INTRODUCTION This report is an analysis of world-wide reported incidents of piracy and armed robbery against ships from 1 January to 31 December 2004. Outrage in the shipping industry at the alarming growth in piracy prompted the creation of the IMB Piracy Reporting Centre (PRC) in October 1992 in Kuala Lumpur, Malaysia. The services of the Centre are free of charge to all ships irrespective of their ownership or flag. The key services of the PRC are:

To receive reports of suspicious or unexplained craft movements, boarding and armed robbery from ships and to alert other ships and law enforcement agencies in the area

To issue status reports of piracy and armed robbery via daily broadcasts on Inmarsat-C through its SafetyNET service.

To collate and analyse information received and issue consolidated reports to relevant bodies, including the International Maritime Organization.

To assist owners and crews of ships that have been attacked To locate vessels that have been seized by pirates and recover stolen cargoes

The report is compiled from the Piracy Reporting Centre’s daily status bulletins. By posting the information on the Internet, ship owners and authorities ashore as well as ships at sea can access the weekly updates. Usually, incidents occurring in the previous quarter(s) are reported to the Centre after a time lag of many months. This late reporting of incidents results in changes to the figures in the tables. The Centre has, as at 31 December 2004, received reports of 325 incidents but expects to receive details of more in the coming months relating to the year 2004. The Centre has responded to suggestions from the industry that this report should separate actual and attempted attacks. Therefore, where possible, the following tables and narrations now appear in separate categories of actual and attempted attacks.

COMMENTS OF DEFINITIONS AND FIGURES For statistical purposes, the IMB defines Piracy and Armed Robbery as;

“An act of boarding or attempting to board any ship with the apparent intent to commit theft or any other crime and with the apparent intent or capability to use force in the furtherance of that act”.

This definition thus covers actual or attempted attacks whether the ship is berthed, at anchor or at sea. Petty thefts are excluded unless the thieves are armed.

The above definition has been adopted by the IMB as the majority of attacks against ships take place within the jurisdictions of States and piracy as defined under United Nations Convention on Law of the Sea (1982) does not address this aspect. The IMB is pleased to record that the International Maritime Organization (IMO) at its 74th meeting of MSC addressed this matter in the draft Code of practice for the Investigation of Crimes of Piracy and Armed Robbery against Ships (MSC/Circ.984) article (2.2) (The Code of Practice). The Code of Practice defines “Piracy “and “Armed Robbery against Ships” as follows;

Piracy means unlawful acts as defined in article 101 of the 1982 United Nations Convention on the Law of the Sea (UNCLOS):

ARTICLE 101

Definition of Piracy consists of any of the following acts: a) any illegal acts of violence or detention, or any act of depredation, committed for private ends by the crew or the passengers of a private ship or a private aircraft, and directed- (i) on the high seas, against another ship or aircraft, or against persons or property on board such ship or aircraft; (ii) against a ship, aircraft, persons or property in a place outside the jurisdiction of any State; (b) any act of voluntary participation in the operation of a ship or of an aircraft with knowledge of facts making it a pirate ship or aircraft; (c) any act of inciting or of intentionally facilitating an act described in subparagraph (a) or (b).

“Armed Robbery against Ships means any unlawful act of violence or detention or any act of depredation, or threat thereof, other than an act of “piracy”, directed against a ship or against persons or property on board such ship, within a State’s jurisdiction over such offences”

The above definitions now cover actual or attempted attacks whether the ship is berthed, at anchor or at sea.

