    municipal governments of Real, Infanta, and General Nakar will develop "green tourism" in this part of the

    province.

    CENRO-Real officer Milleth Panaligan, said they are looking for investors that are interested in establishing a zip

    line in the Sierra Madre Mountain Range and develop water rafting in Agos River in the area.

    The Sierra Madre Mountain Range has bountiful natural resources like water falls, rivers, plants and rare anima

    that could attract local and foreign tourists, thus, a good source of income for the people in the community,"

    Panaligan said.

    The CENRO, according to Panaligan has intensified its campaign to protect and preserve the forests and to

    complement the lack of needed foresters that will guard the forests areas by organizing 'Bantay Gubat' in the

    different barangays.

    In addition, almost 2,000 concerned citizens have joined the text brigade they organized that would relay unlawfactivities in the forests.

    The CENRO based in Real supervises and oversees the environmental operation in the towns of General Nakar,

    President Aquino signs into law a consolidated bill that will strengthen the Bureau of Corrections and safeguardthe basic rights of prisoners

    President Benigno S. Aquino III has signed into law a consolidated bill aimed at strengthening the Bureau of Corrections(BuCor) in a bid to promote the general welfare and safeguard the basic rights of prisoners.

    The Chief Executive signed on May 24 the Republic Act No. 10575 (An Act Strengthening the Bureau of Corrections(BuCor) and Providing Funds Therefore) otherwise known as The Bureau of Corrections Act of 2013.

    The law is a consolidation of House Bill 6887 and Senate Bill 3335 that were passed by the House of Representatives andthe Senate on February 5, 2013 and February 6, 2013, respectively.

    President Aquino said it is the policy of the State to promote the general welfare and safeguard the basic rights of every

    prisoner incarcerated in the country's national penitentiary.

    The State also recognizes its responsibility to strengthen government capability aimed towards the institutionalization ofhighly efficient and competent correctional services, the President said.

    The law seeks to modernize, professionalize and restructure the BuCor by upgrading its facilities, increasing the number oits personnel, upgrading the level of qualifications of their personnel and standardizing their base pay, retirement and othebenefits, making it at par with that of the Bureau of Jail Management and Penology (BJMP).

    Under the law, the BuCor shall be in charge of safekeeping and instituting reformation programs to national inmatessentenced to more than three (3) years.

    The safekeeping of inmates shall include decent provision of quarters, food, water and clothing in compliance with

    established United Nations standards. The security of the inmates shall be undertaken by the Custodial Force consisting Corrections Officers with a ranking system and salary grades similar to its counterpart in the BJMP.

    The reformation programs, which will be instituted by the BuCor for the inmates, shall include Moral and Spiritual ProgramEducation and Training Program, Work and Livelihood Program, Sports and Recreation Program, Health and WelfareProgram; and Behavior Modification Program, to include Therapeutic Community.

    The BuCor director and deputy directors shall serve a tour of duty not exceeding six years from the date of appointment.

    The BuCor, which operates with a directorial structure, shall be responsible for the conduct of classification of each andevery inmate admitted to the BuCor.

    "Aside from those borne of the provisions under Rule 8, Part I, Rules of General Application of the United Nations

    Standard Minimum Rules for the Treatment of Prisoners and that of the existing regulation of the BuCor on securityclassification (i.e. maximum, medium and minimum security risk), inmates shall also be internally classified by the DRDand segregated according to crimes committed based on the related penal codes such as Crimes Against Persons,Crimes Against Properties, Crimes Against Chastity, so on and so forth, as well as by other related Special Laws, Customand Immigration Laws," the President said.

    The BuCor shall employ full computerization in the build-up, maintenance and transmittal of necessary inmate records toall its Prison and Penal Farms and other recipient agencies.

    The BuCor shall maintain a custodial personnel-to-inmate ratio of 1:7 and reformation personnel to inmate ratio of 1:24.

    The Department of Budget and Management (DBM) shall rationalize the existing organizational structure and staffingpattern of the BuCor in accordance with the provisions of this Act and relevant compensation and position classificationlaws, rules and regulations.

    The Department of Justice (DOJ) shall design and establish a professionalization and qualifications upgrading program fopersonnel of the BuCor, in coordination with the Civil Service Commission (CSC) and the Commission on HigherEducation, through an off-campus education program or other similar programs within ninety (90) days from the effectivityof this Act.

    The law seeks to establish attrition system for the personnel of the BuCor within five (5) years from the effectivity of thisAct. Within six (6) months after the effectivity of this Act, the BuCor shall establish a system of promotion for the personneof the BuCor.

