The attached Resolution recommends the approval of a Redevelopment Plan for an Aldi, Inc. private label discount grocery store to be located on Lot 1, Sorensen Comer, southeast of the intersection of 30th Street and Sorensen Parkway, "Sorensen Comer".

The Aldi, Inc. Redevelopment Plan approved by the Planning Board on July 9, 2008 proposed that the City participate in the development by providing $715,000.00 in Tax Increment Financing, which will be used for site acquisition, demolition, preparation, public improvements and other TIF eligible expenses including compliance with ACI-2 design guidelines. The total project cost is estimated to be $3,659,537.85.

The ALDI INC TIF Redevelopment Project is the adaptive re-use of the property. The project is to develop a new ALDI grocery store at this north Omaha site.

The proposed project plan request city support for the project through the approval of the redevelopment plan to develop the site and the authorization of TIF as an economic development tool that will be utilized to assist in financing TIF eligible acquisition, demolition, relocation of residents, development and renovation of the site and related public improvement cost as may be required.

The project site and area meet the requirements of Nebraska Community Development Law and qualify for the application for and the utilization of Tax Increment Financing to cover cost associated with project development plans submitted for approval through the Tax Increment Financing process.

Recommendation: The department recommends approval of the ALDI INC TIF Redevelopment Project Plan for the acquisition and renovation of the site for the development of a ALDI Grocery Store. The approval of the plan facilitates measures required for the completion of the project through the approval of the plan and the subsequent agreement by the Planning Board and City Council as appropriate.

PROJECT DESCRIPTION

General Information:

Developer: ALDI, Inc.

Legal Description: See Exhibit "A"

Current Taxes: $3245.54

This development involves the assembly, purchase and redevelopment of a parcel of land located at North 30th Street and Sorenson Parkway, bounded by 29th and 30th Streets, Fowler Avenue on the south and Sorenson Parkway on the north. Prior to the assembly and purchase of the property by the developer and current owner, ALDI, Inc., the property consisted of the old Kenwood Feed Store and Warehouse on the north end of the parcel, largely vacant land to the south and west and four older homes. In addition, the developer is in the process of vacating Larimore Street between 29th Street and 30th street as well as the north-south alley. The assembled parcel covers an area of 2.23 acres (97, 187 square feet). In addition to the vacation of Larimore Street and the alley, rezoning of the acquired residential property is presently being undertaken. Exhibit "A" is a current AL TA survey of the real estate which is the subject of this request.

The project would involve the construction of a new 16,560 square foot ALDI grocery store with 70 plus parking spaces and site entrances both on 30th Street and on Fowler Avenue. A proposed site plan, elevations and the store floor plan are included as Exhibits "B", "C" and "D", respectively. The developer will be working closely with the Omaha Planning Department to not only accomplish the necessary rezoning and public right-of-way vacations, but also to ensure that the project complies with the new Omaha By Design requirements.

Included in the cost of acquiring and redeveloping the site is considerable expense for relocation of utilities, demolition and removal of existing structures (including abatement of asbestos), substantial "overexcavation" and removal of unsuitable soils and replacement of same with structural fill.

FINANCING PLAN AND PRELIMINARY FINANCING COMMITMENT

The Developer/Owner estimates that the total cost of the project, including site acquisition, preparation, construction would equal or exceed $3,600,000.00.

The Developer intends to develop this project on a cash basis to minimize interest payments. Accordingly, in order to maximize the internal rate of return for this project, the Developer will use TIF to generate payments over the life of the TIF agreement. The funds received from the incremental taxes will not be used as collateral for any outside financing.

PRELIMINARY FINANCIAL DATA

Attached as Exhibit "E" is a pro forma budget showing a summary of currently estimated project costs as well as sources of funds.

STATEMENT AND DEMONSTRATION THAT PROJECT WOULD NOT PROCEED WITHOUT TIF

As shown on Exhibit "F", based on comparable site development and acquisition costs in the general area, without tax increment financing, there will not be a sufficient return to defray the costs of acquisition and development in addition to operating costs, while providing a minimum economic return on the equity investment in the project.

Thus, it is highly unlikely the project would proceed as proposed without TIF.

EVIDENCE THAT PROJECT MEETS EVALUATION CRITERIA

1. MANDATORY CRITERIA. As discussed below, the Project meets all of the mandatory criteria set forth in the Tax Increment Financing Guidelines issued by the City of Omaha.

a. The project must be located within a blighted area or an area eligible for a designation of blight as required and set forth by State Statute.

The Project is located is in a presently designated blighted area.

b. The project must further the objectives of the City's Comprehensive Plan.

