1. Introduction

1. This Updated Resettlement Plan should be read in conjunction with the agreed Resettlement

Plan (RP) dated January 2017 available at

https://www.adb.org/sites/default/files/project-documents/49029/49029-002-rp-03.pdf. This updated

RP only covers the Qitai water transmission pipeline component since the final design was completed

in December 2017. Updated RPs for the remaining components under the Qitai County Subproject

will be submitted to the Asian Development Bank (ADB) for review and concurrence once the final

design becomes available; and the detailed measurement survey (DMS), and other

resettlement-related activities are carried out as per agreed RP.

2. Project variation (changes): According to the final design, in order to better meet the water

supply demand of Qitai county, project management office (PMO), and the water supply company (IA)

adjusted the route and length of the water transmission pipeline network after discussion, and the

newly constructed transmission pipeline network is 71.859 km after adjustment. At the same time, in

order to reduce the temporary occupation impact on farmers, the PMO and IA optimized and adjusted

the transmission pipeline network route, to occupy farmers’ cultivated land as little as possible; the

construction of transmission pipeline will be along state-owned unused land as far as possible. More

details are shown in Table 1-1. The construction of transmission pipeline will not entail any permanent

impacts.

2. Scope of LA Impacts

2.1. Temporary Impacts on Collective Cultivated Land

3. Temporary land occupation impact involved in the subproject is mainly caused by transmission

pipeline network construction: transmission pipeline network construction will affect three towns

(including Biliuhe town, Jibuku town, GuCheng) and five villages (including Dongzigou village,

Yongfengqu village, Shangpuzi village, Dabanhe village, Gucheng village), project construction will

involve 347.59 mu collective cultivated land occupied for temporarily, including temporary excavation

of cultivated land for 59.91 mu, temporary occupation of cultivated land for 287.68 mu, and 53

households with 223 people will be affected.

2.2. Temporary Impacts on State-owned Land

4. Temporary land occupation impact involved in the subproject is mainly caused by transmission

pipeline network construction. The subproject involves temporary occupation state-owned unused

land for 1121.73 mu, including temporary excavation for 116.90mu, temporary occupation for 1004.83

mu, without ground attachments, and affected people.

5. For state-owned unused land and state-owned construction land occupied temporarily, as

confirmed by the Land and Resource Bureau, no compensation is required. It is required to handle the

related temporary occupation procedures and construction permitting procedures in the Land and

Resource Bureau and Bureau of Housing and Urban, and the construction can start, after the

construction is completed, which will be restored to the original status.

2.3. Affected Vulnerable Groups

6. According to the updated socioeconomic household survey and the verification of village

committee, no vulnerable groups will be involved in the subcomponent.

2.4. Affected Ethnic Minorities

7. According to the final design and updated resettlement survey, land occupation of transmission

pipeline network project will affect ethnic minorities for 3 households with 17 people, including Uygur

for 2 households with 14 people, and Hui for 1 household with 3 people.

2.5. Affected Attachments and Infrastructure

8. According to the final design and updated resettlement survey, no impact of ground

attachments and infrastructure is involved in the construction of transmission pipeline network

subproject.

3. Socioeconomic Profile of Affected Areas

9. To learn more about their living and production condition, the suggestions to the subproject of

the affected people and different demands of affected people to the subproject, the specific analysis to

the demands of different people will benefit the identification of the subproject impact and avoid the

negative impact of the subproject as much as possible and promote the smooth implementation of the

subproject. Resettlement consultants ensured full understanding and communication with the affected

groups through the questionnaire survey, interview, discussion, observation and other methods to

learn the demands of affected people, and provided a quantitative material which is consulted by the

local government, opinions of affected people, the demands and concerned problems of women and

ethnic minorities, the social analysis of the affected community, and so on.

3.1. Socioeconomic Status of APs

10. From 9–17 December 2017, resettlement consultant, PMO, Land and Resource Bureau and

relevant personnel of the water supply company conducted socioeconomic survey on population, land,

of engineering water supply company population, land, special facility, and the physical indicators of

different affected people and affected people involved in project impact, and questionnaire was

carried out on 53 affected households (affected by temporary occupation), and held villagers’

meetings.

3.1.1. Affected People

11. The detailed demographic characteristics of affected people are shown in Table 3-1, including

different age, sex, population, education level, and occupation type. In this survey, temporary

occupation affects 53 households with 223 people. Among them, including 112 males and 111

females; 206 Han, 14 Uygur and 3 Hui.

3.1.2. Occupations

12. Among the surveyed labor force, there are about 36.77% of them who are planting, accounting

for the largest proportion, 1.79% of them are doing animal husbandry and the scale is very small, and

15.70% of them are migrant workers; and 5.38% are doing business. The survey shows that some of

the farmers contracted out their own land to others for farming; the farmers themselves will choose

working outside to increase income such as catering service, traffic; and some other farmers do

short-term jobs during slack time to increase income. Among the surveyed people, the students

account for 10.76% as shown in Figure 3-1.

3.1.3. Income and Expenditures

13. Due to affected people affected by transmission pipeline construction, mostly villagers in Jibuku

town, Biliuhe town and GuCheng village, the survey found that these affected households are no

longer limited to traditional agriculture, but form a new rural development type which focused on

migrant labor and self-employment income, in addition to farming income. The economic income and

expenditure of affected 53 households are shown in Table 3-2.