    The law also provides for the establishment of a performance evaluation system which shall be administered inaccordance with the rules, regulations and standards, and a code of conduct for the personnel of the BuCor to bepromulgated by the BuCor through the DOJ.

    The funds required for the implementation of this Act including personnel benefits shall be taken from the budget of theBuCor for the current fiscal year and also from the collections from clearances and certification fees, income frominstitutional projects subject to memoranda of agreements (MOAs), contracts or joint venture agreements; and othermiscellaneous incomes (outside MOAs and contracts), such as penal farm agro-production and inmate handicraft industry

    Such amounts as may be necessary to implement this Act shall be included in the annual General Appropriations Act.

    Under the law, the implementation of this Act shall be undertaken in staggered phases, but not to exceed five (5) years,taking into consideration the financial position of the national government: Provided, That any partial implementation shallbe uniform and proportionate for all ranks.

    The DOJ, in coordination with the BuCor, the CSC, the DBM and the Department of Finance (DOF), shall, within ninety(90) days from the effectivity of this Act, promulgate the rules and regulations necessary to implement the provisions of thAct.

    The BuCor, through the DOJ and the DBM, shall jointly submit to the President of the Senate and the Speaker of theHouse of Representatives an annual report on the implementation of this Act.

    This Act shall take effect 15 days after its complete publication in the Official Gazette or in at least 2 newspapers ofgeneral circulation, whichever comes earlier. PND (js)

    The Chief Executive issued the declaration through Proclamation No. 584 signed by Executive Secretary Paquito N.

    Ochoa Jr. on May 28, to give the people of Sagay the full opportunity to celebrate and participate in the occasion withappropriate ceremonies.

    The Aquino administration welcomed reports that the Philippine economy, as measured by the Gross Domestic Product(GDP) expanded by 7.8 percent in the first quarter of 2013, assuring that it remains focused on fostering inclusive growth

    Deputy Presidential Spokesperson Abigail F. Valte issued the statement during the regular press briefing in Malacanangon Thursday after the National Statistics Coordination Board (NSCB) reported that the Philippines GDP grew by 7.8percentthe highest quarterly growth rate posted under the Aquino administration.

    Valte said that the GDP figure is also the highest in a non-presidential election year since 1988.

    "Based on initial readings, our economy outperformed that of all Asian economies in terms of first quarter growth, includinChina, which grew by 7.7 percent, Indonesia, which grew by 6.0 percent, and Malaysia, which grew by 4.1 percent. Theseresults surpassed almost all market expectations," Valte said.

    "Growth was felt in almost all sectors, most notably in local manufacturing, which grew by 9.7 percent. The continuation ogovernment public expenditures was also key, increasing by 13.2 percent. This was helped by the growth in governmentspending in public construction, which expanded by 45.6 percent. By expenditure, capital formation likewise grew by 47.7percent," she said.

    Valte said the business confidence and consumer optimism fuelled the GDP growth.

    "Without doubt, the confidence of both investors and consumers remains strong, as economic activity accelerates even inan uncertain global economic climate," she stressed.

    Since the Aquino administration took office, the government has been working to drastically expand social safety nets tohelp the most vulnerable sector in country.

    "Most noteworthy is the four-fold increase in the budget of the Pantawid Pamilyang Pilipino Program, which to date hashelped more than 3.9 million Filipino households.     Aquino signs anti-drunk driving law

    President Benigno S. Aquino III signed into law on May 27 Republic Act 10586 or the Act Penalizing Persons DrivingUnder the Influence of Alcohol, Dangerous Drugs, and Other Similar Substances to protect the publics road safety fromthe ill-effect of these substances, a Palace announced on Thursday.

    The new law mandates drivers education to all getting licenses or renewing their licenses, Deputy Presidentialspokesperson Abigail Valte said in the press conference in Malacanang Thursday.

    The drivers education should now include the course on the information relative to safe driving, including theconsequences of driving or operating a motor vehicle under the influence of the those substances, she said.

    Under the new law, law enforcement agencies are empowered to conduct field sobriety, chemical, and confirmatory tests,Valte said.

    A law enforcer, suspecting a driver to be driving under the influence may pull him over and could ask to undertake asobriety test. Suspected individuals may be subjected to a breathalyzer to determine the alcoholic content in their system

    The law also mandates mandatory alcohol and chemical testing of drivers involved in motor vehicular accidents, whether resulted in death or in physical injuries.

