SECTION CONDITIONS 1. REFUND OF ENTRY FEES 1.1 No refunds will be given for livestock exhibits except where RASWA has excess entries in a section or class and is unable to accommodate them. 1.2 If an exhibit is withdrawn, rejected or disqualified by RASWA for any reason, the entry fee will NOT be refundable. 2. WITHDRAWAL OF EXHIBIT 2.1 A Veterinary certificate must be provided to RASWA if an exhibit is withdrawn due to illness or injury. 3. COMPLETION OF ENTRIES 3.1 Application for entry must be completed online at http://entries.perthroyalshow.com.au. 3.2 Exhibitors must supply on their application for entry all the information required, otherwise their entries may be refused. 3.3 No bird may be entered which is not the bona fide property of the Exhibitor at the close of entries. 3.4 Group and Single Entries: No bird in a group class shall be eligible to compete for Single Bird Specials or Championships. 3.5 Junior Exhibitors: At the time of the Show, the Junior Exhibitor must be between six (6) and sixteen (16) years of age. Entries must be the property of the Junior Exhibitor and be a distinct different breed or different variety exhibited by their Parent/Guardian/Grandparent(s). Junior Exhibitors must pen and unpen their own exhibits. 3.6 Catalogues: Results Catalogues are available for purchase from the Pigeons and Poultry Pavilion during the Show at a cost of $8.00 each from Sunday 29 September 2019. 3.7 Breed Pairs must be made up of one (1) male and one (1) female. 3.8 Once entries have closed, exhibits cannot be changed. 4. RESTRICTION OF ENTRIES 4.1 RASWA reserves the right to limit Exhibitors to three (3) entries per class if it be found, after close of entries, that insufficient accommodation will be available. 5. INCORRECT CLASSES 5.1 If a bird is entered in the wrong class, it will not be allowed to compete, and the entry fee will be forfeited to RASWA. 6. EXHIBITOR PASSES 6.1 Exhibitors will be issued with a single-entry pass into the Showground for inspection of birds on any one (1) day of the Show, as per the below allocation. • 1 - 20 exhibits: One (1) single-entry pass • 21 exhibits or more: Two (2) single-entry passes Passes will be emailed after close of entries. 6.2 Single-entry passes do not permit vehicle parking within the Showground. Please Note: There WILL NOT be any ticket sellers at Gate 2 (Dog Gate) during the Show. Only people with passes will be permitted through the gate and all other people must enter through Gate 1 at 10.00am, daily opening time. 7. PREPARATION OF EXHIBITS 7.1 No trimming, plucking or dyeing of feathers, staining of legs or any fraudulent practice will be allowed. 7.2 Every Exhibitor will be deemed responsible for the condition in which their exhibit appears in the pen.

7.3 Birds must be true to breed, no cross breeds. 8. RINGS 8.1 All Pigeons must be rung with recognised Society rings. No plain or split rings are allowed. 8.2 All young pigeon birds must be 2018 rung. 8.3 Ringed Poultry will be accepted but it is not compulsory. 9. PENNING 9.1 Exhibitors must pen their birds on Friday 25 September 2020 between 12.00pm and 6.00pm. The Pavilion will close at 6.00pm. All penning must be completed by then. PLEASE NOTE NEW LOCATION. 9.2 Exhibitors residing 100km or more from the Showground may PEN their birds on the first Saturday of the Show between 6.00am and 8.30am. 9.3 Containers, crates and boxes must be removed from the pavilion after penning. 9.4 Junior Exhibitors must pen and unpen their own birds. 10. UNPENNING 10.1 All sale bird pens will be locked in the afternoon on the last Saturday of the Show before unpenning Sunday between 7.30am and 10.30am only. There will be no birds removed in the afternoon on the last Saturday of the Show. ALL EXHIBITS MUST BE REMOVED between 7.30am and 10.30am Sunday 3 October 2020. Birds left after 10.30am will be the Owners responsibility, NOT RASWA. There will be no unpenning in the afternoon on the last Saturday of the Show. Please refer to the map on page 6 for collection location. The pavilion will be locked after that time. Any birds left after 10.30am on Sunday 3 October 2020 will be the responsibility of the Exhibitor and not RASWA or the Stewards. Junior Exhibitors must pen and unpen their own entries All Stewards and Committee Members on hand must supervise the unpenning. No birds will be unlocked and removed from the pens by Exhibitors, without the above in attendance and with their exhibit forms. Committee Members and Stewards who have birds in the Show must help others first with the unpenning. It will be the Exhibitors responsibility and not the Committee, to make sure they have the right birds before leaving the pavilion. All Exhibitors will have to have patience with the removal of the birds for the benefit of all fanciers. 10.2 No exhibit is to be removed from the pavilion until authorised by the Chief Steward. A Livestock Release Authority form, which MUST be signed by the RASWA Chief Steward of the pavilion, will be issued to each Exhibitor. 10.3 Crating: During crating only Exhibitors and their assistants will be permitted in the pavilion. Stewards will supervise the unpenning of exhibits. 10.4 Please Note: Eggs laid during the Show become the property of RASWA and may not be removed by any Exhibitor. 11. PUBLIC DISPLAY 11.1 The Pigeons and Poultry Pavilion (NEW LOCATION) will be open to the public between the hours of 10.00am and 6.00pm for the duration of the Show. 12. FEEDING AND WATERING 12.1 Exhibits will be fed and watered by RASWA free of charge. Exhibitors cannot feed their own birds unless permission is received from the Chief Steward.

