The Society meets every 3rd Monday of the month at the Market House in Long Sutton at 7.15 pm. COMMON PIT LONG SUTTON

Where in Long Sutton might you once have seen circus elephants bathing? The Common Pit, a one acre man made shallow lake next to The Old Ship pub on London Rd has been useful to the town over the past few hundred years. Its origins and age are uncertain; it may have been dug to provide silt for road building or to construct the adjacent sea defence (Roman Bank). All we know is it is a water filled pit on common land, that was once, before the land was reclaimed, part of the Wash marshes.

Townsfolk have used the Pit for washing fruit barrels, a sheep dip, ice skating, kayaking, fishing ( with stories of a monster pike and eels), watering traction engines, cattle, horses and, at least once, washing those elephants when the circus came to town. Nowadays it is inhabited by around 50 wild ducks that provide entertainment for visiting children and their families. The lake is registered common land, owned by the Parish Council and managed on behalf of the town, by the Civic Society.

On 11th April visitor’s enjoyment of the Pit will be enhanced by the unveiling of an art installation celebrating and drawing inspiration from the Wash. Come along and have a look, sit by the water, feed the ducks (no bread please as it can damage their health) and enjoy a small slice of our local heritage. Pictures show artist working on bird boxes and where new art work

is to be placed.

We rely heavily on friends and committee members of the pre-school to help us, so that every penny raised in fundraising and

any profits are put back into providing the best quality of care for not only our children but for other children in our local

community.

We aim to ensure we have the best facilities and resources available to give every child the best start and the fondest

memories of their early years' experience.

It's also been an exciting time inside the pre-school too. We've held our Valentines

disco, Chinese new year celebrations and our Gruffalo walk for World Book Day, where

all the children dressed up as their favourite book, TV or film character and enjoyed

an exciting trail through Cinder Ash Park, met a Gruffalo and tried some tasty snacks

such as roasted fox (roasted parnips), scrambled snake (scrambled egg), Gruffalo

crumble (cherry crumble) and Owl ice cream (ice cream).

We enrol children all year round here at Cinder Ash Pre-School and currently have spaces for 2,3 and 4 year old children. More

Long Sutton Market House Corn Exchange is an excellent venue for family events and celebrations, for exhibitions, performances and concerts. Our Lincolnshire Churches competition is now open for entries. The next meeting takes place on Wednesday 8th April at 7.30pm. This month we will be doing a practical session on image processing and it is also round 3 in our annual competition, theme being Open. The novice group sessions are proving very popular, with 8 people taking the full course which is very good. The next session takes place on Saturday 11th April at 10am at Lutton Village Hall. 26 members and their friends will be travelling to the Cambridge Botanic Gardens on the 19th April, more on this in the May edition.

Are you thinking of buying a property to let? The Association of Residential Letting Agents (ARLA) gives the following advice: DO Think of buying to let as a medium to long term investment. DO Seek advice from an ARLA letting agent on local market demands. DO Get your sums right. Will the rent cover borrowings and costs, after allowing for void periods? DO Decorate, fit out and furnish to high quality standards, especially kitchens and bathrooms, to attract the best tenants and let quickly every time. DO Use an ARLA member as your letting agent. They are bonded, hold Professional Indemnity Insurance to required standards, have staff trained to ARLA's competency standards and are kept up to date with the latest legal and regulatory requirements. DON'T Let personal taste cloud your judgement. Be sure the property you choose meets market requirements. DON'T Purchase anything with potential maintenance problems unless you are willing and able to undertake this regular work yourself. It will add nothing to the rental value and cost a lot to keep up. DON'T Think that the running of an investment property to let can be left to friends or relatives in your absence. Tenants require a full management service. DON'T Use off-the-shelf tenancy agreements from HMSO or law stationers, or forget to issue the right notices or fail to have a proper inventory and condition report made before a tenant moves in. Leave all documentation to a professional agent. DON'T Furnish with second hand furniture or cast-off soft furnishings. These will probably contravene the Furniture and Furnishing Regulations. The case of Lothian v Dixon and Webb was heard in the High Court in November last year and has just been reported. Like many legal cases there is a story behind it which, in this case, has a happy ending.

Helen Lothian was a cousin of Helen MacArthur. Mrs MacArthur owned a seaside hotel in Scarborough which she had inherited from her parents. Her Will, made in 1983, left it equally to her cousins (Helen Lothian and Patricia Webb); however, she had gradually lost contact with Mrs Webb.

In 2010 Mrs MacArthur discovered she had inoperable terminal cancer and asked Mrs Lothian to live at the hotel, to look after her and to help run the business up to her death; in return for which she would leave Mrs Lothian all she owned. This was a big upheaval for Mrs Lothian as she and her husband lived in Scotland and had their own business there.

Mrs MacArthur gave instructions to her solicitor to make the new promised Will but died in 2012 before she could sign it. By then, Mrs Lothian had spent most of the previous two years at the hotel, running it and looking after Mrs MacArthur. Mr Lothian came down from Scotland at weekends to help.

The estate was worth over £1million.

Mrs Lothian brought a claim for proprietary estoppel. To bring such a claim successfully it must be shown to the Court that 1. an assurance; 2. has been relied on; 3. to the detriment of the person promised, to such a degree that it would be “unconscionable” not to grant relief.

By law, even if the Court agrees that relief is appropriate, the person promised will not necessarily get all that they were promised. The amount of detriment suffered is taken into account so that the order is proportionate. His Honour Judge Roger Kaye QC decided that here the detriment suffered was substantial. Even though there was no legally binding agreement, Mr and Mrs Lothian had changed their lives entirely, for an indefinite period, to help Mrs MacArthur.

Mrs Webb argued that the ‘pleasant atmosphere and sea air’ and free board and lodging were enough compensation; but the judge disagreed. Mr and Mrs Lothian were awarded the entire residuary estate.