The Project results in development of vacant, unused or under utilized property located at a highly visible and heavy traveled intersection. The use of the property as a high quality private label discount grocery store will "anchor" the north end of the City's proposed redevelopment plan for the area.

c. The use of TIF for the project will not result in a loss of pre-existing tax revenues to the City and other taxing jurisdictions. .

The tax increment financing request involves only the increase in taxes resulting from the improvements proposed by the developer.

Previous tax revenues will continue to be paid, as they have in the past, to the City and other taxing jurisdictions.

d. The Developer is able to demonstrate that the project would not be economically feasible without the use of Tax Increment Financing. In addition, if the project has site alternatives, the proposal must demonstrate that it would not occur in the area without TIF.

As demonstrated by Exhibit "F", the Project would not be economically feasible without the use of tax increment financing. Given the unique nature and location of this building, there are no site alternatives for the Project.

e. The Project will eliminate an actual or potential hazard to the public.

As a result of the Project, vacant lots and buildings which are currently deteriorating, vacant or unused will be razed and put to good use as a community grocery store. The possibility of vandalism, fire and further structural deterioration, all associated with unoccupied urban property, will be reduced or removed.

2. DISCRETIONARY CRITERIA. As discussed below, the project meets four of the discretionary criteria set forth in the tax increment financing guidelines issued by the City of Omaha and qualifies for a 15-year amortization period.

a. Location. Project is located within the "North Omaha and Downtown Omaha" area, which has been designated as one of the specific areas in the City's TIF Guidelines.

b. Conditions of Blight. The site displays conditions of blight as established by Nebraska statutes.

c. Start up of entirely new business operation. Upon completion of the project, an entirely new, grocery store business will result on property that was vacant or under utilized and not previously used for such purposes.

d. Declining real property assessments. As shown by Exhibit "G", the site has displayed a recent pattern of declining real property assessments as measured by the Douglas County Assessor's office.

e. Benefit to low and moderate income people. At least 51 % of jobs created will be held by or available to low and moderate income people. It is anticipated that six full-time jobs (with benefits) and 2 part-time jobs will be created. Of these, four full-time jobs and the 2 part-time jobs will be available to people living in the neighborhood or near by and who meet the low or moderate income criteria.

As the project meets five discretionary criteria, the City's TIF Guidelines permit the use of TIF for the full 15 year amortization period as permitted by the Constitution of the State of Nebraska.

PROJECT SITE AND BUILDING PLANS/DEVELOPMENT SCHEDULE.

Assuming approval of its TIF request, the developer is prepared to proceed with the project upon completion and finalization of building and site plans and issuance of permits. Construction could commence as early as July of 2008 and be complete by October of 2008

PUBLIC IMPROVEMENTS TO BE INCORPORATED IN PROJECT

As shown by the site plan attached as Exhibit "B", there will be substantial grading, utility relocation and utility work undertaken in connection with the development of this project. In addition, there will be a significant cost for improvements, includin~ sidewalks and other public access, related to the "street scape" along both 30th and 29t Street.

The developer is a Kansas corporation and is registered as a foreign corporation, in good standing, in the state of Nebraska.

COST-BENEFIT ANALYSIS

The request meets the necessary requirements for consideration. The site is in an area that meets the requirements to be declared and is Blighted and Substandard. The TIF proceeds are to be used to cover any public improvement cost with the remaining balance of the TIF to be used for project specific TIF eligible cost. The proposed TIF will be used to offset, acquisition, demolition, site prep and to defray other site development costs that are eligible activities.

The site was partially underdeveloped and underutilized with depressed tax value based on the underutilization of the property. The development project will provide additional retail grocery capacity for North Omaha. The buildings and site were not being utilized at the fullest and best economic use.

The use of TIF will not result in tax shifts. The current level of taxes will continue to flow to the current taxing entities and only the increased value of revenues resulting from the improvements will be applied to the cost of the improvement.

No community public service need will be generated as a result of this Project. The development of this site will provide an increase in employment opportunities and employees to provide complimentary services related to the retail grocery business. This development will impact other businesses, as there will be an increase in the demand for employees to fill the employment opportunities created by this development. The elimination of the blighted and substandard conditions and the establishment of a new Aldi, Inc grocery store will increase employment opportunities and other economic opportunities by illustrating that there is a market and demand for goods and services.

The development will cause an increase in traffic in the area; however, the current street system is able to accommodate the Project. The creation of new employment opportunities that fosters the increased demand for goods and services justify the cost associated with the Project. The long-term benefits resulting from the elimination of the blighted and substandard conditions and the increase in the tax base resulting from the development are other valid justifications to provide assistance to the Project.

