The IT Department of Indian Railways has started working on developing this system which will be called “NIVARAN” and will come into operation by 24.06.2016. Under this system, a railway personnel will be able to submit his grievances online and can also track the progress in resolution or disposal of the grievances. The main focus areas of the grievance redressal will be reimbursement of medical claims, pension claim, compassionate appointment and improvement in staff quarters. The move will benefit around 13.26 lakhs serving railway employees and around 13.79 lakhs retired railway personnel that is the system NIVARAN will serve the needs of around total 27 lakhs persons. The Railway Minister has also directed the Railway Administration to create a provision or mechanism in this system for “appeal” against a particular decision of an authority. The Railway Minister has accorded important priority to this new system and has decided to personally review and monitor the functioning of this system. The monitoring and review will also be done at Railway Board Level, at Zonal Level and at Divisional level also. The Railway Minister has always been emphasizing on measures aimed at the welfare of the staff and resolution of their problems. In an innovative measure aimed at staff welfare, Minister of Railways Shri Suresh PrabhakarPrabhu has directed railway administration to develop an online system for the redressal of grievancesof Railway Employees both serving as well as retired. The IT Department of Indian Railways hasstarted working on developing this system which will be called “NIVARAN” and will come intooperation by 24.06.2016. Under this system, a railway personnel will be able to submit his grievancesonline and can also track the progress in resolution or disposal of the grievances. 7th Pay Commission – Centre all set toImplement Recommendations – Centre willissue notification most likely in the third weekof June after Cabinet’s nod to therecommendations of 7th pay Commission.

The Central Government is all set toimplement recommendations of 7th PayCommission. Reportedly, the notification for the‘increment process’ will be issued in the monthof June. Source added, Centre will issuenotification most likely in the third week of Juneafter Cabinet’s nod to the recommendations of7th pay Commission. A Finance Ministry sourcewas quoted by a news website as saying, “But incase it’s not issued in third week of June, it will beissued at the beginning of fourth week of June.Usually it takes around one week to issue anotification, after cabinet nod”.

Ministry is also hopeful that EmpoweredCommittee of Secretaries which is looking afterthe recommendations at the moment, will submitits report by June 15. Most likely, increased payoutwill be handed over to central governmentemployees earliest at the end of June or latest byJuly. However, sources suggest that EmpoweredCommittee of Secretaries which has beenentrusted the responsibility to overviewrecommendations will not make much changeinto it. Earlier, the government conceded thatimplementation of new pay scales proposed bythe 7th pay commission is estimated to put anadditional burden of Rs 1.02 lakh crore which isaround 0.7 per cent of GDP.

Giving details of financial implications of therecommendations, Minister of State for FinanceJayant Sinha informed Parliament that the burdenon pay head would increase by Rs 39,100 croreto about Rs 2.83 lakh crore in the current fiscal.Sinha also said that the announcement ofDearness Allowance has no impact on therecommendations of the 7th Pay Commission.

The Empowered Committee of Secretariesheaded by Cabinet Secretary P K Sinha to processthe recommendations of the 7th Pay Commissionwas set up in January. The recommendations ofthe Pay Commission will have bearing on theremuneration of 47 lakh central governmentemployees and 52 lakh pensioners.

SC to govt : Give plan for welfare of elderly

The Supreme Court on Friday expressedconcern for the over 10 crore senior citizens inthe country ,a majority of whom are deprived oflove, care and respect by their kin in a fast-paced world. The SC asked the Centre for aroadmap to provide them basic facilities likeshelter, food and health care.The concern of abench of Chief Justice T S Thakur and JusticesR Banumathi and U U Lalit was palpable asformer law minister and Congress leaderAshwani Kumar, who personally filed the PIL,narrated the pitiable condition in which the agedfind themselves.

“We are a trillion dollar economy and yetthe central government allocates just Rs 25crore for welfare of the aged. Of this, morethan half does not get spent. Mohini Giri’s reporton welfare of senior citizens was given in 2011.It is yet to be acted upon,” Kumar said. “Atpresent, India has a population of 10.38 croresenior citizens. Their number is going toincrease to 14.3 crore by 2021. It is my personalexperience that their children neglect them themost to the extent that in some cases, theyare dependent on neighbours for food...” headded.

Kumar said there were several welfareschemes for the elderly but successivegovernments’ lack of concern and lethargytowards this section of the population hadrendered these schemes nonoperational anddefunct over the years.

The court asked Kumar whether any fundswere being allocated by big companies underthe corporate social responsibility head. Thepetitioner said not a single penny had comeforth for this purpose.