14. From Table 3-3, the agriculture income accounting most for 37.85% and the following are the

outside working income and wage income, accounting for 21.84% and 12.11% respectively. Due to

affected people being rural residents, mainly engaged in planting industry, therefore, the proportion of

agricultural income is high. However, the income source of affected households is not limited to

agriculture, but other industries. From the whole income, it was found that the income structure shows

diversification. Detailed income sources are shown in Table 3-3.

15. Table 3-4 showed the composition of average household expenses of the AHs. The survey

shows that living expenses accounted for 33.66%, followed by expenses on agriculture and clothing

accounting for 20.58% and 7.54% respectively. See other details in Table 3-4.

4. Legal Framework and Policies

4.1. Laws Regulations and Policies Applicable to Resettlement

16. Specific to temporary impacts, compensation standards have been divided into two parts: (i)

temporary occupation, and (ii) temporary excavation.

4.2. Compensation Standards for Temporary Occupation

17. For the temporary occupation of cultivated land, according to the “Reply on the Uniform AAOV

Rates for Land Acquisition of XUAR (XG [2010] No.323)” and the Implementation of Autonomous

Public Notice on Unified Annual Output Value Standard (XL&R issued [2011] No.19, the temporary

occupation of cultivated land will be compensated in accordance with the compensation base of Class

1 cultivate land that is CNY1,500/mu, the compensation time is calculated by the implementation time;

after the implementation the implementing agency (IA) will need to restore the cultivate land; and the

PMO and affected people will be responsible for the exam. In accordance with the benefits of the

affected people, the Qitai PMO, Land and Resource Bureau consulting with the affected people during

RP updating, finally determined that the cultivated land occupied temporally will be compensated in

CNY1,500/mu, as follows: (1) temporary land excavation, one-time compensation of 8 years will be

paid by PMO for temporary excavation of cultivated land used for land restoration, that is to say

CNY1,500/mu*8 year= CNY 12,000/mu; (2) temporary land occupation, one-time compensation of 4

years will be paid by PMO for temporary occupation of cultivated land for land restoration, that is to

say CNY 1,500/mu*4 year= CNY 6,000/mu.

18. In the process of pipeline construction, temporary excavation will damage cultivated land, and

considering the vital interests of affected people, Qitai county PMO and Land Resource Bureau

consulted with affected people. After consultation, PMO and affected people reached consensus to

add a new compensation standard which is for one-time compensation of 8 years for affected

cultivated land caused by pipeline excavation, which will support the affected people for soil

remediation. The temporary occupation causes smaller losses to soil, and one-time compensation of

4 years is used for land restoration which is already set in the agreed RP of January 2017.

19. For the temporary occupation of state-owned unused land and construction land, as confirmed

by the Land bureau, there is no need for compensation, but only a need to check relevant documents

signed by the Land bureau and Housing and Urban-Rural Construction bureau. After finishing the

subcomponent, it needs to be restored to the original status.

5. Measures to Rehabilitate for Temporary Land Occupation

5.1. Objectives of Resettlement

21. The objectives of the project resettlement are to restore the AHs’ annual net income per capita

to the pre-resettlement level and further improved with local economic development.

5.2. Principles for Resettlement Recovery Plan

22. According to the applicable laws and regulations of the PRC and ADB’s Policy on Involuntary

Resettlement, the following basic principles will apply to the resettlement work of the project:

(1) Implement resettlement and the applicable compensation policies properly to improve or at least

restore the production level and standard of living of the affected residents;

(2) The affected people shall be fully consulted for resettlement programs;

(3) The planning layout shall be determined on the principle of “facilitating production and life”; and

(4) Resettlement shall be combined with the local urban development, resources development,

economic development and environmental protection programs. Feasible measures shall be designed

to restore and improve the displaced persons’ production level and standard of living, and create

necessary conditions for their self-development.

5.3. Recovery Plan for Collective Land (cultivated land) Acquisition

23. Based on field work and investigation, temporary land occupation is mostly abandoned land,

some parts of land are planted with wheat. The land occupied by the project is barren and lacks

irrigation, and the annual output/value is very low. According to the current average annual output

value and the acquired land area, the annual loss, net income formula for planting crops can be

24. For example, for the farmer planting wheat, through the survey it was found that the net output

of wheat is estimated to be 410kg/mu. The market price is CNY2.74/kg, the total planting investment

is CNY675/mu, therefore the net income is ((410kg�CNY2.74/kg) –CNY675/mu) =CNY448.4/mu. It

can be seen that the annual output for per mu is very low. For this subcomponent, the PMO will

compensate CNY1,500 per mu. For temporary cultivated excavation land, the PMO will compensate

one-time for 8 years, which is CNY1,500/mu�8 years= CNY12,000/mu. For temporary occupation of

cultivated land, the PMO will compensate one-time for 4 years, which is CNY1,500/mu�4 years=

CNY6,000/mu. As it’s shown in Table 5-1, currently, benefit of growing wheat comes to CNY448.4, the

compensation for temporary occupation is CNY12,000/mu, and the compensation price is 26.76 times

that of net income. The compensation for temporary occupation cultivated land is CNY6,000/mu, and

the compensation price is 13.38 times that of net income. The value of compensation is much higher

than the value of planting. Therefore, the temporary occupation of the project will not have much

impact on the production and life of the affected people, especially for the income (Table 5-1).

