By JOHN JAMES KIRKWOODSpecial To The Penny Press

“I can handle things! I’m smart! Not like everybody says... like dumb... I’m smart and I want respect!” – Fredo Corleone, The Godfather, Part II

THE “FREDO” WINGChris Christie, S.E. Cupp, Joe

Scarborough, Karl Rove and Jeb Bush: hardly an exhaustive list of the “Fredo” wing of the Republican Party but definitely the ones who have made the dean’s list lately. While modern Democrats channel Alinsky’s Lucifer; the GOP seems content emulating the hapless

Corleone throwaway. And while dumb is not evil, to those inclined to care, it is certainly infuriating. “Stuck on stupid” never does trump the malevolently ambitious.

I’m not saying we need to overcome evil with greater evil; just that the next time we throw down against Nosferatu; the silver-tipped crucifix would be preferable to the usual “deer in the headlights” swoon. We need more Van Helsing, less Van Gogh!

Tracking more idiot than savant, the republican“intelligentsia” tell us to turn a deaf ear to the tea-party and cross-dress like the democrats. These are the same genius’ who told us, “the era of Reagan is over” right before their candidate, John McCain got his sass handed to him. The problem with Rove and Cupp et al is that they don’t know what time it is. While Rove is strategizing the next checkers match, the “prince

of the power of unfair” is planning a round of roulette and handing us a semi-automatic pistol. This isn’t a game - it’s a war, and it’s being fought on Central time.

THE CHICAGO WAY“You wanna know how to get

Capone? They pull a knife, you pull a gun. He sends one of yours to the hospital; you send one of his to the morgue. That’s the Chicago way! And that’s how you get Capone. Now do you want to do that? Are you ready to do that?” – Jim Malone, The Untouchables

That’s the advice that Rove, Bush and Cupp should be offering, yet the Hardy Boys and Nancy Drew advise capitulation, retreat and surrender. Note to self: adopting the policies of the left will never defeat the left. If you want to know what’s happening nationally and how to combat it, then you must know about the Chicago way.

Barack Obama was spawned by the Chicago machine and he’s taken his show on the road. It is corruption, extortion and pay-to-play; destroy anyone who won’t take the bribe or get out of the way. Jarrett, Axelrod the President’s favorite domestic terrorist and ghost writer, William Ayers –all of them Chicago thugs trained in the Alinsky tactics of insurgency.

The cold, hard truth is that Illinois was better off when it was run by the mob. You see the mob was efficient and they weren’t communists. Capone and the boys didn’t have a problem with you making a profit; they encouraged it. All they wanted was a taste at the end of the month. And they were a lot more reasonable than what we have now. They weren’t forcing churches to marry Cain and Abel either. As long as they got their “share,” they left you alone to

pursue the American dream. It was functional the way the feudal system was functional and even the feudal system is to be desired over the current totalitarian regime. A serf only paid 10% to his feudal lord and in return received protection. Even the lords and barons didn’t have the crust to take more than that which God asks.

But the mob made a tragic mistake – they cut corners when it came to integrity. They thought that instead of merely having judges and politicians on the payroll, they’d bankroll their own kids’ law careers and finance their campaigns, saving them money while expanding their influence. Who knows, maybe they’d even get a Governorship one day. Five Governors behind bars later and with Illinois registering more judges and politicians under indictment than the rest of the country combined, we see the law of unintended consequences in its full gory. The Titans defeated by the Olympians with Illinois as collateral damage.

THE MACCABEES At the Republican Convention and even during Senator Paul’s recent,

epic filibuster, I kept hearing even from good men that this isn’t a struggle between republican and democrat, liberal and conservative; that this is between the president and the Constitution. What a bunch of Bovine Scatology. How many conservatives spoke on behalf of the president and Eric Holder during the filibuster? How many republicans? How many liberals condemned this strident move toward tyranny after years of whining about Bush and wiretaps and waterboarding and torture? And only one democrat spoke against this? One! Their absence even prompted leftist actor John Cusack to twitter aloud, “for god’s sake, where are democrats?”