PIRACY PRONE AREAS AND WARNINGS Mariners are warned to be cautious and to take necessary precautionary measures when transiting the following areas: SOUTH EAST ASIA AND INDIAN SUB CONTINENT Bangladesh - Attacks have been reported at Chittagong at berth and anchorage. India – Chennai, Kandla Indonesia – Anambas/Natuna Island, Balikpapan, Belawan, vicinity of Bintan Island, Dumai, Gaspar (Gelasa)/Leplia Straits, Pulau Laut, Tanjong Priok (Jakarta). Malacca Straits – Avoid anchoring along the Indonesian coast of the straits unless required for urgent operational reasons. Waters off North Sumatra / Aceh coast / off Belawan is particularly risky. Numerous violent attacks and ‘kidnap and ransom’ cases had been reported in the past. Pirates armed with guns and knives are known to have shot at vessels to stop them. Although there is no report of armed robbery attacks or piracy in the northern areas after the devastating earthquake and resulting Tsunami which struck Northern Sumatera in December 26, mariners are advised to continue maintaining a strict anti piracy watch as the area has not been downgraded to a safe level. The Piracy Centre is monitoring the situation. Further south in the straits, pirates armed with machetes/knives and small arms normally attack/rob vessels. Malaysia – Sandakan Singapore Straits – The straits have been relatively safe and free from attacks for a long period but during the year, there were numerous attacks. AFRICA AND RED SEA. West Africa – Abidjan, Conakry, Dakar, Douala, Freetown, Lagos, Tema, Warri. Gulf of Aden/Red Sea – Numerous pirate attacks have been reported by ships and yachts in the Gulf of Aden. Some of the yachts were fired upon. Somalian waters – Eastern and Northeastern coasts have been high-risk areas for hijackings. Whilst there have been no recent incidents, ships not making scheduled calls to ports in these areas should stay away from the coast. SOUTH AND CENTRAL AMERICA AND THE CARIBBEAN WATERS. TRENDS The total number of worldwide reported attacks reduced to 325 as compared to 445 in 2003. Though the numbers have dropped the violence continues and remains at high levels. A significant drop was also noticed in the year 2001 (335 attacks) compared with year 2000 (469 attacks) but the following years the number had again increased to 445 attacks in the year 2003. Violence continues to rise and the number of crew killed increased to 30 from 21 in 2003. Hijackings of tugs and barges and kidnapping crews from these boats continue to increase especially in Indonesian waters. The IMB is particularly concerned over the increasing number of crew being kidnapped for ransom in the northern Malacca Straits, off North Sumatera. In the past, these attacks were believed to be solely the work of Aceh rebels, though there are now increasing indications that crime syndicates are also operating from fishing boats and are staging copycat kidnaps which they see as an easy way to make money. It appears that when the Authorities increased patrols in the hot spots, the attacks moved to another area. However, after the Tsunami that wreaked havoc in these areas on 26 December 2004, the attacks had halted. It may be that some pirates were killed in the Tsunami, but certainly it is the case that their equipment like boats and weapons may have been lost or destroyed. Similarly, the increased presence of naval ships off Aceh may be a deterrent factor. The IMB has not downgraded the area to a safe level and would continue to monitor the situation. Indonesia continues to record the highest number of attacks with 93 reported incidents in 2004. Although it is a welcome drop from 121 in 2003 it still accounts for more than one quarter of the worldwide piratical attacks. Attacks in Malacca Straits are ranked second highest with 37 incidents. Many of these attacks were serious and involved vessels being fired upon and crew kidnapped for ransom. Unfortunately, 3 crewmembers were injured, 4 crewmembers were killed and 36 were kidnapped in 2004 in the Malacca Straits. This is the second highest number of attacks in the Malacca Straits since the IMB Piracy Reporting Centre commenced compiling statistics in 1991. The highest number recorded was 75 incidents in 2000. Nigeria ranked third highest with 28 reported attacks. These attacks were violent and Nigeria is regarded as the most dangerous area in Africa with regards to piracy and armed robbery. Other countries and areas where there is a marked increase of reported attacks include Singapore Straits, South China Sea and Haiti. There is a welcome drop in the number of attacks in Philippines, Vietnam, Bangladesh, India, Colombia, Venezuela, Dominican Republic and Red Sea/Gulf of Aden. Bangladesh has seen a vast improvement with only 17 attacks recorded compared with 58 attacks in 2003. The IMB hopes that the Bangladeshi Authorities would continue to patrol their waters. The impressive figures from Bangladesh showed that when the Authorities are committed to tackling piracy and provide the necessary resources, the attacks would eventually reduce. Even though there were only two recorded attacks in Somalia, the eastern and northeastern coasts remain a high-risk area for hijackings. With no proper government agencies in Somalia available for assistance, ships hijacked by pirates are detained until a substantial ransom is paid. IMB has continued to advise that ships not specially calling Somali ports should keep well clear of the Somali coast. Improved reporting and rapid collation of data has enabled the IMB Piracy Reporting Centre to issue several warnings so far this year in sufficient time to enable a positive response from respective government patrols in the affected areas such as North Sumatera, Malacca Straits, Singapore Straits, Kalimantan coast / Makassar Straits and Lagos in Nigeria. In some cases, early and subsequent action by government patrols boats in the affected areas concerned has seen pirate activity dissipate quickly.

OBSERVATIONS Narrations of the 325 incidents for the year 2004 can be found on pages 29 to 74. The following serious incidents in chronological order are described in more details. First Quarter of 2004 Malacca Straits : On 5 January 2004, while underway, an Indonesian product tanker MT Cherry 201 was attacked and hijacked by armed pirates in the Malacca Strait. Pirates armed with guns boarded the ship and took 13 crew members hostage. They later released the Captain so that he could convey their demand for ransom. After one month of negotiations with the owners, the pirates shot dead four crewmembers. The remaining eight crewmembers jumped overboard and escaped. On 2 February 2004, in another incident, while underway, a Malaysian fishing trawler was attacked by armed pirates off Pulau Jerajak, Malacca Straits. Twelve pirates pretended to be fishermen from Indonesia approached the trawler under the pretext of buying fish. Once they got closer, five pirates armed with M16 rifles jumped onto the trawler. They took hostage the skipper and the nine crew members. They ordered the skipper to contact the Owner and demanded a ransom of RM500,000 (Approximately USD 132,000). While the skipper was talking to the Owner, the pirates let off a few shots in the air. Pirates took the hostages to Aceh and beat them up. They stole the trawler’s equipment, documents and catch of fish. On 05 February 2004, the hostages were released after the owners paid a ransom of a lower amount. Venezuela : On 28 January 2004, while underway, a South African catamaran Joe’s Dog was attacked by armed pirates at approximately 0900 Hrs LT in position Latitude 11: 41.9 North and Longitude 062:39.3 West, off Testigos, Venezuela. Ten armed pirates in a high speed boat came alongside the catamaran and requested water from the Italian crew members. They suddenly opened fire and minutes later; two of the pirates boarded the catamaran and shot the captain in the head killing him instantly. They stole crew cash, personal belongings and escaped. A cargo ship assisted and escorted the catamaran to Los Testigos where the crew lodged a report with the Venezuelan Coast Guard. Vietnam : On 31 January 2004, three pirates armed with guns opened fire at two Vietnamese fishing boats off Kien Giang province. They came alongside and forced all 18 crew members to jump overboard. Pirates escaped with the fishing boats and fishing gear and headed towards Thailand. One crew member was seriously injured. After several hours in the water, 15 fishermen including the injured man were rescued by a passing Malaysian cargo ship. The remaining three crewmembers are feared dead. In another earlier incident, on 16 January 2004, pirates armed with guns attacked two Vietnamese fishing boats underway at Vietnam’s southern coast. They killed one crew, injured another and forced the remaining 15 crew members overboard. Five crew members are missing and the rest were rescued by other fishing boats.

