Our current statute was written in 1972 and originally reflected what PA practice was at its inception. However, 35 years have come and gone and the current language has not kept pace with the evolution of our profession over the years. On June 27, our delegation from the SDAPA had the opportunity to discuss our proposed changes with the SD Board of Medical and Osteopathic Examiners. I was joined by Diane Weber, outgoing President SDAPA, Sheila Schweitzer, co-chair of the Practice Act Committee, Ann Davis, Government Affairs AAPA, and Kitty Kinsman, consultant SDAPA. Our presentation emphasized the key objectives or our proposed changes and was well received with a few recommendations from the Board. As we continue to promote our proposed changes as an Academy, we will be seeking support from our physician partners, the SD State Medical Association, and other health care entities around the state. We hope that through our discussions, we can show our need for the modernization of this practice act in order to ensure delivery of quality medical services to the people of South Dakota in both rural and urban areas. It is important that all physician assistants practicing in this state, keep in close communication with the Academy and their PA colleagues throughout South Dakota. It takes communication with our clear and consistent message as we spread the word of our efforts in order to make this successful. This is an exciting time for all of us professionally. This is a great opportunity to strengthen our physician-PA teams. This is not an effort for independent practice. Rather, this is a time for clarification and affirmation of a physician delegated practice for physician assistants. We look forward to coming together again as an Academy in September in Sioux Falls for our Fall CME meeting. Enjoy the summer. Keep in touch. From the SD Board of Medical and Osteopathic Examiners (SDBMOE)

Good News To Assist You With

License Maintenance: Forms will be added to the website (www.state.sd.us/doh/medical/ then click on Resources Tab under Menu) to assist the “Change of Supervision” process. According to SDCL 36-4A-37, failure to notify the SDBMOE in writing of the termination of the contract with the person's supervising physician within seven (7) days after the termination can be grounds for refusal, revocation, or suspension of the physician assistant license. The “Change of Supervision” form will help simplify the notification process. It is the physician assistant’s responsibility to that the SDBMOE is notified of any changes of supervision.

Physician Assistant Licenses Simplified:

Beginning July 15, 2006, the SDBMOE will no longer issue separate license numbers for each additional supervision agreement (no more locum tenens license numbers). This will allow a physician assistant to have multiple supervision agreements under one primary license number. (This will not remove the requirement of submitting original supervision agreements to the SDBMOE office prior to beginning any new practice. Also, every supervision agreement must be renewed each year to continue practice.) Finally, the locum tenens administrative charge of $50 will be reduced to $25. This will mean that regardless of which administrative modification is required for your practice (either supervision change or additional practice agreements) there will be one standard rate of $25.

Comments from Lola Pollard who is the vice-president of the South Dakota Academy of Physician Assistants. Washington, DC - The U-S House is expected to approve a significant increase in funding to expand health care to the medically underserved and uninsured. CONGRESSIONAL VISIT

On April 25th, 2006 Wade Nilson, MPAS, PA-C and Louise Papka, MPAS, PA-C from the USD PA Program traveled to Washington, DC on behalf of the SDAPA and AAPA. They met with Senators Tim Johnson, John Thune , and with Representative Stephanie Herseth. The meetings with each Legislator were to discuss current important Legislative matters for Physician Assistants regarding: 1. Restoring Federal Funding support for the Public Health Service Act’s Health Professions Programs, including Physician Assistant Educational Programs;

2. changes needed to implement full coverage of Medicare services provided by Physician Assistants and to ensure Medicare beneficiaries’ access to care (post-hospital care in Skilled Nursing Facilities, Home Health & Hospice Care); 3. need to update the Federal Workers’ Compensation Program to allow Physician Assistants to diagnose & treat injured employees, and 4. optimizing patient care in the Department of Veterans’ Affairs (VA) by elevating the PA advisor to a full-time position in the VA’s central office. Their efforts were positively received by our South Dakota legislators. Both the SDAPA and AAPA were well represented by Mr. Nilson and Ms. Papka. Michelle Gielski Joins SDAPA PR Committee

Michelle Gielski, PA-C from the Vermillion area recently joined the PR Committee. Michelle graduated from the USD PA program in 2000 and since then has specialized in Orthopedics. She is currently working for the Department of Health at the Springfield (Mike Durfee) prison and the Yankton Trustee Unit. She also holds an Orthopedic clinic for the State Prison in Sioux Falls. Michelle also works at the Yankton/Vermillion medical clinic convenient care clinic. Since graduating Michelle has served one year in Iraq with the Washington Sate National Guard. She has been in the Guard for 19 years and a PA in the Guard since 2000. She has the distinction of being the only female to serve with an entire male tanker battalion (303rd Armor). Michelle is 35 years old, married and the mother of two. In her extra time she plays in the Doctor Dendrite and the Twisted Synapses band. The band plays for charities and she admits that they are “not that bad”. She and her family love to camp, ride Harley’s, attend a good hockey game and watch a little “Desperate Housewives” and “Grey’s Anatomy” together. We are excited about the addition of Michelle to the PR Committee and congratulate her on her efforts to further the SDAPA. We are still looking for a representative from the Sioux Falls area. SD Continues to Have High Rates in Diabetes Care