I’m sorry, but we didn’t get anywhere in the last two elections by avoiding the truth: the modern Democrat Party is an enemy within. It is pure, unadulterated evil and it has even grown bored of trying to hide it. The longer that republicans insist on bringing a soup spoon to a gunfight; the quicker the Constitution will be shredded and our remaining freedoms, droned!

The way out of this is the way of Rand Paul. He understands that the

democrats are not the opposition party but an insurgency. He’s been the most consistent rebel leader, taking on Hillary Clinton to the gasps of a Senate audience and this past Wednesday capturing the imagination of a hungry electorate when he and Senator Ted Cruz shamed their colleagues into the chamber for a filibuster reminiscent of Mr. Smith Goes to Washington. While the old “Republican Guard” wants to dust off détente as the party strategy toward the democrats, Paul is emulating the Reagan Doctrine from the Soviet era – “It’s simple, we win and they lose.” You need a hammer to beat the hammer and sickle and Rand won’t bow to Antiochus.

In the meantime, someone is going to have to take Fredo aside and tell him, “Fredo, you’re my older brother, and I love you. But don’t ever take sides with anyone against the Family again. Ever!” It’s the tea-party that has actually won an election recently and they didn’t do it by following the wisdom of beltway blowhards.

I HAVE A DREAMI have to say the thought of Rand Paul securing the 2016 republican

nomination and then inviting the team together for a pep talk has crossed my mind. He’s in a tuxedo, he walks around a table full of the usual suspects – Rove, Cupp, Scarborough … “A man stands alone at the plate. This is the time for what? For individual achievement. There he stands alone. But in the field, what? Part of a team.” He passes behind Rove and Cupp, “Teamwork... Looks, throws, catches, hustles. Part of one big team. Bats himself the live-long day, Babe Ruth, Ty Cobb, and so on. If his team don’t field... what is he? You follow me? No one.” Rand continues, passing behind Jeb Bush, “Sunny day, the stands are full of fans. What does he have to say? I’m goin’ out there for myself. But... I get nowhere unless the team wins. ” … the republican nominee comes to a full stop behind Chris Christie, when Ted Cruz hands him a bat … “Team” … John Kirkwood is a gun-toting, cigar-smoking, incandescent light bulb-using, 3.2 gallon flushing, fur-wearing, Chinese (MSG) eating, bow-hunting, SUV driving, unhyphenated American man who loves his wife, isn’t ashamed of his country and does not apologize for his Christianity.

I Hope They Have The Courage To Stay The Course

So Dwight Jones is out as Clark County School District superintendent, the news breaking this week that he is resigning effective March 22 so that he can care for his ailing mother in Dallas.

I’ve already been asked more times than I can count for my reaction to the news, with most questions focusing on 1) Jones’ performance in his two years on the job, and 2) what his departure will mean for education in Clark

County.It’s difficult to assess where

Jones’ performance would rate on the traditional A through F scale. Given the brevity of his tenure, he probably warrants an “Incomplete.”

But I think that to the extent he leaves a legacy, it is this: He came to the job with great intentions, accomplished some modestly positive things, but in the end proved incapable of fully overcoming the structural impediments to meaningful change.

At his best, he was a superintendent who was not afraid to take on the powerful teacher union, who took some positive steps toward greater school and teacher accountability and who made school district practices a bit more transparent; at his worst, one

who allowed himself to become part of the chorus clamoring for higher taxes as a means of improving student achievement.

But even with that blemish on his record, it can be said that Jones, much like Gov. Brian Sandoval and state Superintendent of Public Instruction James Guthrie, recognized that spending more money on a structurally flawed system is not the path to improvement. Deep, systemic reforms are in order, and Jones deserves credit for at least nudging the district in that direction. The problem is that monoliths are hard to move.

