1. SUMMARY OF RESULTS & RECOMMENDATIONS
1.1 Results
1. Focus Ecology Limited was commissioned by Pegasus Group on behalf of
Mill Pond Developments Ltd to undertake a Phase 1 Habitat Survey of a site
off Bond End in Yoxall, Staffordshire. The survey site is centred on Ordnance
Survey grid reference SK 140 183.
2. Focus Ecology have not viewed any development plans of the site, but it is
understood any proposals are likely to be for a residential development.
3. The site was surveyed on foot by an experienced ecologist on 8 April 2014.
The field survey has been supported by a third-party data search for existing
records.
4. The site is approximately 0.53ha and roughly rectangular in shape. The site
comprises a field of species-poor, improved grassland, with boundary
hedgerows and fencing.
5. There are no buildings on site and none of the trees present along the
boundary are suitable for roosting bats. The site and wider landscape is likely
to be used by bat species for foraging and commuting.
6. A small number of common bird species were recorded during the survey of
the site, including blackbird, blue tit, great tit, house sparrow, woodpigeon and
robin. These species would be expected to nest in the boundary hedgerows in
the appropriate season. However, the bird assemblage within the survey area
is unlikely to be above site importance.
7. No evidence of badger was noted on or adjacent to the site. The site is
considered unlikely to support other protected species such as common
reptiles, great crested newts, dormice, water voles, otters and white-clawed
crayfish.

1.2 Recommendations
The following recommendations are made to ensure compliance with wildlife
legislation (e.g. the Wildlife and Countryside Act 1981 as amended, the Protection of
Badgers Act 1992, etc.), biodiversity legislation (e.g. the Natural Environment and
Rural Communities Act 2006, Conservation of Habitats and Species Regulations
2010), government guidance (e.g. NPPF) and best practice (e.g. PAS2010, UK Post
2010 Biodiversity Framework).
1. No further specialist surveys are recommended for this site.
2. Features of acknowledged ecological value at the site, including the boundary
hedgerows should, where feasible be retained within the development
scheme. Hedgerow removal to allow vehicle access to the site (for example)
should be kept to the minimum length possible.
3. Retained hedgerows and trees should be protected from construction-related
damage e.g. through implementation of ‘BS5837: 2012 Trees in relation to
design, demolition and construction’, and retained as functional units on site
wherever feasible.
4. The removal of potential bird nesting habitat, such as hedgerows and trees
should be undertaken outside of the bird nesting season (March – August
inclusive). Where this is not possible, areas of vegetation should be checked
by a suitably qualified ecologist prior to removal. The ecologist will be able to
identify any nesting birds and advise of appropriate safe working distances.
5. The following recommendations are made to promote biodiversity
enhancements in the post-developed site and ensure compliance with local
and national government policies on biodiversity and wildlife legislation (e.g.
The Natural Environment & Rural Communities Act, 2006). Please refer to
Annex 8.3 for illustrations of the recommended features and Annex 8.4 for a
suggested planting list.

Two sparrow boxes (such as the Schwegler Sparrow Terrace) should
be installed at the post-developed site. Boxes should be installed at
eaves height, and not directly over windows/doors.
Two wall-mounted bird boxes (such as 1MR Schwegler Avianex box)
should be installed on new buildings at the site to provide replacement
nesting opportunities for birds. Boxes should be installed at eaves
height, and not directly over windows/doors.
Any new planting and landscaping designs should provide foraging and
nesting opportunities for a range of wildlife, including mammals, birds,
reptiles and invertebrates. Native species of local origin and
ornamental species with a known benefit to wildlife should be
incorporated into planting schemes.
The impact of lighting on nocturnal wildlife will need to be carefully
considered within any future development proposals for the site. This
can be achieved through the use of low-level lighting, shields and
baffles. Please refer to the following for guidance; Institute of Lighting
Professionals (2011).
6. The results of this survey are deemed to be valid for 12 months from date of
issue. If development works are to be carried out after this time has elapsed
an update survey would be required.

