PETITION FOR WRIT OF MANDAMUS AGAINST DIANNA DURAN NEW MEXICO SECRETARY OF STATE and PURSUANT TO NMSA SEC 44-2-4 and 1-10-9

I INTRODUCTION

This validated petition challenges the Secretary of States decision in

designing the 2012 ballot to prohibit the right of the Plaintiffs and other similarly

situated to vote for the full party ticket See verifications attached as Exhibit 6 It

also challenges her decision to attach party emblems to the Presidential and Vice

Presidential Candidates only the result of which causes voter confusion

As the 2012 sample ballot shows the defendant has misapplied the statute

requiring the placement of a straight ticket option on the general election ballot

Defendant Duran is without authority to omit this option or in the alternative has

no statutory or constitutional authority to place the party emblem next to the

Presidential Candidate only

II UNDISPUTED MATERIAL FACTS

1 As this Petitioner illustrates the facts are not in dispute Also not in

dispute is the fact that Mandamus is a proper remedy as the Petitioner is asking for

a proper reading of the law and not contesting a discretionary act by the Secretary

of State This Court simply needs to read the clear language of the New Mexico

statutes governing the placement of the party emblem on the ballot

2 Prior to this General Election and prior to this Secretary of State

voters in New Mexico were offered the opportunity to vote a party ticket This

opportunity is represented in Exhibit 1 attached

3 Upon information and belief the emblems provided by the Party have

ONL Y been used to designate a ticket with voting options as seen in the 2008 amp

2010 Sample Ballot provided in Exhibit 1

4 The sample ballot for the upcoming general election is attached as

Exhibit 2 and shows that the Secretary of State has erred in her non discretionary

duties by not including an option for straight party ticket andor by applying the

party logo next to the candidates running for the Office of President and nowhere

else

5 The Secretary of States intention to attach the party emblem to the

presidential ticket for the 2012 ballot was also made public knowledge only

recently The earliest this information was made available to the voters of

Bernalillo County was on or about September 28 2012 See email attached as

Exhibit 3 See also9 of Exhibit 4

6 PlaintiffRane became aware of the Secretary of States decision on or

about October 22012 after reviewing the sample ballot See Rane Affidavit at 9

7 In the past the Plaintiffs have chosen the option to vote for the party

ticker and will continue to choose to do so in the future This right has been

improperly withdrawn by the Secretary of State See Affidavits of Ranes and

Marquez attached as Exhibits 4amp5

8 By identifying the party emblem only with the candidates for Office

of the President the Secretary of State has caused and will cause voter confusion

See Marquez Affidavit attached as Exhibit 5

III JURISDICTION VENUE AND PARTIES

9 This is a civil action in the fonn of Writ of Mandamus against a State

Officer Dianna Duran New Mexico Secretary of State to require her to perfonn a

nondiscretionary act and reverse her position outlined and allow a straight party

option on the November ballot The Petitioners ask for a preemptory writ to be

issued and this matter briefed and argued as to why Exhibit 1 confonns with the

law

10 This Court has jurisdiction to correct an error on the ballot namely

through statute

sect 1-10-9 Ballots errors and omissions

A If an error or omission has occurred in the printed ballot the district court upon petition of any voter may order the county clerk to forthwith correct the error or supply the omission or immediately show cause why the error should not be corrected or the omission should not be supplied

B If any error occurs in the printing on the ballot of the name of any candidate or in the designation of the office for which he is nominated the ballot shall nevertheless be counted for such candidate for the office for which he was nominated as shown by the certificate ofnomination

11 Defendant Dianna Duran is the duly elected Secretary of State ofNew

Mexico with offices at the seat of State Government in Santa Fe County New

Mexico As the chief election officer of the State-provided in NMSA 1978 sect 1shy