1. The issue was discussed as Agenda itemNo.4 in the Meeting of JCM Staff Side with youon 10-3- 2016, wherein you had very kindlyagreed to reconsider the matter as indicated inthe following records of the meeting:

Grant of modified parity to all those whoretired prior to 1.1.2006 with reference to theupgraded post : The Staff Side stated that theDepartment of Pension has taken a very narrowview of the matter and the cases are draggedto the courts of law. The very spirit of therecommendation of the 5th CPC to bring aboutat least modified parity if not full parity has notbeen appreciated by the Govt. The issue wasdiscussed at length. The official side pointedout the decisions of the Court in favour of theposition taken by the Government in the caseof K.S. Krishnaswamy in CA No.3174/2006,

which has been upheld by the HonourableGujarat High Court. In reply, the Staff Sidepointed out that the said decisions quoted bythe official side had come about due to thephrase employed while issuing the original orderviz. corresponding replacement scale. Aftersome discussions, the Chairman agreed tolook into the matter afresh and revisit the orderof the Department of Pension in the matter.

3. It may be submitted that, the dates fromwhich the various posts were upgraded ormerged with higher grades, i.e. w.e.f. 1-1- 1996and 1-1- 2006, were quite arbitrary as far asthe reasons for up-gradation were concerned.These cut-off dates could not be used as thereason for depriving the pensioners the benefitof upgrading or merger even at the minimumlevel of the corresponding scales from whichthe Pensioners had retired,as mentioned indetail in our Memorandum dated 24-2- 2016and as held by CAT Chandigarh in theirjudgements in the cases cited below and upheldby the Hon’ble High Court Chandigarh and bythe Hon’ble Supreme Court in SLP (CC) No.22402/2015.

4. a) Hon. Supreme Court of India haddismissed the SLP (CC) No. 22402/2015 ofUnion of India, Ministry of Railways on 05-01-2016 against the common order dated 29-1-2015 of Hon’ble High Court, Chandigarh in CWPNo. 8563 of 2014 (UOI & Ors. VS. Darshan LalBali & Ors.), 2005 of 2014 (UOI Vs Tilak Raj &Ors.) and 25072 of 2014 (Banarsi Das & Anr).

b) In the said Judgment the Courts had directedthe Railways to give the benefit of up- gradationof posts for the Revision of Pension to the Pre-1996 Pensioners and Pre-2006 Pensioners.

c) Ministry of Railway/ Railway Board had sincethen decided to implement the said judgmentof Hon’ble High Court Chandigarh (vide theirorders No. PC-III/2013/CTC- 1/4 dated 1-2-2016) for the applicants only and directed theGeneral Manager Northern Railway to take the

necessary action in this regard immediately andconfirm at the earliest.

c) Confining the said benefit of up-gradationonly to the applicants while denying the sameto the other Pre-2006 Pensioners, isdiscriminatory and against the settled law ofnatural justice as it violates Articles 14 and 39of the Constitution of India.

According to these orders “ Therevised pension of the pre-2006 pensionersshall not be less than 50% of the minimum ofthe pay band + grade pay, corresponding tothe pre-revised pay scale from which pensionerhad retired, as arrived at with reference to thefitment tables annexed to Ministry of Finance,Department of Expenditure OM No. 1/1/2008-IC dated 30th August, 2008, subject to thepension so arrived will be reduced pro-rata,where the pensioner had less than themaximum required service for full pensionas per rule 49 of the CCS(Pension) Rules,1972 as applicable before 1.1.2006 and inno case it will be less than Rs.3500/-p.m”.

(2) Now, GOI, Ministry of P, PG and pension,Dept of P&PW have further issued order undertheir OM No. 38/37/08 P&PW (A) dated 6thApril, 2016, that “The revised consolidatedpension of pre-2006 pensioners shall notbe lower than 50% of the sum of minimumof the pay in the Pay Band and the GradePay (wherever applicable) corresponding

to the pre-revised pay scale as per fitmenttable annexed to Ministry of Finance,Department of Expenditure OM No. 1/1/2008-IC dated 30th August, 2008 without pro-rata reduction of pension even if they hadqualifying service of less than 33 years atthe time of retirement.” Accordingly, Para 5of the OM dated 28.01.2013 would standdeleted. The arrears of revised pension wouldbe payable with effect from 01.01.2006.

(3) In case the consolidated pension calculatedas per Para 4.1 of OM No. 38/37/08-P&PW(A) dated 01-09-2008 is higher than the pensioncalculated in the manner indicated in the OMdated 6th April, 2016, the same (higherconsolidated pension) will continue to be treatedas basic pension.