25. To improve living conditions and income levels of affected people, the PMO will not only

compensate them, but will also develop livelihood support plan based on full consultation for the APs

and in accordance with the status of the AHs. This will be carried out from June 2018 to December

2019 which is also planned for other components of the Qitai subproject.

26. During the whole restoration progress, the PMO will organize affected people for some

technical training, such as economic crop planting. Relevant technical personnel of the department of

agriculture and labor security will be invited to give the affected people some training on planting and

other aspects. The affected households shall have at least two or more technical training and

non-agricultural production technical training. The economic income and livelihood of affected people

can be improved by these measures and improved skills.

27. To improve living conditions and income levels of affected people as soon as possible, the PMO

will not only compensate them, but will also develop a restoration plan based on full consultation with

the APs and in accordance with the status of the AHs, such as, to organize affected people for some

technical training, like economic crop planting. The relevant technical personnel of the department of

agriculture and labor security will be invited to give the affected people some training on planting. The

affected households shall have at least one or more technical training and non-agricultural production

technical training to improve planting skill and increase income of the affected people.

(1) Training contents: According to the industrial structure and market demand of Qitai county,

vocational skills training is focused on service industry, service industry, and breeding industry. There

are mainly agricultural technologies, animal husbandry, and so on

(2) Forms of training: there are three methods: vocational skills training, single training, and job

training. Vocational skills training shall be trained by the administrative department of labor security,

various education training institutions, industries, and employers, especially on agricultural technology,

business training, and skills training.

5.4. Protection of Women’s Rights

28. The project affects a total of 111 women. Women will participate fully in resettlement activities

through information disclosure and village meetings, and enjoy the same rights as men in

compensation, employment, and training. In addition, the following measures will be taken to help

women restore income:

Skills training, including training on home services industry, hairdressing and beauty, and

hotel service will be first made available to affected female laborers so that their economic status

is not reduced;

Affected women will receive relevant information, and participate in public consultation and

resettlement.

5.5. Ethnic Minority Development

29. The subproject temporary occupation involved a total of 3 households with 17 ethnic minorities,

including 2 households with 14 Uyghur, and 1 household with 3 Hui nationality. Through the survey,

the minorities live together with the other local groups. The subproject will not involve any house

demolition of minority people and will not separate the minority groups. The subproject will not impact

their rights of land access and use of resources; therefore, affected minority people in the subproject

enjoy the local social status, and their economic status is consistent with the Han nationality, and they

retain their national characteristics in their habits and religion. The minority population will enjoy the

same rights for compensation, and have priority in employment and training. Overall there is no

difference between the Han and minorities.

6. Public Participation and Grievance Redress

30. According to relevant policies and regulations of the PRC, regional and municipal on LAR, it is

necessary to conduct public consultation and encourage active participation of APs in project

preparation and implementation stages in order to protect the lawful rights and interests of the APs,

reduce grievances and disputes, and realize the resettlement objectives properly. Consultation has

been fully highlighted during preparing the RP and organizing implementation.

6.1. Consultations at Updated Stage

31. The survey respondents were 53 HHs affected by temporary occupation. These surveys are

also intended to make the implementation agency and design unit aware of local conditions and

concerns of the affected people.

32. All affected households have participated in the social impact survey, were fully engaged in

public participation and consultation, and fully expressed their thoughts and wishes. In addition, the

affected people fully understood the content and compensation standards of the project.

33. The resettlement consultants and survey teams investigated affected people through group

interviews and questionnaires. According to the survey results, most of the affected people said they

knew about the project and supported the construction and implementation of the project. Through the

explanation and publicity of village and related staff, the affected people have a good understanding

of land compensation policies as well as compensation standards. At the same time, the affected

people said that if there were non-technical positions during the implementation of the project, they

would be willing to participate in the construction of the project. Most villagers are also willing to

participate if the project or implementation agency provides technical training.

34. As to all significant topics for discussion involved in the planning stage of resettlement, the PMO

has organized meetings and discussions with the design institute, consultant agency, local

communities, and APs to disclose information and conduct public consultation in various ways from 8

December 2017 to 17 December 2017 including:

(i) Design optimization discussion to minimize land acquisition and resettlement impacts;

(ii) Consultation with managers of affected villages, to get their socioeconomic background and

discuss the LA options and the compensation standards with the villagers; and

(iii) The Qitai PMO and RP preparation agency will make a detailed discussion with the affected

representatives on the draft RP and information disclosure.

35. The public participation and consultation provided a basis for the improvement of the updated

RP.

36. Copies of resettlement information booklets will be distributed to the affected households in

January 2018.

37. Through public participation in conferences and socioeconomic surveys, the concerns of the

affected people are mainly focused on the following aspects:

(i) Since the LA area is not large, the LA will have little impact on their income condition. The

current crop and benefits of the land are not good and have little impact on their income. The

most important issue for the affected people is the compensation standard of land occupation,

and then they hope the compensation can be paid timely and whether crop cultivation training

and livestock breeding technical training can be conducted.