    The law also calls for corollary acquisition of equipment to enforce the particular policy.

    Violation resulting to physical injuries or death carries a penalty of three-month imprisonment and a fine ranging fromP20,000 to P80,000, Valte said.

    Stiffer fines are imposed against offenders that caused physical injury, Valte explained. The fine goes up to P100,000 toP200,000 and also longer jail time.

    If the violation involves homicide, the fine goes up to P300,000 to P500,000 as well as imprisonment.

    With the approval of the law, the Philippine Information Agency, the Land Transportation Office, and the local governmentunits are mandated to conduct a nationwide information campaign for the effects and the parameters of the new law.

    The law will take effect 15 days after publication either in the Official Gazette or in two newspapers of general circulation.

    To protect the public from unscrupulous law enforcers who may take advantage of the implementation of the new law,Valte encouraged the public to report any abuse or wrongdoing by law enforcers.

    You can always report any law enforcement officer that willabuse this particular new law. The grievance mechanismsare in place and we do encourage the reporting of law enforcement officers who may want to take advantage of this newparticular law, she said.

    Law enforcers will undergo training for the implementation of the new policy and money will be available to governmentagencies in purchasing equipment for the implementation of the law. PND (as)

    President Aquino signs into law a consolidated bill amending the Overseas Absentee Voting Act of 2003

    President Benigno S. Aquino III has signed into law a consolidated bill amending the Overseas Absentee Voting Act of2003, allowing more overseas Filipinos worldwide to cast their votes in Philippine elections

    The Chief Executive signed last May 27 the Republic Act 10590 (An Act Amending Republic Act 9189, Entitled "An ActProviding for a System of Overseas Absentee Voting by Qualified Citizens of the Philippines Abroad, Appropriating FundsTherefor and for Other Purposes.")

    The Act otherwise known as "The Overseas Voting Act of 2013 is a consolidation of Senate Bill 3312 and House Bill6542.

    The Senate and the House of Representatives passed the consolidated measure on February 5, 2013 and February 6,2013, respectively.

    The amendment to Republic Act 9189 will provide easier access to overseas Filipinos through field and mobile registratiocenters.

    Under the law, Overseas Filipino voters may file their application personally at any post abroad or at designatedregistration centers outside the post or in the Philippines, as approved by the Commission on Elections (Comelec).

    All applicants shall submit themselves for live capture of their biometrics while the Comelec shall issue an overseas voteridentification card to qualified voters.

    With the passage of the law, overseas Filipino voters, who are not disqualified by law and at least 18 years of age on theday of elections, may be allowed to cast their votes not only in presidential and midterm elections, but in all nationalreferenda and plebiscites as well.

    The new law allows those who have reacquired or retained their Philippine citizenship under Republic Act 9225, otherwiseknown as the Citizenship Retention and Reacquisition Act of 2003 to cast their votes.

    Qualified Philippine citizens abroad who have previously registered as voters pursuant to Republic Act No. 8189,otherwise known as the Voters Registration Act of 1996, shall apply for certification as overseas voters and for inclusion ithe National Registry of Overseas Voters (NROV.)

    In case of approval, the Election Officer concerned shall annotate the fact of registration/certification as overseas voterbefore the voters name as appearing in the certified voters list and in the voters registration records.

    The law allows the creation of a Resident Election Registration Board (RERB) to be posted abroad. The RERB will havethe power to approve, disapprove, deactivate, reactivate and/or cancel registration records.

    The RERB in the Office for Overseas Voting (OFOV) shall be based in the main office of the Comelec and shall becomposed of a senior official of the Commission as the Chairperson and one (1) member each from the Department ofForeign Affairs and the Department of Labor and Employment, whose rank shall not be lower than a division chief or itsequivalent.

    No member of the RERB shall be related to each other or to an incumbent President, Vice-President, Senator or Memberof the House of Representatives representing the party-list system of representation, within the fourth civil degree of

    consanguinity or affinity.

    The Comelec shall maintain a National Registry of Overseas Voters or NROV containing the names of registered overseavoters and the posts where they are registered.

    "Likewise, the Comelec shall maintain a registry of voters (ROV) per municipality, city or district containing the names ofregistered overseas voters domiciled therein. The Commission shall provide each and every municipality, city or districtwith a copy of their respective ROVS for their reference, the law stated.

    The Comelec shall, through the posts cause the publication in a newspaper of general circulation of the place, date andtime of the holding of a regular or special national election and the requirements for the participation of qualified citizens othe Philippines abroad, at least six (6) months before the date set for the filing of applications for registration.