Which brings us to the future. The monolith must be moved, for the sake of Clark County’s children. Whoever replaces Jones should

embrace the reforms of the past two years, and then build upon them. Most important, though, is this: Whether at the state or local level, education policy in Nevada must be guided by an understanding that the way to truly improve student achievement is to empower parents with more control over how and where their children are educated.

It’s far too rare that someone like Dwight Jones, willing to speak hard truths and shake things up, is even given a chance to run a school district. So credit the school-board trustees for making the bold choice to bring him in to begin with. Now let’s hope they’ll have the courage to stay the course. "It is with regret that I write to inform you that I have requested that President Obama withdraw my nomination to this position at this time," Cadish said in a letter sent to Nevada's senators and made public. While she shouldn’t have been confirmed, she saved us a lot of time and grief.

Never be cold again

As Al Borland on Home Improvement I was the man with all theanswers. However, as Richard Karn I still look for money sav-ing and efficient heating in my home. I have an EdenPURE® In-frared Portable Heater in my California home and like millionsof others found it to be a super-safe, reliable source of porta-ble heat all year long.

We live in an area which is known for very cold winters. Our facility isnearly 7000 square feet in area. When we began to utilize the first unit wewere amazed to see how even the heat was for the entire living room area.We ordered a second and a third unit which now warms the entire home.Much to our surprise we are saving over $250 a month and had the lowestexpense for heating we have ever experienced here. I would heartily rec-ommend your products to anybody who is interested in really nice, even

heat in their home and also interested in saving on their utility expenses. Dennis Crystal, Troy, MT (Retired Airline Pilot)

Enclosed you will find printouts of our electric bill and gas/heat-ing/cooking bills for 2007 - 2008. Our gas company, AmeriGas,stated that more money was saved than would show up becauseof the cost going up. We would turn the gas on early in the morn-ing and turn it down to 60 degrees; We would use the EdenPURE®

heaters from then on and they provided such warmth and cozyheat. Many of our friends have informed me recently that they are

going to purchase these heaters for their homes this winter. Gloria D. Smith, Boydton, VA (Retired Elementary Principal)

I rarely end up agreeing with the Obama Administration on much of anything, but we seem to have some common ground on the issue of copyright law as it affects the nation’s telecommunications policy.

Now I know that sounds eye-glazingly long and ominous.

So, let’s put it a different way.

Do you know what those morons in Congress have brought about?

Imagine that you bought an iPhone 4 from Verizon, paid them well over $100 a month for the two year contract and the contract has expired. Let’s say you’ve paid $1,500 or so.

Sprint offers you a better deal. But the phone is “locked” on Verizon. So you buy an inexpensive piece of software on eBay which will unlock the phone.

Because of an obscure law passed by the same clowns who can’t cut the budget (or, in the case of the Senate, even pass a budget) and an even more obscure decision made by the Librarian of Congress you could be fined $50,000 and go to prison for five years.

That’s right. Eric Holder—despite his boss’ agreement with me that this is nonsense—can come thundering after you and your unlocked iPhone on behalf of a cellular carrier and put you in Gitmo. (OK, probably not gitmo, but you never know.)

Now it might be one thing if you stole the phone.

But this is a phone which you not only paid for but honored the contract on with your original carrier.

What the hell kind of public policy is that?

I’ll tell you what it is. It is the same kind of public policy which was written by a consortium of Apple, Nokia, AT&T and Verizon. And handed to Congressional staffers by K-Street lobbyists. And inserted in a bill without ever having been read by an elected official. Just like Obamacare.

If you ever wanted to know about the corrosive effects of allowing the foxes to guard the henhouse, this is it. Business executives lobbying for laws to enrich them and screw everyone else.

I hasten to add that I am not picking on just these companies. It is the nature of most competitive businesses that if they can use a law to enrich their own positions, they will. That’s why the government should just keep its nose out of business and avoid doing anything which has the effect of picking winners and losers.