(4) All other conditions as given in OM No. 38/37/08-P&PW (A) dated 1.9.2008, as amendedfrom time to time shall remain unchanged.

(5) All pension disbursing authorities (PDAs)are therefore, requested to revise the pensionin affected cases in terms of Govt. OM No.38/37/08-P&PW(A), dated 06-04-2016 w.e.f.01.01.2006. Payment made w.e.f. 01.01.2006will be adjusted against the arrears now beingpaid and these cases may be reflected in themonthly account sent to this office as ‘changeitem’.

The Cabinet Committee on Empowermentof Women (2014-15) in their fifth reports(Sixteenth Lok Sabha) have urged the Railwaysto examine the possibility of moving the ladies’coaches in all Passenger and Local trains tothe middle of the train.

2. In View of the recommendation of theCommittee, it has been decided that to theextent feasible in all Passenger and Localtrains, unreserved accommodation for womenpassengers should be earmarked in the middleof the train. There will, however, be no changein case of suburban train.

3. Necessary instructions may be issuedto all concerned. Any remarshalling, ifproposed, should be with the written consentof the concerned CPTMS.

4. Wide publicity may be given through allpossible means to make general public awareof these changes.

Other provisions governing grant of DR inrespect of employed family pensioners and re-employed Central Government Pensioners will beregulated in accordance with the provisionscontained in this Department’s OM No. 45/73/97- P&PW (G) dated 2.7.1999 as amended videthis Department’s OM No. F. No. 38/88/2008-P&PW(G) dated 9th July, 2009. The provisionsrelating to regulation of DR where a pensioner isin receipt of more than one pension will remainunchanged.

6. In the case of retired Judges of the SupremeCourt and High Courts, necessary orders will beissued by the Department of Justice separately.

7. It will be the responsibility of the pensiondisbursing authorities, including the nationalizedbanks, etc. to calculate the quantum of DRpayable in each individual case.

8. 2. To facilitate the PAOs to process thesecases, a tentative list of such pensioners hasbeen provided on CPAO’s website i.e.www.cpao.nic.in in CCA’s login and PAO’slogin. All PAOs may download the same byusing their login provided by CPAO. PAOs maycheck these cases from their records too fortheir coverage under OM No.38/37/08-P&PW(A) dated-6th April,2016 Further, if additionalcases come into notice which are covered bythis 0M, may also be processed by PAOs

3. A Ministry-wise list of total number ofpensioners whose details have been providedin respective CCA’s & PAO’s login is alsoenclosed for Pr. CCAs/CCAs/ CAs/Accountants General and Administrators of UTsto monitor the disposal of revision cases bytheir concerned PAOs. The pending few casespertaining to OM No. 38/37/08-P&PW (A)dated-3oth July, 2015 have been incorporatedin this list as present e-revision utility of NIC-CGA takes in to account the effect of pendingpost-2006 revisions in respective cases, asapplicable.

4. All Pr.CCAs/CCAs/CAs/AccountantsGeneral and Administrators of UTs arerequested to ensure that all pending revisioncases are processed and sent to CPAO latestby 31st May, 2016 positively.

Family Pensioners—regarding.

The undersigned is directed to say that thepension of pensioners/family pensioners whowere drawing pension/family pension as on1.1.2006 under the CCS(EOP) Rules was tobe revised in accordance with Department ofPension & Pensioners’ Welfare OM No.38/37/

2008-P&P&W(A) dated 1.9.2008. Accordingly,instructions were issued vide this DepartmentOM of even number dated 30th September,2010 for extension of benefits of modified parityto past pensioners for revision of disabilitypension/family pension covered underCCS(EOP) Rules.

2. Orders were issued vide this DepartmentsOM No.38/37/2008-P&PW(A) dated 28thJanuary, 2013 for further stepping up of normalpension/family pension to 50%/30% of the sumof minimum pay in the pay band and grade paycorresponding to the pre-revised pay scalesfrom which the pensioner had retired, as arrivedat with reference to the fitment table annexed

to the Ministry of Finance, Department ofExpenditure OM No.1/1/2008-IC dated 30thAugust 2008. It was decided to extend thisbenefit to pre-2006 disability pensioner/familypensioner covered under the Central CivilServices (Extraordinary Pension) Rules vide thisDepartments OM of even number dated20.11.2014.

