Wow it’s busy. Lots of new stock flying in & getting sold subject to contract almost straight away. Older stock suddenly becoming popular and also selling too. Major shortage of properties to offer. At the time of writing this editorial we have just over 50% of our property stock sstc, leaving us few properties to offer. Despite this some properties still struggle. Also lots of legislation changes have been coming into force or happening over the past year/months, some of which are a hot topic lately relating to the way properties are marketed and estate agents terms. So I’ve added some information about those points below. On 13th June 2014 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations – there were changes in regulations for estate agency contract cooling off periods where the contract is NOT signed by the customer/consumer in the estate agents office. Prior to that date the cooling off period was 7 days this has now been extended to 14 days. However, there is a lot more to it than that. The agent must also give you a right to cancel notice, so you are fully notified of the terms in which you can cancel during the cooling off period and also informing you of any costs you may have to reimburse. If the consumer is not informed, then the cooling off period is extended to 12 months and 14 days, meaning that they have the right to cancel at any time without penalty for over a year. Of particular importance is that agents cannot market a property for 14 days unless there is a specific clause in their contracts, with a signature box, whereby vendors give them signed permission to go ahead. So when you instruct an estate agent to market your property and do not sign your agreement in the estate agents office, by law they now have to give you a 14 day cooling of period where you have the right to cancel your agreement. BUT the estate agent should also not commence any marketing of your property during that period unless you specifically give them written authority to do so and signed a box on their agreement permitting them to do so. By authorising an agent to commence marketing within the 14 days does not affect your right to cancel the agreement within the 14 day cooling off period. Furthermore, any agent wishing to claim a fee to recover money spent marketing a property during the 14-day cancellation period must ensure these costs are outlined prominently in the contract or right to cancel notice, or the consumer cannot be held liable for those costs. The second change is that with The Property Misdescriptions Act being repealed on 1st October 2013 estate agents and property owners are all the more governed by the Consumer Protection from Unfair Trading Regulations 2008. Along with many points related to the wording of property details and availability of information about a property there is one point often overlooked by sellers and estate agents - the way properties availability statuses are marketed e.g. when a property is sstc. Before if you accepted an offer on your property, your agent had to offer the seller the choice whether to continue advertising it, or whether to advertise it as sstc. Now it is false/misleading advertising to wrongly advertise a property status – so now the choice is no longer yours/the sellers or the agents. If a property is sstc it has to be advertised as such etc… Leading on about improved sales activity mentioned at the start there is lots of speculation about the UK housing market still - will it boom, will it bust? Who’s to tell – we’d all love to be able to predict the future. What I can say is that buyers are very savvy now compared to what they were a couple of years ago and no matter how much they fall in love with a property will not risk overstretching their budget. Sellers just aren’t cottoning on to this as quickly as they need to and spend too much time listening to what they want to hear about the housing market and ignoring what they need to hear. Concentrating on what you hear in the national press hyping up the housing market isn’t going to help you to make an informed decision about selling your home in a local area that is performing differently. Making the offer negotiation stage all the more stressful as trying to get the two sides on the same page is all the more difficult. Don’t make the mistake of many and end up kicking yourself when you turn down a good offer and another at that level doesn’t come along. I am all for the Mortgage market review which came into force in April, it is about time homeowners were more sensible with their spending and living within their means and I’m all for more responsible lending. But as the lenders staff get to grips with their procedure changes we are finding that with some lenders it is causing delays. So I’d advise both sellers and buyers not to panic if things are taking longer than normal with a mortgage application – it doesn’t necessarily suggest a problem, more often than not lately we are finding it’s just the mortgage lenders settling into a new way of doing things and working through a backlog of cases created by the changes. As you will see, there’s a lot more to ‘selling houses’, than just selling houses. With all the changes in legislation, mortgage lending and housing market conditions an estate agents job can be quite a paper exercise too.

Following the mild winter the winter flowering plants were still looking very good, but we had to remove them to make space for the Summer Bedding which was ready in the Nursery. All the tubs and containers are now planted and we are watering them to ensure a continuous beautiful show throughout the summer, even if it has been raining you will see various members with their watering cans giving them a drink. The Community bed has now been planted up with the chosen plants; the muted colour scheme invites the passer-by to rest a while on the bench. Do spare a few moments to look around it when you come to Sutton Bridge. It can be found beside the car park in front of the Curlew Centre.

Pat’s Garden on the Falklands estate has been trimmed and some plants removed as it was getting overcrowded. We are in the process of Mulching to control weeds; the perimeter has now been defined with Gravel boarding. Maybe you have seen the wild Poppies in the bed; we deliberately have left them in situ as a memorial to the fallen during the 1914-1918 World War.

As stated in my last editorial, a regular question we are asked at Fenland Estates is whether it is a good time to be investing in property to rent, or ‘buy to let’. A recent report produced for Halifax by the National Centre for Social Research has shown some interesting insights into attitudes to property rentals and supports our own anecdotal evidence. According to the report, one in five 23 – 27 year olds have no desire to own a home. Almost half agree that Britain will become a nation of renters within the next generation and 46% agree Britain is becoming more like Europe, where renting is the norm. Additionally, 86% of potential first time buyers refuse to sacrifice the quality of their rented accommodation to reduce the rent they pay in order to save for a deposit. Craig McKinlay , Mortgages Director at Halifax said ‘with attitudes softening towards the social implications of renting, and the number of people who say they will never own a property increasing, we may be heading towards the point where the aspiration to own a nice home will be replaced by the aspiration simply to live in one. It seems that people are now beginning to accept a lifetime of renting and this would not only change the way the property ladder looks in the future, it could even bring into question whether or not it will exist at all for some people.’ While there remains a preference for home ownership, fewer people now agree that renting means they cannot settle in an area or that they can’t make a property feel like home. In the past year alone the proportion of people not wanting to raise children in a rented property has fallen by 10%, the same figure also applies to the reduction in the number of people worried about renting having a negative impact on their retirement. 7 members of the group took part in a photography course run by Chris Herring starting at Holkham and finished at sunset in Cromer. A good day was had by all.

At our last meeting we enjoyed getting to grips with stress line photography and also Photoshop Elements. We will be repeating these exercises later in the year. Our next group meeting takes place on Monday 14th July at 7.30pm at the Market House, Long Sutton.

Our photography day takes place on Saturday 6th September we already have our speakers confirmed. We will also be carrying out the presentation to the winners of the photo competition at some point during the day. Confirmation of speakers, ticket costs and timings will be confirmed shortly.

Following on from our photography day we welcome Mr Des Ong a wildlife photographer from Leicestershire who will be a presentation on Captivating Nature - Wildlife of Britain & Beyond on Monday 8th September.
