5. BYLAWS

(a) Thompson Road Road Closure Bylaw No. 1419, 2017

Staff recommendation:

That Thompson Road Road Closure Bylaw No. 1419, 2017 be

finally adopted, signed by the Mayor and the Corporate Officer

and sealed with the Corporate Seal.

6. CORRESPONDENCE

(a) Correspondence dated August 18, 2017 from Mayor L. Helps,

City of Victoria, regarding inclusion in a focus group to create a

plan to guide the McPherson Playhouse and Royal Theatre

governance and operations.

Staff recommendation:

That Council identify the representative(s) to the focus group.

7. NOTICE OF MOTION

(a) Councillor Thornburgh requests Council's consideration of the

following motion to be forwarded to UBCM for consideration at

its annual convention:

Whereas:

1. It is crucial that BC taxpayers and ratepayers are

protected from excessive and unnecessary increases in BC

Hydro rates; and

2. It is imperative that the BCUC is able to consider all

options for the production of electrical power in its oversight of

the Site C dam project;

Therefore:

The Government of British Columbia will amend the Clean

Energy Act to ensure that the power from all appropriate

sources, specifically the Burrard Thermal Generating plant and

the Columbia River Entitlement, can be considered in any

decision about the need for Site C.

BYLAW NO. 1419

A BYLAW TO CLOSE A PORTION OF HIGHWAY

WHEREAS, pursuant to Section 40 of the Community Charter, Council may, by bylaw,

close to traffic a portion of a highway that is vested in the municipality and remove the

dedication of the highway, if prior to adopting the bylaw Council publishes notices of its

intention in a newspaper and at the District’s public notice posting place and provides an

opportunity for persons who consider they are affected by the bylaw to make

representations to Council;

AND WHEREAS the Council of the District of North Saanich deems it expedient to close to

traffic and remove the dedication of highway of that portion of Thompson Road comprising

approximately 0.240 hectares (2,400 m²) dedicated as road by BC Gazette Notice dated

December 19, 1883 and by Plan EPP68293, (the “Closed Road”), which is shown outlined in

bold black on the reference plan prepared by Brad Cunnin, B.C.L.S., of Brad Cunnin Land

Surveyor, on the 2nd day of December, 2016, a reduced copy of which is attached hereto as

Schedule “A” (the “Road Closure Plan”);

NOW THEREFORE the Council of the District of North Saanich, in open meeting

assembled, enacts as follows:

1. The Council hereby authorizes the closure to traffic and removal of highway

dedication of the 0.240 hectares (2,400 m²) portion of highway dedicated as road by

BC Gazette Notice dated December 19, 1883 and by Plan EPP68293 shown on and

labelled “Road to be Closed” on the Road Closure Plan.

2. On deposit of the Road Closure Plan and all other documentation for the closure of

the Closed Road in the Victoria Land Title Office, the Closed Road is closed to public

traffic, it shall cease to be public highway, and its dedication as a highway is

cancelled.

3. The Mayor and Corporate Officer are authorized to execute all plans and other

documentation necessary to effect this road closure.

4. This Bylaw may be cited as “Thompson Road Road Closure Bylaw No. 1419, 2017”.

READ A FIRST TIME this 20th day of February, 2017.

Dear Mayor and Council,

Two weeks ago I shared the compendium of comments from the presentations made to 12municipal councils as part of the City of Victoria’s outreach to you on the future of theMcPherson Playhouse, and subsequently the Royal Theatre.

Now I would like to invite you to participate in the next and final phase of ourconversation.

Shortly, a focus group comprised ofyour representatives and members ofthe City ofVictoria working group (with Royal and McPherson Theatre Society Board Directors andstaff, my Deputy City manager and staff, and Councillors Pam Madoff and MarianneAlto) will come together to create a specific plan to guide the theatres’ governance andoperations

This will take place over six weeks, in three conversations, tentatively scheduled forTuesday September 19, Tuesday October 3, and Monday October 1 8. All will begin at 2pm, last no more than two hours, and take place at Victoria City Hall.

I invite you to identify, or confirm, the councillor(s) you wish to participate.

My colleague Councilor Alto will follow up with you towards the end ofAugust toconfirm details and answer any questions you may have about these next steps.

Once these conversations are complete, a penultimate report with recommendations willbe shared with you for your feedback, before final recommendations are conveyed to myCouncil and the Capital Regional District.

This is an exciting opportunity for you to add your voice and wisdom to the futuregovernance of these important cultural assets. I thank you, in advance, for yourcontinued consideration and participation.