(ii) Land compensation. During the investigation and consultation, Qitai PMO and resettlement

consultants consulted with the affected people on the standard of compensation for the

temporary occupation and finally reached an agreement.

(iii) Due to the construction of pipeline, the production of agriculture may be affected and the

construction process may cause noise, dust, construction waste; and measures have to be taken

to deal with or mitigate pollution.

(iv) The road construction period and dates should be published promptly to inform the residents

living nearby, and let them know the inconvenience in advance.

(iv) As for the temporary land occupation, the affected people hope to sign a temporary land

compensation agreement with the LRB or related departments.

38. Based on the above discussions, the PMO:

(i) has developed temporary land occupation compensation standards according to the

concerns of the affected people. The compensation standard will be disclosed to the affected

people before the construction. The compensation will be paid on time as soon as the affected

people have signed the temporary land occupation agreement with LRB.

(ii) Discussed with Qitai County People's Government about APs most concerned issues, such

as the resettlement work, and discussed with the labor and social security bureau about the

relevant training issues for AHs.

(iii) has communicated and consulted with the project implementation agency according to the

concerns of the affected households. The construction announcement will be posted in the

construction area 1 month before the project starts to state project construction time and remove

construction waste and garbage during construction period and to reduce damage to the

environment. In addition, the construction work should be carried out strictly in accordance with

the requirements during the construction period, to minimize the impact on farmers' agricultural

production.

6.2. Public Participation and Consultation

40. During the implementation of the subproject, the PMO, Women's Federation, and community

committee staffs will establish a cooperation mechanism, through forums among women and other

ways to learn about their demands and hopes at different stages of the subproject. During the whole

progress of the subproject, the subproject implementation agency will invite the Women's Federation

staffs to join in.

41. With the progress of project preparation and implementation, Qitai County PMO, affected village

committee, and communities will conduct further public participation, including the LA compensation

standard, and the scope of training for the APs, disclosing construction issues, soliciting comments

and expectations from the APs during implementation, disclosing the compensation rates and appeal

44. All resettlement costs come from domestic funds. The total cost of this subproject was

CNY2.86 million, as detailed in Table 7-1.

46. Qitai PMO and Water Supply and Drainage Company (implementation agency) are scheduled

to start construction in June 2018 and complete at the end of October 2018, for 4 months. In addition,

the implementation agency plans to give the affected people full amount of compensation in a timely

manner before the project starts in April 2018.

8. Resettlement Implementation 47. Before construction for the project starts, the temporary occupied land area should be

announced, the RIB should be distributed, and public participation in relevant work should be

completed.

8.1. Work before Resettlement Implementation

(1) Verification of the scope of LA

48. The scope of the temporary LA will be defined according to the project preliminary design and

layout. The resettlement work will be assigned to township and village via meetings, and then

informed to the village committee. The Qitai PMO will survey and register land, houses and

attachments, and their ownership within the defined project scope.

(2) Field investigation of the temporary occupation

49. The Qitai PMO will organize relevant staff of Qitai LRB and the village to visit the affected areas,

investigate and register land, houses, attachments, facilities and equipment, etc., judge the nature

and ownership of infrastructure, and keep detailed records.

(3) Negotiation

50. The PMO and LRB need to negotiate with township government and affected people,

respectively on the payment of the compensation.

(4) Contract signing

51. Under the coordination and direction of Qitai PMO, Qitai Housing and Urban-rural Construction

Bureau will enter into land acquisition agreements with Qitai LRB, and pay the contract price.

52. The resettlement implementation schedule of this subproject will be prepared according to the

implementation progress of LA compensation and preparation of resettlement work. The specific

implementation time may be adjusted due to the deviation of the overall progress of the subproject, as

shown in Table 8-1.

9. Monitoring and Evaluation

53. Preparation and submission of monitoring reports will be carried out as per agreed RP

(please refer to Section 10). XUAR PMO will organize the Changji PMO and Qitai PMO to use

government counterpart funds to hire a qualified and experienced resettlement agency as the

Appendix 1: Resettlement Information Booklet (RIB)

(Name of affected person)

In order to relieve traffic congestion, and improve road safety and the county town’s

overall image, Qitai County Government (executing agency) plans to use part of an ADB loan

to implement a municipal infrastructure in Qitai County, which is one of components of the

ADB-financed Xinjiang Changji Integrated Urban-Rural Infrastructure Demonstration Project

The Project will affect your family (entity) to some extent. This booklet is provided to you

so that you understand the basic information of the Project, state policies on land acquisition,

house demolition and resettlement, and possible impacts on you.

I. Content of the Project

In order to meet water supply demand of Qitai county better, Qitai county is ready to use

ADB loan to build a new pipeline network of 71.859 km, transmission pipeline network

construction will cause temporary occupation impact, according to the final design of Qitai

county in December 2017, transmission pipeline network construction will affect three villages

and towns (including Biliuhe town, Jibuku town, GuCheng village) and five villages (including

Dongzigou village, Yongfengqu village, Shangpuzi village, Dabanhe village, Gucheng

village).

