalker. Fuzzy has his own blue pool to swimand splash in, and he gets along great with the chickens.