    The law mandates Comelec to adopt more efficient and reliable technology for onsite remote registration and elections.

    The law authorizes the Comelec to establish an Office for Overseas Voting (OFOV) tasked specifically to oversee andsupervise the effective implementation of the Overseas Voting Act.

    It also establishes the Overseas Voting Secretariat under the Department of Foreign Affairs to assist the OFOV, and to

    direct, coordinate and oversee the participation of the DFA in the implementation of the Overseas Voting Act.

    The amount necessary to carry out the provisions of this Act shall be included in the budgets of the Comelec and the DFAin the annual General Appropriations Act.

    The Comelec shall promulgate rules and regulations for the implementation and enforcement of the provisions of this Actwithin sixty (60) days from the effectivity of this act.

    This Act shall take effect 15 days after its publication in the Official Gazette or in at least 2 newspapers of generalcirculation. PND (js)

    Aquino signs laws creating additional courts

    President Benigno S. Aquino III signed five laws on May 24 creating additional courts in Pampanga, Rizal, Bohol, Cebu,Zamboanga Sibugay, and North Cotabato.

    The President signed Republic 10582 a law creating six additional branches of the regional trial court in the third judicialregion in Angeles City in Pampanga, amending Batas Pambansa 129 or The Judiciary Reorganization Act of 1980.

    The President also approved the Republic Act 10580 creating five additional branches of the regional trial court in thefourth judicial region to be stationed in Morong, Rizal. The new law also amends Batas Pambansa 129.

    Also signed by the President is Republic Act 10579 that creates an additional branch of the regional trial court in the

    seventh judicial region to be based in Talibon, Bohol.

    Republic Act 10578 was also signed by the President on May 24 creating two additional branches of the municipal trialcourt in the cities and seven additional branches of the regional trial court in the seventh judicial region stationed in Lapu-Lapu City in Cebu.Also the President approved Republic Act 10577 a law creating two additional branches of the regional trial court in theninth judicial region in Ipil, Zamboanga Sibugay.

    Republic Act 10576 was also signed by the President to put up an additional branch of the regional trial court in the 12thjudicial region in Kidapawan City in North Cotabato.

    With the approval of the new laws, the Supreme Court is expected to assign the branch number for the newly createdbranches of the municipal and regional trial courts.

    The law mandates the chief justice of the Supreme Court, in coordination with the secretary of the Department of Justice timmediately include in the courts program the implementation of the new laws.

    The funding requirements for the creation of new branches of trial courts will be included in the annual GeneralAppropriations Act.

    The Aquino administration expressed its condolences to the family of National Artist for Film and Broadcast Arts Eddie S.Romero who passed away at the age of 88 on Tuesday night, a Palace official said.

    Deputy Presidential Spokesperson Abigail F. Valte issued the statement following reports that Romero died at 9 p.m. ofTuesday. He had been suffering from prostate cancer.

    Born on July 7, 1924, Romero was named National Artist of the Philippines in 2003.

    "The Aquino administration condoles with the family, friends, colleagues, and numerous admirers of film director EddieRomero. An acclaimed National Artist of the Philippines, his aesthetic, according to his citation, was delivered in an uttersimple styleminimalist, but never empty, always calculated, precise and functional, but never predictable, Valte said.

    "His work spanned generations; Mr. Romero influenced numerous filmmakers, both here and abroad, to tread the samepath and to aspire for the same sweeping ambitions that he held dear.     President Aquino calls on all departments, agencies, local government units to support technical working groupon Baguio and Boracay

    President Benigno S. Aquino III has enjoined all departments, agencies and instrumentalities of the national governmentand local government units (LGUs) to actively support the Technical Working Group (TEG) on Baguio and Boracay for thepreparation of comprehensive plans and programs to preserve and develop these places.

    The Chief Executive issued the directive by virtue of Memorandum Circular (MC) No. 47 signed by Executive SecretaryPaquito N. Ochoa Jr. on May 17.

    Baguio City and Boracay Island are leading tourist destinations that are considered national assets, the President said.

    He said rapid growth, commercialization, and the lack of a comprehensive development and zoning plan have caused thedegradation and deterioration of the two localities.

    The President has directed the secretaries of Tourism, Environment and Natural Resources, Interior and LocalGovernment, and Justice to constitute a Technical Working Group (TWG) to review the environmental, commercial,tourism, and law and order situation in Baguio and Boracay for the purpose of developing comprehensive plans topreserve these vital national assets.