12.2 A variety of water drinkers are available to meet the requirements of different breeds. 13. ADVERTISING 13.1 No notice or advertisement, other than that authorised by RASWA, shall appear on any pen, or anywhere in the pavilion. 14. SALE OF EXHIBITS 14.1 This should be nominated on the Entry form. The sale price cannot be changed once entered. The Committee reserves the right to ensure that Exhibits for sale are true to type before sale price is entered on the pen, or the birds will not be offered for sale. • Sale birds will be inspected before they are put up for sale. • Cross breeds or birds not true to type will not be allowed to be sold. • All sale birds must be true to type. • Sick birds will be removed immediately and the Owner will be contacted to pick up the bird/s. • Minimum sale price of all sale birds $30.00. A commission of 15% is charged by the Society for all birds sold during the

Show. If registered for GST, the commission is levied on the sale price inclusive of GST. Payment for birds sold will be remitted after the Show.

• All purchased birds to be removed by 9.30am on Sunday unpenning day. • It is the Exhibitors responsibility to discuss with the Cheif Steward what Exhibits of theirs have or have not been sold. • All sales to be through the pavilion Cheif Steward. 14.1 Birds may be offered for sale at the Show. This should be nominated on the application for entry. 14.2 A flat fee of $10.00 will be charged to every Exhibitor who wishes to sell birds during the Show. 14.3 RASWA will not be involved in the transaction and the transfer of ownership, which will only be between the seller and the buyer. 15. VETERINARY SERVICES 15.1 A Veterinary Officer will be on call throughout the Show to provide services to injured or sick livestock. Exhibitors requiring services will be responsible for payment for all services rendered. 15.2 The Veterinary Office and Medication Control Centre is located at the corner of Edgar Avenue and the Cattle Lanes. 15.3 The duty Veterinary Officer can be contacted from 6.00am to 9.00pm through Asset Services on (08) 6263 3161 or (08) 6263 3146. After 9.00pm on any day please call Asset Services on (08) 6263 3127. 16. DANGEROUS OR DISEASED EXHIBITS 16.1 All birds found unwell will be removed from the pavilion and the Exhibitor notified to pick up the bird(s). Department of

Agriculture ruling on inspection and removal of such birds. 16.2 In the interest of general public safety, aggressive birds will be withdrawn from the competition and the Exhibitor will be informed by the Stewards to collect their bird(s). 16.3 It is strongly recommended that all birds shown have been vaccinated for Avian Paramyxovirus and Rota Virus within the last 12 months and not less than four (4) weeks prior to the Show. 17. JUDGING 17.1 Judging will commence on Saturday 26 September 2020 at 9.00am. 17.2 Judges may withhold premier awards, special prizes, championship certificates etc., if in their opinion such awards are not warranted. However, where there are five (5) or more exhibits, a Judge may, in addition to first and second prizes, award a third prize if warranted. 17.3 Judging standards will be those recognised by the Australian Standard or the British Poultry Standard where applicable. 17.4 Judges must not award prizes, including Champions and Reserve Champions, even where there is no competition, if in the Judge’s opinion the exhibits are not of Royal Show standard or are not suitable for the class in which they are competing. Judges may award a second or third prize instead of a first prize if deemed appropriate.

