Order No. 5/91-2015 HRME (3) Dated, Panchkula the, 22.07.2016

Ld. Judicial Magistrate, First Class, Ambala vide order dated

01.09.2015 has inflicted the following punishment upon Sh. Amarjit Singh, Dy.

Supdt (Retd) in the criminal complaint no. 129/1/2008 titled as ,Hari Singh Versus

Sukhwinder Singh and others:-

1 U/S 420 OF IPC Two Years Simple Imprisonment and Rs 500/:, each as fine

2 U/S 467 of IPC Two Years Simple Imprisonment and Rs 500/- each as fine



5 U/S 120 B of IPC Six Months Simple imprisonment All the sentences shall run concurrently

Therefore, 'said Sh. Amarjit Singh filed Criminal Appeal No. 333 of 2015

against the judgement of conviction and order of sentence dated 31.08.20.15 passed

by the Court of Ms. Rekha Ld. JMIC, in the court of Ld. Additional Session Judge,

Ambala, who vide its order dated 17.09.2015 suspended the said sentence during

the pendency of the appeal. This clearly implies that the conviction remained intact

and was not stayed by the Appellate Court.

The said incumbent got superannuated at the age of 58 years on

31.01.2016. In view of conviction in a serious crime, prima facie, it was imperative

to impose a penalty of dismissal, in accordance with the offences pertaining to the

moral turpitude, as provided in proviso (a) to Article 311 (2) of the Constitution of

India and as per instructions issued by Punjab Government Circular Letter No.

4819-0 11-57/11919, dated 08.07.1957 from the Chief Secretary to Government,

Punjab, addressed to all the Heads of Departments, which was not done till the date

of retirement on 31.01.2016 and the said incumbent continued to get pension. As a

consequence of the same, the competent authority issued show cause notice to Sh.

Amarjeet Singh vide office letter No. 5/91-2015 HRME(3) dated 22.07.2016

proposing penalty of withholding or withdraw a pension or any part of it.

. The Retd official replied to the abovesaid notice on 11.08.2016 in

details interalia mentioning that this notice is not sustainable in present form. •

Thereafter, vide orders dated 06.12.2017 the Hon'ble Punjab and