2-1 et seq-she is the State official charged with the responsibility of

administering the Election Code and ensuring that elections within the State are

conducted in a fair and lawful manner As such she is named as a defendant in her

official capacity

12 This Mandamus Action is brought pursuant to this courts original

jurisdiction under Act VI sect 13 of the New Mexico Constitution

IV PARTIES

A Plaintiffs

13 Plaintiff August J Rane is a registered voter in the State of New

Mexico County of Bernalillo Mr Rane has voted in past New Mexico elections

and intends to vote in the upcoming 2012 General election described herein

14 Plaintiff Willie Marquez is a registered voter in the State of New

Mexico Santa Fe County Mr Marquez has voted in past New Mexico elections


15 Plaintiff Democratic Party of New Mexico located at 3200 Monte

Vista Blvd Albuquerque NM 87106 whose Chairman is Javier Gonzales who

signed the verification

B Defendant

16 Defendant Dianna Duran is the duly elected Secretary of State of New

Mexico Under NMSA 1978 sect 1-2-1(A) she is the chief election officer of the

state and is required to obtain and maintain uniformity in the application and

operation of the Election Code of New Mexico to make rules and

regulations necessary to carry out the purposes of the Election Code

17 Plaintiffs sue Defendant Dianna Duran in her official capacity as

Secretary of State

Her duties relating to this suit involve

Secretary of State general duties The Secretary of State shall A generally supervise all elections by administering the Election Code in its statewide application B prepare instructions for the conduct of election and registration matters in accordance with the laws ofthe state C advise county clerks boards of county commissioners and boards of registration as to the proper methods of performing their duties prescribed by the Election Code

F be responsible for the education and training of county clerks regarding elections G be responsible for the education and training ofvoting machine technicians and H assist the county clerks in the education and training of registration officers N M S A 1978 sect 1-2-2

V CONSTITUTIONAL AND STATUTORY FOUNDATION FOR MANDAMUS ACTION

AMANDAMUS

This Courts authority to resolve this matter through Mandamus is well

settled and most squarely applied to its reasoning as stated in State ofNM ex reI

League of Woman Voters v Herrera 145 NM 563 566 203 P3d 94

97 (NM2009) In League of Women Voters the Court reasoned

We first consider the Leagues standing to bring an action in mandamus and whether mandamus is an appropriate remedy This Court in its discretion may grant private parties standing to vindicate the public interest in cases presenting issues of great public importance State ex rei Sego v Kirkpatrick 86 NM 359 363 524 P2d 975 979 (1974) Determining the validity of individual votes is of unquestionable importance Establishing clear rules prior to election day as to how such validity is to be established is of equal if not greater importance Therefore there can be little doubt that construing the statute governing the counting of hand-tallied ballots qualifies under the great public importance standard of the Sego line of cases

The New Mexico Constitution gives this Court the power to issue writs of mandamus against all state officers NM Const art VI sect 3 Mandamus is appropriate to compel state officers to perform a statutory duty State ex rei Clark v Johnson 120 NM 562569904 P2d 11 18 (1995) Here the Secretary is clearly a state officer within the meaning of the Constitution and it is clear that the Secretary must follow the Election Code and does not have the power to change its mandatory provisions Weldon v Sanders 99 NM 160 164-65655 P2d 1004 1008-09 (1982)

B NEW MEXICO CONSTITUTION

New Mexicos Constitution says

sect 3 Discrimination in voting juror selection and holding office

The right of any citizen of the state to vote hold office or sit upon juries shall never be restricted abridged or impaired on account of religion race language or color or inability to speak read or write the English or Spanish languages except as may be otherwise provided in this constitution and the provisions of this section and of Section One of this article shall never be amended except upon a vote of the people of this state in an election at which at least threeshyfourths of the electors voting in the whole state and at least two-thirds of those

voting in each county of the state shall vote for such amendment

C NEW MEXICO STATUTE

I Party Emblem and Designation

sect 1-7-6 Party name and emblem

A The chairman of the state central committee of a qualified political party shall file with the secretary of state a certificate setting forth the name selected for the political- party and showing a representation of the emblem by which the party is to be represented