17.5 Where Judges are unable to agree on the Reserve Champion and Grand Champion Award, the Chief Steward is empowered to appoint an independent Judge. 17.6 No person, Exhibitor or otherwise, may in any way hinder or interfere with a Judge or Steward in the discharge of their duties. 17.7 No person, Exhibitor or otherwise, may in any way communicate with a Judge or Steward, until all awards have been made and all cards displayed upon the pens. 17.8 The recorded opinion of the Judge as to merit will be final. 18. PROTESTS AGAINST AWARDS 18.1 An Exhibitor may protest against an award won by an exhibit, alleging breach of RASWA's General Show Regulations or Section Conditions or ineligibility. 18.2 A protest must be made in writing, giving reasons for the protest and signed and submitted to the Councillor in Charge, not more than one (1) hour after the completion of the judging of the class. 18.3 Such protest must be accompanied by a deposit of $50.00 which may be forfeited to RASWA if in the opinion of the Councillor in Charge the protest is unfounded, frivolous or vexatious. 18.4 If an exhibit is awarded a prize and is subsequently disqualified the prize will not automatically be awarded to the next placegetter. The final decision will be at the discretion of the Judge(s). 18.5 Any prize money awarded for an event, which is the subject of protest, shall be retained by RASWA until the protest has been resolved. 19. CLUB BANNERS 19.1 All Pigeon, Poultry and Waterfowl Clubs may display their banners in the pavilion provided they are delivered to RASWA by 1 September 2019. 20. AWARDS 20.1 No first place will be awarded if in the Judge’s opinion any bird in a class shall be deemed not worthy of this place. Second place only will be awarded.

GENERAL SHOW REGULATIONS The Society’s General Show Regulations and Section Conditions regulate the conduct of the Show. Upon acceptance of an entry the Exhibitor is irrevocably contracted to be bound by those General Show Regulations and Section Conditions. A copy of the Society’s General Show Regulations may be obtained on application or from the website http://perthroyalshow.com.au/general-regulations. An Exhibitor who breaches any General Show Regulation or Section Condition may be disqualified, or suspended for any period, fined or otherwise penalised. The Society may publish to: a) all Royal Show Societies in Australia; b) the relevant Breed Society; and c) the body with which the exhibit is registered, or is eligible for registration, the result of any proceedings before the Disciplinary Committee in which a person has been found to have breached any General Show Regulation or Section Condition. The Society may recognise and act upon any penalty imposed by any other similar society, organisation or body in Australia on any person or exhibit. It is in the Exhibitors best interests to carefully read all conditions. INSURANCE The Owner/Exhibitor is responsible for the insurance of their exhibit whilst the exhibit is on the Society’s Showground. DAMAGES The Owner/Exhibitor shall be liable to reimburse the Society for any damages, costs, claims, expenses or liabilities incurred, or likely to be incurred, by the Society arising from the withdrawal of an exhibit. WITHDRAWAL OF EXHIBIT BY THE SOCIETY The Society may, at its sole discretion, withdraw, reject or disqualify an exhibit. Refer to the Society's General Show Regulation 3.18. DANGEROUS, OBJECTIONABLE OR DISEASED EXHIBITS The attention of Exhibitors is drawn to the Society’s General Show Regulation 4.7 and 4.8, with reference to dangerous, objectionable or diseased exhibits. PRIZE MONEY RASWA has a policy whereby all prize money is paid by EFT (Electronic Funds Transfer). Your banking details will be kept secure and can only be used by RASWA to credit your bank account. Please complete your account details on the entry form even if you have provided them previously. In accordance with the rules of the competition, failure to provide your bank details will mean that any prize money you earn will be forfeited and retained by RASWA. Prize money as stated in the schedule does not include GST. The prize money which the Society pays to successful Exhibitors ("you") depends on the information that you provide to the Society. If you confirm that you are GST registered and provide your Australian Business Number (ABN) the Society will pay the appropriate prize money plus 10% GST. The Society will provide to you a Recipient Created Tax Invoice (RCTI) within 28 days of the day you were successful at your event, detailing the GST which you will need to submit to the Australian Tax Office (ATO). If any adjustments need to be made, the Society will issue an adjustment note to you within 28 days of the adjustment. Upon entry into the competition and completion and signing of the application form, this form will become a RCTI agreement as required under (Goods and Services Tax) Act 1999. Furthermore, you acknowledge your agreement to the following: • The Society will issue you a tax invoice in respect of the successful exhibit;