This is a request for preliminary and final plat approval and to rezone from R5(35) and GI to CC. On August 1, 2007, the Planning Board laid over this request to allow the applicant time to meet with neighbors. The applicant submitted documentation that indicates a neighborhood meeting was held on August 22, 2007.

The Planning Department's recommendation, which follows, remains the same.

RECOMMENDATION Approve the rezoning from R5(35) and GI to CC.

Approve the preliminary plat subject to the applicant addressing the following with the final plat and subdivision agreement: 1. Dedicate easements for any existing sewers in Larimore Avenue. 2. Note on the plat that direct access to 30th Street will be restricted to right-in/right-out turning

movements. 3. Submit an acceptable final subdivision agreement.

Approve the final plat as amended by the conditions of preliminary plat approval, which must be addressed prior to forwarding the final plat to the City Council.

II. SPECIAL INFORMATION

Site Characteristics: A 2.55-acre flat, previously platted site containing several houses and a commercial use.

Development Proposal: To replat the site into one (1) lot for the construction of an ALDI store.

Public Improvements: Traffic and Circulation - This replat will vacate Larimore Avenue. Easements must be dedicated on the final plat for any existing sewers in Larimore A venue. Access to 30th Street will be restricted to right-in/right-out turning movements and must be noted on the plat.

Sidewalks - The reconstruction and replacement of sidewalks has been provided for in the draft subdivision agreement.

Grading and Drainage: A net increase in stormwater runoff from the site will not be permitted. On site detention may be required by the Public Works Department.

Land Use and Planning: The proposed subdivision complies with both zoning and subdivision ordinances. ·

III. ANALYSIS If the conditions of approval are addressed by the applicant, this request will be consistent with the city's Master ~Ian.

No Building Permit will be issued based on a site plan which does not comply with the provisions of the Zoning Ordinance. Approval of the rezoning by the Planning Board and City Council does not include or imply an acceptance of the site plan for permit purposes.

II. SPECIAL INFORMATION

Site Characteristics: This is an 110,819 square foot site planned for the development of an ALDI grocery store. A application for a plat and rezoning have been before Planning Board already. The pre-liminary plat was approved By City Council in December of 2007. The Final Plat and rezoning have not yet been approved.

Development Proposal: An ALDI grocery store that sits on one lot and meets the ACI-2 Overlay district requirements.

Land Use and Planning: A preliminary plat has been approved by the Planning Board. The zoning and final plat have not yet been before Council. The applicant went before the Zoning Board of Appeals on July 17, 2008. Waivers were granted for the front yard setback. The waiver that was granted sets the build-to/setback line for this particular development in the ACI-2 overlay. A preliminary site plan review did not find any inconsistencies with ACI site plan requirements. However, building elevations were not submitted so a review for compliance could not be done.

III. ANALYSIS: The ACI-2 overlay district is consistent with the proposed development and the final plat and rezoning application. The site plan is also consistent with the plan approved at the Zoning Board of Appeal meeting.

PLANNING BOARD MINUTES

REQUEST: LOCATION:

Approval of an ACl-2 Overlay District Southeast of 30 Street and Sorensen Parkway

At the Planning Board meeting held on August 6, 2008, Mr. John Kettmann, Thompson, Dreessen, & Dorner, 10836 Old Mill Road, presented this request.

Mr. Kottmann stated that the applicant has decided to enter into a development agreement with the City for this location. He stated that the site has been redesigned to meet the City's new urban design guidelines, which is to put the building up on the right-of-way line (O' build setback line) of 30 Street. The building has been turned to face the south because this would allow for maneuverability of trucks on the site, O' build on the west end of the building, and truck entrance to the east. Mr. Kottmann stated that the green space along 29 Street has increased from a 30' minimum to 38' wide on the north half and 50' wide at the south. He stated that they would be installing an enhanced amount of landscaping in this area with two lines of trees and a row of bushes at the edge of the parking lot and felt this would screen the parking lot from the residential area to the east. The building is also further removed from the residential area.

Mr. Mancuso questioned what kind of timetable the applicant would have for the construction of this project. Mr. Kettmann stated that the site has been cleared of the previous structures and the applicant wants to the store to open by October 2009.

Mr. Ken Johnson, Economic Development Manger, Planning Department, stated that he has met with the neighbor who has some concerns about this project. He stated that he has visited the site many times and has driven around the area several times. Mr. Johnson stated that the Department is in support of this plan and has worked with the applicant on this proposed plan and rezoning.

Ms. Lenore Rush, 4711 N. 29 Street, stated that she is concerned about maintaining her privacy from this commercial project. She stated that another concern is having car lights from the vehicles in the parking lot shining into her home. Ms. Rush stated that she is also concerned about the noise pollution.