For the second year in a row, South Dakota met the Healthy People 2010 objectives for 2 or more A1c tests (goal of 65%) and dilated eye exams (goal of 76%). Only three other states, Maryland, Minnesota and Tennessee, also met these objectives in 2004. In addition, only SD and MN reached these objectives in both 2003 and 2004.

The Division of Diabetes Translation in the Centers for Disease Control and Prevention (CDC) uses 7 national goals for benchmarking and reporting to Congress and others. These goals are:

-Increase Influenza Vaccination Rates

-Increase Pneumococcal Vaccination Rates

-Increase Rate of A1c tests

-Increase Rate of Dilated Eye Exams

-Increase Rate of Foot Exams

-Identify & Reduce Health Disparities for High Risk Populations with Respect to Diabetes Control & Prevention

-Establish Linkages to Promote Wellness and Physical Activity for Persons with Diabetes

Accomplishments such as this are not the work of one entity or one initiative. Is is the infrastructure built over the years and the collaborative spirit we share. Congratulations to all of you for providing such a high level of care and helping those with diabetes live healthier lives. Keep up the good work!

PAAC REPORT On June 27, 2006 members of the PAAC, Jan Hines, Jim Cody and Rod King met with the Board of Medicine and Osteopathic Examiners in Sioux Falls at the downtown Holiday Inn. The only topic discussed at this meeting, involving PAs was the proposed changes in the PA practice. Representatives from the SDAPA, Dan Palmer, Diane Weber and Sheila Schweitzer, Ann Davis from AAPA and our lobbyist Katherine Kinsman presented the proposed changes and fielded questions afterward. SDAPA president Dan Palmer actually did most of the talking during the presentation. Overall the board was fairly receptive to most of the changes. The following were recommended to be changed or revised: 36-4A-7 This point may need to be clarified further with the board; however they felt that they wanted this left in fearing federally employed PAs who are not required to carry a SD license might have occasion to work in the private sector and would therefore need to be licensed in SD. 36-4A-8.1 (inactive license) The board did not like the idea of inactive status. They do not allow that with physicians and felt the same for PAs. It allowed them to keep track of people. 36-4A-11 Mr. Donald Srstka, the legal counsel for the board felt that this piece should stay in our practice act. He felt that it might be helpful to have it sometime. 3 6-4A-20 The board definitely felt that they wanted a copy of the practice act with the board and not just on file in the practice. It was also recommended that we include in this part of the practice act language taken from Vermont’s practice act stating that “It is the obligation of each PA/supervising physician team to insure that written scope of practice submitted to the board clearly delineates the role of the PA in medical practice.” They also wanted something here, a little more specific, about how and how much supervision would take place.

36-4A-29 It was noted that there was some redundant language when looking at this item and looking at 36-4A-20 that should be removed. There was nothing to be omitted. It’s just that some of it didn’t need to be stated twice. 36-4A-31 The board wants to continue the yearly renewal of licenses for PAs, however there was interest in changing the calendar end to the end of December. 36-4A-32 The wording here would therefore stay at 12 months instead of the 24 months proposed. 36-4A-37 The recommendation from the board here was to replace ‘satisfactory proof’ to ‘preponderance of the evidence”. They also recommended striking out gross in (1) and wanted to keep (3) in regard to notifying the board on termination of a contract. One last item that was brought up by Margaret Hansen, executive director for the board and Don Srstka, the lawyer for the board was in regard to locum tenens licenses. Don stated that he found nothing in the law that supported the need for PAs to have anything other than a SD license to practice anywhere, meaning that locum licenses will soon be a thing of the past. Requesting additional practice agreements will take the place of separate locum tenens licenses. Contact the board staff for the new process. The administrative change request to the board will be the responsibility of the PA. I feel that the board was quite impressed with how this was presented to them, and with the obviously large amount of time and effort that has gone into this thus far. They were also impressed with our having Katherine Kinsman on board with us. They seemed favorably familiar with her reputation. I must commend Dan Palmer and the others on doing such a good job of presenting this to the board. The next meeting with the board of medicine is September 12, 2006.