II. Impacts of the Project

According to the final design of project, temporary land occupation impact involved in

the subproject mainly caused by transmission pipeline network construction, according to the

final design of Qitai county in December 2017, newly constructed transmission pipeline

network length is 71.859 km, transmission pipeline network construction will affect three

villages and towns (including Biliuhe town, Jibuku town, GuCheng village) and five villages

(including Dongzigou village, Yongfengqu village, Shangpuzi village, Dabanhe village,

Gucheng village), a total of temporary occupation for 1469.32 mu is involved in the project

construction, including temporarily occupied collective cultivated land for 347.59 mu, 53

households with 223 people are affected; temporarily occupied state-owned unused land for

1121.73 mu is involved, without ground attachments and affected people. In addition, no

house demolition impact is involved in the construction of transmission pipeline network.

III. Compensation Standards

3.2 Compensation Standard for Temporary Occupation

Temporary land occupation impact involved in the subproject is mainly caused by

transmission pipeline network construction, transmission pipeline network construction will

affect three villages and towns (including Biliuhe town, Jibuku town, GuCheng village) and

five villages (including Dongzigou village, Yongfengqu village, Shangpuzi village, Dabanhe

village, Gucheng village), project construction will involve 347.59 mu collective cultivated land

occupied for temporarily, including temporary excavation cultivated land for 59.91 mu,

temporary occupation cultivated land for 287.68 mu, 53 households with 223 people are

affected.

For the temporary occupation of cultivated land, according to the “Reply on the Uniform

AAOV Rates for Land Acquisition of XUAR (XG [2010] No.323)” and the Implementation of

Autonomous Public Notice on Unified Annual Output Value Standard (XL&R issued [2011]

No.19, the temporary occupation of cultivated land will be compensated in accordance with

the compensation base of Class 1 cultivated land that is CNY1,500/mu, the compensation

time is calculated by the implementation time; after the implementation the implementing

agency will need to restore the cultivate land; and the PMO and affected people responsible

for exam; in accordance with the benefits of the affected people, the Qitai PMO, Land and

Resource Bureau after consulting with the affected people, finally determined that the

cultivate land occupied temporally will be compensated in CNY1,500/mu, which is divided into

two parts: (1) temporary excavation, one-time compensation of 8 years will be paid by PMO

for temporarily excavation cultivated land, CNY1,500/mu*8 year= CNY12,000/mu; (2)

temporary occupation, one-time compensation of 4 years will be paid by PMO for temporarily

occupation cultivated land, CNY1,500/mu*4 year= CNY6,000/mu.

In the process of pipeline construction, as temporary excavation will damage cultivated

land and considering the vital interests of affected people, Qitai county PMO and Land

Resource Bureau consulted with affected people. After consultation, PMO and affected

people reach consensus, for one-time compensation for affected cultivated land caused by

pipeline excavation, which is used in soil remediation; the temporary occupation cause

smaller losses to soil, one-time compensation of 4 years is used for land restoration.

For the temporary occupation of state-owned unused land and construction land,

confirmed by the Land bureau, there is no need to compensated, it just needs the relevant

documents signed by Land bureau and Housing and Urban-rural construction bureau, and

after the implementation, it needs to be restored.

V. Training for Livelihood

55. To improve living conditions and income levels of affected people, the PMO will also

develop livelihood support plan based on full consultation with the APs and in accordance

with the status of the AHs. This will be carried out from June 2018 to December 2019 which is

also planned for other components of the Qitai subproject.

56. During the whole restoration progress, the PMO will organize affected people for some

technical training, such as economic crop planting. Relevant technical personnel of the

department of agriculture and labor security will be invited to give the affected people some

training on planting and other aspects. The affected households shall have at least two or

more technical training and non-agricultural production technical training. The economic

income and livelihood of affected people can be improved by these measures and improved

skills.

57. To improve living conditions and income levels of affected people as soon as possible,

the PMO will not only compensate them, but will also develop a restoration plan based on full

consultation with the APs and in accordance with the status of the AHs, such as, organize

affected people for some technical training, like economic crop planting. Relevant technical

personnel of the department of agriculture and labor security will be invited to give the

affected people some training on planting. The affected households shall have at least one or

more technical training and non-agricultural production technical training to improve planting

skill and increase income of the affected people.

(1) Training contents: According to the industrial structure and market demand of Qitai

county, vocational skills training is focused on service industry and breeding industry. There

are mainly agricultural technologies, animal husbandry and so on

(2) Forms of training: there are three methods: vocational skills training, single training, and

job training. Vocational skills training shall be trained by the administrative department of

labor security, various education training institutions, industries, and employers, especially on

agricultural technology, business training,w and skills training

VI. Appeal Procedure

If you as an AP have any complains and problems during the LAR implementation,

please follow procedures below and contact relevant persons listed below:

Stage 1: If any AP is dissatisfied with any land acquisition and resettlement of any other

safeguards related problems, he/she may file an oral or written appeal with the community

committee/sub-district office orally or in writing. In case of an oral appeal, the community

committee/sub-district office shall handle such appeal and keep written records. Such appeal

should be solved within 2 weeks.