While the public spirited Warren Buffet will suggest that it is improper for him to pay a lower tax rate than his secretary, he will also have one of his companies fight a tax increase until there’s

blood all over the floor.

Steve Wynn will excoriate the President on job creation and overregulation while he uses the Clark County District Attorney’s office to collect gambling debts at his casinos in the criminal courts.

The law—and its use—creates hypocrites of us all.

But those businesses which stand to benefit from these ridicules laws are both willing to take the chance of being called a hypocrite and the results of a little negative publicity if they are held up to public ridicule. It’s kind of like being tossed out of a ballgame for calling the umpire an obscene name. It’s considered a cost of doing business.

The obvious answer here is to have a truly free market. Copyrights are for original works of intellectual property and patents are for genuine innovations. They were originally designed to provide incentives to be creative and innovate—not to allow companies to dictate the terms of commerce.

When I buy a phone with your software inside, I buy the right to use it as I see fit.

You shouldn’t have the right to dictate to me how or where I use it, any more than Ford Motor Company has the right to tell me I can’t speed in the F-150 they sold me.

But merely selling a phone and service isn’t enough for some executives at some companies. They have to somehow rig the system to give themselves a commercial advantage. And that would be ok if we had a choice in the matter. But instead of using their own technology, they choose to try and use the government to accomplish their goals.

And that’s wrong.

Let me be clear.

If you can accomplish what you want to in the free market, I’m all for it.

If Steve Wynn can sue someone in civil court to collect his markers, more power to him.

But just as I don’t think the threat of debtor’s prison should be allowed to be used to collect gambling markers in Las Vegas, I also don’t think a misguided copyright law should be allowed to be used to stop you from taking your paid for iPhone from AT&T to T-Mobile.

Strangely, the Obama Administration appears to agree with me.

2008? That’s Ancient History, Right?Memories are short, and 2008 is ancient history. Consumers can’t

suppress their urge to consume. Lenders can’t suppress their urge to lend. We’ve learned nothing from the last boom-bust. We are repeating it, piling error upon error.

“People will spend more of their equity,” Chris Christopher, an economist at IHS Global Insight in Lexington, Mass., tells Bloomberg. “It won’t be as much as they spent when prices were gaining at a rapid pace in 2005 and 2006, but it should have a positive impact on consumer spending.”

As you may have detected in Mr. Christopher’s statement, bankers (speaking of short memories) are back in the business of making home equity lines of credit — HELOCs — and consumers are ready to ramp up the good life again.

Bloomberg reports:“After six years of declines, lending for so-called HELOCs will

rise 30%, to $79.6 billion, in 2012, the highest level since the start of the financial crisis in 2008, according to the economics research unit of Moody’s Corp. Originations next year will jump another 31%, to $104 billion, it projected.”

This borrowing will spur consumer spending, which, according to Bloomberg, is the largest party of the economy. The Mortgage Bankers Association’s crystal ball predicts home prices will gain 8% this year, and, in turn, Bloomberg reports, “The amount of equity homeowners had in the second quarter rose by $406 billion, to $7.3 trillion, the highest level since 2007.”

Of course, this increase in home prices is a temporary mirage, as empty homes and those occupied by strategic squatters are held off the market by legal kinks in the foreclosure hose. ZeroHedge estimates that an additional 2.5 million homes should be for sale. For now, millions are living in homes mortgage-free “just to perpetuate the illusion that ‘housing has rebounded,’” writes ZeroHedge.

The problem with this consumer debt is that while analysts cheer on the consumer purchases, the debt is what market analyst Robert Prechter calls unproductive. Three years ago, Prechter pointed out in his Elliott Wave Theorist newsletter that banks had been lending to consumers at the expense of businesses.