• You are requested not to issue a tax invoice to the Society in respect to prize money received; • It will be necessary for you to notify the Society if you cease to be registered for GST; and • The Society will notify you if it ceases to satisfy any of the requirements of the determinations. If you provide your ABN but are not registered for GST, the Society will pay the prize money as detailed in the prize schedule. If you are a business Exhibitor and do not provide your ABN to the Society, 47% tax will be deducted from your prize money under the ATO PAYG provisions. If you confirm that you are entering as part of a private recreational pursuit or hobby, the Society will pay the prize money as detailed in the prize schedule. AWARDS The Society will not be responsible for awards or prize money not received by Exhibitors after 31 December 2019. 17.1 Exhibitor Accepts The lodgement of an Application of Entry form shall be deemed

to be acknowledgment by the Exhibitor of his or her agreement that the Society shall be under no liability for:

17.1.1 No Liability for animals or birds The loss, injury or death of any animal or birds exhibited, or

any other animal or birds, whether caused by, or attributable to, the negligence of the Society, or of its servants or Agent, or otherwise howsoever.

17.1.3 No Liability for injury to, or the death of, Exhibitor or

general public Any injury to, or the death of, the Exhibitor or any other

Exhibitor, or any member of the general public, whether caused by, or attributable to, the negligence of the Society, or of its servants or Agent, or otherwise howsoever.

17.1.4 No Liability for contracting any disease or suffering

animals or birds Any loss or damage suffered by any Exhibitor as a result of

any disease contracted or suffered by any animals (including birds) after, or as a consequence of any animal Exhibits, or their progeny, being brought onto the Showground.

17.2 No Liability for Livestock Sales The Society and the Auctioneers of Royal Show Livestock

Sales shall be under no liability to any Owner or purchaser of livestock (whether exhibited or otherwise) entered for sale or sold at any Royal Show Livestock Sale.

17.2.1 No Liability for livestock auctioned In respect of any loss or injury to such livestock; whether such

loss or injury be caused by or be attributable to, the negligence of the Auctioneers specified in the Regulations relating to the Royal Show Livestock Sales or to the Society or any of its servants or Agents.

17.2.2 No Liability for other livestock, property, Exhibitor or

general public For any injury or damage occasioned to any other livestock or

property, or to any other Exhibitor, or to the general public, whether caused by, or attributable to, the negligence of the Auctioneers specified in the Regulations relating to the Royal Show Livestock Sales or to the Society or any of its servants or Agents.

17.2.3 No Liability for consequential loss and loss of profits For any loss or damage (including without limitation

consequential loss and loss of profits) suffered by any Owner or purchaser of livestock as a result of any disease contracted or suffered by any livestock after, or as a consequence of any livestock being entered for sale, at any Royal Show Livestock Sale.

17.3 Exhibits Sold Privately Where any animal exhibited, or any other exhibit, is sold

privately during the time of the Royal Show the vendor thereof shall indemnify the Society against all liability to the purchaser in respect of any loss, injury, disease or damage to such animal or other exhibit, whether such loss, injury, disease or damage be caused by or attributable to the negligence of the Society or any of its servants or Agents.

17.4 Accidents and Incidents Competitors, Exhibitors and Attendants must report promptly

to the Society all accidents and incidents causing or likely to cause injury to persons or damage to property.

17.5 Trade Practices Act To the extent that any matter relating to entry or remaining

upon the Showground relates to the supply of goods or services by the Society within the meaning of s. 68A of the Trade Practices Act 1974 (Cwlth), the Society’s liability is limited as follows:

(a) in case of goods, the replacement, repair or payment

for the replacement or repair of the goods. (b) in the case of services, the re-supply of the services or

the cost of the re-supply of the services. It shall be in the Society’s absolute discretion as to whether it

replaces, repairs or pays for replacement or repair of goods. It shall be further in the Society’s discretion as to whether it re-supplies or pays the cost of re-supply or services.

