Made by the Lieutenant-Governor and deputy of the Governor inExecutive Council.

1. Citation

These regulations may be cited as the Financial AdministrationAmendment Regulations 2001.

2. Regulation 24A inserted

After regulation 24 of the Financial AdministrationRegulations 1986* the following regulation is inserted �

24A. Internal audit function � exemptions

(1) For the purposes of section 53(f) or 55(f) of the Act,the Treasurer may exempt the accountable officer of adepartment or the accountable authority of a statutoryauthority respectively from the responsibility todevelop and maintain an effective internal auditfunction if �

(a) adequate internal controls and adequatefinancial reporting practices are in place in thedepartment or statutory authority; or

(b) the costs incurred or likely to be incurred indeveloping and maintaining an effectiveinternal audit function would or would be likelyto outweigh the benefits.

(2) An exemption is subject to the following conditions �(a) the condition that the accountable officer or

accountable authority notifies the Treasurer ofany changes that affect or could affect theinternal controls or reporting practices of thedepartment or statutory authority;

(b) any other condition specified in the exemption.

Citation1. This amendment may be cited as the Onslow Prawn Managed Fishery Management PlanAmendment 2001.

Principal Plan2. In this amendment the Onslow Prawn Management Plan 1991* is referred to as the principalPlan.

Clause 2 amended3. Clause 2 of the principle Plan is amended by inserting in alphabetical order the following�

� �try net� means a trawl net having a headrope length not exceeding 5 metres.�.

Clause 11 amended4. Clause 11 of the principal Plan is amended by inserting immediately after�

(a) �11.�, the following��(1)�, and

(b) paragraph (b) the following subclause��(2) In addition to or instead of any means of fishing for prawns authorised or approved undersubclause 11(1) a person may fish for prawns with a single try net.�.

Clause 12 amended5. Clause 12 of the principle Plan is amended by;

(a) deleting from subclause (1) the words from and including �subclass� to and including�anchoring� and replacing them with the following��this clause the Master of a boat licensed to operate in the Fishery must ensure that all otterboards are stowed on board and all trawl nets are unshackled from the otter boards and arelowered on deck while the boat is moving through or is anchored�;

(b) deleting from subclass (2) the words �securely attached to the boat and�; and

Citation1. This Order may be cited as the Prohibition on Fishing (Cottesloe Reef) Order 2001.

Prohibition on commercial fishing2. A person must not fish for a commercial purpose in the waters specified in Schedule 1.

Prohibition on non-commercial fishing3. A person must not fish for a non-commercial purpose in the waters specified in Schedule 1.

Exception to prohibition on non-commercial fishing4. Clause 3 of this Order does not apply in the circumstances specified in Schedule 2.

Prohibition on certain forms of bait5. A person must not use blood or offal for the purpose of attracting fish in the waters specified inSchedule 1.

Schedule 1All those waters bounded by�

(a) the high water mark,(b) a line drawn 800 metres westward from the high water mark (being a prolongation of the

centre of Grant Street, Cottesloe where Grant Street meets with Marine Parade, Cottesloe),(c) a line drawn 800 metres westward from a point on the high water mark west of a point fifty

metres north of the northernmost part of the Leighton Railway Overpass where it meetsCurtin Avenue, Cottesloe, and

(d) a line linking the westernmost points of the lines described in (b) and (c).

Definition2. In this Order �waters of the Cottesloe Reef� means all those waters bounded by�

area. Acceptable methods of clearing include grazing, mowing, grading or burning.2. If lot is larger than 2024M2 (1/2 acre), there be a firebreak of either 3 metres inside the

boundary or 3 metres outside the boundary. Where there is a road free of flammablematerial, applications can be made annually to the Chief Fire Control Officer forexemption.

(c) Fuel DumpsIn respect of land owned or occupied by you, on which is situated any fuel dump, in additionto the requirements of paragraphs (a) and (b) you shall remove all flammable materials ormaterial likely to become flammable during summer from land occupied by bulk storagetanks and/or drums used for storage of liquid fuel whether the bulk storage tanks and/ordrums contain liquid fuel or not. This includes the land on which ramps for holding thedrums are constructed.The flammable material free ground must be maintained to a distance of at least 3 metresoutside the perimeter of any drum, stack of drums or drum ramp or bulk storage tank.Flammable material is defined for the purpose of this notice to include vegetation, timber,boxes, cartons, paper and like materials, rubbish and any other combustible matter, but doesnot include green standing trees, garden plants, growing bushes or maintained lawns,stacked wood heaps or buildings.

(d) If it is considered to be impracticable for any reason to clear firebreaks on the land in thesituations required by this Notice or by the date required by this Notice, you may apply to theCouncil or its duly Authorised Officer for variations by the Order. An application must bemade no later than 14 days prior to the date by which firebreaks are required to beconstructed, for permission to provide firebreaks in alternative positions or by an alternativedate or to take alternative action to abate fire hazards on the land. If permission is notgranted by the Council or its duly Authorised Officer you shall comply with the requirementsof this Notice.

(e) The penalty for failing to comply with this Notice is a fine of $100 by infringement or notmore than $1,000 if prosecuted, and the person in default is liable, whether prosecuted or not,to pay the cost of performing the work.

(f) If the requirements of this notice are carried out by burning, such burning must be inaccordance with the relevant provisions of the Bush Fires Act, 1954.