The nominal numbers are striking. At year-end 1999, according to FDIC figures, commercial and industrial (C&I) loans stood at $971 billion. On June 30 of this year, C&I loan totals stood at $1.4 trillion, an increase of only 44% over more than a dozen years. Again, these numbers are not adjusted for inflation.

Meanwhile, loans secured by real estate totaled $4 trillion on June 30, 2012, a 167% increase from $1.5 trillion on Dec. 31, 1999.

Only business loans are self-liquidating. Healthy businesses generate cash flow that can pay off debt, while consumer loans “have no basis for repayment except the borrower’s prospects for employment and, ultimately, collateral sales,” Prechter wrote.

Lines of credit to businesses are provided with the understanding that

the business borrowers will “revolve the debt,” borrow to pay vendors and employees and then pay down the debt as their customers pay them for product. Thus, the debt is directly tied to the business firm’s production. The funds tend to be borrowed only for short periods of time. Credit, in this case, aids a business in potentially earning entrepreneurial profits, which build capital, which ultimately fuels economic expansion.

Conversely, consumer debts are not self-liquidating, but instead stay on the banks’ books for long periods of time, with payments being made only to service the interest and pay down very small portions of the loan principal balance.

Economists think HELOC loans will spur consumer spending and, in turn, GDP. After all, household purchases account for 70% of GDP, according to Bloomberg. However, phony GDP numbers are not a good gauge of the economy’s health. Besides, burying yourself in debt and consumer toys is not the way to individual prosperity.

Austrian economist Hans Sennholz has made a sharp distinction between “productive” and “unproductive” debt:

“A debt incurred for productive purposes, e.g., a commercial or industrial investment designed to earn future incomes, may cover its interest costs and even yield entrepreneurial profits.

“In contrast, new debt in the form of a second mortgage on a home may finance the purchase of a vacation home, new furniture or another automobile, or even a luxury cruise around the world. The debtor may call it ‘productive,’ but it surely does not create capital, i.e., build shops or factories or manufacture tools and dies that enhance the productivity of human labor.”

Capital and wealth are created by saving, not by borrowing and spending.

At the same time, banks are still licking their wounds from the real estate crash. It’s hard to fathom that they would be piling into HELOCs again when they are not ever done writing down these type of loans made in ’06 and ’07. ZeroHedge points out:

“What is shocking is that this is all happening just as the last batch of HELOCs has hit record default rates, and have yet to be cleared off the banks’ nonperforming books. But who cares: Uncle Ben will fix it all.

“That this will all end in another epic housing and credit bubble collapse is by now perfectly clear to everyone. And yet nobody is doing anything to stop it. Surely, once the system collapses for good next time, as at this point the central banks too are all in on rekindling the bubble and there will be nobody left holding the bag, ‘nobody will have been able to foresee any of this happening.’ But for now, the music plays, and one must dance.”

The housing market has not fully corrected, and now banks are looking to kick-start their loan books by lending on collateral that will again plunge in value when the foreclosure tsunami gets under way.

But while bankers must dance and their memories are short, one thing they always remember is that Washington is their friend and its checkbook is big. For HELOC customers, on the other hand, there will be no bailout, just more debt and despair. DOUG FRENCH

Weather Satellites: A Critical Piece of Our Nation’s Infrastructure

Severe winter weather has been sweeping the country. New England was recently buried under one of the worst blizzards in recorded history. Crippling snow storms just shut down large portions of the Midwest.

Fortunately, officials and businesses in those regions knew the storms were coming and were able to prepare. States of Emergency were declared. Flights were rerouted or cancelled. Response teams were organized.

Such pre-storm precautions limit economic damage and save lives — vital outcomes that wouldn’t be possible without the cutting-edge satellites orbiting Earth that allow meteorologists to accurately forecast where and when storms will hit.

And yet, we may be without the crucial weather data this technology provides in just a few years. Our leaders must get the next series of weather satellites into space — and soon. If they don’t, our ability to forecast and prepare for potentially catastrophic storms will diminish, thereby risking critical infrastructure and human lives.