2. INTRODUCTION
2.1 Scheme Background
No firm development plans are currently available, but it is understood that proposals
are likely to be for a residential development. This Phase 1 Habitat survey has been
commissioned to provide supporting information on the possible presence of legally
protected species at the site and direct appropriate further works including additional
surveys, mitigation, compensation and licensing if required.
2.2 Survey Objectives & Limitations
The objectives of the survey were:
1. to carry out a Phase I Habitat Survey of the site to identify any habitats,
species or features of nature conservation significance;
2. to carry out a third-party data search for existing historical records within
1km of the site;
3. to provide a concise written report of the results, making any appropriate
recommendations to ensure compliance with wildlife law and recognised
best practice.
All surveys were carried out by a suitably experienced ecologist from Focus Ecology
Ltd. The month of survey (April) is within the acceptable survey period, rather than
optimal survey period for many habitats and species in England. However, a basic
site appraisal or Phase 1 Habitat survey such as this can be completed by an
experienced ecologist at any time of year subject to suitable weather conditions.

3. METHODS
3.1 Desk Study
A desk study was undertaken in April 2014 to identify any existing data records of
protected/notable habitats and species for within the site boundary and a 1 km area
around the site. The following third party consultees were contacted: Staffordshire
Ecological Record.
3.2 Phase 1 Habitat Survey
An experienced ecologist from Focus Ecology Ltd undertook a field survey on 8 April
2014 broadly in accordance with the guidelines presented in the Handbook for
Phase 1Habitat Survey (JNCC, 2003). Higher plant nomenclature follows Stace
(2010 - 3rd Edition) with English/common names generally used in the text for ease
of reading. Bryophytes follow Atherton et al. (Eds) (2010). Other authorities are
provided in the text for certain taxa (e.g. fungi) where required.
Target Note (TN) descriptions were recorded for features of nature conservation
importance, these may include areas of valued vegetation and field signs of
protected and/or notable species.
The survey method was extended to include a search for fauna species of nature
conservation importance, including those that are afforded legal protection or are
otherwise notable.
A ground-based inspection of trees for bat roosting potential was undertaken in
accordance with BCT guidelines (2012). Features that can provide roosting sites for
bats in trees include:
woodpecker holes;
cracks, splits and fissures in trunk and limbs;
rot holes;
trunk cavities;
loose bark;
dense ivy growth;

Taking into account the presence of such features, as well as their height, aspect,
isolation, potential impact of wind, rain and artificial lighting, trees were then
assessed as having either ‘high’, ‘medium’ or ‘low’ potential to support roosting bats,
and categorised using the BCT Good Practice Guidelines 2012 (shown below).

4. RESULTS
4.1 Desk Study
The information presented in Table 1 (see below) is based on existing records held
for an area within a 1 km radius of Ordnance Survey grid reference SK 140 183.
Please refer to Annex 8.2 for the consultees response.

Birds: A large number of bird records
have been returned from within the 1km
search area. A number of bird records are
in proximity to the site including peregrine
falcon, hobby and goshawk.
Bird nesting and foraging habitat
on the site is largely limited to the
boundary vegetation.
4.2 Protected Species Survey
4.2.1 General Site Description
The site is located off Bond End in Yoxall, Staffordshire, centred on Ordnance
Survey grid reference SK 140 183. The road, Bond End abuts the site to the west,
detached residential dwellings are to the north, and agricultural fields are present to
the east and south.
The site is approximately 0.53ha in area and roughly rectangular in shape. The site
comprises a field of species-poor, improved grassland, with boundary fencing and
hedgerows.
4.2.2 Grassland
The majority of the site comprises species-poor improved grassland, which has been
using for grazing previously. The sward is relatively short (c. 30 - 40mm in height).
The sward is dominated by perennial rye-grass, with the following species recorded
frequently to occasionally; Yorkshire-fog, ribwort plantain, broad-leaved dock, white
clover, spear thistle and meadow buttercup.
4.2.3 Trees
Two trees are present on the site and both are located along the western boundary
hedgerow. Please refer to section 4.2.7, for an assessment of the bat roosting
potential of the trees.
Tree 1 (T1) is a semi-mature, multi-stemmed ash tree. The trunk has a thin covering
of ivy, but is generally in good condition.
Tree 2 (T2) is also a semi-mature ash tree. Again a small amount of ivy growth is
present on the trunk, but the tree is in good condition.