3. Orders have been issued vide thisDepartments OM No.38/37/2008-P&PVV(A)dated 30.7.2015 to revise the pension/familypension of all pre-2006 pensioners/familypensioners in accordance with thisDepartments OM No.38/37/2008-P&PW(A)dated 28.1.2013 with effect from 1.1.2006instead of 24.09.2012. Accordingly, it has beendecided that the benefit of revision of disabilitypension/extra-ordinary family pension in termsof this Departments OM of even number dated20.11.2014 would also be applicable w.e.f.01.01.2006 instead of 24.09.2012.

4. All other terms and conditions in the O.M.dated 3.2.2000, as amended vide O.M. No.45/3/2008-P&PW (F) dated 18.11. 2008,30.09.2010 and 20.11.2014 shall remainunchanged.

5. This issues with the concurrence of theMinistry of Finance, Department of Expenditure,vide their I.D Note No.1(5)/EV/2012, dated23.02.2016.

6. All Ministries/Departments are requestedto bring the contents of these orders to thenotice of controller of Accounts/Pay andAccounts Officers and Attached andsubordinate Offices under them on a top prioritybasis. All Pension disbursing officers are alsoadvised to prominently display these orders ontheir notice boards for the benefits of disabilitypensioners/Family pensioners.

Sub:- Incorporation of Aadhaar number in

fresh Pension Payment Orders

(PPOs).

Attention is invited to CPAO OM No. CPAO/Tech/Jeevan Pramaan/2015-16/1770 dated07.03.2016 (Annex-I) and D.O. letter dated30.07.2015 from CGA to all Secretaries (CivilMinistries) regarding incorporation of Aadhaarnumber in the fresh PPOs (Annex-II). In thiscontext, it is observed that progress inincorporation of Aadhaar numbers in the freshPPOs has been very low. For the period July,2015 to March, 2016 out of 25608 total freshPPOs received in CPAO, only in 1907 (7.45%)cases Aadhaar number was mentioned.

In view of Aadhaar Cards numbers crossing100 crores marks and implementation ofAadhaar linked Biometric Attendance Systemin most of the central government offices, it isvery unlikely that a retiring government servantwill not have Aadhaar number. Further, DOPTvide its OM No. Z-20025/9/2014-Estt (AL) dated-03.11.2014 (Annex-Ill) had requested allMinistries/Departments to ensure that theService Books of all employees have an entryof Aadhaar number.

In view of above, all Pr. CCAs/CCAs/CAsare once again requested to take up the matterwith JS (Admn) and Heads of Offices ofrespective Ministries/ Departments to arrangefor providing Aadhaar number in all pensionpapers to be submitted to concerned PAOs toenable them to incorporate the same in PPObooklets.

Sub: Passes for widows of RailwayEmployees.

In terms of Board’s letter of even numberdated 24.04.1998 widows of Railway servantswho were in service prior to 12.03.1987 havebeen made eligible to be admitted to the

scheme of widow pass on a one timepayment of Rs.250/- as the notional valueof two sets of PTOs and also subject tofulfillment of the terms and conditionsstipulated in Board’s letter No.E(W) 85PS5-8/2 dated 30.06.1987.It has been laid downin para 5.4.1 of Board’s letter dated30.06.1987 that the first application forpasses (Annexure-B) from the widowsshould be certified by at least 2 servingemployees to confirm, the bonafide of theapplicant and the authentici ty of theparticulars given in the application.

2. NFIR have brought to the notice of theRailway Board about the difficulties likely tothe faced by the wives of pre-1987 retiredRailway servants in the even of their deathin obtaining certificate from two servingemployees as stipulated in Para 5.4.1 ofBoard’s letter dated 30.06.1987 referred toabove.

3. The matter has been considered bythe Board. It is seen from widow Passscheme that at the time of retirement of anemployee, a certificate is given by his officeindicating his entitlement for post-retirementpasses. The certificate is also given to thewidow on death of a serving employee. azerox copy of this certificate is to besubmitted by the widow/retired railwayemployee at the time of applying for passfor the first time. The details furnished bythe widows can very well be verified from thiscertificate. It has, therefore, been decidedby Board that the requirement of certificateby two serving railway employees may bedispensed with and Annexure ‘B’ (format forapplication to be submitted by widow) maybe amended accordingly by deleting thecertificate portion from the application.

Attention is invited to this office OM No.CPAO/Tech/e-PPO/ZOIS-16/440-511 dated03.07.2015 (copy enclosed) on the abovesubject, whereby all the banks were requestedto provide following:-

(i) Server finger print for SFTP

(ii) Username of SFTP

(iii) Password for SFTP

2. Paperless movement of digitally signede-Revision authorities were scheduled to beimplemented w.e.f. 01.02.2016 in all banks videCPAO's OM No. CPAO/Tech/e-PPO/ZOIS-16/1743 dated-28.01.2016 (copy enclosed). Forthis purpose, all CPPCs were supposed toprovide their SFTP accounts to N lC-CPAO toenable it to push the digitally signed e-RevisionAuthorities to their server.