Meteorologists can predict complicated and massive weather patterns with such precision thanks to an advanced system of weather satellites.

Polar-orbiting satellites cover the entire planet twice daily, gathering enormous amounts of moisture, temperature, and image data to track the weather as it takes shape.

Beginning with the launch of Suomi National Polar-orbiting Partnership (S-NPP) satellite in 2011, our nation significantly upgraded its weather monitoring capabilities. The Joint Polar Satellite System (JPSS) program, currently in development, continues the advancements proven on S-NPP.

But due to recent budget constraints, there’s the dangerous potential for a multi-year gap in coverage between S-NPP and its successor - JPSS-1, or in the case of a launch failure, its backup JPSS-2.

We must develop JPSS-2 now. Any break in information would impair the quality and precision of our weather data, with catastrophic consequences.

And not only for severe storm forecasting. Polar-orbiting satellites provide drought forecasts valued at $8 billion a year to the farming, transportation, tourism, and energy sectors. Just by forecasting volcanic ash, they save the airline industry some $200 million annually.

But to truly see the power of these satellites, consider the major U.S. weather event of last year — Superstorm Sandy.

In October, the storm hit the East Coast with a wall of water and winds of up to 90 miles per hour. Sandy claimed 125 American lives and resulted in over $100 billion in damages.

Polar-orbiting satellites provided 84 percent of the data in the National Weather Service computer forecast models that tracked Sandy. Almost a week before Sandy made landfall, forecasters accurately predicted when it would hit and how strong it would be.

That forecast gave public officials, businesses, and ordinary citizens substantial time to prepare. New Jersey declared a state of emergency. Millions of families boarded their windows, stocked up on basic supplies, and evacuated to safer areas.

Without polar-orbiting satellite data, Sandy forecasts would have been off — way off. Europeans recently re-ran their Sandy forecast model without the data collected by polar-orbiting satellites. The resulting prediction of the storm’s pathway was hundreds of miles off — and didn’t show it hitting land at all.

Without the information furnished by polar-orbiting satellites, the next Sandy could catch us off guard — and further devastate both people and property.

To maximize weather security, a robust satellite program is critical. Federal officials must adequately fund JPSS-1, expedite the development of its backup and ensure timely introduction into service. Commentary: Albert ThomasParabolics Always End In Disaster

As my long-time readers know I have told investors to get out of the market in 2000 and 2008 as I saw signs of collapse.

The indicators this time are different, but investors are about to lose their money again. Only this time there will not be a rally back.

No, I don’t see the exact top. What I see is the momentum run we are in now is drawing in more and more fools. Don’t expect any help from your broker to protect you on this next downfall. He has been taught to buy and does not know when to exit. I dare you to ask him if he has an exit strategy. Make him put it in writing on company letterhead. He won’t.

Do you remember when gold originally shot up to $800 and then for years slowly agonizingly worked its way down to $250? Look at a chart of that last 800 year. It was almost straight up.

My guess, and I always say I’m guessing, is the Dow Jones and Standard & Poor 500 are going to take off in that same type of run. It always sucks in the late-comers. Only the smartest investors with trailing stop loss orders will survive.

On the recent run of gold to over 1900 I was running a $100 trailing stop on most of my positions. I still have 2 small positions and am waiting for the next run up that I seriously doubt will make a new high.

As the DOW makes new highs each week brokers and financial touts

will be having financial orgasms. It will be fun while it lasts.History has shown that bull and bear markets run in 16 to 18

year cycles. It is my contention the bear actually started in 2000 and knowledgeable investors target 2016 to 2018 as the next potential bottom. Those who use demographics target 2023. I don’t pretend to know until it gets there.