4.2.4 Hedgerows & Other Boundary Features
Hedgerow 1 (H1) runs along the southern boundary, and comprises a defunct, but
managed hedgerow. Hawthorn is the dominant species, with occasional blackthorn,
ash and ivy. The ground-flora includes common nettle, Yorkshire-fog, broad-leaved
dock, cleavers, lord’s-and-ladies and hedge woundwort.
Hedgerow 2 (H2) forms the western site boundary and separates it from Bond End.
This hedgerow is intact and managed, and a post and wire fence is located on the
field side of the hedgerow. The height of the hedgerow increases by approximately
1m, at the southern part of the hedgerow, after the pair of semi-mature ash trees.
Hawthorn is the dominant species with occasional bramble and ivy. The ground-flora
includes common nettle, hedge woundwort, herb-Robert, Yorkshire-fog, broad-
leaved dock, white deadnettle and cleavers.
Approximately half of the eastern boundary is formed by a wooden post and wire
fence, with electric fence erected in front, and the remaining half is open.
4.2.5 Bats
There are no buildings on site. The two semi-mature ash trees are considered to
provide no roosting opportunities for bats (Category 3 with reference to BCT, 2012).
This is due to the small stature and lack of potential roosting features.
The grazed grassland is likely to be too open and managed to provide good foraging
habitat for bats. However, the boundary hedgerows and wider landscape are likely to
be used for foraging and commuting. A variety of bat species would be expected to
use the site boundaries and wider landscape.
4.2.6 Badgers
No active badger setts were found on the site, and no evidence indicating the
presence of badgers on site was noted.

4.2.7 Other Mammals
The hedgerows on site are considered unlikely to be used by species such as the
hazel dormice. Dormice are known to use mature hedgerows and scrubby habitats,
which provide connectivity to the wider landscape and areas of broadleaf woodland
in particular. Scrub is lacking from this site, and the managed nature of the
hedgerows significantly reduces their suitability for this species.
The site is highly likely to support other mammals typical of rural areas such as the
fox, brown rat, wood mouse, common shrew and grey squirrel.
4.2.8 Birds
A small number of common bird species were recorded at the site during the survey;
namely blackbird, blue tit, great tit, woodpigeon, robin and house sparrow. This
should only be taken as a ‘snapshot’ of avian activity rather than an exhaustive
account of those species likely to use the site over the course of a full season.
With the exception of the house sparrow, none of these species have any notable
conservation significance (e.g. JNCC Birds of Conservation Concern Amber or Red
List, NERC Act 2006 S.41 species of principal importance for the purpose of
conserving biodiversity).
House sparrows are currently Red List birds of conservation concern owing to a
significant decline in population of over 50% since recording began in 1969 (see
Eaton et al. 2009).
4.2.9 Amphibians
The improved grassland within the site is considered too short to provide suitable
terrestrial habitat or a ‘place of shelter’ for amphibians such as the great crested
newt. Therefore, development of this site is considered unlikely to impact on this
species.
4.2.10 Reptiles
The grassland on site is too short to provide suitable habitat for common reptiles.
Development of this site is considered unlikely to impact on this species.

4.2.11 Invertebrates
A full assessment of the invertebrate assemblage at the site is beyond the scope of
this survey. However, no triggers were identified to indicate that the proposed
development areas support an interesting or notable assemblage of terrestrial
invertebrates.
4.2.12 Invasive & Non-native Species
No notifiable invasive plant species (e.g. Japanese knotweed) listed under Schedule
9 (Part II) of the Wildlife and Countryside Act 1981 (as amended) were recorded
during the survey.