3. While 14 banks have alreadyimplemented these, even after rigorouspersuasion by NIC-CPAO 15 banks are stilllagging behind (list enclosed) in providing theirSFTP accounts. Consequently, the movementof paperless e-Revision authorities could notbe implemented fully in all banks.

4. If remaining banks are facing somedifficulties in providing their SFTP accounts,Sh. Davinder Kumar, Technical Director, NICat his E-mail mm or Mobile No.9354806172may be contacted. The SFTP accounts maybe provided to the MC, CPAO at the earliestand in any case not later than 30.04.2016.

Government of India, Ministry of Defence,Department of Ex-Servicemen Welfare videnotification No. 12(1)/2014/D(Pen/Pol)/Part-IIdated 07.11.2015 issued orders forimplementation of One Rank One Pension(OROP) scheme for Defence pensioners.Detailed implementation orders of OROP with101 tables containing revised pensions ofdifferent ranks and categories have also beenissued by MoD, DESW vide order No. 12(1)/2014/D(Pen/Policy)-Part-II dated 03.02.2016and uploaded on the website of DESW atwww.desw.gov.in. The Pension DisbursingAgencies (PDAs) have been authorized to carryout revision of pension of pre 1.7.2014pensioners drawing pension as on 1.7.2014 interms of MoD order dated 3.2.2016 withapplicable rates of Dearness relief withoutcalling for any applications from the pensionersand without any further authorization from thePension Sanctioning Authorities concerned.

2. All affected Defence Forces pensionersof various categories, Pensioners’ Associationand all concerned authorities are requested totake note of these orders for their informationand further necessary action.

3. In order to take cognizance of anomaliesthat may arise in implementation of OROPorders, its implication on service mattersincluding inter-services issues, Government hasappointed a one-member Judicial committeeheaded by Justice L. Narasimha Reddy, retiredChief Justice of Patna High Court vide MoDnotification No. 12(01)/2014-D (pen/Pol)-Part¬IIdated 14th December, 2015.

The demand raised by AIRF in the PNMForum (item No.29/2011) to allow postretirement retention of Railway accommodationfor a period upto 2 years, to those Railwayemployees who are retired on ground of totalmedical incapacitation and in whose casescompassionate appointment of any of theirfamily members is in process, had been underconsideration of the Railway Board.

2. In this regard, Railway Board, in exerciseof its powers to make reasonable relaxation inpublic interest in all or any of the existingprovisions regarding allotment/retention ofRailway accommodation and charging of renttherefor for a class group of employees, inpartial modification of provisions contained inPara 5 of Board’s letter No.E(G) 2000 QR I -23dated 01.06.2001, have now decided thatRailway employees who are retired on groundsof total medical incapacitation and in whose

cases compassionate appointment of any oftheir family members is in process, may beallowed retention of Railway accommodationfor the maximum period upto 2 years on normalrent from the date of retirement.

Subj: Procedure for grant of permission tothe pensioners for commercialemployment after retirement —revision of Form 1.

As the Railway Administration are aware,in terms of Rule 11 of Railway Services(Pension) Rules, 1993 retired Railway servantsproposing to take up commercial employmentwithin a year of retirement are required to seekpermission from the Government. They arerequired to apply for permission in Form 1 ofRailway Services (Pension) Rules 1993. Form1 prescribed under the said rule has since beenreviewed with a view to simplify the procedure,The revised Form 1 is enclosed.

2.The revised form incorporates theconditions prescribed in clauses (b) to (f) ofsub-Rule 3 of Rule 11. There is now norequirement for obtaining an affidavit asprescribed in the Declaration in the notificationissued vide Board’s letter No.E(G)2007/EM 1-1 dated 19/9/2007.

The undersigned is directed to refer to thisMinistry’s O.M No. S 11011/16/2013-CGHS(P)dated 10th June, 2014 vide which it was decidedto extend the CGHS facilities to the retiredemployees of those autonomous/statutoryorganizations whose serving employees werealready covered under CGHS in Delhi/NCRonly.