When the exit sign lights up as the market turns over I will see it and buy what is called bear ETFs and mutual funds. These will make money as the stock markets around the world slowly crumble. Ask your broker about them. If he pooh-poohs them you better find a new broker. Most of these equities pay very little, if any, commission. Hmm!

China is about to experience a housing price implosion that will make the one we had look like a pimple on a bull. Their fools are still rushing in.

One of the reasons parabolic run-ups are so dangerous is everyone is wildly bullish. If an investor expresses caution or negative sentiment he is shouted down. Mob psychology has taken over.

Don’t wait. Now is the time to plan an exit strategy. AL THOMASAl’s new book, “If It Doesn’t Go Up, Don’t Buy It!”, 3rd edition, Chapter Two shows in detail a method that made 400% during the 2000-2010 period with only 7 trades, no losses and paid no commission. Read the first chapter at mutualfundmagic.com and discover why he’s the man that Wall Street does not want you to know.

Killing the Obamacare Zombie: Hope Lives!

“But Republican governors are folding like cheap lawn chairs,” you say. “And political eunuchs in the GOP establishment are bowing to Obama like he bows to foreign dictators. Any hope of repeal is long dead, and besides, Chief Justice John Roberts put the final nail in the judicial coffin last summer, didn’t he? Any chance of killing the Obamacare zombie is gone, right?”

Wrong. Not surprisingly, the mainstream media paid it little attention, but

back in November the U.S. Supreme Court shocked many in the legal community by granting Liberty Counsel’s motion for a rehearing on its multi-pronged challenge to Obamacare. The high court ordered the 4th U.S. Circuit Court of Appeals to rehear arguments. This is extremely rare and means, almost certainly, that Chief Justice Roberts will get another bite at the rotten apple – this time, with a whole new quiver of legal arrows.

Following the Supreme Court’s directive, Liberty Counsel recently filed its brief in the case of Liberty University v. Geithner. The Christian civil rights firm represents Liberty University and two private individuals in this case. While there are other legal challenges to the employer contraceptive/abortifacient mandate, Liberty Counsel’s is the most comprehensive case pending in the country.

The lawsuit challenges 1) the employer mandate for all employers; 2) the abortion mandate for religious employers; 3) the abortion mandate for individuals; and 4) the entire law because tax bills must originate in the House and Obamacare originated in the Senate.

This case is the only one in the country that challenges the entire employer mandate for all employers. Like other pending cases, Liberty Counsel’s also challenges the so-called “Preventative coverage” mandate, which requires employers to provide free contraceptives, sterilization, abortion-inducing drugs and IUDs, of which the latter two cause abortion.

Additionally, Obamacare compels individual citizens to violate their conscience by making them directly fund abortion homicide – both surgical and chemical – under penalty of law. It forces all employees who are part of a plan that offers abortion coverage to pay $1 per month directly to a “free” abortion fund. There is no opt-out provision, and information relative to which plans offer abortion is intentionally covered-up. This too is part of the case, so don’t let anyone tell you that Obamacare doesn’t require you to fund abortion on demand. If they do, they’re simply lying through their triple-grande-four-pump-hazelnut-mocha-stained teeth.

Finally, Liberty Counsel’s brief argues that Obamacare is invalid because, since it’s a tax – as the Supreme Court already ruled in June – it violates the Constitution’s Origination Clause. To pass constitutional muster, tax bills must originate in the House, not the Senate.

Before the Democrat-led Senate rammed it through in the dead of night, Christmas Eve 2009 – Senate Majority Leader Harry Reid used a House bill unrelated to Obamacare, struck all the language and the title so that only the former HR number remained, and then inserted a new

title and over 2,000 pages of job-killing, economy-crushing, health-care-rationing compost.

Sneaky? Yes. Typical? No doubt. Unconstitutional? Absolutely. It’s like dropping a Ford Pinto engine into a totaled Ferrari body, patching it up and then selling it to some unsuspecting dupe as a “brand new Ferrari.”