5. DISCUSSION OF IMPACTS
No development plans have been viewed by Focus Ecology. However, it is
understood proposals are likely to be for a residential scheme. This is likely to result
in the loss of a proportion of the grassland on site. The central areas comprise
species-poor improved grassland. This habitat is common and widespread both
locally and nationally and considered to be of low ecological importance.
The features of greatest ecological value within the survey are the hedgerows along
the site boundaries. These features are likely to be used by nesting birds in the
appropriate season. The ground-flora is taller along the boundary hedgerows and
this accordingly provides a wildlife corridor to the wider landscape for species such
as small mammals, invertebrates, birds and bats. As no development plans are
currently available, it is not known if this habitat will be impacted. However, it is
assumed that a section of hedgerow may be lost to allow vehicle access onto the
site. To avoid negative impacts on ecology at this site, development proposals
should aim to keep any hedgerow loss to an absolute minimum, replace what is lost
elsewhere on site and protect the existing features during construction.

8.1 Summary of Protected Species Legislation
The following provides an overview of the legislation affecting those protected
species recorded or discussed in the course of this report. It does not pertain to be
an exhaustive review of the law affecting legally protected species in the UK.
Professional legal advice should always be sought and the definitive up to date
legislative texts consulted in the event of any doubt over the law affecting these
species.
8.1.1 Birds
All wild birds in the UK are afforded protection under the Wildlife and Countryside Act
1981 (as amended). This protection includes killing, injuring or taking wild birds as
well as taking, damaging or destroying bird nests in use or being built, and taking or
destroying eggs. A small number of derogated bird species, principally members of
the genus Corvus (crows), Larus (gulls) and Columba (pigeons), may be killed by
authorised persons under a ‘general licence’.

Important Considerations
Information supplied by SER is always based on historical data of varying age and is only based upon the records supplied to SER. This should not be seen as an alternative to on site work. Absence of records should not be seen as definitive proof of the absence of the species or habitat in the search area.
Mobile species can move and their presence within the search area could be resident (present all year), seasonal (only present for part of the year) or incidental (species just passing through) and certain species are only protected at specific parts of their life-cycle (i.e. the breeding season). All records for any protected species are listed, even those outside the time at which they are protected!
Some datasets supplied by SER incur additional restrictions/information and these are listed in the Appendix.
Supply of data
1. SER data is usually supplied as a combination of PDF (for maps and citations) and Excel spreadsheet to allow clients to include the data within reports, however, the client should not alter the meanings of any digital data supplied.
2. Excel data is usually supplied as a species file and a sites file in Excel2000® format (*.xls) – these both include multiple worksheets, one for each category supplied, please ensure you check all worksheets for content.
Species based information
The locations of protected and Biodiversity Action Plan priority species are supplied subject to the following limitations:
1. Unless otherwise stated, the information relating to species records is as accurate as possible, but is reliant on the quality of the original data supplied to SER. SER cannot be responsible for any errors in the data, nor the consequences of their use.

2. Unless otherwise stated, personal information is not normally supplied in reports, however, if present, it is deemed confidential under the Data Protection Act and should not be passed to a third party.
3. Unless otherwise stated, records of badger (Meles meles) and all bat species are deemed confidential and badger records can only be published at reduced resolution (1km precision) even where precise information is supplied by SER for analysis purposes. Under certain circumstances, other species records may be deemed sensitive and need to be handled in a similar fashion.
4. Species data now includes a Composite Species List covering all species found during the search, however because it is based on 1km sq data, it is likely that records from just outside any search area will also be included in this list (these data would not be included in the full record searches which are based on precise grid references), hence figures may be slightly higher than the individual record searches.
5. The “Distance from Site” information is only supplied as an estimate, it should not be considered definitive, and for 1km precision records is either based on the centre of the 1km square or omitted entirely.
Site based information
The boundaries of Local Wildlife Sites (=Sites of Biological Importance {SBIs}), Biodiversity Alert Sites (BASs) or Local Geodiversity Sites (=Regionally Important Geological/Geomorphological Sites {RIGS}) are supplied subject to the following limitations:
1. Site boundaries are as precise as the original survey maps and base mapping allow.
2. The presence of a marked boundary on supplied maps does not infer any right of public access. Gaining permission to visit is the client’s responsibility.
3. Site status is conferred by a Grading Committee and is correct at the time of notification. Changes may have occurred since the survey which affect the site’s quality, however, the grading remains in effect until reviewed by the Grading Committee.
4. The boundaries of Sites of Special Scientific Interest (SSSIs), other statutory sites and Ancient Woodlands may be included on maps, but are not the property of SER. These are reproduced under licence to Natural England to add value to the report.
5. Maps produced by SER now use Ordnance Survey OpenData (usually StreetView) as a background image. These can now be further reproduced providing OS OpenData licence is adhered to, please refer to the OS website www.ordnancesurvey.co.uk/opendata/licence for further details.
General comments
Staffordshire Ecological Record strives to supply information which is accurate, up-to-date and relevant and where possible will indicate the limitations of any given dataset. However, SER cannot be responsible for any errors in supplied information or the consequences of their usage unless the client has checked with SER and SER has failed to act on any known errors.