2. This Ministry had received a request fromIndian Council for Cultural Relations (ICCR) forthe Arts to extend the CGHS facility to its retiredemployees. The proposal was examined in thisMinistry and it has now been decided to extendthe CGHS facilities to the retired employees ofIndian Council for Cultural Relations (ICCR)subject to the following guidelines:-

a) CGHS facilities shall be extended to theretired employees of Indian Council for CulturalRelations (ICCR) only in Delhi/NCR. They willbe entitled to OPD facilities and medicines fromCGHS dispensaries in Delhi/NCR only on thesame lines as is being done in case of servingemployees of Indian Council for CulturalRelations (ICCR).

b) They may avail treatment from CGHSempanelled hospitals at CGHS approved rates.The medical expenses for [PD/hospitalizationtreatment will be borne by Indian Council forCultural Relations (ICCR) and they will not beeligible for cashless medical facilities.

c) The pensioner’s card will be issued tothose pensioners who have been recommendedby Indian Council for Cultural Relations (ICCR)and on payment of service charges on cost tocost basis in advance on yearly basis at therates determined by Department of Health andFamily Welfare in consultation with O/o theChief Advisor (Cost), Department ofExpenditure, Ministry of Finance.

d) The CGHS membership card will have tobe renewed annually by Indian Council forCultural Relations (ICCR) in advance for bothserving as well as retired employees (wherever

Shri J P Nadda, Union Minister of Healthand Family Welfare launched two majorDigital initiatives to provide easy access tohealth services to the public: GIS-enabledHMIS application and the self-printing of e-CGHS cards, here today. Launching theseinitiatives of the Health Ministry, the Union Ministerstated that the Health Ministry remainscommitted to strengthening public health systemsand providing user-friendly health services in thecountry. He further stated that that this will providea tremendous opportunity to further strengthenand enhance the reach of key interventions.

Terming these as significant and forwardlooking steps contributing to Digital India, Shri JP Nadda said: “The initiative will not only monitorthe performance and quality of the healthservices being provided under the NHM, but willalso provide effective health care to the ruralpopulation throughout the country”. The GIS-enabled HMIS services will providecomprehensive data on a GIS platform on 1.6lakh Government Health facilities spread across

The project has been developed withthe objective of enabling the effective usage ofthe HMIS application, enhancing analyticalcapabilities of States/UTs and providing ageographical display of HMIS data using GIS.The application also has scope of incorporatingmap layers of roads and water bodies which willprovide comprehensive information regardinghealth facilities and disease vulnerable areas ofthe country. At present, the application is availablein login domain of HMIS portal. It is planned toput it in public domain in near future. Moreover,the mapping provides data only on public healthfacilities presently, which shall soon be expandedto cover private facilities also, the Union Ministerinformed. Health Management InformationSystem (HMIS) is a web-based monitoring systemthat has been put in place by Ministry of Health& Family Welfare (MoHFW) to monitor its healthprogrammes and provide key inputs for policyformulation and interventions. It was launchedduring October, 2008 with uploading of districtconsolidated figures. To make HMIS more robustand effective and in order to facilitate local levelmonitoring, “facility based reporting” was initiatedsince April, 2011. At present, 1.94 lakh healthfacilities (across all States/UTs) are uploadingfacility wise data on monthly basis on HMIS webportal. Data are presently being made availableto various stakeholders in the form of standard &customized reports, factsheets, score- cards etc.HMIS data are widely used by the Ministry andStates for policy planning, monitoring andsupervision purpose.

The Union Health Minister, while launchingthe self-printing of the E-CGHS card, stated thatthis will provide ease and access to all thosebeneficiaries such as the pensioners who mayfind it difficult to go to the CGHS centres forrenewal, and in the event of loss/misplacementof the card. As this can be printed from anylocation once the process of application basedon authentic documents has been approved, thisenables easy reprinting by the beneficiary himself/

Pavanasam & OrsVs UOI & Ors). Hon’ble Tribunal has dismissedabove OAs vide orders dated 13.04.2016 ( Copyenclosed) holding as follows:-

“40. Therefore, after taking into considerationthe entire materials placed before us and afterconsidering the facts and circumstances of thecase in detail, we are of the view that theapplicants herein do not have any historicalparity with that of employees of CSSS/RBSS/CAT and as such they are not entitled to ahigher grade pay of Rs. 4800 initially and 5400with gazetted status on completion of four years

in the cadre of Private Secretary Grade II asclaimed by them on the analogy of judgementin S.R. Dheer vs UOI in OA No. 164/2009.Therefore, after detailed consideration, we holdthat the OAs are devoid of merits and aretherfore, liable to be dismissed.