    He said there is need to ensure full support and cooperation from all officials and employees of government agencies andinstrumentalities, including Government-Owned and Controlled Corporations for the successful completion of its tasks andfunctions.

    The President designated the Secretary of Tourism as coordinator of the technical working group to ensure properformulation and full integration of social and economic policies, plans, and programs.

    He directed the said technical working group to work with all concerned stakeholders, including the LGUs with jurisdictionover Baguio and Boracay, in the preparation and implementation of plans and programs, and to submit regular reports tothe Office of the President.

    The Act is a consolidation of House Bill 5360 and Senate Bill 3282 that were finally passed by the House ofRepresentatives and the Senate on February 4, 2013 and January 30, 2013, respectively.

    The new law amends Section 4 of Republic Act 7353 to enable foreign individuals and entities to acquire equity of up to60% in rural banks.

    "Non-Filipino citizens may own, acquire or purchase up to sixty percent (60%) of the voting stocks in a rural bank. Thepercentage of foreign-owned voting stocks shall be determined by the citizenship of the individual or corporatestockholders of the rural bank," the law said.

    Prior to the passage of this Act, foreign banks are allowed to acquire equity in rural banks but prohibits foreign individualsor foreign entities from doing the same.

    The new law provides "that no rural bank shall be operated without a Certificate of Authority from the Monetary Board ofthe Bangko Sentral ng Pilipinas. Rural banks shall be organized in the form of stock corporations. No less than fortypercent (40%) of the voting stocks of a rural bank shall be owned by citizens of the Philippines or corporations orassociations organized under the laws of the Philippines at least sixty percent (60%) of whose capital is owned by suchcitizens."

    Under RA 10574, non-Filipino citizens may become members of the Board of Directors of a rural bank but theirparticipation in the Board shall be limited to their proportionate share in the equity of the rural bank: Provided, however,that at least one (1) independent director shall be elected to the Board of Directors.

    "No director or officer of any rural bank shall, either directly or indirectly, for himself or as the representative or agent ofanother, borrow any of the deposits or funds of such banks, nor shall he become a guarantor, indorser, or surety for loansfrom such bank to others, or in any manner be an obligor for money borrowed from the bank or loaned by it except with thewritten approval of the majority of the directors of the bank, excluding the director concerned. Any such approval shall beentered upon the records of the corporation and a copy of such entry shall be transmitted forthwith to the appropriatesupervising department. The director/officer of the bank who violates the provisions of this section shall be immediatelydismissed from his office and shall be penalized in accordance with Section 26 of this Act," the law said.

    The Monetary Board may regulate the amount of credit accommodations that may be extended directly to the directors,officers or stockholders of rural banks of banking institutions. However, the outstanding credit accommodations which arural bank may extend to each of its stockholders owning two percent (2%) or more of the subscribed capital stock, itsdirectors, or officers shall be limited to an amount equivalent to the respective outstanding deposits and book value of thepaid-in capital contributions in the bank.

    Under this Act, loans or advances extended by rural banks organized and operated under this Act shall be primarily for thepurpose of meeting the normal credit needs of farmers, fishermen or farm families owning or cultivating land dedicated toagricultural production as well as the normal credit needs of cooperatives and merchants.

    The new law "provides supplemental capital to any rural bank until it has accumulated enough capital of its own orstimulate private investments in rural banks, the Land Bank of the Philippines, the Development Bank of the Philippines oany government-owned or -controlled bank or financial institution shall subscribe within thirty (30) days to the capital stockof any rural bank from time to time in an amount equal to the total equity investment of the private shareholders which shabe paid in full at the time of the subscription or such amount as may be necessary to promote and expand rural economicdevelopment: Provided, however, that shares of stock issued to the Land Bank of the Philippines, the Development Bankof the Philippines or any government-owned or -controlled bank or financial institution, may, pursuant to this section, at antime, be bought at adjusted book value."

    According to the new law, the Bangko Sentral ng Pilipinas, consistent with Section 11 of Republic Act No. 7353, "shallprescribe the necessary rules and regulations on the amendments of the Rural Banks Act of 1992 in consultation withvarious stakeholders as well as disseminate this information to allow entry of foreign equity into our rural bank system torevitalize the rural banking industry and improve access of banking services to the rural areas in the country."

    The implementing rules and regulations shall be published within ninety (90) days from the publication of this Act in two (2newspapers of general circulation in the Philippines.