Stage 2: If the AP is dissatisfied with the disposition of Stage 1, he/she may file an appeal

with Qitai County Land and Resource Bureau or the LA and HD management office

(depending upon the issue) after receiving such disposition, which shall make a disposition

within 2 weeks.

Stage 3: If the AP is still dissatisfied with the disposition of Stage 2, he/she may file an

appeal with Qitai County PMO receiving such disposition, which shall make a disposition

within 2 weeks.

Stage 4: If the AP is still dissatisfied with the disposition of Stage 3, he/she may apply for

administrative reconsideration with Qitai County Government after receiving such disposition

within 3 months.

Alternatively, he/she may file an action in a civil court in accordance with the Civil

Procedure Law of the PRC at any time irrespective of the use and progress of the GRM

process.

At each stage, when the responsible agencies receive the appeal, it will be also copied to

the PMO for discussion, so that the grievance can be redressed at lower levels. All

grievances (and their resolution) at each stage will be recorded and kept. The PMO will report

the grievances and their resolution) to ADB in semiannual monitoring reports.

Alternatively, the aggrieved person(s) may submit a complaint to the ADB’s Project Team

to try to resolve the problem. If good faith efforts are still unsuccessful, they may submit their

complaint to ADB's Accountability Mechanism (2012).1 The first step requires good faith

efforts to resolve the problem with the ADB Project Team. Besides, reporting behaviors which

are against ADB's policies or procedures is also welcomed. Website is: www.adb.org/

APs may file an appeal on any aspect of resettlement, including compensation rates, etc.

The above means of appeal, and the names, locations, persons responsible, and telephone

numbers of the appeal accepting agencies will be communicated to the APs at a meeting,

through an announcement, or the RIB, so that the APs know their right of appeal. Mass media

will be used to strengthen publicity and reportage, and comments and suggestions on

resettlement from all parties concerned will be compiled into messages for disposition by the

resettlement organization at all levels.

All agencies will accept grievances and appeals from the APs for free, and costs so

reasonably incurred will be disbursed from the contingency costs. During the whole

construction period of the Project, these appeal procedures will remain effective to ensure

that the APs can use them to address relevant issues.

1. Forum Minutes

Time: 10 December 2017

Location: Gucheng township government;

Under the coordination of water supply company and village committee staff, affected villagers

(about 32 people) were organized to hold a forum, including 10 women; land occupation in

Gucheng three groups of involved in water supply pipeline network project, including cultivated

land, collective land, collective wasteland and other land types, this forum is to introduce the

ADB project, and understand the opinions and suggestions of affected farmers.

Concerned problem:

1 what affected farmers’ most concerned problem is land compensation standard and the

distribution of compensation fee.

2 Whether land occupied affects the planting of crop, including ploughing vehicles, agricultural

production and other issues.

3 The specific time of construction should be determined as early as possible, so as to not affect

crop planting.

4 Water supply pipeline network construction, drinking water quality is expected to be improved.

The results are as follows:

1 Land compensation standard is formulated in accordance with the relevant national policies and

regulations, it is formulated according to the first-class land compensation standard, the

compensation standard is CNY1,500/mu, of which the compensation of cultivated land excavation

occupation will be paid according to 8 years, temporary excavation will be paid for 4 years, one-time

compensation will be distributed before the construction.

2 The construction width of pipeline is 13.5 m, of which excavation occupation for 1.5 m, land

occupation for 12 m, construction party will consider what farmers concern including ploughing and

watering problems in advance, and formulate a specific construction schemes, in the process of

construction, the interests of farmers will be fully guaranteed to be not damaged.

3 Specific construction time hasn’t been determined at present, preparatory work in prophase need to

be finished, as long as the final verification work of Bureau of Land Management is finished, and we

will sign the compensation agreement with affected farmers, discuss and solve existing problems,

compensation fee will be distributed to farmers after signing the agreement, and the project starts to

construct, and provide convenience for farmers, it is considered that crop should be planted is both

sides firstly or the construction is completed firstly before planting, the specific work arrangement

could be negotiated with affected farmers in more meetings.

Water quality improved will be beneficial for farmers’ physical and mental health, which is a livelihood

project to solve drinking water issues, as long as the construction does not affect the basic interests of

farmers, everyone is very supportive and expectant.

Expectation and suggestions for project:

1 Compensation fee of affected villagers should be available and timely.

2 Provide technical training, such as agriculture technical training.

3 It is expected that road safety signs and corresponding protection measures should be available in

the project construction site.

interests of farmers, everyone is very supportive and expectant.

this forum is to introduce the ADB project, and understand the opinions and suggestions of

affected farmers.

Main problems and contents of discussion:

1 It introduces the contents of ADB loan project, including road construction, transmission

pipeline network project and household waste disposal sub-project, and focuses on the

construction purpose of transmission pipeline network project.

2 Temporary land occupation involved in project construction, to explain related content of

compensation standard and the distribution of compensation fee to 3 affected villagers. The main

contents include that the compensation standard is CNY1,500/mu, which is compensated

according to excavation and occupation, of which the compensation of cultivated land excavation

will be paid according to 8 years, excavation will be paid for 4 years, land occupation

compensation is paid according to the highest land compensation standard.