Bangladesh : On 7 February 2004, a Mongolian Bulk Carrier, MV Star-4 was attacked by armed pirates at 0300 Hrs LT at Chittagong Outer Anchorage. A gang of armed pirates boarded the ship and shot two watchmen when they tried to resist the pirates. Pirates stole ship’s property and escaped. The two injured watchmen were rescued by a tug boat and sent to the shore hospital where they succumbed to their injuries and died. Indonesia : On 9 February 2003, while underway, an Indonesian tugboat Singsing Mariner and barge Kapuas 68 were hijacked by armed pirates between Lingga and Bintan Island. Pirates boarded the barge and kidnapped all five crew members and landed them at Mesanak Island. Later, the local police managed to arrest the pirates. The tug unaware of the kidnapping of the barge crew continued sailing. The tug boat last contacted the Owner on 12 February 2004 at 1500 Hrs LT. Thereafter, there was no communication from the tug and barge. The tug and barge were subsequently hijacked by another gang of pirates. The IMB sent out an alert to ports and authorities in the region. On 13 March 2004, the IMB received information on the location of the tug and barge. Both were subsequently detained by the Royal Thai Marine Police. Nigeria : On 11 February 2004, while underway, a Liberian flagged barge carrier MV Baco-Liner was approached by four pirates armed with automatic weapons during a passage to Warri. Pirates in a speed boat demanded cash for safe passage. After receiving the money, the pirates claimed the amount was not enough. They then fired 20 to 30 shots where five to six shots hit the ship’s hull and superstructure. On 23 March 2004, armed pirates in six boats surrounded MCT Almak, a Liberian tanker underway in Warri river and ordered her to anchor. They then ordered the tanker to pump gasoline (cargo) into a barge they had brought alongside. Pirates released the tanker after stealing about 650 MT of cargo Second Quarter of 2004 Nigeria: On 7 April 2004, while at anchor, a Nigerian chemical tanker MT Ashabi was attacked by armed pirates at approximately 0104 Hrs LT in position 05:28 North and 005:05 East, at Escravos Anchorage, Nigeria. Five pirates armed with machine guns in a boat approached the ship. The anti-piracy crew raised alarm and directed the foam monitor at the pirate boat. Pirates opened fire at the duty crew who retreated into the accommodation and locked all the doors. Pirates boarded and tried to enter the accommodation but did not succeed. They then started shooting at the portholes and wheelhouse door and tried to enter the bridge. Some of the crew hid in their cabins and engine control room. Pirates managed to enter the bridge and took the chief engineer hostage. They took him to his cabin where he gave them USD100 which the pirates threw away and demanded thousands of US dollars. When the pirates were unable to get more cash, one of the pirates hit the C/E with an axe. The pirate gang leader ordered another pirate to shoot the C/E who deflected the gun barrel and the bullet went into the deck. Pirates left after 30 minutes taking with them some ship’s stores and equipment. The Second and Third Officers suffered injuries from shrapnel and glass due to gun fire.

Philippines: On 11 April 2004, while underway, a Malaysian tugboat East Ocean 2 and barge Sarinto 1 was attacked by armed pirates in the vicinity of Taganak Island, Sulu Sea, Philippines at approximately 1900 Hrs LT. A group of eight to ten pirates in black uniforms and armed with M16 rifles and grenade launchers boarded the tug towing the barge. They destroyed the radio equipment and stole the tug’s property. They kidnapped the master and two crew members and later fled in a speedboat towards the islands in Southern Philippines. Seven other crew members who hid in the lower deck were unharmed and sailed the tug and barge to Sandakan port and made a police report. Later, the pirates demanded a ransom for the release of the crew members. Philippines: On 17 April 2004, pirates armed with guns attacked and opened fire at a Philippine fishing boat while underway off General Santos City, Celebes Sea, Philippine. They stole personal belongings from crew. They killed two crew members and escaped. Four other crew members are still missing. Malacca Straits: On 25 May 2004, while underway, a Singaporean General Cargo ship, MV Berjaya II was attacked by armed pirates in the Malacca Strait in position 03:33.49 North and 099:41.8 East at approximately 1700 Hrs LT. Pirates in a speed boat opened fire at the ship forcing her to stop. Four robbers with machine guns and grenades went to the bridge and damaged all the communication equipment. They kidnapped the master and chief engineer and seized all the ship’s trading documents and warned the crew not to proceed to Belawan, which was the next port of call. The ship then proceeded to Pulau Angsa, West Malaysia. Pirates later demanded ransom for the release of the master and C/E. On 8 June 2004, an Indonesian General Cargo ship, MV Ika Murni, while underway was attacked by armed pirates in the Malacca Strait near Berhala Island at approximately 0800 Hrs LT. About 20 pirates boarded the ship and kidnapped the master and chief engineer. 12 crew members jumped overboard and were rescued by fishing vessels in the vicinity. The abandoned ship was later towed back to port. Pirates are demanding a ransom for the release of the master and chief engineer. On 11 June 2004, while underway, a North Korean General Cargo Ship, MV Yon Pung Ho was attacked by armed pirates in the Malacca Strait at position 04:03.18 North and 099:21.34 East at approximately 0310 Hrs LT. Pirates in a speed boat opened fire at the ship to force her to stop. Crew raised the alarm and the attempted boarding was aborted by the pirates. Two crew members were injured due to the heavy gunfire. On 11 June 2004, an Indonesian Product Tanker, MT Pematang/Pertamina 1021 was attacked and hijacked by armed pirates in the Malacca Strait off Pulau Berhala. One of the crewmembers managed to alert the Authorities. The Indonesian Navy (TNI) stormed the ship and shot dead 3 pirates suspected to be GAM rebels. Other pirates managed to flee. Three AK 56 automatic guns and bullets were seized from the victims. Earlier, it was reported that the pirates had demanded 500 million Rupiah (USD52,630) ransom. On 13 June 2004, while underway, a Singapore tug, Britoil 29 was attacked by armed pirates at position 05:03 North and 098:45 East in the Malacca Strait at approximately 1800 Hrs LT. Pirates armed with guns in eight small boats open fire at the tug towing a barge. Pirates in the boats indicated that they would continue to fire unless the tug slowed down and stop. The tug stopped and seven armed pirates boarded. They stole cash, crew personal belongings, ship’s documents and kidnapped the master and chief engineer. They threatened the chief officer not to alert the Authorities for 5 days or the master and C/E would be killed.