    President Aquino signs laws creating more courts, amending Family Code

    President Benigno S. Aquino III recently signed into law Republic Acts creating more courts of justice in the Philippinesand amending provisions in the Family Code Establishing the Liability of the Absolute Community or Conjugal Partnership

    for an Obligation of a Spouse who Practices a Profession and the Capability of Either Spouse to Dispose of an ExclusiveProperty, Deputy Presidential Spokesperson Abigail Valte said on Wednesday.

    In a press briefing in Malacanang, Valte said the President signed Republic Acts 10562 up to 10571 creating courts inseveral areas.

    First, from R.A. 10562 to R.A. 10571we now have new courts in Paniqui, Capas, Concepcion, Tarlac (in the province oTarlac); in Digos, Davao del Sur; as well as in Pasig (in Metro Manila); in Urdaneta, Pangasinan; Antipolo, Rizal; Bian,Laguna; Cebu City; and Bais, Negros Oriental, Valte said.

    Valte added that the President signed RA 10572 which establishes the Liability of the Absolute Community or ConjugalPartnership for an Obligation of a Spouse who Practices a Profession and the Capability of Either Spouse to Dispose of aExclusive Property.

    According to Valte, this new law amends Articles 73 and 111 of Executive Order No. 209, also known as the Family Codeof the Philippines (FCP) designating the Courts to determine if there is basis for any objection between spouses inexercising any legitimate occupation, business or activity and to discern whether any benefit from this exercise shouldaccrue against community property or separate property; and allowing either spouse may mortgage, encamber, alienate,or otherwise, dispose of his/her exclusive property, respectively.

    So, ang spouse po hindi kailangan ng pahintulot sa kanyang kabiyak para mag -practice ng isang legitimate occupation oprofession. Ngunit kung meron disagreement, the court can step in and decide if there is basis to the objection of thespouse, Valte said.

    Ngayon, kung nag-benefit na po ang pamilya from the proceeds of that occupation or profession that is being objected tothen puwede na pong i-charge ang benefit to the community property. Kung hindi naman po nag-object, nag-benefit munatapos saka lang nag-object, then it should be charged to the separate property of the spouse, she said.

    Valte said the amendment to Article 111 of the Family Code was done to reflect changes in the law. PND (rck)

    A year after former chief justice Renato Corona was convicted by the Senate for not fully disclosing his assets, DeputyPresidential spokesperson Abigail Valte said the administration hasnt wavered in reforming the countrys judiciary.

    Its still a work in progress, Valte said in a press conference in Malacanang on Wednesday. Perhaps, the impactimmediately that you could already see is the emphasis given on the filing of SALNs [statements of assets, liabilities andnet worth] when it comes to employees of the government. But it is still a work in progress, she said.

    We hope to continue the reforms that the President has been talking about since he was a candidate for the presidency inMay 2010, Valte said.

    In May last year, the Senate, sitting as impeachment court, voted 20-3 to convict Corona for betrayal of public trust andculpable violation of the Philippine Constitution.

    The court ruled that Corona was guilty of Article II of the impeachment complaint: the chief magistrate did not fully discloshis assets in his SALN.

    Coronas conviction came at the end of a five-month trial with the entire nation glued to their television sets watchingevents as they unfolded.

    The verdict was seen as a triumph for President Benigno S. Aquino III who campaigned in the 2010 presidential electionunder the daang matuwid reform agenda.

    The President never recognized Coronas appointment as chief justice by then -President Gloria Macapagal-Arroyo a fewweeks before she stepped down in 2010. PND (as)

    President Aquino vetoes rights of Internally Displaced Persons Act of 2013

    President Benigno S. Aquino III has vetoed a consolidated bill entitled Rights of Internally Displaced Persons Act of 2013saying the measure's provisions are in conflict with the Constitution.

    The Chief Executive vetoed last May 24 "An Act Protecting the Rights of Internally Displaced Persons, Providing PenaltieTherefore and For Other Purposes"

    The vetoed measure is a consolidated enrolled Senate Bill No. 3317 and House Bill No. 5627.

    In his veto message sent to the Senate, the President said that while the objectives of the bill relating to the protection anpromotion of rights of internally displaced persons (IDPs) are laudable, the measures provisions conflict with theConstitution.

    The President cited four grounds in vetoing the bill.