3 Pre-construction work contents. Temporarily occupational cultivated land area is in

accordance with the surveying and mapping data of Bureau of Land Management, and Bureau

of Land Management will show specific announcement, PMO will post notices according to the

before the construction of the project.

Attitude and suggestion towards project

1 Express support and expectation to the project, and actively participate in the project.

2 The compensation standard is fair and reasonable, and the distribution of compensation is on

time, which will not the livelihood of farmers.

3 Water quality is improved, villagers’ health is also improved, and the quality of life will be

improved accordingly.

Project can provide livelihood rehabilitation measurements, and agricultural planting technology

and other corresponding training.

4. Record for Symposium

Time: December 9, 2017

Location: Meeting room of Jibubu township government

The PMO held a workshop with the responsible person of Jibuku government and the

responsible person of the affected village (14 people), including transmission pipeline project

involved staffs of Jibukutownship Da Banhe No.6 village and No. 1 village committee. The

purpose of this symposium is to introduce the current situation of the affected village while

introducing the ADB project.

1. The workshop introduces the contents of the loan program of the ADB, including the construction of

the road, the water distribution pipe network project and the life waste disposal sub-project, and focuses

on the project construction purpose of the water distribution pipe network.

2. Project construction involves temporary land occupation, explaining the compensation standard and

compensatory contents. The main contents include the compensation of CNY1,500 per mu for

excavation and occupation. According to the standard, the compensation for excavation is CNY1,500/mu

and shall be paid one-time for 8 years, for the land and livelihood recovery. The compensation for the

occupation is CNY1,500/mu and shall be paid for 4 years, for the land and livelihood recovery. The land

occupation compensation is paid according to the maximum compensation standard.

3. The current situation of the affected village. The main crop of the affected villagers is wheat and the

annual per capita disposable income of farmers is about CNY16,000. It is understood that, JI Buku

township scale operation planting area is about 78,000 mu, liberate 400 people, and more than CNY500

is added to the labor force of the secondary and tertiary industries, more than CNY300 were added

through farming and picking. As a result of actively exploring the planting direction, adjusting planting

plans, transforming the industrial structure, and explicitly increasing the way of getting rich, the average

per capita income is added by CNY900.

Suggestion and attitude for the project:

1. Looking forward and in favor of the project, and more villagers will participate actively in the project;

2. The compensation standards are reasonable and timely distributed without affecting the livelihood of

the farmers.

3. The quality of water is improved and the quality of life will be improved accordingly;

4. We hope that the project can provide corresponding training for agricultural planting technology and

increase the income of farmers.

The PMO held a workshop with the responsible person of Bi Liuhe government and the

responsible person of the affected village (18 people). The purpose of this symposium is to

introduce the current situation of the affected village while introducing the ADB project.

Project impact: The water distribution pipe network project only involves the temporary occupation of

land, including cultivated land, collective land and collective wasteland. According to the final DMS and

verification, the transmission pipeline will occupy 1,469.32 mu land, including 176.81 mu excavation land

and 1,292.51 mu occupation land for soil piling, with 53 HHs and 223 people.

Main problems and contents of the discussion: (1) Introduce the project content, explain the relevant

policies and regulations, and the temporary occupation compensation of the affected people. Land

compensation standards are based on the Xinjiang Uygur Autonomous Region about “the approval of

the uniform annual output standard of the Xinjiang Uygur Autonomous Region” (the new letter [2010]

No.323) and “notice on concerning the implementation of the annual standard of annual output of the

Xinjiang Uygur Autonomous Region” (the new homeland issue [2011] No.19). The temporary occupation

of cultivated land will be compensated according to the compensation base of first class cultivated land,

CNY1,500/mu. The compensation time will be divided into two kinds, the excavation will be paid with 8

years, the occupation will be paid with 4 years and the compensation will be paid one-time.

(2) To determine the construction time, speed up the relevant formalities, the design will come out as

soon as possible and inform the affected people in advance, in order not to affect planting. In addition,

the construction will be completed before the peak of the water rush to meet the problem of drinking

water for tens of thousands of people.

(3) In view of the potential impact of project construction, the PMO will make specific construction

announcements, including environment, safety and noise. And make a series of specific mitigation

measures to minimize the impact.

(4) Develop skills training for affected farmers, such as planting, breeding, etc. In addition, the

employment created by the project will be given priority according to the will of the affected people.

(5) The preparation work will be carried out in an orderly manner, including notice posted, hand out RIB

and Public grievance procedure. To meet the basic interests and needs of the affected person.

6. Interview record

The workshop is held by PMO, conference attendance of 25 people, including 7 women. The

workshop is aimed at introducing the content of this ADB project for affected person, explain the

ADB project related policies, listen to the villagers' attitude towards the project, existing

problems, and the needs towards the project and the suggestion.

Project content: The PMO introduce the content of ADB project at the beginning of the meeting. Qitai

county coordination urban and rural infrastructure construction demonstration project is a subproject of

ADB financed Xinjiang Changji State coordination urban and rural infrastructure construction

demonstration project. The main content includes four parts: road engineering, water distribution pipeline

engineering, household garbage treatment engineering and capacity building.

