Protocol in response to COVID-19 March 22, 2020
Please find below the Tri-County Courthouse Remote Appearance Protocol.
As noted, Bails will be held in the following locations on the following days:
Monday – Peterborough
Tuesday – Cobourg
Wednesday – Lindsay
Thursday – Peterborough
Friday – Cobourg
Further please be informed that matters heard within the Tri-County will be heard in a single court
each day in the following courtrooms:

If you should have any questions or concerns regarding the attached protocol please feel free to
contact myself or the respective Supervisor of Court Operations for your court location.

Where a teleconference line will be used for a proceeding, the Crown will provide the details to the
counsel for the accused.
3.4 Instructions
All matters in Peterborough will be held in courtroom #2 at 70 Simcoe Street. A teleconference line
has been set up in the courtroom to allow counsel to attend remotely to speak to his or her matters.

4. Process for Proceedings
4.1 In Advance of Proceeding
By 5pm of the day before the proceeding CECC will provide scanned or faxed copies of all necessary
paperwork for accused on the list the following day.
By 8:30 am (or as soon as possible thereafter) of the day of the proceeding, police services will
provide scanned or faxed copies of all necessary paperwork for the accused on the list that day.
Police services will also email the names of any new detainees being held for bail that day to the local
CLA and duty counsel reps at: [email protected], [email protected]

at the stations/detachments in advance of bails.
Tri-County Court Administration will assemble all paperwork for in-custody accused on the list each
day.
4.2 Parties to Proceedings
4.2.1 Sureties
Where the accused is in custody at CECC, the surety will attend to the Courthouse bail court.
Sureties attending court for bail will be asked to attend court when called/paged in by clerks. Sureties
must to be cognizant of social distancing and not sit in courtrooms or in hallways in close proximity
Where the accused is in custody at a police services detachment, the surety will attend to said
detachment.
4.2.2 Victims and Witnesses
Victims and witnesses will continue to be asked to attend the courtroom in person or via video in
accordance with regular procedure. Victims and Witnesses attending court for bail will be asked to
attend court when called/paged in by clerks. Victims and Witnesses must to be cognizant of social
distancing and not sit in courtrooms or in hallways in close proximity
4.3 After Proceeding has Concluded
Tri-County Court Administration will provide scanned or faxed copies back to the appropriate police
services or CECC to have the accused sign. Once signed, the paperwork must be returned to the Tri-
County Courthouse via scan or fax.
All paperwork with original signatures must be returned to Tri-County Courthouse. For example,
where an accused is released, paperwork with signatures should be sent at the earliest opportunity
via mail or with an officer.