Mr. Johnson stated that previously this property was vacant and trucks and cars were parked here and had no concern about anybody's privacy. He stated that he felt that this concept provides a high degree of shelter from the lights going into her home. Mr. Johnson stated that he felt that a retaining wall is not appropriate for what the applicant is trying to accomplish on this site. There is a possibility of constructing a fence to provide additional screening. He stated that he felt the applicant has done everything they can to minimize the impact of the lights and noise from the parking lot. Mr. Johnson stated that they would be following the ACl-2 zoning regulators.

Mr. Kettmann stated that they do not have parking stalls facing to the east. This is a drive aisle that is primarily an exit path for the trucks. He stated that there is a continuous hedgerow in this area. Mr. Kettmann stated that he felt that they might be able to do some type of screening fence with the hedge row so that it is not one long fence, but something that would aesthetically enhance the screening.

Mr. Weaver stated that the plan presented at today's meeting is not necessarily tied down by the approval of the zoning. He stated that he felt that a retaining wall is not appropriate in this area and they would also be reviewing access issues. Mr. Weaver stated that the Department recommends approval of the rezoning.

NOTICE OF PUBLIC HEARING ON THE ALDI, INC TAX INCREMENT FINANCING REDEVELOPMENT PROJECT PLAN

Notice is hereby given that the Omaha City Council has set Tuesday, November 25, 2008 at 2:00 p.m. as the date of Public Hearing on the Aldi, Inc. Tax Increment Financing Redevelopment Project Plan.

The Aldi, Inc. Tax Increment Financing Redevelopment Pro~ect Plan is located on Lot 1, Sorensen Corner, southeast of the intersection of 30t Street and Sorensen Parkway. The Redevelopment Plan is located within an area declared blighted and substandard and in need of redevelopment by the Omaha Planning Board and City Council.

The Aldi, Inc. Tax Increment Financing Redevelopment Plan is for the 2.54-acre project study area to facilitate the rehabilitation of the site to develop a 16,560 square feet Aldi, Inc. discount grocery store utilizing $715,000.00 in Tax Increment Financing to offset site acquisition and project development cost, to relocate residents, and to modify and construct public improvements as required in the abutting rights-of-ways. An Industrial Development Bond issue may be used in this blighted and substandard area to assist with the project financing. The total project cost is estimated to be $3,659,537.85.

A copy of said plan is available for public inspection in the City Clerk's Office.

Public Hearing will be held before the City Council of the City of Omaha, in the Legislative Chambers, Omaha/Douglas Civic Center, 1819 Farnam Street, Omaha, Nebraska.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:

WHEREAS, the primary objectives of the City of Omaha's Master Plan and Community Development Program are to encourage additional private investment and infill development within inner city neighborhoods; and to eliminate the conditions which are detrimental to the public health, safety and welfare by developing vacant, underutilized property within these neighborhoods; and,

WHEREAS, State Statute 18-2109 requires that before any redevelopment plan be prepared, the City Council must declare the proposed redevelopment area to be "substandard and blighted" and in need of redevelopment; and,

WHEREAS, the proposed 2. 54 acre Aldi Inc. discount grocery store site located on Lot , 1 Sorensen Comer, Southeast of 30th Street and Sorensen Parkway meets the conditions of both a substandard and blighted area as defined by State Statute 18-2103 (see Attachment 1 for complete legal description); and,

WHEREAS, the Planning Board and City Council of the City of Omaha have previously declared that the proposed Aldi Inc. Tax Increment Financing Redevelopment Project Plan site located on Lot 1, Sorensen Comer, Southeast of 30th Street and Sorensen Parkway meet the conditions of both a substandard and blighted area as defined by State Statute 18-2103; and

WHEREAS, the Aldi Inc. Tax Increment Financing Redevelopment Project Plan for the 2.54-acre project study area is to facilitate the rehabilitation of the site to develop a 16,560 sq. ft. Aldi Inc., discount grocery store utilizing TIF to offset site acquisition and project development cost, to relocate residents, and to modify and construct public improvements as required in the abutting rights-of-ways as indicated here in "Exhibit A" and attached hereto and made a part hereof; and,

WHEREAS, an Industrial Development Bond issue may be used in this blighted and substandard area to assist with project financing; and,

WHEREAS, Section 18-2108 of the Nebraska Revised Statutes requires the City of Omaha to adopt a redevelopment plan before taking an active part in a redevelopment project; including the division of ad valorem taxes under Sections 18-2147 through 18-2150, Revised Statutes of Nebraska; and,