India: On 26 May 2004, while at anchor, a Liberian Container ship, MV Tiger Cloud was attacked by armed pirates during the hour of darkness at Chennai Roads, India. Four robbers in a boat boarded the ship using grapnel hooks attached to a rope. While another four waited in the boat. Alert crew spotted the pirates and raised alarm. Pirates stabbed one of the crew and escaped empty handed. During the same night/morning, the same pirates again attempted to board another container ship MV Ruhunupura at anchor. Alert crew raised alarm and contacted the Port Trust and Coast Guard who had then deployed a patrol vessel. The Coast Guard vessel arrived at the scene and pirates tried to flee in a speed boat but they were chased and apprehended with their knives and swords. Pirates were handed over to the local police. Somalia: On 20 June 2004, a U.K. yacht Alcor was attacked by armed pirates at approximately 1100 UTC in position 10:30 North and 051:15 east, off Raas Xaafuun, Somalia. Nine pirates in a fishing boat approached the yacht, which was anchored for attending an injured crew. Pirates in the boat initially waved their hands and behaved friendly but then suddenly they raised their machine guns and shot at the yacht causing damage. Crew of the yacht retaliated by opening fire at the boat, which retreated and fled. Not willing to risk the pirates returning with reinforcement, the yacht immediately hauled its anchor and sailed away. Madagascar: On 27 June 2004, while at anchor, a Greek Bulk Carrier MV African Trader was attacked by pirates at approximately 0400 Hrs LT in Majunga Inner Anchorage, Madagascar. Three pirates boarded the ship and hit the Duty A/B on the head and neck a few times causing serious injuries. They stole the forward liferaft and escaped. The injured crew was rushed to hospital for treatment. Malacca Straits: On 11 June 2004, while at anchor, an Indonesian product tanker MT Pematang / Pertamina 1021 was attacked by armed pirates at approximately 1625 Hrs LT in position Latitude 03:36 North and Longitude 099:15.5 East, 28 miles off Belawan. The ship had earlier sailed from Dumai decided to anchor to clean and gas free the slop tanks and to prepare for dry docking. Approximately 10 pirates armed with machine guns in a boat approached the ship. They opened fire at the tanker and 6 pirates boarded while 4 others remained on their speed boat. They ordered the master to surrender all ship’s document. All crew were gathered at the crew messroom. During the attack, the Radio Officer managed to send a distress message to the Indonesian Navy. The Navy sent a patrol boat KRI KS Tubun to the location. Using their own satellite phone, pirates ordered the master to contact the ship’s Manager for ransom money. Due to off office hours, there was no response from the Managers. When the TNI patrol boat approached the tanker, the speed boat with the four pirates fled. At 2245 Hrs LT, when the TNI Naval personnel boarded the tanker, the pirates hid in the engine room. Most of the crew were evacuated to the forecastle Bosun Store.

At approximately 0100 Hrs LT, the TNI Navy personnel started to move from forward main deck to the accommodation area. All watertight doors had been closed and locked from the outside except for the poop deck access. All lightings were switched off. At approximately 0210 Hrs LT, battle between TNI Naval personnel and the rebels ensued. At approximately 0430 Hrs LT, the gun battle stopped. 3 pirates were killed and 3 others went missing. Indonesian Authorities claimed that the pirates were suspected GAM rebels although there was no official confirmation. Third Quarter of 2004 Malacca Straits: On 26 July 2004, while drifting for engine repairs, a South Korean Bulk Carrier MV Hanjin Tampa was attacked by armed pirates in position Latitude 04:48.4 N and Longitude 098:38.9 East at approximately 0910 Hrs LT. A group of pirates armed with guns in a fishing boat boarded the ship and opened fire causing damaged to the bridge windows. They later fled. Fortunately there were no injuries to the ship’s crew. The same day, while underway, an Indonesian landing craft Muara Sele was attacked by armed pirates off Pulau Jarak. Pirates boarded and stole the craft’s fuel and radio equipment. They then kidnapped the master and chief engineer for ransom money. In another incident on 30 September 2004, while underway, a Tuvalu tug TB Rinco and a Singapore barge Surya Nawa I were attacked and boarded by armed pirates in position Latitude 03:27.6 North and Longitude 099:47.2 East at approximately 1900 Hrs LT. Pirates broke the window and stole the boat’s equipment, satellite phones, hand phones and documents. They then kidnapped the master and chief engineer for ransom money. The Owners were in the process of negotiating with the pirates for the safe release of the master and chief engineer. Indonesia: On 26 July 2004, while at anchor, a Panamanian LPG carrier MT Antares Gas was attacked by armed pirates in position Latitude 06:01 South and Longitude 105:55 East at approximately 2040 Hrs UTC. Five robbers armed with guns and knives boarded the tanker. They fired several shots at the duty A.B. who fortunately escaped unhurt. The duty Officer raised the alarmed and robbers escaped with ship’s stores and equipment. In another incident on 30 July 2004, while at anchor, a Vietnamese product tanker was attacked by armed pirates in position Latitude 06:00.97 South and Longitude 106:53.73 East at approximately 1205 Hrs LT. It appears that it may be the same robbers who had attacked MT Antares Gas earlier on 26 July 2004. The five robbers armed with knives boarded the ship from a boat using a hook and a rope. They attacked the seafarer / oiler who was on anti-piracy watch on the poop deck. They strangled and choked him to prevent him from raising the alarm. The robbers stole ship’s safety equipment and crew personal belongings and escaped in an unlit boat. Peru: On 27 September 2004, while at berth, a Philippine Bulk Carrier, MV Handy Tiger was attacked by armed pirates at Conchan at approximately 0130 Hrs LT. Five robbers armed with guns boarded the ship and took hostage the security guard on patrol. He was severely beaten by them. The shore security patrol responded with an exchange of gunfire. The robbers stole ship’s stores and managed to escape in a high-speed boat.