41. Accordingly the OAs are dismissed. Nooreder as to costs.”

record of the deceased employees is notpreserved,it is a proved fact that the deceasrdwas an employee under the Respondents ashis son ws given a compassionate appointment.If service record of the deceased employee isnot available, the service record should bereconstructed in view of RBE No.86 of 2006,dated 18.07.2008 by adopting appropriate waysand means. The only reason for denying familypension to the Applicant is that, the servicerecord is destroyed after 3 years of death of theex-employees and the status of the ex-employee as permenent or not cannot bedecided. Also the entitlement to get pensioncannot be decided.

It is very sad to note that the service record ofthe deceased employee was destroyed withoutfollowing the relevant rules. Hence it was held :

Held : “It is obvious that the Applicant is entitledto get the family pension since her son wasappointed on compassionate ground and hencethis fact is sufficient to hold that the deceasedwas in regular employment of the Respondentat the time of his death”. In the result, this OA ispartly allowed. Respondents are directed toreconstruct the record of the deceased by virtueof provisions of RBE No. 86 of 2008, dated18.07.2008 within a period of three months fromthe date of receipt of this order.

On reconstruction of service record of thedeceased, the Respondents shall fix the familypension of the Applicant by passing appropriateoffice order within a period of two months underintimation to the Applicant. The arrears of familypension is restricted to 3 years only prior to thedate of order fixing the family pension. Interestat the rate of 9% per annum is payable to theApplicant on the arrears to be paid to her fromthe date of grant of family pension till it is paid.

for family pension by her representation, dated19.07.1979 and followed it with reminders. Butit was rejected due to non-availbility of recordsof the deceased by the Respondents. In themeantime, the son of the deceased wasappointed on compassionate ground on12.07.1980. This OA is filed for setting asidethe impugned letter, dated 19.05.2011 rejectingher claim for family pension and grant familypension from 07.01.1978 the date of death ofthe ex-employee and husband of the petitioner,the leave salary,gratuity, etc. and other reliefsas deemed fit.

The Tribunal heard both side and observed thefollowing :

The point that arises for consideration is,wheather the Applicant is eligible for familypension. If so, the recourse to be adopted forfixation of the family penion by the Respondentsin the absence of the non-availability of therelevant service record.The tribunal firstconsidered the limitation in filling this OA. Afterconsiderig the details of the case, it was heldthat “it is settled law that pesion/family pensiongives rise to recurring cause of action, if denied.This being so, although the Applicantapproached the Tribunal for the first time in theprevious OA in which it was directed to approachthe Respondents for relief in the year 2010, thesame was entertained and disposed of as notedabove. For the above reasons, it cannot be saidthat the present OA is barred by limitation”.

The son of the ex-employee was appointedon compassionate ground on temporary basiswhich is a proof, the deceased was serving withRespondents. There are clear instructions fromRailway Board for preserving the records. It is tobe destroyed preserving it for few years.Appendix IX under Para.121 captioned as “Periodfor which records in accounts offices are topreserved is to be followed”. Though the service

Delay Should not be taken in grant offamily pension as it is a social obligationon the part of the employer. If the recordsof the deceased employee is not availableor destroyed due to the long passage oftime, the records should be reconstructedfor payment of family pension.In this case,the request for family pension arose from1985 and as the Applicant approached theTribunal after a very long time, she is notentitled to claim the interest on the arrearsof family pension and other retiral benefits

Facts : The Applicant herein is the widow ofone Shri Bhura Patil Late Bhura worked as yardKhalasi in Nagpur Division of Central Railwayand died on 19.8.1985. The Applicant tried herlevel best to get her family pension and alsothe retiral benefits of her late husband. Shefiled earlier O.A.No.2089 of 2011 for the benefitswhich was disposed of directing theRespondent as per law. That representationwas disposed of on the ground of non-availability of records due to the passage oflong time after the death of her husband.Challenging the reply, this OA is filed on variousgrounds praying for setting aside the reply,dated 27-08-2012 whereby her claim wasrejected and payment of relief as noted above.The Tribunal after hearing both sides andchecking the records passed a reasoned order.Held: The only point involved is in regard tothe status/dependency of the Applicant to claimthe family pension and the aspect of the non-availability of service register and other relevantrecords. The cryptic reply does not state anyreasons to come to the conclusion that theApplicant failed to prove her dependency andeligiblity. That impugned letter, dated 27-08-2012 is reproduced in the judgment. The recordshows production of seven documents by theApplicant to sustain her case. The copy of the

provident fund slip of the deceased shows thatthe case of the Applicant as a nominee of thedeceased is proved. In spite of it, theRespondents denied her claim only on theground of non-availability of service record ofthe deceased, the husband of the Applicantwithout any serious consideration of thedocuments produced.