    First, the bills provision on damages unlawfully differentiates between displacements caused by security agents of theState and other entities;

    Second, the power granted to the CHR (Commission on Human Rights) to determine damages incurred against IDPs andfacilitate the award of such claims is a power that belo ngs exclusively to the Judiciary, thus impinging on the lattersexclusive power;

    Third, the additional powers that it grants to the CHR exceed those which the Constitution intended to give as it wasconceived as an investigative and recommendatory agency exercising limited powers; and

    And fourth, the provision allowing individuals to claim financial assistance and compensation from the government opensthe door to a slew of claims or cases against the government, and goes against the 'non-suability' character of the State."PND (js)

    Binigyang diin ng Pangulo na ang RA 10575 Batas na Nagpapatatag sa Kawanihan ng Koreksiyon (BuCor) at Paglalaanng Pondo Ukol Dito ay pagkilala sa pananagutan ng pamahalaan na magkaroon ng napakahusay at may kakayahangserbisyong koreksiyonal para sa mga nahahatulang nagkasala sa mga batas ng Pilipinas.

    Pakay ng batas na gawing makabago, propesyonal at baguhin ang balangkas ng BuCor sa pamamagitan ng pag-aayosng mga piitan, pagdaragdag ng tauhan, higit na mataas na antas ng kuwalipikasyon ng mga tauhan at pagtataas ngkanilang mga sahod, mga benepisyong tulad ng sa pagreretiro at iba pa upang makapatay ito sa Bureau of JailManagement and Penology (BJMP).

    Ayon sa batas, ang BuCor ang bahala sa pangangalaga at pagsasagawa ng mga reporma sa mga bilanggong

    nahatulang makulong nang mahigit sa tatlong taon.

    Kasama rito ang pagbibigay sa kanila ng maalwang kulungan, pagkain, tubig at kasuotang naaayon sa pamantayangitinakda ng Bansang Magkakasanib. Ang pagtatanod sa mga bilanggo ay ipauubaya sa Custodial Force na binubuo ngmga Correction Officers na ang ranggo at antas ng sahod ay kahalintulad ng mga tauhan ng BJMP.

    Ang mga programa sa pagbabago na isasagawa ng BuCor para sa mga bilanggo ay tulad ng Programang Moral atIspirituwal, Programa sa Edukasyon at Pagsaanay, Programa sa Trabaho at Kabuhayan, Programa sa Palakasan atLibangan, Programa sa Kalusugan at Programa ng Behavior Modification na kinabibilangan ng Therapeutic Community.

    Ang direktor at deputy directors ng BuCor ay maglilingkod sa loob ng apat na taon, ngunit hindi hihigit sa anim na taonsapul sa petsa nang sila ay italaga sa tungkulin.

    Ang BuCor na maglilingkod sa ilalim ng isang directorial structure ang mananagot sa klasipikasyon ng bawat isang bilanggong ipinasakop sa ahensiya.

    Bukod sa mga alituntuning naaayon sa Rule 8, Part 1, Rules of General Application ng United Nations Minimum Rulessa Pagtrato sa mga Bilanggo at sa mga umiiral na tuntunin ng BuCor ukol sa security classification (tulad ng maximum,medium at minimum security risk), ang mga bilanggo ay ipaiilalim din sa panloob na klasipikasyon ng DRD atpaghihiwalayan sang-ayon sa nagawa nilang krimen alinsunod sa mga kaugnay na kodigo penal na tulad ng KrimenLaban sa Tao, Krimen Laban sa Ari-arian, Krimen Laban sa Puri, at iba pa, gayundin sa mga kaugnay na Special Laws,Custom and Immigration Laws, paliwanag ng Pangulo.

    Lubos na komputerisasyon ang gagawin ng BuCor sa pag-aayos, pag-iingat at paglilipat ng mahalagang rekord ng mgabilanggo sa lahat ng Prison and Penal Farms at iba pang ahensiyang tatanggap nito.

    Pananatilihin ng BuCor ang kanilang custodial personnel-to-inmate ratio na 1.7 at reformation personnel sa bawat

    bilanggo na 1.24 ratio.

    Aayusin ng Kagawaran ng Badyet (DBM) ang umiiral na organizational structure and staffing pattern ng BuCor alinsunodsa mga probisyon ng Batas na ito at mga kaugnay na kompensasyon at batas sa klasipikasyon ng puwesto, mga batasat iba pang tuntunin.

    Babalangkas naman ang Kagawaran ng Katarungan ng desenyo at magtatatag ng professionalization and qualificationsupgrading program para sa mga tauhan ng BuCor sa pakikipag-ugnayan sa Komisyon ng Serbisyo Sibil (CSC) atCommission on Higher Education sa pamamagitan ng off-campus education program o kauri nitong mga programa saloob ng siyamnapung araw buhat sa pagkakabisa ng Batas na ito.