B The certified party name and emblem shall thereafter be used to designate the ticket of that political party on all ballots

C The secretary of state shall certify the party name and emblem of the party to each county clerk

D The state convention of a political party may change the party name and party emblem by adopting in their stead another name and emblem The new party name and party emblem shall be filed in the same manner as was the original party name and party emblem provided the certificate shall be signed by the presiding officer and the secretary of the state convention adopting the new party name and party emblem

E No political party shall adopt any party name or party emblem which is the same as similar to or which conceivably can be confused with or mistaken for the party name or party emblem of any other qualified political party in New Mexico

B A statute that is intended to be uniform with those of other states is construed to effectuate that purpose with respect to the subject of the statute

C The presumption that a civil statute in derogation of the common law IS

construed strictly does not apply to a statute of this state

III What is On The Ballot

1-10-3 Ballots uniformity

A Ballots shall be uniform throughout the state and compatible with the type of voting machine used in the county

B The secretary of state shall determine in each election where applicable the position of the parties constitutional amendments questions and the names of nominees to be voted on by the voters of the entire state

VI ARGUMENT

A The Secretary is State is Obligated under 1-7-6 to Place Straight Party Option on 2012 Ballot

Throughout New Mexicos history voters have been provided the option to

vote for the full party ticket This right was fIrst removed by this Secretary State

only recently and without announcement This is contrary to the primacy of the

text of sect1-7-6 which states the certifIed party name and emblem shall thereafter

be used to designate the ticket of that political party on all ballots The relevant

portions of this statute to be parsed are in bold The fIrst is that the statue is

mandatory not permissive as it uses the term shall not may See sect12-2A-4

Therefore the emblem must be used The next question is for what purpose The

Statute then requires that emblem shall designate the ticket and nothing else It is

not disputed that the only use of this emblem in the previous election was to

designate where a voter could vote for a particular ticket See UDMF 3 see also

Exhibit 1 (2008 and 2010 Ballot) Under the limited authority granted by the

legislature for ballot form and content the Secretary of State only has discretion to

determine the limited issues of the position of the parties constitutional

amendments questions and the names of nominees to be voted on by the voters of

the entire state See NMSA 1-10-3

The Secretary of States mistake is that she makes no distinction between

ticket and candidate But this distinction is important to the purpose of the statute

See NMSA sect 12-2A-18 The reference to ticket creates the distinct right on the

ballot to vote for all candidates that belong to that party See eg Ie sect 34-906

which states There shall be a single general election ballot on which the complete

ticket of each political party shall be printed Each political party ticket shall

include that partys nominee for each particular office The secretary of state shall

design the general election ballot to allow for write-in candidates under each office

title The office titles shall be listed in order beginning with the highest federal

office The secretary of state has the discretion and authority to arrange the above

classifications of offices as provided by law To put it another way it is a

practical manner to avoid having to attach the emblem to every single candidate in

that ticket That is the voter has a choice under New Mexico Law vote the

ticket as identified by the party emblem or go through the full ballot and vote

for individual candidates See Exhibit 4 ~7 of Marquez Affidavit

Therefore the Secretary of State has no discretion to make a unilateral

decision to simply remove the ability for a ticket option to be made available to all

voters on all ballots See NMSA 1-7 -6 see also Davidowitz v Philadelphia

County 324 Pa 17 26 187 A 585 588 - 589 (Pa1936) which states the

secretary is not permitted to substitute his discretion in this regard for that which

the legislature has there definitely commanded To say that the Legislature by this

section intended to vest in the Secretary of the Commonwealth an uncontrolled

regulation of the arrangement of the ballot labels would cause the act to run afoul

of the principle which forbids delegation of legislative power

Both individually named Plaintiffs have availed themselves to the right to

vote the full ticket in the past and the elimination of this right restricts their ability

to exercise their right to vote See affidavits ofRane and Marquez

B In the Alternative 1-7-6 Does Not Allow the Emblem to Designate Only the Presidential Candidate

