10.4.2 Setbacks and building envelope for all dwellings
Objective:
To control the siting and scale of dwellings to:
(a) provide reasonably consistent separation between dwellings on adjacent sites and a dwelling and its frontage; and
(b) Assist in the attenuation of traffic noise or any other detrimental impacts from roads with high traffic volumes; and
(c) Provide consistency in the apparent scale, bulk, massing and proportion of dwellings; and
(d) Provide separation between dwellings on adjacent sites to provide reasonable opportunity for daylight and sunlight to enter habitable rooms and private open space.
P1/P2:
The proposed building fits within the plan building setbacks; however a portion of the southern wall of the proposed second storey extends past the projected building envelope by approximately 1041-1067. And a portion of the approximately 1582 of the north/west corner of the deck/balcony roof section also extends past the projected building envelope for the acceptable solutions.
Being a corner block the front set back isn’t consistent with the existing neighbouring properties. And the other properties on the street have dramatically different setbacks for instance the dwelling of 4 Hogarth road has a front setback of approximately 5m and the dwelling of 362 preservation drive has an approximate front set back of only 2m.
The top storey extension will be in the same character as most dwelling along preservation drive where they have built 2 storey buildings to take advantage of the unobstructed sea views and northerly aspect.
the new proposal will not be adversely effected by the abutting road any more than the existing building was effected by noise because the new balcony/deck is actually set back further away from the road than the existing out door entertain area was. All windows will be replaced with double glazing to lessen the effect of noise within the dwelling also.
Discretion is requested for the garage setback, because although the separation to the boundary is only 3356, the new crossover at the roadside kerb is 8956 due to the extensive nature strip. There is also another existing crossover at the primary frontage allowing for rear access to the existing shed and plenty of onsite parking and manoeuvrability.
P3:
The proposed extension has an modest separation from the neighbouring dwelling of 4 Hogarth road of approximately 10m. There is also an existing shed to the north of the existing neighbouring property and a fence that casts the majority of the shadow; As shown in red on the attached plans page a13. The private open space to the north/west of the neighbour still achieves ample sunlight from noon till sunset for the winter solstice. Considerations have been made in the design to try and reduce the overall height of the building by sloping the roof to the south and keeping the ceiling height and pitch as low as possible in the first storey extension.
10.4.6 Privacy for all dwellings
Objective:
To provide reasonable opportunity for privacy for dwellings.
P1: consideration has been given in relations to the balcony and deck within 3m of a side boundary in relation to privacy and overlooking. A timber privacy screen 1800h has been shown to alleviate any privacy concerns.
Window 6 of bedroom 4 is within 3m of a driveway and has a sill height less than 1.7m. As such shall be white glass to minimise direct view.
10.4.12 Setback of development for sensitive use
Objective:
Development for a sensitive use is to –
(a) Minimise likelihood for conflict, interference, and constraint between the sensitive use and the use or development of land in a zone that is not for a residential purpose; and
(b) Minimise unreasonable impact on amenity of the sensitive use through exposure to emission of noise, fumes, light and vibration from road, rail, or marine transport
P2:
The proposed extension within proximity to the railway is within the existing footprint of the existing dwelling so shouldn’t increase the impact. All windows will be replaced with double glazing to lessen the effect of noise within the dwelling also.