17.6 Indemnity To the maximum extent permitted by law, each Competitor and

Exhibitor must indemnify and keep indemnified the Society and its officers, employees, members and Agents from and, against all actions, claims, demands, losses, damages, costs, expenses and liabilities including without limitation, consequential loss and loss of profits for which the Society is or may be become liable in respect of or arising from:

(a) loss, damage or injury to any person in connection with

the exhibit or the relevant event; (b) without limiting sub-regulation (a) loss, damage or injury

to any other exhibit or Exhibitor, his or her family, invitees, Agents, or to the property of the Society, or its members, or to the general public, caused or contributed to or by any act or omission of an exhibit of the Exhibitor or by the Exhibitor, his or her family, invitees or Agents; and

(c) without limiting sub-regulation (a) loss, damage or injury to the exhibit, or the Exhibitor, his or her family, invitees, or Agents caused or contributed by an act or omission of an exhibit of the Exhibitor or by the transportation, feeding or housing of an exhibit of the Exhibitor.

17.7 Removal of Exhibit

Without prejudice to any other provision of these Regulations, where the Society, its officers, employees, members or Agents remove an exhibit, or causes an exhibit to be removed from the Showground, the exhibit is removed or caused to be removed entirely at the risk of the Exhibitor. The person or persons removing the exhibit will be deemed to be the Agent of the Exhibitor, and his or her acts and omissions will be deemed to be the acts and omissions of the Exhibitor.

ANIMAL / LIVESTOCK OWNERS / EXHIBITORS PUBLIC LIABILITY INSURANCE

The Royal Agricultural Society of Western Australia (“RASWA”) has a Public Liability insurance policy in the interests of Owners / Exhibitors of Animals / Livestock exhibits entering competitions in accordance with RASWA’s General Show Regulations and Section Conditions. INSURED PARTIES: Owner(s) / Exhibitor(s) of Animal(s) / Livestock exhibit(s) upon payment of entry fee(s) and provided such Owner(s) / Exhibitor(s) comply with all requirements herein together with RASWA’s General Show Regulations and Section Conditions. Failure to comply may render the Owner(s) / Exhibitor(s) personally liable for any claims that may arise as a result of any incident to which they may have contributed. PERIOD OF INSURANCE: For the period the Animal(s) / Livestock exhibit(s) are on RASWA’s Claremont Showground, Claremont, Western Australia for the purposes of the 2019 Perth Royal Show. INSURED ACTIVITIES: All activities undertaken whilst within the confines of RASWA’s Claremont Showground, Claremont, Western Australia consistent with the (Business) Insured Parties’ Animal(s) / Livestock exhibit(s) activity. DESCRIPTION OF COVER: Insurance in respect of the Insured Parties’ liability to pay costs and compensation in respect of loss of, or damage to, third party property and death of, or injury to, third party persons caused by, and arising out of, the insured parties’ activities, all subject to RASWA’s policy terms, conditions, exclusions and warranties etc. AMOUNT OF COVER: $150,000,000 any one (1) occurrence. Excess: $10,000 each and every claim. It should be noted that the payment of the excess in the event of a claim is the responsibility of the Owner(s) /Exhibitor(s). JURISDICTION: Australia. TERRITORY: The Royal Agricultural Society of Western Australia’s Showground, Claremont, Western Australia. INSURER: Lloyds of London and others as listed on policies held by RASWA.

IMPORTANT CONDITIONS: The Owner(s) / Exhibitor(s) must: 1. Exercise reasonable care to maintain all premises, fittings and plant

in sound condition; 2. Take all reasonable precautions to prevent injury and damage to

persons and property; 3. Promptly comply with any request made by the Royal Agricultural

Society of WA which it may, at its sole discretion, require of Owner(s) / Exhibitor(s);

4. Give immediate notice:

a) of an incident that may give rise to a claim; or b) if in receipt of advice of a claim;

5. Not make any admission, offer or promise in connection with any

claim and must not at any time admit liability; 6. Make themselves aware of, and comply with, the policy conditions

including duty of disclosure. NOTE: 1. All enquiries are to be referred to RASWA. 2. THIS INSURANCE ONLY APPLIES TO OWNER(S) /

EXHIBITOR(S) ENTERING COMPETITIONS IN ACCORDANCE WITH RASWA’S GENERAL SHOW REGULATIONS AND SECTION CONDITIONS.