It is clear now that the Secretary of State in deciding to eliminate the right

to vote for the full ticket did not read sect 1-7-6 It is not disputed that the emblem

shall be used on all ballots In addition it can only be used to designate the ticket It

may not be used to show a particular candidate as the Secretary of State has done

in Exhibit 2 The reasoning is that having the emblem designate a candidate only

causes great voter confusion It appears that-especially in a State that has

traditionally had straight ticket voting-the emblem next to the President would

count as a vote for the full ticket The concern then is that those voters who like

the Plaintiffs like to vote the full ticket will drop off the ticket Given the citations

provided above if the Court fmds somehow that the Secretary of State can simply

eliminate ticket voting it cannot endorse her decision to simply use the emblem in

any way she decides especially in a manner that causes confusion to voters by

limiting it only to Presidential Candidates

C In the Alternative if the emblem is to be used it must be applied next to ALL candidates whose party is designated by that emblem

The only way to give proper effect to sect 1-7-6 and allow the Secretary of State

to validate her erroneous and irrational attachment of the emblem to the

Presidential Candidate is to place the emblem next to all of the candidates That is

if the language of sect1-7-6 namely emblem shall thereafter be used to designate

the ticket of that political party under the Secretary of States proposed 2012

Ballot it must be changed to place the emblem on every candidate on that ticket

Upon information and belief to do so is a practical impossibility and if that is

shown to be true this remedy must give way to the option for the full ticket as seen

in the 2008 ballot See Sept 14 email Bern Clerk to Shearer Exh 3 attached That

is to give 1-7-6 its true effect the emblem shall designate a straight ticket option

or be left off entirely

WHEREFORE Plaintiffs respectfully request this Court

a Issue a Writ of Mandamus declaring the Secretary of States

actions in omitting the straight ticket option that is inconsistent with sect 7 -6-1

and require any further form or ballots include the straight party option as

outlined in Exhibit 1 hereto

b Alternatively issues a Writ of Mandamus declaring the Secretary

of States actions in placing the party emblem only next to the Presidential

Candidate violates the plain reading of 7-6-1 and remove that emblem from

the Presidential Candidates name

c Alternatively declare that the Secretary of States action in

placing the party emblem only next to the Presidential Candidate violates the

plain reading of sect7-6-1 and require the Secretary of State to show cause why

either the emblem is placed next to each candidate on the ballot or the

straight ticket option is reinstated

d Grant such other relief as the Court considers appropriate

of my party and affmnatively voting for the entire party ticket by so indicating

next to the emblem ofmy party

ticket of my party by making a single vote or at a minimum by voting for all

those candidates who are identified to my party by the emblem of my party

United States ofAmerica and I identify and desire to support entirely one ofthose

two platforms rejecting the other and as a result of this political desire and in

conformance with the tradition of my family and my father it is an important

political position for me to be able to vote by party emblem identification alone for

the entire ticket ofmy party on the general election ballot on November 62012

8 I have in past elections since 200S especially taken political pride and satisfaction

in marking a single place on my ballot to not only support the individuals running

for political office of my choice but also to indicate my solidarity with the party as

II UNDISPUTED MATERIAL FACTS

1 As this Petitioner illustrates the facts are not in dispute Also not in

dispute is the fact that Mandamus is a proper remedy as the Petitioner is asking for

a proper reading of the law and not contesting a discretionary act by the Secretary

of State This Court simply needs to read the clear language of the New Mexico

statutes governing the placement of the party emblem on the ballot

2 Prior to this General Election and prior to this Secretary of State

voters in New Mexico were offered the opportunity to vote a party ticket This

opportunity is represented in Exhibit 1 attached

3 Upon information and belief the emblems provided by the Party have