Appendix
LIMITATIONS TO SPECIFIC DATASETS
These may or may not be relevant to the data search you are receiving, but refer to the Source column in the supplied species information
1. BCT/NE Bat Roost Reports: Data from this source are received by SER without any site name apart from the postcode, therefore SER is unable to verify these locations are correct. Refer to separate disclaimer for these data.
2. Staffordshire Badger Group: Data from the Badger Group should always be considered confidential, and under no circumstances should the full details of any sighting be reproduced in reports or passed to any third party. This restriction originates from the Dataset’s copyright owner and as such is not negotiable and excluded from being released under the Freedom of Information Act (2000) or the Environmental Information Regulations (2004).
Metadata Notes on interpreting data from NBMP surveys
General note: NBMP data are collected for the purposes of UK surveillance of bats according to a stratified random or other sampling design. The results do not, therefore, necessarily reflect the true distribution of the species in 1km squares, nor are they a complete record of species occurrence in each area, and properly designed surveys to assess species presence should still be carried out. However, they do contribute additional information to the recording effort for each region. NB If planning to visit any Colony Count or Hibernation Survey sites listed in the dataset, it is very important to liaise with the named recorder (contact the NBMP team at [email protected] if help is needed with contacting the recorder). This is to reduce disturbance at the site and check for landowner permissions and health and safety issues.
Survey methodologies
Colony Counts: Subject species are common pipistrelle, soprano pipistrelle, pipistrelle sp (i.e. not identified to species level), serotine, Natterer’s bat and lesser horseshoe. A few incidental records of other species are also included. Volunteers carry out counts of bats emerging at dusk from known bat roosts, normally on two evenings in June, although some counts carried out in other months are also included. Counts commence at sunset or shortly before (depending on the species being counted); reasons for stopping the count are given in the dataset.
Field Survey: Subject species are common pipistrelle, soprano pipistrelle, noctule and serotine. Any other species encountered are not recorded. Volunteers are asked to carry out two surveys in July. The survey begins 20 minutes after sunset. Volunteers walk a roughly triangular transect within a 1km square normally selected from a list of randomly generated 1km grid refs. In each survey square the same route is followed each year (with slight variations if parts of the route become dangerous or inaccessible). Twelve spots, approximately evenly spaced, are marked out along the survey route. At each spot the bat detector is tuned around 50 kHz and common and soprano pipistrelle passes are counted for two minutes. While walking between each spot the bat detector is tuned around 25 kHz and noctule and serotine passes are recorded. NB the number of passes indicates levels of bat activity and not numbers of individual bats.
Waterway Survey: Subject species is Daubenton’s bat, but a few incidental records of other species are also included. Volunteers are asked to carry out two surveys in August. The survey begins 40 minutes after sunset. Volunteers walk along a stretch of waterway of roughly 1km in length. Sites are normally selected from a list of waterways previously surveyed as part of the Environment Agency’s River Habitats Survey. At each survey site the same route is followed each year (with slight variations if parts of the route become dangerous or inaccessible). Ten spots, approximately evenly spaced, are marked out along the survey route. At each spot Daubenton’s bat passes are counted for four minutes with the bat detector tuned to 35 kHz. NB the number of passes indicates the levels of bat activity and not numbers of individual bats.
Hibernation Survey: Licensed volunteers visit known or potential bat hibernation sites, preferably once in January and once in February, although some counts from other months are also included. All bats seen are identified where possible and numbers are counted. The survey is biased towards hibernation sites which are accessible to humans, such as caves, mines and tunnels, so bat species which tend not to use such sites are under-recorded. The results are