Sierra Leone: On 2 August 2004, while at anchor, a Cyprus General Cargo ship, MV Patraikos II was attacked by armed pirates in Freetown outer anchorage at approximately 0420 Hrs LT. Ten robbers armed with guns approached the ship. When the ship’s crew spotted them, robbers opened fire at them. The robbers boarded the ship by using hooks, smashed all cabin doors, held the crew at gunpoint and stole their cash and personal belongings. The robbers left at 0500 Hrs LT. Master managed to contact the Port Control whilst the robbers were onboard. However, the Port officials only boarded after 0700 Hrs LT. Four crewmembers were injured and hospitalised. United Arab Emirates: On 20 June 2004, an U.A.E. fishing vessel Victorious R151 was hijacked by armed pirates at approximately 1800 Hrs LT in position Latitude 26:10 North and Longitude 055:44 East, off Saleh Maritime Oilfield. Five pirates in a boat approached the vessel and boarded it. They attacked the master and hijacked the fishing vessel. They then abandoned the crew on an unmanned platform in the middle of the sea. Crew were later rescued on the following day. No one was injured. Fourth Quarter of 2004 Haiti : On 7 September 2004, while at anchor, a Panamanian General cargo ship MV Florida Star I was attacked by armed robbers at Miraguane. Robbers armed with guns boarded the ship and shot the master. They also threatened and assaulted the crewmembers. Robbers stole ship’s property and escaped. Somalia : On 21 September 2004, a general cargo ship was attacked by armed pirates while underway approximately 100km off Mogadishu, Somalia. The ship was sailing from Yemen to the port of Eelman in southern Somalia. Fifteen pirates armed with guns approached the ship in two speedboats and ordered it to stop. They boarded the ship, which had a cargo of mostly food items and ordered the Captain to anchor close to the coast. The 21 crewmembers were led away to nearby villages where they are reportedly still being held hostage. Malacca Straits: On 02 October 2004, a Singapore tug Erna towing a barge Kingpin was attacked by armed pirates at position Latitude 04:46 North and Longitude 098:41East at approximately 1820 Hrs LT. Eight armed pirates believed to be Indonesians in a fast fishing boat fired, causing damage to tug’s wheel house windows and destroying all radio and navigational equipment. Four pirates armed with guns boarded the tug and stole crew belongings and tug’s documents. They escaped after kidnapping the master and chief engineer. The chief officer later took command and sailed the tug to Singapore. The remaining crew onboard were in a state of shock. All pirates were said to be plainly dressed with civilian clothes and were aggressive. In another incident on 27 November 2004, tug Svitzer Damka towing another tug Svitzer Mora was attacked by armed pirates at position Latitude 04:58.9 North and Longitude 098:26.0 East at approximately 0910 UTC. The tugs were on passage from Singapore to Middle East. Pirates armed with machine guns from a fishing boat fired at the tugboat. They boarded the tugs and went to the bridge. They stole the tug’s documents and property. They escaped kidnapping two Captains, one chief officer and one Cook. At 1900 Hrs UTC, the pirates again boarded the tug Svitzer Damka and disconnected all VHF wires and took away the GPS system. The tugs later decided not to wait for the Indonesian Authorities and sailed towards Malaysia for safety.