Project impact The current construction sub item is water distribution pipeline engineering. The

construction of transmission pipeline will affect 3 townships (Bi Liuhe township, Ji Buku township and Gu

Chengxiang township), 5 villages (Dong Zigou village, Yong Fengqu village, Shang Baozi village, Da

Banhe village and Gu Cheng village). The construction of the project involve a temporary occupation of

347.59 mu of collective cultivated land, including temporary excavation of 59.91 mu cultivated land and

temporary occupation of 287.68 mu occupation land, affecting 53 households with 223 person. Involving

Bi Liuhe township, Ji Buku township and Gu Chengxiang township cultivated land, collective land and

wasteland.

The villagers also participated in the discussion and published their respective opinions. The main

concerns of and the confusion of the affected person are summarized as follows:

(1) The area of land occupation, the standard of compensation and the payment of the compensation;

(2) Specific beginning time of the construction and the construction period;

(3) Whether the construction will affect the crops during the construction.

In response to the above concerns, the PMO respond positively: (1) The land area occupied by

pipeline construction will be based on the direction of the pipeline; the land area and ground class will be

determined by the second investigation image of Bureau of Land Management. At present, the Bureau of

Land Management is doing the final investigation and verification. Land compensation standards are

based on the Xinjiang Uygur Autonomous Region about “the approval of the uniform annual output

standard of the Xinjiang Uygur Autonomous Region” (the new letter [2010] No.323) and “notice on

concerning the implementation of the annual standard of annual output of the Xinjiang Uygur

(2) The specific beginning time of the construction will be based on the time of preparation. Therefore,

the preparatory work in the early stage requires that the project office and the affected people cooperate

with each other to ensure the basic interests and carry out the work in an orderly manner. The

construction period is expected to be 1 year, and the actual completion will be less than 1 year.

(3) Due to the construction position is in the middle of the farmer's farmland, the farmer can only cultivate

on both sides, and they become worried the impact on agriculture. The PMO will formulate specific and

optimal construction plans, and the specific measures will be further negotiated with the farmers, to

ensure that the normal crop planting is not affected.

Attitudes and expectations on the project:

For the purpose of the project, it is a people-benefit project and we will fully support it;

The compensation should be paid in time and the construction time needs to be determined as soon as

possible;

The construction cannot affect the normal crop planting of the farmers and affect the harvest

It is also highly desirable to provide assistance, including training and temporary jobs, to increase the

income of farmers.

Zhao Duojun, male, 53 years old, live in Gu Cheng township No.3 team. Three family members in total

and both couples work in agriculture, the only son (27 years old) works at power plant after graduated

from junior college. The family has 24 acres of land, mainly planted wheat, the annual agricultural

income is about CNY50,000, the son monthly salary CNY4,000 and the family income around

CNY100,000. The bigger expenditure in the family is agricultural investment, which can cost

CNY17,000 a year, and the daily living expenses of CNY15,600. The other expenses are not large, the

water bill is CNY126/year, and the current water rate is CNY1.8 per square; electric charge

CNY1,300/year; the heating fee is CNY2,200/year, CNY18.8 per square meter; garbage costs

CNY34/year; gas CNY120/year; medical expenses CNY2,000/year.

Q: Have you heard or heard about the about project? Whether to support project construction or

not?

I have learned that government of Qitai county use the ADB loans to finance the construction of urban

and rural infrastructure in Qitai, including road construction and pipeline network construction. The

construction of the project is to promote the economic development of towns and cities in Qitai county

and improve people's living standard. Among them, the transmission pipeline project involves the

temporary occupation of farmland in Gucheng township. We are in favor of the construction of the

project. This is a government project as well as a people-benefit project. We are not only affected but

also beneficiaries. We will actively participate in the project.

Q: How many cultivated area of your family have been occupied? Do you know the standard of

the compensation?

The construction of transmission pipeline will occupy 0.5 mu cultivated land. The compensation standard

had been told in the workshop held by village committee; the land compensation standard is

CNY1,500/mu by means of excavation and occupation. The recovery compensation for excavation has

been paid for 8 years, and the recovery of the occupation has been compensated in accordance with

the highest standard in Qitai county for 4 years. We are all satisfied with this compensation standard. In

general, the harvest of wheat on an acre of land is CNY400–500.The government also takes into

account the interests of our farmers and raise the land compensation standard to CNY1,500 per mu.

The compensation was two to three times higher than our normal income, and the temporary

occupancy didn't cause much damage to us.

Q: What is your biggest concern during the construction of the project?

Land compensation standards are based on government policies and regulations, but I am more

concerned with the payment method and the time of land compensation, the construction time,

construction period and other specific arrangements. The compensation will be paid in a lump sum

before construction, but the construction time is not yet determined. Therefore, I hope the construction

can be started as soon as possible and the compensation can be paid timely to reduce the impact on

our farmers. In the process of construction, the garbage must be clean up in time, so as not to cause

damage and pollution to the environment.

Q: What are your expectations and recommendations for project construction?

I hope the project will carry out construction work properly, avoid construction in the middle of the road

for the reason that the water supply will be cut and the vehicle cannot move in and will effect on farming.

Additional projects should be carried out with some training in planting techniques or temporary positions

to increase the income of affected people.