Even though the marriage certificate of theApplicant is not produced, the Tribunal held thatApplicant is the legally wedded wife of thedeceased employee. Even though, sherepresented for her claim belatedly byrepresentation, dated 02.02.2011, it cannot bedismissed as the settled position is that, claimfor pension gives rise to continued/recurringcasuse of action.

Even though,belated submission ofApplication beyond one year cannot beaccepted under Section 21 of the AT Act, thefamily pension being a recurring one everymonth, hence, cannot be rejected on accountof delay. Further, in the previous OA, theRespondents did not raise such a contentionand hence that contention cannot be allowedin the present OA submitted due to the rejectionof her earlier OA by the Respondents. Further,the ground of rejection of her request by theRespondents for not proving her as thedependent wife of the deceased cannot beraised. The Respondents cannot submit thatthe records of her deceased husband is notavailable as it is their obligation to fix familypension even if the record is not readily availbaleby preparing fresh records by speaking to thepeople concerned in the department.TheApplicant place reliance on the RBE No. 86 of2008, dated 18.07.2008. To state so, that RBEletter is captioned as “Avoidance of delay infinalization of terminal benefits-loss of serviceBook”. That RBE letter is reproduced in thejudgment for clarity.

The sevice records of the deceasedemployee should be reconstructed fixing theconcerned official for not maintaining/losing thatrecord. Instructions to preserve valid and

Resondents are directed toreconstruct the service record of the deceasedemployee within a period of four months fromtha date of receipt of this order in view of RBENo. 86 of 2008, dated 18.07.2008. Onreconstruction of record, the Respondents aredirected to issue necessary office order re-fixingof the family pension in favour of the Applicantwith effect from 19.08.1985 and all retiralbenefits and family pension should be paidwithin a preiod of four weeks. However, thearrears of family pension is restricted to a periodof three years only prior to issuance of the saidorder.

Since the Applicant failed to approach theRespondents in time after the death of herhusband, She is not entitled to claim intereston the arrears of family pension and retiralbenefits.

(a) & (b): As per the Audited ConsolidatedAnnual Accounts of Employees’ Provident FundOrganization (EPFO) for the year 2014-15, theclosing balance of Funds managed by EPFOis Rs. 6,34,174.33 crore.

Regarding EPFO being the eleventh largestpension fund in the world, no such informationis available with EPFO.

(c): No, Madam. The fresh accruals in 2015-16 in the three Schemes framed under theEmployees’ Provident Funds & MiscellaneousProvisions (EPF & MP) Act, 1952 as per therevised estimates is Rs. 1,01,538.54 crore.

(d) & (e): The revised estimates for the year2015-16 are projected to be 13.81 per centhigher than the Budget estimates. The detailsof revised estimates of the three Schemes areas under:

(i) Employees’ Provident Funds (EPF) Scheme,1952 :- Rs. 71,398.25 crore

(ii) Employees’ Pension Scheme (EPS), 1995:-Rs. 29,000.00 crore

(iii) Employees’ Deposit-Linked Insurance(EDLI) Scheme, 1976:- Rs 1,140.29 crore.

DELHI : income Tax Retired PersonsWelfare Assn. —  In its quarterly bulletin ’Sunrise’ for quarter ending March,2016,ITRPWA has expressed its disappointmenton general budget for 2016-17 presentedby Finance Minister Arun Jaitley in LokSabha on 29-02-2016 and subsequentslashing of interest on small savinginstruments especially PPF and Sr Citizenscheme 2004 reflecting a very callousattitude exhibited towards senior/supersenior citizens who constitute a significantsegment of society in India. IRTPWA hadarranged a picnic  on 16-03-2016 at LodhiGardens, New Delhi which had a goodresponse  and resulted in free and frankinteraction not only amongst members butmembers and their families with theManaging Committee. Shanghai residents who fail to visit their elderlyparents regularly may have their names added toa creadit blacklist that could make it difficult forthem to apply for jobs and loans, and even impacttheir eligibility for welfare. The move is the latestthe city has made to encourage people tofrequently visit elderly parents and ensure theyare cared for, both physically and mentally. Parentswho think their childern aren’t showing sufficentfilial piety - a major aspect of Confucian tradition-can take them to court. Punishments include ablack mark on their credit record, making it moredifficult to open a bank account, or even registerfor a library card, law office deputy director LuoPeixin says. Official statistics show that 30% ofShanghai’s population is over the age of 60, twicethe national average. Today’s elderly have fewerrelatives to look after them than the previousgenerations, and the goverment wants to ensuretheir kids are good to them.