In another related incident on 30 November 2004, a Malaysian tug Masindra 13 towing a barge Tropical Jaya on passage to Iran was attacked by approximately 50 armed pirates at position Latitude 05:06.09 North and Longitude 098:36.07 East at 1425 Hrs LT. The armed pirates believed to be Indonesians in fishing boats boarded the tug that had 12 crew onboard and kidnapped the master and chief engineer and stole the tug and barge documents before escaping. Later at 1925 Hrs LT, the tug and barge was again attacked by armed pirates believed to be Indonesians. Pirates surrounded the tug and barge and started firing at them. Crewmembers were threatened and ordered to release the barge under threat of gunfire. Indonesia : On 23 October 2004, a Norwegian Bulk Carrier MV Jorita was attacked by armed pirates while underway at position Latitude 02:57 South and Longitude 107:18 East, 3 nm west of Mendanau Island, Gelasa Straits, Indonesia at approximately 1130 Hrs LT. Six armed pirates wearing masks and black clothes in a grey coloured speedboat approached the ship. They fired at the ship’s superstructure and ordered the ship to stop. Master raised alarm, sounded ship’s whistle and took evasive manoeuvres. Pirates aborted the attempt and fled. Malacca Straits : On 3 November 2004, a Dutch tug Smitwijs London and a Marshall Islands jack-up rig Ocean Sovereign were attacked by armed pirates while underway at position Latitude 05:02 North and Longitude 099:11 East at approximately 1930 Hrs LT. The tug and rig had sailed from Singapore bound for Chittagong, Bangladesh. Several “fishing boats” were seen following the tug and rig. One boat came close which was visible in the floodlights. Suddenly, the pirates onboard the boats started firing at the tug causing extensive damage to the navigation equipment, bridge windows and superstructure. In response, the tug’s crew switched on lights, activated fire hoses and fired three rocket flares at the boats. Pirates continue to fire with automatic weapons and came within 50 metres. The tug then took evasive manoeuvres and pirates moved away. Crewmembers were badly shaken after the incident. Nigeria : On 25 November 2004, an Italian product tanker MT Allegra was attacked by armed robbers while at anchor at position Latitude 06:19 North and Longitude 003:23 East, off Lagos at approximately 2345 Hrs LT. Fifteen robbers armed with guns and long knives boarded using hooks and ropes and took hostage the duty A/B. Upon boarding, they fired all around. The Duty officer raised alarm, crew mustered and locked accommodation doors. The robbers proceeded to the bridge and ordered the Duty officer to shut off all communication equipment. They took hostage the master and threatened and manhandled the crew. They then forced the master to open the ship’s safe and stole ship’s cash, ship’s property and crew personal belongings. The robbers then fled in two speedboats at 0030 Hrs LT. Master and four crewmembers sustained injuries in the attack. All the crew was in a state of shock. The duty officer tried to contact the port control but received no response. In another incident, on 29 November 2004, a Panamanian refrigerated cargo ship Frio Atlantic I, was attacked by armed pirates while underway at Buoy No. 19, Eskravos River, Nigeria at approximately 0145 Hrs LT. Five pirates armed with machine guns boarded the ship and took hostage the duty watchman and beat him up. They fired at the crew, stole cash from the ship’s safe, ship’s property and crew personal belongings before escaping. Again in another incident, on 2 December 2004, a Nigerian LPG tanker MT Awero was attacked by armed robbers while at anchor at Lagos Roads, Nigeria at approximately 0130 Hrs LT. Twelve robbers armed with guns, knives and axes in speedboats approached the tanker. The Second Officer directed searchlights but the robbers nevertheless boarded and rushed to the bridge. They ordered the Second officer not to raise the alarm and threatened the master with a gun pointed to his temple and a knife at his throat and demanded money. They also threatened the chief officer demanding more money. The Chief officer overheard the robbers saying that they wanted to kill one crew to force the

other crewmembers to cooperate. Fortunately, one robber did not agree and it was not carried out. The robbers stole ship’s cash and then proceeded to the crew’s cabins and stole cash and valuables. They fled at 0145 Hrs LT. Master received knife wound on his throat and some crew members were assaulted. Indonesia: On 10 December 2004, a Singaporean tug Surya Wira I and barge Surya Nawa 9 was attacked by armed pirates while underway at position Latitude 00:05.27 South and Longitude 103:58.43 East at approximately 2030 Hrs LT. Ten pirates armed with guns boarded the tug and hijacked her. They then cut off the towing hawser, setting the barge adrift. Later, they landed the ten crew members in Jambi, Sumatera and sailed away. The IMB Piracy Reporting Centre coordinated the search with the Indonesian Navy who had dispatched an aircraft and four patrol boats and warships and the tug was located and detained on 12 December 2004. Several pirates were detained by the Navy. The tug was then escorted to the Navy’s HQ in Jakarta. Philippines : On 14 December 2004, while underway, a Singaporean tug Christian and Barge Flora were hijacked while en-route from Philippines to Banjarmasin, Indonesia. The last contact the owners had with the tug was on 14 December 2004 at position Latitude 05:34 North and Longitude 119:22 East. Thereafter, there was no communication with the tug. On 25 December 2004, the tug and barge was later spotted at Semporna, Sabah but managed to disappear again. The tug was subsequently located and recovered at Tawau. The fate of the 9 crew members is still unknown. Malacca Straits: On 15 December 2004, a Singapore tug-boat Ena Sovereign was attacked by armed pirates while underway at position Latitude 05:59 North and Longitude 098:56 East at approximately 2150 Hrs LT. The tug towing a barge had sailed from Singapore bound for Mumbai, India. A group of twenty pirates armed with machine guns in two fishing boats fired at the tug and barge. They boarded the tug and kidnapped the master and chief engineer, stole tug’s document and crew’s property and cash and escaped. The tug with the remaining 10 crew then proceeded to Penang, Malaysia to seek refuge and await instructions from owners.