    Hangad ng batas na magkaroon ng attrition program para sa mga tauhan ng BuCor sa loob ng limang taon buhat sapagkakabisa ng Batas na ito. Sa loob ng anim na buwan pagkaraang magkabisa ang Batas na ito, magtatakda ang

    BuCor ng promotion system para sa mga tauhan ng ahensiya.

    Itinakda rin batas na dapat magkaroon ng performance evaluation system na pangangasiwa nang ayon sa mga tuntunin,regulasyon at pamantayan, gayundin ng code of conduct ng BuCor na ihahanda ng ahensiya sa pamamagitan ngKagawaran ng Katarungan.

    Ang mga pondong kailangan sa pagpapatupad ng Batas na ito, kasama ang benepisyo ng mga tauhan ay manggagalingsa budget ng BuCor para sa kasalukuyang fiscal year at sa mga nalilikom na halaga buhat sa clearances and certificationfees, kita mula sa institutional projects ayon sa memoranda of agreements (MOAs), mga kontrata o kasunduan sa mga

    joint venture at iba pang miscellaneous incomes (bukod sa MOAs at mga kontrata) na tulad ng penal farm agro-production and inmate handicraft industry.

    Ano mang halagang kakailanganin upang ipatupad ang Batas na ito ay isasama sa taunang General Appropriations Act.

    Ang pagpapatupad ng Batas na ito ay yugtu-yugtong gagawin, ngunit hindi dapat humigit sa limang taon, dahilisinasaalang-alang ang kalagayang pinansiyal ng pamahalaang pambansa. Ano mang partial implementation aykailangang magkakatulad at angkop sa lahat ng ranggo..

    Sa loob ng siyamnapung araw sapul sa pagkakabisa ng Batas na ito, ang DOJ, katuwang ang BuCor, CSC, DBM at

    Kagawaran ng Pananalapi ay maghahanda ng mga tuntunin at mga regulasyong kailangan para maipatupad ang Batasna ito.

    Ang BuCor, sa pamamagitan ng DOJ at DBM ay magkasabay na maghaharap sa Pangulo ng Senado at sa Speaker ngKapulungan ng mga Kinatawan ng taunang report ukol sa pagpapatupad ng Batas na ito.

    Magkakabisa ang Batas na ito 15 araw matapos na buo itong malathala sa Official Gazette o sa dalawa man lamangpahayagang malaganap ang sirkulasyon, alinman ang mauna. PND

    Malugod na tinanggap ng administrasyong Aquino ang mga ulat na tumaas ng 7.8 porsiyento ang ekonomya ng Pilipinasbatay sa panukat ng Gross Domestic Product (GDP) sa unang kuwarter ng 2013, kasabay ng pagtiyak na mananatiliitong nakatuon sa pagsisikap na ibayong mapaunlad ang bansa.

    Ito ang sinabi ni Deputy Presidential Spokesperson Abigail Valte sa pulong-balitaan sa Malacanang Huwebes mataposiulat ng National Statistics Coordinating Board (NSCB) na lumago ng 7.8 porsiyento ang GDP ng Pilipinaspinakamalaking quarterly growth rate sa ilalim ng administrasyong Aquino.

    Sinabi pa ni Valte na ang GDP ay pinakamataas sa taon na hindi halalan ng pangulo buhat pa noong 1988.

    Ayon sa mga paunang ulat, nahigitan ng ating ekonomya ang mga ekonomya ng buong Asya, kabilang ang Tsina na

    lumago lamang ng 7.7 porsiyento, 6.0 porsiyento ang Indonesya at ang Malaysia ay 4.1 porsiyento. Ang resultang ito ayhumigit sa lahat ng inaasahan ng merkado, dugtong pa ni Valte.

    Naramdaman ang pagsulong sa lahat halos ng sektor, lalo na sa lokal na manufacturing na lumago ng 9.7 porsiyento.Nakatulong din ang patuloy na paggugol ng gobyerno sa mahaha-lagang pagawaing bayan na umabot sa 13.2porsiyento. Natulungan pa ito ng paglaki ng gugol ng gobyerno sa kostruksiyong lumawak ng 45.6 porsiyento. Angcapital formation man ay lumago ng 47.7 porsiyento, paliwanag pa ni Valte.

    Binigyang diin ni Valte na ang tiwala ng negosyante at pag-asa naman ng mga mamimili ang lalong nagpaangat sa GDP.