Unfortunately, America was that unsuspecting dupe.Well, the jig’s up. The Constitution is unambiguous on this matter: “All

Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.” Const. art. I §7, cl. 1.

As Liberty Counsel’s brief notes, “Though denominated with a House bill number, the Act actually originated in the Senate, and therefore violates the Origination Clause.”

“Obamacare represents a frontal attack to religious freedom,” said Mat Staver, founder and chairman of Liberty Counsel. “Obamacare is a train about to collide with the fundamental right to free exercise of religion. Not only does Obamacare violate the rights of religious employers because of its abortion mandate, it violates the rights of individuals who oppose abortion and the rights of all employers, religious or not.

“And to boot,” continued Staver, “the entire law is invalid because tax bills must originate in the House, and Obamacare originated in the Senate.”

Yep, doctor shortages, medical-school dropouts, skyrocketing premiums, no money for pre-existing conditions, trillions more than promised, forced taxpayer funding of abortion, critical health-care rationing and a bankrupt nation.

Welcome to America’s fall.Welcome to Obamacare.Zombies eat brains. If they weren’t already dead, they’d most certainly

starve to death on the squalid diet of grey matter served-up by Obama, Reid, Pelosi and every other cracked skull who voted to open the curtain on this unconstitutional Obamacare freak show.

Thankfully, Chief Justice Roberts, whom I strongly suspect regrets voting to uphold it, looks to have another chance to bury it once and for all.

I wonder if that was his strategy all along.I sure hope so.

The Moderate Mike Gang Strikes Gold!

The Nevada Republican Party’s official position on the issue of taxes:“We believe the residents of the State of Nevada are not under-taxed

and that state government is not under-funded, and our current budget crisis is the result of years of overspending. We oppose raising taxes or fees of any kind to fund the current budget shortfall.”

Even English Language Learners from DirkaDirkastan would have no problem understanding such plain, clear, unambiguous language. Unfortunately six Republican state senators, including their leader, apparently can’t.

Senate Minority Leader “Moderate Mike” Roberson (R-PLAN) and five terribly misguided colleagues – Sens. Joe Hardy, Ben Kieckhefer, Greg Brower, Scott Hammond and Mark Hutchison - stepped up to the podium a few days ago and announced their support for a new $780 million (or more) tax hike on one of Nevada’s only healthy industries.

And make no mistake: This is no “revenue neutral” tax reform proposal to broaden Nevada’s tax structure. This new mining tax is in addition to the re-imposition of the $620 million “temporary” tax hikes that Gov. Brian Sandoval is pushing and the Gang of Six are supporting.

That’s a $1.4 billion money-suck from the private sector to the government…and is twice the size of the Mother of All Tax Hikes in 2003!

As if that’s not bad enough – and it is – the Gang of Six excused this obscene spreading of the wealth by adopting the hard left’s arguments and rhetoric that (a) mining is evil and (b) we’re not funding education adequately.

And no, accusing Roberson of hating mining, despite denials on his part, is not hyperbole. He bitterly said as much in the last legislative session when talking about the alleged side effects of mining on his home town of Galena, Kansas way back in the 1960s.

The scars from his childhood are evident, and payback’s a witch. As for the absolutely absurd notion that “mo’ money” is going to fix

education in this state, pretty much the only people who foolishly believe such nonsense are unconstituted liberals and Republicans who either work in the education establishment – as Hammond does – or have a relative who does.

Roberson’s wife is a teacher. But none of this should come as any surprise. For his part, Roberson

has shown his word is every bit as believable as one of those Nigerian email scams.

When running for office in 2010, Roberson signed, then broke, the Taxpayer Protection Pledge promising the voters of his district and the people of Nevada that he would “oppose and vote against any and all efforts to increase taxes.” He then made sure none of his five cohorts in the Great Nevada Mine Robbery signed it.

Sounds like it’s time for the GOP to form a posse. When’s the primary again? CHUCK MUTH