PIRACY RELATED NEWS ShipLoc There are a number of other reliable ship tracking devices available on the market today based upon Inmarsat and other satellite systems. The IMB endorses ShipLoc, an inexpensive satellite tracking system, which allows shipping companies, armed only with a personal computer with Internet access, to monitor the exact location of their vessels. It is a non-lethal, electrifying fence surrounding the whole ship, which has been specially adapted for maritime use. The fence uses 9,000-volt pulse to deter boarding attempts. An intruder coming in contact with the fence will receive an unpleasant non-lethal shock that will result in the intruder abandoning the attempted boarding. At the same time an alarm will go off, activating floodlights and a very loud siren. The IMB strongly recommends ship owners to install this device on board their ships. Further details can be obtained at www.secure-ship.com. For safety reasons it cannot be deployed on vessels carrying inflammable cargoes. Post Tsunami piracy in the Malacca Straits Reports received by the PRC indicate piracy and armed robbery attacks in the Malacca Straits had ceased due to the devastating Tsunami that had wreaked havoc in North Sumatra with a large number of casualties on 26 December 2004. Even unaffected areas in central and south Malacca Straits recorded zero attacks since 26 December 2004. It is probable that once life resumes normally in North Sumatra crime will return and with it attacks against ships. The pirates like the rest of the population have lost vital equipment and some even their lives. When the attacks resume, it is vital that the law enforcement agencies respond quickly and positively to prevent it being seen by criminals as an easy option. IMB warns ships transiting the Malacca Straits to continue maintaining a strict anti piracy watch even-though there were no attacks recorded since the Tsunami hit Northern Sumatera on 26 December 2004. The IMB has not downgraded the Malacca Straits to a safe level and is currently monitoring the situation. Tracker proves timely for hijacked tug and barge Swift action by the IMB Piracy Reporting Centre and the Indonesian Navy secured the recovery of a hijacked tug and barge in under 36 hours in December 2004. Key to the success of the operation was the fact that both the tug and barge were fitted with tracking devices that not only alerted the owners the moment the vessels deviated from their intended course but also ensured they could be tracked throughout the recovery operation.

The incident proves beyond doubt that tracking devices can play a vital part in the security of modern maritime commerce and owners should consider fitting them to their vessels as a matter of priority. The benefits of tracking devices have been demonstrated on several occasions and with increased take-up of the systems the costs can be as low as $60 - $70 per month per vessel depending on the number of units fitted. In the latest case, the Singapore owners of the tug Surya Wira I were able to notify the Piracy Reporting Centre in Kuala Lumpur of the hijack within hours of the attack when the vessel missed a routine radio check and using the tracking system, confirm that the tug had altered course from her intended voyage to Lumut, Malaysia and was now heading towards Kalimantan. She had departed Sumatra two days earlier towing a 70ft long barge loaded with 4,200 tonnes of coal. The message was immediately passed on to the Indonesian Navy, which notified its two patrol boats in the area and began mobilizing other Navy ships and planes to proceed to the area. In total, 2 planes and 4 vessels searched for the tug and found her within 24 hours despite the fact her name had already been painted out and her colour changed from white to blue by the hijackers within this short period. A warning shot was fired and the four pirates remaining onboard surrendered immediately. The other six had apparently fled earlier in a speedboat and the tug’s crew of nine Indonesians had been put ashore in south Sumatera. Surya Wira I was attacked by 10 pirates who raked the tug with gunfire from a speedboat before boarding her. Once onboard, they cut the barge loose and left it drifting unmanned and unlit, and a danger to shipping. Fortunately, the barge was also fitted with a tracking device and with knowledge of her position, was spotted by a Navy plane south of Batam. A tug was sent to tow it to Batam whilst Surya Wira I was escorted to safe haven in Jakarta by the Navy. Commenting on the event, the International Maritime Bureau (IMB) which operates the Piracy Reporting Centre and acted as an additional communications link between the tug’s owners and the Indonesian Navy said the case once again demonstrated how the combined efforts of victims and national authorities could work together through a trusted intermediary to defeat piracy. IMB Director Pottengal Mukundan congratulated both parties on their pro-active response and said that he hoped operations like this could deter pirates operating in Indonesian waters, which remains one of the world’s most active piracy hotspots. On the subject of tracking devices, he said “The hijack of the tanker MT Selayang” in 2001 in the same area proved the value of tracking devices such as “Shiploc” and there have been several cases since where they have been of great help in either indicating something is wrong at an early stage or assisting to locate vessels known to be in the hands of pirates. “It is worth bearing in mind that without these relatively cost effective devices the IMB PRC has to rely on its extensive network of informants and whilst efficient, the use of such people invariably adds to the cost of any recovery and increases the time taken to act.” “And with tugs and tows an increasingly popular target for pirates, I urge underwriters to add their weight to the argument by encouraging owners to fit tracking devices, which as we can see have a growing role in the defeat of piracy.” Redefining piracy could detract attention from the problem The IMB agrees in principle with a recent Malaysian claim that piracy cannot be equated to terrorism but has stopped short of endorsing its request that a new definition of piracy is needed. Malaysia’s Deputy Prime Minister Datuk Seri Mohd Najib Tun Razak said his country along with Singapore and Indonesia was seeking a new definition that would place piracy under categories of crimes to isolate them from terrorism. He added that it was necessary to show that piracy in

