A separate response has been submitted by the Applicant at Deadline 4 regarding the ‘Rule 17’ letter of the 2 nd April 2015. The Deadline 4 submission comprises the following: Comments on LIR Document 10.2 sets out the Applicant’s comments on the Local Impact Reports submitted by Norfolk County Council and the Borough Council of King’s Lynn and West Norfolk. Comments on responses to the ExA’s first written questions The applicant has noted the responses to the ExA’s first written questions made by Norfolk County Council, the Borough Council of King’s Lynn and West Norfolk, Natural England and the Environment Agency. Document 10.3 provides those responses and summarises the Applicant’s comments at this stage. Responses to comments on Relevant Representations The Applicant has been in further discussion with Royal Mail, as documented in the email from BNP Paribas to the Inspectorate on the 27 th March 2015. We note from that correspondence that on the basis of the further information provided Royal Mail have

withdrawn their initial objection as submitted at the Relevant Representations stage.

• Comments on Written Representations The Applicant has no comment on the Written Representations submitted by the Environment Agency on 23rd March 2015 or by Natural England on 23rd March 2015, since in both of those cases those parties have provided responses to the First Written Questions, which are addressed specifically where appropriate in Document 10.3.

• Responses to any comments on any submissions received prior to the preliminary meeting The Applicant has addressed any comments on the S51 Response Letter within their comments on the First Written Questions in Document 10.3.

• Any revised draft DCO from applicant The Applicant has noted the amendments suggested by the ExA in the DCO Hearing Agenda, together with the answers to First Written Questions which have implications for the DCO. No revised draft DCO has been provided at this stage; instead the Applicant intends to provide a revised DCO for Deadline 5 of the Examination process which will allow it to take account of any discussions at the DCO Hearing.

• Revised Matrices requested by the ExA A revised set of matrices have been provided within the Deadline 4 submission [Document 10.4].

• Any further information requested by the ExA The Applicant has made a separate submission to address the ExA’s Rule 17 letter of the 2nd April 2015.

Other Documents Provided Discussions have been ongoing between the Applicant, Natural England and the Environment Agency regarding the Statements of Common Ground which have been requested by the ExA. As set out in the Applicant’s Rule 17 response, both those parties are conscious that discussions are taking place regarding the issue of the Habitat Regulations and in-combination assessments, along with the fact that an Issue Specific Hearing will be held to discuss that matter on 30th April 2015. As such both parties have agreed to working drafts of the SoCG’s to be submitted at this stage [Document 8.3 and Document 8.4]. It is anticipated that those SoCG’s will be the subject of further discussion following the Issue Specific Hearing, with the intention of submitting final agreed SoCG’s by Deadline 5 of the Examination process, on 18th May 2015. A revised Document List is appended to this letter. That List takes into account the documents provided by the Applicant at Deadline 4, as listed above, together with those documents provided in response to the ExA’s Rule 17 letter of the 2nd April.