also biased in favour of bats that hang in full view and against those that tend to conceal themselves in nooks and crannies. The ratio of bats seen to bats not seen is unknown. If no bats are recorded at a site it should not be assumed that bats are not present.
Sunset / Sunrise Survey: This survey takes place in July and August and is aimed at engaging new volunteers and enabling both new and experienced volunteers to locate new roosts in their local area. The survey comprises two parts, either or both of which may be carried out. The Sunset Survey involves going out into a garden or other open space at dusk, looking out for bats flying past and making a note of the general direction from which they appear to be arriving. The Sunrise Survey involves going out one hour before sunset and looking for bats “swarming” as they arrive back at their roosts. Observations made while doing the Sunset Survey on a preceding evening can be used to guide the volunteer in looking for possible roost sites. As many of the participants are beginners, the species identifications are not necessarily accurate. The main value of the data is recording the presence of bats and/or bat roosts in the survey area.
Interpretation of data Established statistical techniques for interpreting data have been applied when producing national species population trends based on NBMP data. expertise is in the production of specialist ecological reports and advice to support planning
applications. However, our flexible approach, range of skills and broad project experience
allows us to adapt to your individual requirements. The joint founders of the company, Fern
Fellowes-Day and Graham Davison are both Masters-qualified Ecologists. We have a wide
range of practical experience from major infrastructure contracts to smaller projects for
private individuals across the UK.
Fern Fellowes-Day BSc (Hons) MSc MCIEEM MSB
Fern has over nine year’s professional experience in the ecological consultancy field. Prior to founding
Focus Ecology Ltd with joint Director Graham Davison, she worked in a senior position at a leading,
independent ecological consultancy managing numerous contracts countrywide. She holds BSc
(Hons) in Zoology from the University of Wales, Aberystwyth and MSc in Habitat Creation and
Management from Staffordshire University. Fern is a skilled botanical surveyor, specialising in
Baseline, Biodiversity and Phase 1 Habitat Surveys. She is proficient with the BREEAM and Code for
Sustainable Homes schemes and meets the strict criteria for a ‘suitably qualified ecologist’. Fern’s
particular expertise is with protected species surveys, she has extensive knowledge in dealing with the
badgers, with practical experience in artificial sett design and creation and has held numerous Natural
England licences to close or disturb badger setts. In addition Fern holds survey licences (Natural
England and Countryside Council for Wales) for great crested newts, bats and white-clawed crayfish.
Fern has held Natural England Mitigation (development) licences for great crested newts and white-
clawed crayfish Conservation licences. She is particularly experienced in dealing with newt issues
affecting the quarrying, mineral extraction and landfill industry. Fern is also a competent surveyor of
reptiles, water vole and otters.
Cassie Needham BSc (Hons) MSc ACIEEM
Cassie is an Ecologist with three years of experience in the ecological consultancy field and joined
Focus Ecology in 2012. Prior to joining Focus Ecology she assisted on a number of large projects
nationwide with two leading ecological consultancies. She holds a BSc (Hons) degree in Geography
with Ecology from the University of Sussex and an MSc in Conservation from University College
London. Cassie is experienced in conducting surveys for protected species; great crested newts,
reptiles, white-clawed crayfish, bats, dormice and water voles. She also holds Natural England survey
licences for bats (Class 1), great crested newts and white-clawed crayfish, and is an Associate
member of the Chartered Institute of Ecology and Environmental Management (CIEEM).