Malaysian waters and the Straits of Malacca was not as serious as world opinion currently perceives it. Najib has suggested to the IMB that acts of piracy be categorized under extortion, seizure, kidnapping and terrorism. Responding on behalf of the IMB, Director P. Mukundan said the organization’s view had always been that piracy and terrorism were completely separate crimes and that its recent meeting on piracy and maritime security held in Kuala Lumpur earlier in the year not only endorsed this but went as far as to challenge the piracy/terrorism link. Captain Mukundan stressed that piracy was always motivated by commercial gain whilst terrorism invariably sought political gain. And he points out that the majority of acts defined as piracy by his organization could be clearly seen to be motivated by commercial gain whether this was to seize crew money and property, hijack ships to steal their cargoes or hold hostages for ransom to raise money. In fact, he noted the only clear case of maritime terrorism in recent years against a merchant vessel had been the bomb attack in October 2002 on the tanker MT Limburg in Yemen, whose perpetrators were recently jailed. The only other major case was a bomb planted on a ferry in the Philippines. Captain Mukundan said that the IMB’s comprehensive piracy reports already broke incidents down into various categories. This enabled readers to quickly see whether an attack was in port, at anchor or steaming, was an attempted or actual attack, involved hijacking, gave details of armed attacks by country, the number of crew killed, held hostage or injured etc. However, in the light of Najib’s comments, he said he was willing to look at the report’s structure again to see if further categories for incidents were required. In addition, Captain Mukundan said, “Many of the states are doing a great job to get to grips with the problem and the IMB stands ready to assist them in any way it can. “The only accurate way to assess the actual situation is via careful analysis of the facts. In respect of our Piracy Reports, I believe the facts are presented as accurately as possible based on the information we have. Our information comes from the best possible source – contemporaneous reports from ship masters and crew who are the front line victims of this crime.” “Piracy is a serious enough problem in its own right. We need to keep the public attention focused on it and I think any attempt to redefine piracy at this stage would only serve to confuse people at a time when we need their support,” he adds. Conference on safety of Malacca Straits in Jakarta A decision was made during the 93rd session of International Maritime Organization (IMO) Council’s meeting in London in November 2004 to hold a conference in July next year in Jakarta, Indonesia. The high level meeting is to discuss the security and safety of the Straits of Malacca particularly piracy and maritime terrorism. In an immediate reaction, the International Maritime Bureau (IMB) said the meeting was a step forward in addressing piracy problems in the busy waterway. Mr P. Mukundan, Director of the IMB said that the conference was useful in combating one of the world’s most pirate infested waters. He said the initiative would help strengthen the links formally and informally between the law enforcement agencies in Asia. “This kind of cooperation and understanding is invaluable. We are particularly glad that Jakarta has been chosen as the venue. Indonesia has had difficulties allocating resources to adequately address

this crime. We hope it signals the determination of the Indonesian government to deal with piracy and armed robbery against vessels” said Mukundan. Although some measures have been taken by the littoral states of Indonesia, Malaysia and Singapore against piracy, the attacks are still relatively high particularly in Indonesian coastal waters. The IMO said that the conference would consider ways and means of enhancing safety, security and environmental protection in the Straits of Malacca and Singapore. It will also cooperate with the littoral states and efforts to ensure these straits remained safe, secure and open to international navigation. This would be done via increasing awareness, sharing information, training personnel capacity and technical cooperation. The meeting would also touch on the Marine Electronic Highway project. Key representatives from the littoral states, user states and other stakeholders of the Straits are expected to attend.

While underway, twelve persons approached the trawlers fishing in the area under pretext of buying fish. Once they got closer, five armed men with M16 rifles boarded three fishing trawlers. They took hostage the skippers and nine fishermen. The leader forced one of the skippers to contact the owner and asked for a ransom of RM500,000 (about US$132,000). Pirates stole trawler’s equipment, documents and catch of fish. They then took the hostages to Aceh and beat them up. On 05.02.2004 the crew were released after the owners reportedly paid a ransom of RM180,000.

While underway, the tug and barge under tow were boarded by pirates who kidnapped all five crewmembers on the barge and landed them at Mesanak Island. The local police arrested the pirates. The tug unaware of the kidnap of the barge crew, continued sailing. The tug last contacted the owners on 12.02.2004 at 1500 hrs. Thereafter, there was no communication from the tug and barge. On 13 March 2004, the IMB received information on the location of the tug and barge. Both were subsequently detained by the Royal Thai Marine Police.

While underway, pirates armed with AK 47 and AK 56 rifles hijacked a fishing boat with her 11 crewmembers. The Indonesian Navy acting on intelligence, spotted the boat and ordered her to stop. In an ensuing exchange of gunfire, the 11 crew jumped overboard and were rescued by the Navy. The three pirates remained in the boat defying orders of the Navy. Finally the Naval ship fired at the boat causing her to sink. Pirates, reportedly GAM rebels, jumped overboard. They were picked up and detained by the Navy.

They were beaten up and the Naval Officer demanded USD 5,000 in exchange for their release master negotiated this demand down to about half the amount plus provisions. 3/O was held captive until the master handed over the ransom money. The IMB-Piracy Reporting Centre reported the incident to the Indonesian authorities, who advised the IMB that they were investigating the matter.

They took ship’s documents, threatened crew and gathered them in messroom. Radio Officer managed to sent a distress message to the Indonesian Navy. The Navy sent a patrol boat KRI KS TUBUN to the location. Rebels asked master to contact owners for ransom. Master was unable to contact owners. When the TNI patrol boat approached the tanker, the speedboat with four rebels fled. When Naval personnel boarded the tanker, the rebels got frightened and hid in the engine room. Battle between Naval personnel and the rebels ensued at 0430 and three rebels were killed and three others went missing.

Master reported that there was little communication from the boarders except they were from Yemen.

Pirates opened fire at the duty crew who retreated into the accommodation and locked all doors. Pirates boarded and tried to enter the accommodation but did not succeed. They then started shooting at the portholes and wheelhouse door and tried to enter to the bridge. C/E was held by pirates and taken to his cabin. He gave USD100 which the pirates threw away and demanded thousands of US dollars. When pirates were unable to get more cash, one of the pirates hit C/E with an axe. The pirate gang leader ordered another pirate to shoot the C/E who deflected the gun barrel and the bullet went into the deck. Pirates left after 30 mins taking ship’s property. The 2/O and 3/O suffered injuries from shrapnel and glass. The ship later proceeded seawards.

The tug then took evasive manoeuvres and the pirates moved away. No physical injuries to crew but they were shaken after the incident.
